evening, we were sitting around. and we decided we would just go out and scout out everywhere. >> reporter: that's when monet's brother found her body in the alley. now, they want to know why the gun that killed her ended up in a police officer's car. >> reporter: police are consulting with the city state's attorney's office, as their investigation continues. derek valcourt, wjz eyewitness news. >> all right, derek, thank you. william c. marsh middle school will be hosting a vigil tomorrow at 4:00. state police are investigating a shooting in maryland's eastern shore that claimed the life of a toddler. denise has more on what happened. >> reporter: when police responded to the scene, they found a 4-year-old and his mother shot. it happened at a home in hebron, near salisbury. state police say shaniece woke up after feeling something hit her. then she found her son shot to death. jamal died at the hospital last night. his mother was hit in the hand and is expected to be okay. >> police say they found a large-caliber handgun on the bed where the shooting is believed to have happened. an investigation is ongoing. right now, rank and file are taking a no confidence vote. new questions emerge about his power and whether he can withstand an indictment. mike hellgren has new reaction to the scandal for us. mike? >> reporter: mary, -- more than 500 officers are casting their votes. those votes should be in by 10:00 tonight. and we have all new reaction on the scandal that is making waves throughout the county. >> reporter: anne arundel county executive john leopold faces another no-confidence vote. this time, from a rank and file police officer. the state prosecutor claims leopold used his security detail for demeaning personal tasks, including driving him to secret sexual encounters. >> the state prosecutor saw it as an opportunity to fire a shot across the bough of other politicians who might be tempted to misuse state employees in similar ways. >> reporter: legal analyst andrew levy believes the state tax on the prosecutor's team, the same office who brought down former baltimore mayor sheila dixon, are unfounded here. >> you don't have to go back very far before you can find democrats who are the target of the office, as well as republicans. >> reporter: and the allegations go beyond sex. susan whitman heads the watchdog group, common cause. >> we are concerned about the allegations of the political activity that he had county employees engage on, on county dollars. >> reporter: including accusations county employees were forced to place campaign signs other cleks cash donations -- collect cash donations. and keep files. >> unfortunately, the cases of some people that abuse the system, helped to ruin it for everybody. >> reporter: leopold vows to fight the allegations and stay in office, despite their emotional drain. >> i don't think that anyone is humanly capable of not letting that weigh on them. >> and according to court records, the leopold will be arraigned on march 26th. an anne arundel county man is arrested after several complaints he was exposing himself to women. the alleged incident took place on the main campus in arnold. police say this man, jacob bovia, pretended to expose himself to several women, while using fake private parts. now, he's charged with three counts of indecent exposure, and two counts of disorderly conduct. a volunteer county firefighter is hurt, after parts of a tree falls on him during the rescue. these are pictures that they sent us. 22-year-old michael murphy was at the scene of a serious accident in lutherville, trying to rescue the driver. when a tree limb, came down, hitting him on the head. he was taken to the hospital and has since been treated and released. murphy is also a career firefighter. a harford county school is evacuated because of a suspicious odor. it happened at st. margaret's school. three faculty were taken to the hospital after smelling naodor. students in grades one through three were evacuated. they are all okay. officials say the odor came from cross-contamination of cleaning solutions. it is super tuesday. voters in 10 states are heading to the polls to choose the republican candidate for president. danielle nottingham reports for wjz, mitt romney is choosing to solidify his front runner stat -- status. >> reporter: voters in stubenville, ohio, are casting their ballots for a gop presidential nominee. ohio is taking center stage for the 10 states holding super tuesday contests. the head-to-head battle prompted some democrats to weigh why the ceo is facing harsh criticism of his own tonight. >> reporter: good evening. all of this comes, the tour with the mayor, just days after marylanders and baltimore city parents especially learned that the ceos driver makes more in overtime than most of us marylanders do in a year. the mayor and school ceo tour barkley elementary middle school, a school that's literally falling apart. with $14 million of the education budget paying staff overtime these past four years and more than $200,000 going toward dr. alonzo's private driver, there isn't enough money to pay for repairs. >> a lot of parents are upset with you. >> i think parents understand how hard i'm working for the kids of baltimore city. that i work 70-90 hours a week. >> reporter: he says it requires the use of a personal driver. >> it's no different than the mayor or the governor. >> reporter: he's getting paid more than the governor. the mayor, who earns the same amount as the driver is also taking heat for proposing a bottle tax for school funding. >> the bottle tax is a first step. it will help put over 140% increase in school construction funds in play. >> reporter: when asked about education money going to pay for alonzo's driver. >> there's no amount you could pay one employee that could fix this school or the next school. >> reporter: the principal has a mess to deal with. >> heating, the ceiling tiles, the bathroom tiles are deplorable. >> reporter: and dr. alonzo said his driver is also used in his protection. i asked if he felt his life was in danger when he visited these schools. he said no. >> still a lot of questions remaining with all of this. thank you. he says enrollment in city schools is higher than it has been in the past 40 years. the department of public works is using some state of the art technology to inspect the southwest transmission main. the