robbery. but at least one was a hate crime. 19-year-old jermaine holley is behind bars for bludgeoning 51- year-old martin reyes to death. >> she wasn't raised to be prejudice, to hate nobody. >> reporter: holt's aunt, who she lived with, said the teen doesn't hate anyone. >> to hear it in her voice, that she had tears. and that she was hurting because she's 14. i mean, in this building with grown people. it's not right. >> reporter: and holt's family said she had a file open with the department of juvenile services for her behavior. but a spokesman says she was never committed full-time, because she never actually broke the law. we're live in central booking tonight, weijia jiang, wjz 13 news. >> police say the other victim in holt's case was treated and released from the hospital. an extensive search tonight for a home invasion suspect. and baltimore county police say he could be armed and dangerous. denise is in the newsroom with more on the suspect for us. denise? >> reporter: this suspect is believed to be in possession of six handguns, an assault rifle and a hand grenade. levar maurice rich was involved in the home invasion on the 19th. the victim told investigators, armed men forced their way into a home, took his weapons and some jewelry. four other people have been arrested and charged in connection with the home invasion. mary? >> all right, denise. thank you. anybody with information about the location of rich is asked to call baltimore county police, the number 410-307- 2020. baltimore police commissioner just fired the officer at the center of an infamous you tube video. it shows his rant against the skateboarder at the inner harbor. mike hellgren has more on the move that goes against the recommendation of a disciplinary panel. mike? >> reporter: kai, that panel only recommended a suspension. but the commissioner does have the right to fire the officer. it's the latest twist in this drama that began more than three years ago. >> sit down, i'm not a dude! >> the conversation between officer salvatore rivieri and teenage skateboarder eric bush, will cost rivieri his job. the commissioner let him go. in a rare move. he disagreed with the panel. last month, that panel cleared officer rivieri of using the force. >> officer rivieri in this case used as much restraint as he could to get the kids to remove. they didn't want to leave. they weren't listening to him. and he decided to take a little more forceful action. >> obviously your parents don't put a foot in your butt. >> reporter: they filed the excessive force charge. the trial board only found rivieri guilty of failing to file a report and giving a contact receipt. wjz spoke with the teenager. >> shraped me upside down my face. and i was just going on with it. and he tackled me. >> reporter: a judge dismissed a civil suit his family filed against police because of a deadline. but some believe it is wrong. >> the comment of "dude," how in god's name, could that rise to the level of grabbing him and throwing him to the ground. >> first of all, you disrespected me, this badge, and my department. >> reporter: officer rivieri has been working desk duty since the incident. >> if you were to talk to him and his wife and his family, they have received death threats. >> reporter: he served on the force for more than 20 years. >> the fraternal order of police denied the calls. called the commissioner's decision outrageous. we've got no comment from officer rivieri's lawyer so far. >> mike, thank you. the police commissioner declined to comment on the decision. more than a dozen people recovering tonight after a bus collides with a van in montgomery county. it happened this morning in rothville at frederick road in ridgemont. when a ride-on bus hit the van. 13 people were hurt. no word on the extent of their injuries tonight. police are still investigating the cause of the crash. frederick road was shut down in both directions at the accident scene. right now, all northbound lanes and two lanes running southbound are open. and a bicyclist is dead after she was hit by a tractor- trailer in union bridge, carroll county. sky eye chopper 13 over the scene, as the tractor-trailer involved was towed away. maryland state police say arthur martin, jr., was hit by the tractor-trailer yesterday as it was making the right turn. stacy martin was pronounced dead at the scene. $250 million is now headed to maryland schools. as wjz told you, the state is one of the big winners in the federal race to the top education coveragetition. in tonight's school watch report, local and state education leaders are working out how they will spend the prize money. wjz is live. derek valcourt explains, the state already has plans for much of that money. derek? >> talk about a gift that comes just in time for the start of the school year. about half of that money will go to the local school systems. the other half will go to statewide education improvement. >> reporter: in order to win federal grant money, maryland school board had to submit a detailed plan on how it promises to spend that money to improve its education system for all students. >> it was a four-year grant. >> assistant state superintendement of schools jim berrant said the state was committed to the plan, regardless of whether it won the race for the top money. but -- >> resources matter. and had we not gotten the grant, it would have extended out into the ears, our ability to do some of these things. we just wouldn't have had the resources to do it. >> resources like turning around the lowest achieving schools. improving development. and perhaps the most thorny issue, creating a statewide system of evaluation for teachers and principals. >> any time you deal with evaluation of someone's performance, you need to be fair. it has to be ethical. and has to hold legal mustard. has to be defensible. >> half will go to local school systems, with baltimore city, receiving the most at $46.8 million. p.g. county will get 29 million. 