it's the latest action over budget battles in pension. good morning once again andrea. >> reporter: the union's accuse the city of ignoring years of financial advice, which they say ultimately led to this crisis. the fire and police unions along with several retired members are suing the city for what they call systematic under funding and mismanagement of the pension fund, which is runed by the city and a board of trustees. the lawsuit claims the city ignored the advice of financial experts for years an didn't fund the system as much as they should have. now, the unions are suing for $64 million, the amount they claim the city should have already paid out. >> i go out and go back to work i'm 71 years old. ain't nobody going to hire me and there's 2500 of us out there. >> reporter: faced with a $121 million budget shortfall, the city has proposed changing the way it funds the pension system. including increasing the minimum retirement age, increasing contributions from union members and lowering the coast of living increases. >> they said, well, we need to fix the system so what we're going to do is come in and we're going to not only ignore the money we didn't pay in the past but we're going to take more money from you past by taking away some ben nits. >> reporter: in a statement the mayor says >> reporter: city council member says she plans to introduce this pension over haul in a bill next week. it's not clear yet though what affect this new lawsuit will have on her proposal. don, back to you. >> thanks very much andrea. union members are eligible are retired after 20 years of service. they want to set a minimum age of 55. assault and child abuse in the death of his one-year-old daughter. key ton irons was found alone with his daughter at his apartment on tuesday. she was unconscious and taken to the hospital where she suffered from critical head injuries and she died yesterday. irons is being held without bond. an update now on a story we first brought you at this time this morning. a man is dead after being struck by a hit and run driver. it happened around 1:00. after first being struck by a car, gust sabra was left lying in the road and then a tractor- trailer hit him. >> the tractor-trailer driver stopped immediately upon striking the body within the roadway, there was actually an ambulance that was following the tractor-trailer