agency is launching a free swimming pipe diver down the main to prevent breaks from this one happening. the tool using waves to energize wires and help determine which sections of the pipe need to be repaired or replace. eight years since a water taxi capsized. >> carrying 25 people when a strong storm hit. gusts exceeding 50 miles an hour sent the passengers hurling into the river. they finally recovered the bodies of all five victims. the national weather service issued a severe weather warning 5 minutes after the accident. >> thank you. officials later determined that it was carrying too much weight to withstand the heavy wins. he fought off a home invader. now he's fought off a state gun control law. it's a legal victory for carrying a concealed weapon for self-protection. >> reporter: buying a handgun in maryland means paperwork and a background check by state police. to carry a concealed gun takes a special permit, granted to those who have proof their lives may be in danger. >> he was the victim of a home invasion on christmas eve in 2002. >> reporter: the suspect was captured and he's now out of jail. when he went to renew his conceal permit, he didn't get it. >> despite the fact that the criminal lives miles away. it had taken the police two and a half hours to respond. he had failed to show what the maryland state police call a good and substantial reason to carry a firearm. >> reporter: woolard won on the grounds -- >> people have a right to keep and bare arms in maryland. they don't need to prove they have the right to exercise the right. he's entitled to carry a gun. >> reporter: the attorney general will ask to repeal the ruling. >> we are quite confident we'll prevail on appeal. >> reporter: but it won't come without a fight here. >> the lawsuit does not challenge the background checks and other requirements of a common gun permit. breaking news. sky chopper 13 is over the scene of a deadly accident involving a tractor trailer. >> we have another head-on crash. this is at route 213 and boyds meadowlane. apparently two vehicles collided. the tractor trailer went off the right side of the roadway. the sedan, which collided with the tractor trailer is significantly damaged. there is a fatality here. the sheriff's department, is the sheriff's office is on the scene as well as maryland state police and several folks from the local fire bureau. 213 is closed just south of lloyd's meadow lane. the sheriff and state police continue their investigation. no word on injuries to the truck driver. we'll keep you updated as we continue to gather information. back to you. >> thank you. an early morning fire rips through a home in north carolina killing two young girls and a special forces soldier. authorities say that soldier was trying to rescue his 4 and 6-year-old daughters from the top floor of their burning home. the mother made it out safely. she's currently being treated at the hospital. president obama held his first news conference of the year and answered questions on a range of subjects including those about his republican rivals. >> reporter: in his first news conference of the year, president obama faced questions about iran's nuclear program. tensions are growing after israel threatened to attack iran and prevent that country from building a nuclear weapon. >> this can still be resolved diplomatically. that's not just my view. that's the view of our top intelligence officials. it's the view of top israeli intelligence officials. >> reporter: he took aim at the republican candidates whom he called too casual about war with iran. >> when i see some of these folks who have a lot of bluster and a lot of big talk but when you ask them what they would do, it turns out they repeat the things we've been doing over the last three years. >> reporter: he also said u.s. military action would be a mistake. the president's aids say it's just a coincidence he held this news conference on super tuesday as voters in 10 states select a gop candidate. rising gas prices were also mentioned. the president is looking at quick solutions, such as opening bottlenecks in the supply chain. >> i want gas prices lower because they hurt families. >> reporter: and he took a question about criticism mitt romney has leveled at him. >> what would you like to say mr. romney? >> good luck tonight. >> reporter: he'll be back on the road on wednesday in north carolina talking about his economic plans. >> president obama also announced an agreement with major banks to repay members of the armed services who faced wrongful foreclosures or were denied lower interest rates. strong winds making it tough for crews to contain a fire in oklahoma. gusts of up to 50 miles an hour are preventing them from getting the upper hand. there have been no reports of injuries. investigators think someone set the fire on purpose. harrowing stories of survival. hundreds of national guard troops are rushing to the nation's heart land to help victims of this week's devastating tornadoes. some are telling their tales from hospital beds. >> reporter: he tried to help a family of five, sheltering them in his mobile home. but it swept them away, killing all five including 14-month-old angel babock. >> i put my >> reporter: a mother in indiana successfully used her body to shield her two kids. she lost one leg above the knee and the other above the ankle. >> i was holding them and trying to keep everything away from them so it didn't hit them. i had two steel beams on my legs, and i couldn't move. i was stuck. >> reporter: and a man in missouri got something precious back. >> i gave this to my wife 10 years ago. i just kept digging and digging. and all of this here. i called her, she was crying. >> reporter: kentucky senator says fema has started damage assessment in the hard hit town of west liberty. >> we'll try to help these folks rebuild their lives. >> it claimed 45 lives in five states. an avalanche causes problems for folks on a ski resort. you can't see it, but dozens of people to escape, they are simply struggling to stay alive. >> the fighting is also getting more intense in the city of buroque. a 15-year-old boy and five government soldiers were killed today. emotions boil over in a massachusets courtroom during a hearing for a murder suspect. two members were wrestled to the floor after charging after santiago. the rest of the family was cleared from the courtroom