6.1 for anne arundel. and $2.6 million for harford county. >> all of the stripes are different colors. >> each of the school systems has 90 days to submit their plan for money in writing. the state and federal government plan for approval. the government has also created approval for council for educator effectiveness. their job will be to come up with statewide recommendations for that teacher, for that statewide teacher evaluation system. they're going to have their first meeting tomorrow. they're going to have to come up with recommendations for the governor and for the legislature by december 31st. back to you. >> all right, derek. thank you. frederick county and montgomery county, refused to heat. wjz is live. tim williams has a look at your updated numbers. >> well, we have a boy and a girl, mary. the atlantic has given birth to one of each. we have a danielle and an earl. we'll talk about that them in a second. right now, we're looking at first warning doppler radar. we have no clouds in our region. it is starting to move out of here. and the next cloud cover. the warmer our temperatures will get. we have a coastal flood advisory in effect, much like we had last night for the western shores of the bay. we've had a persistent wind in from the northeast. and that has been building water at times of high tide. from harford to southern maryland. that is going to be in effect through 7:00 p.m. this evening. here they are. the first couple of atlantic. danielle is the first one, still moving to the west/northwest. at just around 17 miles per hour. this is a category 1 hurricane. expected to strengthen to a category 2 status. but not expected to impact any u.s. mainland. bermuda is the only real land mass that this storm may impact. as of 5:00, the national hurricane center has named earl, now a tropical storm, with sustained winds at 40 miles per hour. expected to kind of crisscross and meander right behind danielle. we'll keep you posted how earl is doing. it's just a minimal tropical storm now. with two storms in the atlantic. at the same time, things are really heating up. and you can't take your eyes off of them. we'll continue to keep you posted. for now, kai, back to you. we have breaking news to report to you right now. in chase, baltimore county. sky eye chopper 13 is over the scene of the accident. let's go to captain mike perry with more. >> reporter: we're at bird river road in bevins lane. this isn't chase. east of martin state airport in baltimore county, where a vehicle has left the roadway and rolled over. initially, this was with rescue. but both parsons were extricated. we're told the passenger was not as seriously injured as the drive. drivers are a priority, going to a local area trauma center. as a precaution by ground at this point. baltimore county police have closed bird river road, south of bevins road. this is in the chase area of baltimore county. and right now, it's just a local area, primarily. it's not a heavily traveled road. so there's no need for a detour. back to you on tv hill. elin nordegren broke her silence in an interview with "people" magazine. she said she's, quote, been through hell, since her husband's sex scandal hit the tabloids. their divorce was finalized on monday. >> i certainly understand that she is sad. and i certainly feel the same way. >> woods says he knows his actions are to blame. >> they focused more on his private life than has golf game. >> i thing. >> noshed gren told "people" magazine she was blindsided by his infidelity. she won't comment on reports of a $100 million settlement, saying money doesn't make you happy. but i have to be honest, it is making some things easier. i have the opportunity to be with my children as much as i want. she's focusing on her children, taking 3-year-old sam and 19- month-old charlie to the doctor on tuesday. while their father tries to get his game back and his life on track. >> i made a lot of errors in my life. and that's something i'll have to work on. >> nordegren says she is still working the tunnel. act now and save 20 dollars. more details apply. fireworks today at city hall. the senator is back under new ownership. the former owner purposely lashed out he calls it a secret process to wrestle control of the theater from him. >> reporter: after years of financial struggle, tom keef- auber lost control of the theater his family built. a year ago, the city bought it for $800,000. keith waited for the development to keep it open. in the end, there was only one bid but he said it wasn't open or transparent. >> i think for this to be presented now. and about 100 things wrong with this deal. >> the new owner gets it for a dollar a year in rent. the city attorney briefs the board on the process. keith auber says his facts are all wrong. >> you're out of order. >> this is out of order. this is out of order. >> with that, keith auber goes to the back of the room to await the vote. on the table, a dollar a year rent. and $700,000 in construction loans. then the mayor says -- >> i'm looking very forward to the senator under new letterheadship. >> reporter: 5-0, with comptroller pratt abstaining. the deal is approved. >> motion carried. >> shame on all of you. shame on you. >> he's emotionally tied to the theater. his family, i believe, built the theater. i understand has strong emotions. i don't condone the behavior. >> reporter: keith auber feels the city's deal will pay for construction of the historic theater. >> today was a sham. it really was a sham. and it will come back and bite the taxpayers. because now we're going into the millions in a city that is broke. it is way premature. it was a bum's rush. >> the new owners were at the morning's meeting but did not comment. a massive fire in the middle of a blizzard. tonight, the dundalk fire station