happened. >> reporter: a jury of his peers must decide if leave stevens will pay the ultimate price for his crimes. today stevens decided to let a jury decide if he should face the death penalty for killing officer david mcquinn at the now closed maryland house of correction, that is according to our partner the baltimore sun. first jurors will return to decide if stevens meets the criteria to be eligible for a death sentence. she would be the first person executed since they changed their capitol punishment law, making it harder to sentence inmates to death. back to you. >> ron, thank you, ready to hear more about how yeardly love. we have this report. >> reporter: good afternoon, as the prosecution gets ready to wrap up its case experts predict an uphill battle for the defense. he had a pattern of getting drunk and assaulting his girlfriend. last week jurors heard a two hour police interrogation, initially he denied knowing she was dead but later he admited to putting his hands around her neck. another lacrosse player from the university of north carolina also testified. mike burns told jurors huguely went into a fit of rage when he found out they hooked up. burns walked in on huguely choking love, then months later and days before her death huguely sent love an e-mail that said when i found out about you and burns i should have killed you. >> the prosecution's case looks solid. >> legal expert byron warnken says when the defense gets its turn he expects them to put her character on trial, hoping to cast doubt on the cause of death and try to prove it was an accident. >> the medical examiner said it was blunt trauma, it was from banging her head against the wall, apparently the defense is going to argue that between prescription medication and alcohol there may have been other factors that led to her death. >> if the prosecution is successful in proving huguely intended to kill love, he could serve life in prison for first degree murder. if not, he violating his rights over his videotaped arrest. sharp recorded it during the preakness back in 2010 but officers confiscated his cell phone and deleted that video. the department has since changed its policy, making it very clear the public has the right to record police incidents. a federal judge just ruled the case can move forward. elsewhere in the city mayor stephanie rawlings-blake will address tough budget issues in her state of the city address. this is the first address for her as an elected mayor. she won a full term in november after completing the term of mayor sheila dickson, the city is facing tough choices this year with another budget crisis looming. >> same sex marriage is set to take center stage in annapolis and at the state house again today. hundreds of gay rights advocates are preparing to rally there. this comes as the general assembly and its commits continue to debate legislation to legalize same sex marriage. last month opponents rallied, calling for hear land law to define marriage as being between one man and one woman. >> after a weekend of very chilly weather things are feeling a little nicer today. taking a live look outside, the sun is out and rock and kansas city. the bottom line is although it appears to be tapping gulf moisture and getting ready to come east and slam us, it is actually weakening and not really pulling a ton of moisture north and east with its movement. got a graphic to show you. the low itself kind of passed north of the area and it really is going to weaken. for a variety of different reasons. the bottom line is this. we don't expect a whole lot of issues tomorrow morning. it is going to be great valentine's day but that low is going to drag mild air our way through the afternoon. it is going to be albeit music ] a major clean up is underway in greece after a night of firey protests there. demonstrators set fire to historic buildings and clashed with police over the weekend after lawmakers approved harsh new measures as they try and avoid bankruptcy, athens officials say rioters destroy or damaged 93 buildings. more than 150 people were arrested or detained. >> closer to home investigators are trying to figure out how a huge fire at a pennsylvania resort got its start. a two story ski lodge at the woodlands resort was destroyed by the blaze. everyone inside made it out safely. one firefighter was injured, crews say the cold temperatures disabled some of their equipment allowing the flames to grow out of control. >> at one point the smoke got so bad that all the equipment was lost in the smoke and when the fire erupted out through the roof that is when we had to pull back. >> the resort did have a sprinkler system but investigators say the fire was just too big and the arctic winds just kept fanning it bigger. >> a big day on capitol hill as lawmakers get their first look at the president's new budget proposal. it cuts $4 trillion from the deficit over the next decade and is calling for more spending in some areas to boost the economy. republicans are already criticize in the proposal saying it calls for too much spend in and raises taxes on the wealthy. >> forecast and the first warning of severe weather. >> welcome back, everybody. well, we are warming up nicely today compared to yesterday. 43 degrees right now in baltimore, still 30s up there to the north and west. take a look at this hour right now compared to yesterday at this hour. we are already at least 10 degrees warmer for most of us, 13 in baltimore. now the winds are not out of the northwest but still out of the west and that is going to bring in change. one more thing we want to show you, tracking this the past few days, the arctic air starting to leave the united states. behind it more moderate. that is what is moving our way for the next couple of days, via a storm. now, here that is storm coming our direction. out of the rockies moving across the deep south. the snow line getting far south with this one, too. it is picking up steam as it moves through the middle part of the country but as it moves our direction it is going to lose that steam so what we are thinking the clouds come in tonight, then rain and a few showers tonight but that is about it. so the forecast is like this, here that is storm from the west. notice on this man it loses its green etch. that is a lot of the moisture. so not much with it. it gets out of here by wednesday. sun shine returns. back up to the 50s. and watching for another storm to come our way later in the week. the forecast comes together like this. today we are going up to about 46 degrees warmer than yesterday definitely and probably back above average. tonight down to 29. the clouds start to come in. a little bit of rain or snow is possible. early in the day maybe a couple of showers tomorrow afternoon but back up to 49 degrees. so a little bit better than it was yesterday as far as temperatures go. that followed 1200 seniors and found those who ate the most were twice as likely to develop memory problems. doctors say cutting calories and eating healthy may be a simple way to avoid the issue. a new study finds children with juvenile arthritis are about four times more likely to be diagnosed with childhood cancer. some arthritis drugs are associated with an increased cancer risk but researchers at the university of alabama say that alone does not explain the higher numbers. doctors say more research is needed to determine the link between juvenile arthritis and cancer. children today don't get enough sleep, but neither did their parents or their grandparents or even their great-grandparents. they looked at sleep recommendations and found children slept less in every generation since
