a 39-year-old man described by police as having a lengthy history of violent crime. that life ended about 1:30 this afternoon. >> he was laying to the side of the van, dead. just got shot up. and i don't know what he did, what happened happened. >> what happened came at the end of a stakeout in ceilings a series of armed robberies. they found out he had an appointment with his parole officer at a building off mount hope drive of as the man hided for his show, detectives approached the man pulled a powerful handgun out of his car. >> he produced an incredibly large 50 caliber revolver and engaged the detectives in a brief but violent gun battle. >> the shooting happened in front of the gateway school of speech and learning. this mother who did not want to be on camera said the school was not locked down and there was security present. but the firepower of a 50 caliber weapon could have easily claimed an innocent bystander. >> it takes rounds bigger than the diameter of your thumb and equally as long. i think idiots carrying guns on our streets are violent criminals and i think they're morons and i think they pose a danger to you and me and everyone that's going to listen to this tape. i think they pose a danger on all of us. and we're going to work our tail off to get them out of the city and put their tails in jail, that's where they belong. >> it's not known yet how many officers returned fire. none of the officers was hurt. we do know more about the suspect. we don't have a name but he was 39 years of age, released from prison last year after serving time for robbery and handgun violations. he was drew to stay on parole through 2012. there will be a news conference later this evening at baltimore county police head quarters where we hope to learn more. kai, back to. >> thank you. as we told you this the second police involved shooting in two days. yesterday police shot a suspect who they say shot two people in south baltimore. michael guest died last night at shock trauma. police say he had an extensive drill record. tonight a search for the person responsible for a deadly hit-and-run that left an elderly woman dead. live at county police headquarters susan collins with more on the victim and the suspect vehicle. >> reporter: right now police only have the broken head lamp but hope someone may have witnessed this 5:30 a.m. fatal accident. on busy eastern avenue in north point, the 70-year-old woman is struck. police break the news to delores strait's husband, a retired longshoremen as he drinks his coffee. >> love to see who did it. love to see them go to jail. because they should be stopped. >> the mother of four leaves behind more than a dozen grandchildren and two great grandchildren who are shocked and angry someone could be so callus. >> very furious. i cannot believe someone would just hit somebody, just keep on going. not stop to even see if she was okay. >> strait was discovered at 5:30 a.m. in the eastbound lanes of eastern avenue at 54th street. her family believes she was crossing eastern avenue to get to the bank for cash, then she would take a bus to a city market for food. her family says the italian woman cooked every day and always went out to buy fresh meats and vegetables, for spaghetti and meatballs or lasagne, feeding neighbors and family. >> she's very early riser. she doesn't like to be in part of the big hustle and just wants to get her stuff done and get moment. when there's not a lot of people out. so that's why she liked to go really early. >> police need witnesses or someone who sees the damaged car to call. >> from the evidence recovered at the scene, the best we can tell that the vehicle was a mazda. >> don't know the color. >> no court color, no other description. we only have the headlight and some of the glass at the scene. >> anybody who just couldn't stop or wouldn't stop, i mean, they have to live with that. i'm hoping somebody knows somebody with the mazda and sees that it was in an accident recently. >> now the broken pieces of the headlight had the word mazda printed on them but unfortunately that doesn't let police know was it a car or truck. back to you. >> thank you, police ask anyone with information to call, there is a reward offered. guilty. that's the plea from a man who prosecutors say stole hundreds of thousands of dollars from the mta. police say an electronic trail led to the arrest. we're live downtown, mike hellgren has more on the suspect 3 his plea made a short time ago. >> reporter: kai, he was wearing a very nice suit and 4 an iphone with him in court. he will have to forfeit his assets or cash to pay the agency back. he is not in jail tonight but did have to surrender his passport. federal investigators used electronic codes from the fair boxes on mta buses to track down an employee who took a massive amount of money from them. wjz was in court as pattawi pled guilty to stealing money in fares. >> we knew the government and his counsel negotiated the plea in advance of seeking an indictment. >> pattawi worked theover night shift where he was largely unsupervised. cash would come in and he secretly used a portable electronic key to access the cash boxes, hobbly 16 and00 times. >> i wouldn't have gone forward with it, i didn't think justice was served by. >> pattawi handled radio communication