u.s. attorney to investigate the shootings and hopes to restore calm to the streets. one did have to be rushed to the hospital after being shot in the head with a pepper ball. we'll have the latest from anaheim. meanwhile a foot chase ended with a deadly plunge near niagara falls. the suspect jumped a retaining wall and the officer falled. falling 100 feet to the niagara gorge. the officer was lifted to safety with serious injuries. it's unclear why the suspect was chasing the man. and the first catholic church official to be convicted in the child abuse scandal has been sentenced to three to six years in prison. the judge said philadelphia monsignor william lynn lead monsters to destroy the souls of children. and new fallout this morning from the abuse scandal at penn state. there's word the school's credit rating may now be down graded. forcing it to pay high interest rates. and state farm insurance pulling its ads from football games. general motors is consider reconsidering itsen sponsorship. meanwhile overseas, take a look. in china. at least 37 people were killed by raging floodwaters that swamped beijing. it swept away virtually everything in its path. and a man eventually rescued and is okay. again the man involved is okay. thanks, josh. now to the latest from colorado. we learned new details about what suspected shooter james holmes was doing the weeks leading up to the massacre and emotional visit by christian bale to the victims. abc's dan harris is at the hospital where bale visited yesterday. good morning. >> reporter: good morning to you. by all account, this is something christian bale did it entirely on his own. he did not represent the movie studio. did not hold a press conference, but created a sensation. the man who played the dark knight in real life swooped in to the people that got shot because they wanted to see him be batman on screen. christian bale and his wife made a surprise visit, laying flowers outside and spent two and a half hours at the hospital. meeting with doctors, first responders and seven wounded. >> it was very emotional to see him in person. they enjoyed the visit. >> reporter: bale specifically asked him not to alert the media and news leaked on twitter and when patients posted pictures online it lit up the anguished city. meanwhile we're learning more about the suspect, james holmes. abc news learned june 7th. hours before he took a key oral exam at the university of colorado, which he failed, holmes went to the store and bout a high-powered rifle, adding it to his growing arsenal. three days later he dropped out of the program with no explanatio explanation. experts say he had an underlying mental illness triggered by his failure. >> all of that can make a dorm nant schizophrenic come out, and come out quickly. >> reporter: law enforcement officials are trying to figure out where and with whom holmes may have learned to use his weapons. on a more hopeful it note. these new pictures, new life amid all of the horror. this is hugo medley. his mom survived the shooting unscathed. gave birth to the same hospital where her husband, hugo's dad is recovering from his gunshot wounds. >> we know he's a fighter. we know he will not stay out of that child's life for any length of time if he can avoid it. >> reporter: according to the family. the baby's father is getting better every day. when they brought the baby into the dad's hospital rhyme room for the first time. his pulse went up and he moved his hand as if to reach for his new son. who is named after the missing in iowa. and new development in the case that turned up few leads to this point. abc news obtained surveillance video that shows the girls riding by on their bikes. may be the final glimpse of them before they went missing. abc's alex perez has the latest. >> it lasts only seconds and to some may look like a blur. look closely, one bicycle crosses the top of the frame shortly thereafter a second bicycle. this video obtained by abc news is one of the last times 8-year-old elisabeth collins and cousin lyric cook were seen. >> it looked grainy to me. zoom, they were by the thing. so it's hard to make much out on the thing. >> not much, but investigators saying they're now analyzing the video for any clues. >> the girls were less than a block from the house when this camera captured them riding by. important to note they were riding away from meyers lake. both of the bicycles were recovered are near the leek on friday. they haven't been seen since. the surveillance camera belongs to the local auction house. with few clue, the manager thought to look for the video and turn it over to the fbi. >> anything we can do to help. we want to see them come back safe, alive. >> reporter: the video matches the police time line. investigators say the girls left home to ride their bikes shortly after 12:00 noon. the camera's clock shows it was 12:11 when they rode by. >> that video is one of the few pieces of hard evidence in this case. although they would not offer details. the investigators say they do believe the girls alive. robin, george. now to london with the open ceremonies (in her head) that's wassup. famous brands. famously easy. famous footwear. victory is yours. back now with that terrifying video of a killer whale attacking a sea world trainer. released as part of a lawsuit that federal government said they should change their practices. >> reporter: issue of terror captured in this video ken peters, grabbed by his leg, dragged under water. flailing helplessly with by a whale he trained for years. the silent video made public was obtained by david kirby. >> she said she didn't want to perform. >> reporter: she is rag dolling him. holding him under water. 30 seconds passes and then bringing him up. >> if she wanted to kill him she would kill him. >> ken peters is incredibly lucky to be alive. he's kicking his legs trying to keep her away from his body and she grabs him again and down they go. >>. >> reporter: then she releases him, you see him thrashing for the edge of the pool. trying to run, he stumbles. his feat mangled. this video was used in a courtroom. after this fatal incident in sea world orlando in 2010. 40-year-old trainer dawn branch, pulled under water and killed by the 11,000 killer whale. his third fatal attack on a human. the occupational safety and health administration claimed the theme park put trainers like her at risk and this video proved sea world was aware of the danger. in response to the case at the time. sea world asserted they're unaware the whales could be deadly. after the 2006 incident. peters showed skillful execution of the emergency response and remains a member of the team at shamu stadium to this day. that interaction between peters and the whale lasted for nine agonizing minutes. but advocates say there's millions of interactions with whales and humans, the vast majority of them safe. there's millions of dollars riding on this. they tend to appeal that ruling. >> nine minutes is a long time. coming up we secured the phone call with randy jackson. . >> what happened was the executors of the estate have used every trick in the book to try and deflect the attention from the question that has not been answered. the question is, on july 7th, 2002, he swore under penalty and perjury that the will was signed by michael jackson. the other persons on that will in los angeles, was in fact there is footage that clearly shows that on july 7th, my brother was in harlem with al sharpton. he was there the day before, the day after. i want some answers. how come john mclean have not answered that question. anything other than that has been the estate using my mother, my nephews and nieces at pawns to protect their own financial greed and gain. >> you have been very consistent in asking for answers to those questions. as you said, there is video showing that your brother was across the country when they said he signed the second will. when is the last time you talked to your mother, katherine, randy? >> my mom is on her way back to los angeles. she was under doctors orders that she go. her health was really bad, and he wanted her to go somewhere where she could be on the phone, and just cut off from the outside world for a few days. so she's fine. her health is a lot better. but, you know, this is -- this is all part of the plot to try to hide the truth. and we want answers. >> paris is tweeting day after day, claiming she didn't know where your mother was, even your brother in a recent interview was very upset and confused in saying he didn't know where his mother was. did -- were the children made aware that she was going to be leaving them for a time to get some rest? >> first of all, my brother said my mother's fine. they're using bits and pieces that they want to use to try to confuse the public. this is all in an effort to try to hide the fact. there's questions we want answered. we just want answers. that's all we want. >> and a final question to you, randy. you know there are a lot of people who have been watching this, and they feel that some of michael's siblings, that it's about the money. how do you respond to those people who feel that's what the bottom line is here. what do you say to them?
