gardner in a section called baby beach, where the waters are calm. >> seeing if there is any forensic evidence. and going through smart phones. maybe a laptop as well. >> reporter: giordano's lawyer says his client denies any wrongdoing. his house is deserted. but there is a sign warning visitors they are under constant video and audio surveillance. >> reporter: giordano is also accused of videotaping a sexual encounter with a woman. he was never charged in that case. >> he seemed to be someone you didn't want to know. >> reporter: in a public statement, gardner's family says they're keeping faith she'll be found alive. she said, i hope you understand that we are keeping quiet as to not jeopardize the investigation. please continue to pray for robyn. >> reporter: now, gardner has a boyfriend, who claims he never knew she was on vacation with giordano. he now says he has evidence that her e-mail account was tampered with and used after her disappearance. reporting live, mike hellgren, we'll eyewitness news. -- wjz eyewitness news. >> arubean authorities sent gardner's blackberry to the netherlands as part of the investigation. accused of being part of an international drug ring is in court. and the judge makes a controversial ruling. kai is in the newsroom with the latest on this high-profile case. >> reporter: a short time ago, a federal judge ruled that officer daniel redd can be released. he is accused of a drug ring that brought heroin to baltimore. during a hearing, he pled not guilty to all seven counts against him. the proscooecutor -- prosecutor begged that he not be released. but the judge said he must be treated like every other drug suspect. however, he will be monitored. >> redd could be released as early as friday. there is new reaction tonight in connection with the explosive video of a officer being shot by fellow officers. mary joins us now with the latest on this case. >> reporter: a crime camera captured the chaos outside the west baltimore nightclub, where officer william torbit was killed. tonight, his sister watches the video with us. >> reporter: the crime camera captures a caotic scene and the death of an officer. >> that just don't sit right with me. >> reporter: sherry torbit, sister to slain officer william torbit is disturbed by what she sees. the video shows a plain clothed officer arguing with a group. here, he gets punched in the face. what follows is a tragic order of events. torbit fires his gun, after getting knocked to the ground. you see the people scatter. a man involved in the fight. now notice the smoke to the right of your screen. another officer, unaware torbit is a cop, fires at him on the ground. three other officers join in, shooting torbit some 20 times. >> how can you gun down somebody that many times? you know what it takes to make a person stop. this is close range to me. how could you not know that that was your fellow officer? i could see if it was at a distance shooting. but you're right up on him. just as close as you and i are. >> reporter: city attorney gregg bernstein announced he will not bring criminal charges against the officers after reviewing the crime camera and testimony from more than 100 witnesses on the scene that night. officer torbit's family is extremely angry and disappointed with that decision. >> how can you say you don't see the person at that point? and continuing to shoot like that? he's already down. >> reporter: today, we showed the video to attorney byron worken to get his idea. >> we don't want to get out there to get nothing but holes. there's still holes. but they mostly get filled in if you have objective information. >> and you would say this video is the objective information? >> yes. >> the panel is reviewing police processes, including crowd control and firearms training for the officers. >> at least 40 shots were fired during the mayhem. another wild day on wall street. some positive economic news sends the stock markets soaring. here's a look at the closing numbers. dow soared 423 points. closing above the 11,000 mark. the s&p 500 and nasdaq also posted big gains. carrie eterrer reports from the new york stock exchange. >> the dow surged more than 400 points in wall street's wildest week since the financial meltdown in 2008. good news from the labor department sent stocks higher. application for unemployment aid last week fell 7,000. the biggest drop in the past four months. >> probably the most important number we get all week is that jobs number. unfortunately, there's still 7 million people on benefits. but it still is at least going in the direction we want it to go. >> reporter: but the dow hasn't decided which way it wants to go. the fluctuations made history. it's the first time ever that the dow has had four straight, 400-point days. >> it's a roller coaster ride without the fun involved in it. >> i'm not sure what the market is going to do. but europe -- europe is our problem. >> reporter: french banks are especially volatile, as investors fret about their exposure to the debt of countries like french and italy. french president nick cas las sarkozy and german chancellor angela merkel plan to meet next week. >> u.s. is a big trading partner. what happens in europe matters instantly here, especially with banking. >> reporter: the u.s. says that they can cope with their debt crisis. and the last three were named to the 12-member bipartisan panel, that will recommend ways to cut debt here in the u.s. one of the people on the committee says everything will be on the table, including tax increases. on wall street, carrie eterrer, wjz eyewitness news. >> the leaders of france and germany, and the biggest european comay say they -- economy says they will meet next week. a man accused of killing a young johns hopkins researcher. the star witness for the prosecution takes the stand. meghan mccorkell with more on what