repairs for the mt arc. the thefts happened between january 2007 and march 2008. regular writers were stunned at how someone could take so much cash. >> in that industry that's a bad sign. you trust your employees with kind of responsibility of handling money, and to have one of them do this hurts. >> he admitted to the judge he had a few drinks last night before making the plea and admitted his guilt and the possibility he could face years in jail. >> i find it hard to believe there's that much money in the boxes. they hardly ever have them working. >> they were working a number of these the beltway. chopper 13 over the scene, captain mine mike with more. >> reporter: we are in woodlawn along i-70, westbound, where utility contractor truck, a pickup truck, is overturned in the median strip of i-70, westbound. initially it was called as a rescue. apparently the driver has been taken from the vehicle. he is in a nearby ambulance. this is blocking one lane westbound i-70, so the backup now extends well back on to the baltimore beltway. so you can expect delays in the area. the maryland state police just arrived, it's unclear how long it will take this to be cleared up. so during the evening rush-hour you can expect delays in the area of i-70, westbound at woodlawn. back to you. >> thank you very much. investigators are working to determine what caused a deadly fire at a baltimore county motel. it happened in the 7900 block of po lass ski highway after 3 this morning. rescue crews found a man inside 3 was rushed to bayview medical center burn unit, where he died. three teenagers are accused of defacing a local high school with graffiti. howard county police say the vandalism happened at mount hebron high. the three 15-year-olds arrested all attend the school. it happened on december 5th when the teens allegedly spray- painted racist graffiti inside a portable trailer at the school. in tonight's flu report, hundreds of thousands of h1n1 vaccines for children are being recalled. but officials say there's no need for parents to worry. >> reporter: children the affected age group are supposed to get two doses of the vaccine one month apart. health officials don't think children need to get vaccinated again. even if they got two doses from the recalled lots. 800,000 swine flu shots for children are being recalled. tests show the doses lost some strength after they were shipped. >> the recall is not because this vaccine was bad. or dangerous. the recall is because they didn't have the confidence that this vaccine would do as well as they would like. >> the recall involves pre- filled syringes for kids ages 6 months to three years old. the is for skis control says the vaccines were distributed last month and most have been used. >> we believe the vast majority of these doses have already been administered based on the high demand we've had for vaccines. >> the company is voluntarily recalling the vaccines and says these lots passed all quality controls and met all specificiations required by government agencies at the time of shipping. federal health officials are stressing that parents do not need to worry because even if the ribbon schools are recognized for their high patch performance and significant improvements in reading and math. beside eastern tech, northern middle school was recognized. new mark elementary. napolitano all honored today. there are many national blue ribbon schools awarded every year, and in the last six years every maryland school nominated has won. many of the schools students are at a high rate. >> they have high expectations for all students and they look at each child and were data driven and we work on individual plans, success plans. >> students we spoke to say they're jody francis who said with a new owner they can compete. >> i look at that as like the calvary coming over the hill. to save the day. because the reason that the message has not gotten out up until now, i believe, as to why laurel would be such a desirable site and be able to get to market so quickly is because the racetrack and the entire racing industry has been in a shadow of a huge black cloud created by this bankruptcy. >> the bid was thrown out because it didn't put the money required. and the license has been awarded to the cordish company for slots at mills. but there's still support for slots it at the track. >> i've long believed we would be best off if slots were kept at the tracks because part of the rational was we wanted to keep horse related agriculture in maryland with all jobs that racing supports. >> the anne arundel county council delayed a decision to zone the area and also considering a proposal for slots. the council votes on monday. >> i have my fingers crossed hoping they deny the zoning. >> the auction is january 8th so if the county council approves the mills location what does that mean for laurel. >> then what you're looking at is someone buying the tracks to preside over their funeral. >> with all these uncertainties, the future of the preakness and horse racing in general in maryland is still up in the air. post-time, january 8th. pat subject of gay marriage. denise joins us with how the voting went and what is next. >> reporter: the council voted overwhelmingly to legalize gay marriage in the nation's capitol. 