>> we have new video to show you that police and prosecutors say shows him attacking another person. right here next to me, you can see the impact of this young researcher, steven pit-karen and his friends made a makeshift memorial today, on what would have been his 24th birthday. >> reporter: this should have been a day of celebration for steven pit-karen and his friends. his birthday. instead, they placed the cake at the spot where he pleaded for his life on st. paul street, where robbers stabbed the johns hopkins researcher to death. >> makes you angry when anybody gets hurt, no matter who they are. just doesn't make no sense. >> reporter: both of his accused killers have long records. merits mostly for drugs. she was held without bail. but wagner's history has sparked controversy. prosecutors tell wjz, he violated his probation four times in the past year. and the courts allowed him to stay on the streets. >> in two. court hearings, he was found guilty of violation of probation. but no additional court time was imposed. >> and in april, this video from wjz shows what prosecutors and police believe is him robbing and beating a man for just $7. but court records showed the victim refused to cooperate and that case was dropped. >> we have spent the last 24 hours, pouring over court records that are over a foot high, trying to say what could have been done differently. and our conclusion is that we as prosecutors did everything that we could. >> reporter: in pit-karen's case, charging documents reveal merit and wagner were on the hunt to rob someone. and he was in the wrong prase at -- place at the wrong time. innocently walking back on his iphone with his mom, who heard the murder unfold. >> she heard people screaming at him to give his money. she said, moors my cash. -- i don't have cash. here's my wallet. then she heard him like screaming and making noises in pain. >> reporter: they found the victim's blood on a door and shoes. the victim's wallet, his iphone and several folding and fixed- blade knives. >> they busted the door down right here on the first floor. >> reporter: back at the memorial, the victim's friends wrote of their love, their pain now, and how they'll never forget him and their desire to make sure justice is served. >> and we're live here on st. paul street. the victim's mother said she wanted her son to take a cab. but he loved to walk. she also said the most aggressive voice she heard on the phone was a man's voice. reporting live in charles village, mike hellgren, wjz eyewitness news. >> steven is from florida, a standout from hopkins. he did stem cell and breast cancer research and planned to attend medical school. a teenager seriously injured, continues her long recovery tonight. wjz continues to update you on emily kerstetter's condition. kai is live in the newsroom with more. >> reporter: family and friends closely monitoring emily's condition tell wjz today, it will be at least two months before she will be able to leave south africa. the 15-year-old was seriously injured in a bombing in uganda earlier this month. she was in that african nation with her church group, doing missionary work. she suffered serious injury to both arms and legs. they have established a website for donations to help with her growing medical bills. you can go to wjz.com to find a link to that. >> the terrorist attack killed more than 70 people, including another american missionary. >> reporter: a prince george's county grand jury indicts a 27- year-old man. and police say he's a serial killer. investigators say jason thomas killed two women in this home in january of 2009. he has not been charged in that case, but the former u.p.s. worker has been charged with two counts of first-degree murder, for allegedly killing two other women in march of 2009. a young baltimore county girl makes a terrible discovery in her backyard. a newborn baby in a trash bag. and tonight, police say her own sister gave birth to that baby. wjz is live in county police headquarters. mike schuh with more on this case for us. mike? we have a guy, local to mississippi, knows the gulf real well. so from a p.r. standpoint, i think it's a good move. >> reporter: the oil disaster is keeping ernest ulrich's restaurant packed with customers. he's actually seen his business go up 10%, while neighbors have had to cut back. >> i'm hears people say, you need to file a claim, loss of business, you need to do this. we haven't filed a claim. we're just grinding it out, day in and day out. >> reporter: even with the increased business, ulrick would give it all up for the disaster to be over. and for life around here to return to normal. kendis gibson, cbs news, gulfport, mississippi. >> they hope to seal the well by mid-august. blasting from on top of the rail. there were nine robberies at two light rail stations in south baltimore at the cherry hill stop. and the patapsco avenue stop. one robbery actually happened on the train. the others were near the platform or in residential areas near the station. police say the suspect targeted the victims getting off or waiting for the train. police have arrested four juveniles. one as young as 14. and a 17-year-old who was charged as an adult. a judge rules an elderly man, not competent to stand trial in the murder of has wife. police say thomas sherrer beat his 82-year-old wife to death inside their home in april. he then tried to burn down the home. he will remain in custody at the clifton t. perkins hospital next year, when he will be given another mental competency test. a warning about being on open water. as the thunderstorm quickly approached, an emergency call came in, and about two people in distress on jet skis, about a haf mile south of the bay bridge. >> got caught in the severe thunderstorm, which produced winds about 60 miles an hour. waves 5 to ixis feet. -- 6 feet. >> reporter: one person was killed as he and a friend raced back to the park. the strong winds knocked them both off their jet ski. >> when he got back on the jet ski, he looked around hears if partner. noticed he was facedown on the water. went over to a tugboat. and they call the 911. nay they say -- they say that this is a powerful reminder, people need to know what the the alarm, about a popular drug used to treat diabetes. 10 years ago, she noticed some patients who were taking the medication were having heart problems. it is the story of one small voice against a pharmaceutical giant. millions of people with diabetes hope this pill, avandia, would save their lives. but most had no idea avandia could also trigger a heart attack. what is, except for maryland doctor mary money. >> you actually blew the whistle on this 10 years ago? >> yep. >> i'm surprised the other physicians didn't take the ball and run with it. >> back in 2000, she took on avandia's maker glaxo smith glaxosmithkline. >> the first patient i prescribed it to was having severe problems with leg swelling. shortness of breath. had to sit up at night. >> months later, she made an alarming discovery. 20 had significant side effects. three had symptoms of heart failure. >> do you feel like you had to get the warning out? >> get the warning out. that's right. i was contacting the doctors in all of the emergency rooms that i knew. i decided to contact the company directly. talk to their medical director. >> reporter: so what was their reaction? >> he really didn't seem that interested. >> what do you think he was there to do? >> to tell us that we were wrong. >> reporter: soon after, she got this letter from the drug maker, calling her concerns unsubstantiated, and accusing her of spreading misinformation. >> after receiving that, i felt somewhat threatened. >> reporter: even her colleagues at washington county hospital, got the letter, stating that we respectfully ask that your hospital not involve itself in the matter. >> what this company has done is actually tainting this. >> refusing to be muzzled. dr. money quietly pressed on. sending a researcher to a well researched cardiologist. >> the mistake that was made here. >> reporter: last week, a decade after his alert, they finally took action. it recommends restrictions and warnings for avandia. >> i definitely think that the drug needs to be looked at again. >> what lesson do you think we should learn from this whole situation? >> it's very, very important for us, as physicians to listen to our patients. give them credit. if they think something is causing the trouble. and be willing to contact a company, even if it might prove to be an embarrassment later. >> reporter: adam