was said on the stand today. meghan? >> reporter: vic, lavelva meritt says she was there when her boyfriend, john wagner, stabbed stephen pitcairn. meritt testified today, in exchange for murder charges being dropped against her. >> reporter: lavelva meritt in court, identifies the knife she says her boyfriend, john wagner used to stab pitcairn. he was walking home in charles village. >> it eats away at me. i've got to live with this for the rest of my life. meritt tells the jury, she admits she robbed pitcairn and took his phone, but says she didn't stab him. she told the jury, it wasn't supposed to go down like that. she originally said her roommate and cousin was responsible for the stabbing. this morning, cospee beetook the-- cosby took the stand. >> he came home and found her out of breath. he said wagner told him, i just beat this white guy so bad, i feel so bad about it. he said he tried to use pitcairn's credit card at a gas station. then wagner asked him to get rid of pitcairn's wallet. he admits he threw it in a dumpster, but says that's where his involvement ends. >> reporter: in a final statement, meritt's mother, says she was asleep at the time. new census data shows the changing face of maryland. it shows a 51% jump in the number of same-sex couples in the last decade. they say the increase was likely from same-sex couples, rather than an increase in gay couples moving to maryland. the census also reveals tathe median age is also up, not surprising, considering people are living longer. if you live for summertime, then this weather is for you. a live look outside right now. very pleasant temperatures. low humidity. who could ask for anything more? the job is tough. >> the expectations since i arrived is that kids come first. and we're going to move fast. and in the process, for many people that just wasn't the way they wanted to work. >> reporter: dr. alonzo says there are several reasons why 75% of the principals who once headed schools when he arrived are now gone. some of them were promoted and had to come here to central office. others retired. and then there are those who as dr. alonzo says, just weren't a good fit for the job. >> if you're not a good fit for our kids, maybe you should go someplace else. >> reporter: and that's causing a stir, especially amongst civil rights activists like dr. mark cheatam. he fears that experienced principals won't be around. >> it's not as much of us second-guessing dr. alonzo. we're just saying we have to be concerned. these principals have been there for a while. >> reporter: plus, cheatham says those replacing outgoing ones may not have a strong connection to students or the community. >> they need to understand, appreciate and respect the culture in which they're going to be principals over. and it takes a while to do that. >> with a little more than two weeks before the new school year, dr. alonzo says he's almost finished filling the 42 vacant positions. this year, he hired 15 new principals. >> reporter: only about nine vacant principal positions remain. dr. alonzo says he'll make a final position by august 22nd. two baltimore mayoral campaigns will fight. >> reporter: the stage stawg campaign accuse -- stephanie rawlings-blake campaign accuses cath rin pugh of a stolen campaign plan. she unveiled her plan today and got a scolding from the rawlings-blake campaign. the wording differs both will work to get stay laws. target repeat offenders and enhance penalties for crimes committed with guns. >> it's stated, our mayor not doing enough, why would they propose the same plans she's already implementing? it maybes you wonder if the senator really believes her own rhetoric. >> nowhere in that language will you see what she's talking about. but what she's talking about is a general strategy that any city, that is focusing on violent crimes. >> reporter: pugh says her plan comes from her website, not her plan. and the ways of achieving the goals varies greatly. >> but what this plan is, which she's obviously not read, is a crime prevention strategy for baltimore. it focusing -- focuses on youth, the community, and our work we've don with the faith- based community. and we've sat dun -- down with the police department. and this is what we've crafted. >> reporter: crimefighting is a major mayoral issue in this debate. and it's only inevitable that some of the strategies would have to overlap. reporting live, i'm pat warren, now back to you on tv hill. >> a baltimore mayor candidate's forum is taking place in northeast baltimore tonight. >> all right. well, i'll tell youing this weather makes you happy to work the night team. >> very happy. >> we're home all day. then we come here. who cares? norvay. the majority of those killed were special operations forces, including members of the seal team 6, the unit that killed osama bin laden. in all, 30 americans were killed, reportedly on a mission to help another team on the ground in trouble. denise? >> thank you, mary. eight afghans on the chopper were also killed. new controversy in the jared loughner case. prosecutors say jared loughner should be forcibly medicated, with anti-scottic drugs, despite his lawyer's claims that this violates his due rights. loughner is accused of a rampage in arizona earlier this year. tonight, people are asking for the public's help to track down a suspect. the woman you see here is wanted for stealing walleltselts and credit cards from a medical center in towson. police say she rang up also paying attention to two people who aren't running for the white house, at least not yet. >> reporter: texas governor rick perry is expected to make his candidacy official soon and visit iowa sunday. and former vice presidential candidate sarah palin's bus tour is headed on the road. she is expected to visit the iowa state fair friday. but she's not part of the straw poll and still won't