11 of the 13 councilmembers voted in favor of the measure. hundreds of gay marriage supporters turned out at a rally prior to the vote. mayor fendi promised to sign the bill, then it will go to congress for final approval. opponents say they will try to get congress to overturn it or attempt to get it on the ballot for the voters. >> thank you. if the district approval then same-sex marriage licenses should be issued starting mid- march. millions of households are on alert after one of biggest recalls in u.s. history. alexis reports for wjz involving popular window coverings posing a danger are children. >> reporter: linda kaiser's heart breaking story is a warning to all parents. >> i walked into the room and my daughter was in the court corner of her crib with her head down and unnatural position. >> cheyenne was just a i year- old when she was strangle by the cord from a window blind and other tragedies have followed, leading to this massive consumer action. more than 50 million roman shades and roll-up blind are being recalled. retailers are offering customers free repair kits. the consumer product safety commission says eight deaths have been reported since 2001 and more than a dozen near strangulations. the problem is not just dangling cords, but the ones hidden inside, which can become looped around a child's neck. >> and it's a defect in the products that a lot of people don't know about. >> as you can see here with this roman shade, if a child puts their hand through the side, this cord becomes a choking hazard. owners say their customers are always concerned. >> their biggest districts a man of first degree rail and several over charges. roger irvin was found guilty of rape in august of 2007. he was also convicted of burglary and gun charges. he is scheduled to be sentenced in february. the man accused of killing chandra leavy faced new charges against him in court today. he plead not guilty to threatening a witness in the case. he already pleaded not guilty the first-degree murder charges in april. levy, a federal intern, was killed in may of 2001. her body discovered a year later in rock creek park. united states is moving forward with plans to have a nature of terror suspects held at guantanamo bay stand trial in the united states. and one suspect has ties to maryland. he lived in baltimore before moving to pakistan. he is labeled as a high value suspect by the u.s. government. counter-terrorism officials say he met suspected september 11th mastermind sheikh khalid mohammed and played a range of rolls in terrorist plots. and it president obama announced as many as 100 terror suspects will be moved to u.s. soil. >> reporter: as many as 100 terror suspects will soon call america's heartland home. today the president ordered the federal government to buy the maximum security prison in thompson, illinois, and get it ready to hold guantanamo bay committee containees. >> the president has great confidence in the military of this country. those are the people that operate guantanamo bay. those are the people who operate a facility in thompson. >> the president's announcement helps them keep a campaign promise to disclose the detention center at guantanamo bay, cuba, and also gives new life to an almost empty prison about 150 miles west of chicago. the facility costs illinois taxpayers $120 million to build in 2001, but budget problems have kept it from fully opening. the the new detainees will come with $1 billion in federal funds and thousands of jobs. >> people are desperate for good jobs. and the jobs we're talking about here are some of the best. >> one of detainees that could end up in the illinois prison is self-proclaimed mastermind sheikh khalid mohammed they will be try here in new york in federal court. not a military court. that decision sparked protests and some new yorkers are worried the trials will provoke more terror is tax. now some folks from illinois feel the same. >> i don't think anybody with a serious face is making the argument that this makes the united states safer. >> illinois lawmakers also question whether it's constitutionally legal to house the detainees on american soil. the obama administration considers some of them too difficult to prosecute, or too dangerous to release. so the plan is to keep them there indefinitely. terrell brown, cbs news, new york. in vietti and 24-year-old katie nolan have been missing since friday. the body of their friend was found over the weekend. rescue kerrs say they're hoping the climbers carved out a snow cave on the mountain. family friends and police continue to search for a little boy in new york. police say the four-year-old vanrd from his apartment in newburgh monday. that's upstate new york. the boyfriend of the child's mother has been charged with reckless endangerment after investigators say he was not watching over the boy when he went missing. the mom has also admitted to having a strained relationship with the child's father. says she does not believe he's involved. the senate judiciary committee hears from rape victims today who say rape kits are vital to keeping rape assaults off the streets. congress passed the act in 2004 giving police the money needed to take on a backlog of thousands of untested dna rape kits sitting in storage. one victim describes how after six years her