was celebrating its new home. the two-alarm fire happened in february at the fire station. now, nearly six months later, baltimore county fire department held a rededication ceremony for the rebuilt fire station. prepare cost -- repair costs more than half a million dollars. crews say during the repairs, there was no interruption in fire service to the dundalk community. >> i've done a couple of talks on that as well. they kept going. there was no place to keep going to park the fire trucks at the time. and they keep answering the calls. >> dedication. >> we're happy for them. and fortunately, to push the water away from the western shores of the bay. and it's also helping to dry us out. we're going to see more and more breaks in the clouds as we move into the next few days. and with those breaks, we'll see more sunshine. and with a shift in the wind, we'll see more wind coming in. that comes in pretty dry as well. along with a cold front that is very dry. and kind of wipe all of the moisture out. and take a lot of that humidity with it. we'll be looking at a gorgeous next few days. starting tomorrow, we'll start to see improvement. we're starting to see this dry air moving into our region. the low that has been just bothering us for the last few days. continues to move up toward the canadian maritime. and with this front moving on through, high pressure really dominates the forecast. and coming from the west, it has no real influence from the oceans or the -- from the oceans or the bays. we'll be into the 90s by the beginning of the next week. 7:47. 8:13. 64 degrees. partly cloudy. average of 63. with 86 tomorrow. so it begins. we start to warm up, breezy with clouds and sun. afternoon showers, very slight chance. but again, it's going to get warmer. we will for staying with wjz eyewitness news. and here are some of the stories people are talking about tonight. some are calling on a candidate to pull a campaign ad off the air. the controversy surrounds an ad, run by greg bernstein who is challenging city state's attorney pat jessamy in the primary. political reporter pat warren has more on the fallout. >> we lost five children and a parent. this ad blames pat jezamy and others. when they reported illegal activity to police. today, two state delegates are demanding they pull the ad. there was no sensitivity. no regard for the family. it was an horrific tragedy. and why thaw would would politicize something of that mag stude is beyond me. >> reporter: a race that set commissioner bealfield and jessamy at odds. >> we're speaking to the exploitations of a family who suffered a tragedy. if we want to discuss the entire system, we'll do that at a later date. but do not exploit our people for political purpose. >> reporter: the bernstein campaign says it was approached by former witness protection coordinator tanya madden and says it has notice plans to pull the ad. it also files against the city and later dismissed. but jessamy's supporters stand by her record. >> pat jessamy has been in annapolis, on dozens of occasions, trying to strengthen the witness intimidation law. >> reporter: apparentlyux it's still too sensitive of a subject for the politics of the campaign. outside in east baltimore, i'm pat warren. back to you on television hill. >> pat, thank you. the bernstein campaign is also running a radio adabout the death of carl lackle who was killed to prevent him from testifying in a murder trial. we have breaking news right now in downtown baltimore. sky eye chopper 13 over the scene of an altercation. captain mike perry has more for us. >> reporter: police were called to lafayette and mosier. this is downtown. just about 10 minutes ago, for a report of a woman beating a man with a baseball bat. there apparently was a large crowd when police arrived. they found the man conscious and breathing at the time. he has been taken to a waiting ambulance. apparently the baseball bat was waiting at the scene. police are searching the area of lafayette and mosier downtown. looking for the suspect and suspect vehicle. it appears the man did suffer some head injuries. but at this point, it is not clear how significant those injuries are. back to you to you on tv hill. >> we'll continue to follow it. new details. vic is in the newsroom with information from a newly released federal report. vic? >> the plane crash killed bill philips, along with former senator ted steven little. the new report shows the impact of the crash just lodged an emergency locator beacon from its mounting bracket. it took one night to reach the crash site. but 13-year-old willy phillips and three others' survivors lay injured. it showed the plane crashed just 15 minutes after takeoff, at 2:45 p.m. that wreckage wasn't spotted until 8:05 p.m. mary, back to you. >> the state medical examiner says the victims' injuries were supposed to fear a quick response from rescuers probably would not have made a difference. two beams of charred metal from the world trade center are about to go up. where a 9/11 memorial is being built in millersville. the monument will not cost taxpayers a penny. >> reporter: the twisted metal beams will soon be installed at a 9/11 memorial, going up in front of anne arundel police and county headquarters. people can see the debris to help remember that catastrophic day. >> having this monument here is a great tribute to the people that died on 9/11. but also a tribute to the men and women who work in our department and are dedicated to this type of emergency type service work. >> this is the planned design. 13 black gum benches. the man heading the monument said the beams were available free, under certain conditions. >> all you have to do is go pick them up and bring them to your site. but you have to incorporate it in the memorial. >> reporter: a cousin who lost his cousin is pleased about the memorial. >> you can't let people forget. >> a firefighter killed while trying to save victims in the attack. >> i made a promise to my aunt, who passed -- passed away last year, that i would never let his memory be forgotten. >> reporter: he say he'll regularly visit the new monument. >> reporter: no tax dollars are being used to build this memorial. as a matter of fact, all of the contractors donated their time and material. and another $14,000 was raised to pay for lighting. the anne arundel county memorial will be built in august 2011. >> people who want to donate to any future costs can pay for a paver's stone engraved with their name. a mexican drug cartel kidnapped and killed 72 migrants trying to reach the u.s. border this week. a survivor escaped and stumbled to a highway checkpoint where he alerted marines. one marine was killed yesterday while trying to apprehend the gunman. this is the largest massacre to date in mexico's drug war. the primary results are in. this season brings many victories to established candidates. but others are fighting for their political lives. joel brown reports for wjz from washington. >> reporter: the face of congress could look much different after november's midterm elections. another incumbent, alaska senator lisa murkowski is on the verge of losing her job, with 98% of the votes counted, the gop lawmaker is running behind tea party candidate joe miller. he's a constitutional conservative who got a key endorsement from sarah palin. >> if joe miller's lead holds, then it looks like sarah palin won another one, in terms of being a king maker in these primaries. >> reporter: palin also supported her former running mate, arizona senator john mccain. he held off an aggressive challenge from even more conservative challenger j.d. hayward. >> i promise you, i take nothing for granted. i will fight with everything i have to make my case for the senate. >> reporter: six incumbents have been ousted so far this season, as voters send the message that they're not happy with the status quo. >> there's a new element of anger here. it's over the economy, over the stimulus, over healthcare. >> reporter: in florida, experience did pay off in one race. congressman kendrick meek won the democratic primary. and will battle marco rubio. and battle governor charlie crist in the fall. tuesday cannot be comforting to republicans or democrats. with the balance of power up for grabs in both houses of congress. joel brown, cbs news, washington. it would could be a few weeks before all votes were counted in alaska's senate race. and troubled actress, lindsay lohan has been released from a court-ordered rehab facility. the new arrangement allows lohan to continue to work. however, she is mandated to attend counseling sessions several times a week until november. lohan was set to pris -- sent to prison in july for violating her probation from a 2007 drunk driving arrest. she only served 13 of her 90- day sentence behind bars. state regulators are calming fears about the national egg recall. the maryland department of agriculture says none of the registered plants is expected to sell eggs in our state. they also request whether the salmonella contamination may be by vaccinating against the bacteria. they are already driving wholesale places up. -- prices up. time now for a quick look at some of the stories you'll find in tomorrow morning's edition of the arundel county, sky eye chopper 13 over the scene of an accident. captain mike perry above us with more. >> reporter: we are along i-95, north of route 100. where a car has departed, i-95 and gone into the wooded area. the woman driving the vehicle initially looked like the firefighters weren't going going to get her out. and now, she has been removed from the vehicle. we have a significant police and fire presence along northbound i-95, just north of route 100. and the backup extends about a half mile or so. there's no word on what the cause of this accident is. and as you can see, about a lane and a half here as you come north of route 100 are blocked. but that is the only significant blockage here at this point. and looks like state police are in the process of getting this cleaned up. so back to you on tv hill. >> all right, captain mike perry. back to you. it has been a long battle. but the super fresh in delaney plaza will be closing its doors. it will affect thousands of food shoppers in the area. >> reporter: the super fresh in the delaney plaza shopping center is a towson landmark. but after a 50-year run, the store will be closing in december. devastating news for long-time shoppers like cricket hicks. >> i love this store. it's convenient. it is friendly. i know everyone there. i just -- i'm very sad about it. >> you can ask any of the clerks. they all know me. >> reporter: rosalie rosety is here three times a day, shopping. for many of the seniors who live in these nearby apartments. >> and we're all going to miss it. and i feel very sorry for so many handicapped seniors. and it's going to be a big loss. >> it will probably cause a hardship to some of the residents in the area. and looks like their businesses. and some towns folk want to come and get a salad and go back to work. >> the parent company of the super fresh chain is closing 25 stores in five states, including this one. >> well, i was surprised that they would close this one because of all of the apartments around it. but if they replace it with something, you know, that will be good. >> for shoppers, all is not lost. the owners of the shopping center say they're negotiating with an upscale grocery store to replace the super fresh. >> i also heard trader joe's. then i've heard of eddie's. and i also heard of whole foods. >> in towson, ron matz, wjz eyewitness news. >> there's no word alt this time on how many employees will be affected by the closing. it's not the only one. giants have closed over the years, even before the economy started to
