Both taken to the hospital to be treated to be checked out. Look just beyond the side look at the very active situation here, active investigation here. The focus is trying to find out where this bullet or bullets came from. The focus off in the woods somewhere here to the left they are trying to find the source of the bullets, where the shooter was. From there, they hope to be able to track down this individual or individuals and take the investigation from there. Hopefully lead to a suspect. At this point, no reason why no rational at this point for why this would have occurred who might have opened fire. Again, two people injured. But minor injuries. The alternative to this bad deal is a much better deal later in the day president obama said there are no viable alternatives to the negotiations that are already under way. Attorneys for Jesse Matthew want a judge to push back the start of his trial. Matthew is accused of killing 18yearold Hannah Graham in charlottesville. A hearing is set for tomorrow to consider that delay request and some other pretrial motions. Right now, arguments in that case are supposed to begin june 29th. And we have breaking news out of Fairfax County this evening where the countys attorney announced in just the last hour that he will be retiring. Alison about 45 minutes ago board of supervisors members got out of a two hour closed door meeting with county attorney in which they discussed his handling into the investigation of the Fatal Shooting of john geer. Right after that meeting, it was announced that the man who has been the county attorney for 20 years will be restructuring the office before retiring in june of 2016. He said very little during todays Board Meeting but supervisors say the county attorney has a lot of explaining to do for how he handled the investigation into the Fatal Shooting of john geer. A lot of this could have been avoided. The supervisor is referring to recent revelations that bob deans office did not tell supervisors about an ongoing dispute between the Police Department and Commonwealth Attorney ray morrow and that he also didnt tell supervisors that morrow wanted to meet with them to discuss the case. Breach of a basic responsibility of an attorney and i think its unacceptable and i think we need to make some changes. There was a communications severe breakdown that caused us to lose time. Geer 46 was shot and killed while standing in the doorway of his town home following a standoff with Fairfax County in august of 2013. Meanwhile, in response to the incident, the board chair got approval for a 25 Member Commission to examine how Police Shootings are handled which will include members of law enforcement, Community Leaders and the media. I think this is an excellent move and i think its the right thing to do. I have a very strong feeling that we are going to muddy the waters of transparency. The family of john geer is suing Fairfax Police claiming that the shooting by officer adam torres was not justified. I spoke just minutes ago with the attorney for the family mike leeberman and he tells me that his retirement is a good First Step Towards transparency in terms of fixing some of these Police Policies that have been problematic here in Fairfax County going back for years. Well leon, police say gary knighting left his home in Rappahannock County in june of 2011 and ended up on a quiet street in bethesda where he knocked on that elderly womans front door. What happened, detectives say is three years of dramatic price gouging. This is the split level that police say gary knighting preyed on billing the home owner, i 72yearold disabled woman for falsely, unneeded repairs. Invoices show he charged one grand to trim shrubs 10,000 to patch up the Backyard Patio and fence and 15k to install a new roof. In the end, investigators say the disabled home owner lost 321,000. Its heart wrenching. The neighbor is stunned. I guess she trusted him. You know once somebody does a job, they kept coming back. Theyre very good at determining what will get the victim to hand over their money. Police say in some cases victims lose more than a million dollars. Thats whats so sad about these cases, they gain these peoples trust. They try to confuse them. Sometimes actually intimidate them and before long theyve taken these peoples life savings. But first, 7 on your side steps up for a condo owner sitting with no water well imagine during this bitter cold winter weve been having not having either heat or hot water in your home for your family. Well, a fairfax man and his daughter say they have been suffering in the cold because of a dispute with their hvac companya faulty heating unit. So they contacted our 7 on your side trouble shooter Horace Holmes to see if he could get them to turn up the heat and get things fixed. Joe kaufman says its been 6 1 2 weeks. 6 1 2 long cold weeks without heat or hot water in his fairfax condo. On auto to wash your hands, its ridiculous. Its cold. It hurts. He and his two teenaged daughters have been out in the cold all this time he says because of a faulty heat and hot water unit that was broken kaufman claims by united air temp, the company that installed the unit he says nine years ago. We have called. We have begged. We have pleaded with these people to come and fix it. Kaufman says back in january, he and his landlord called united air when the hot water started turning cold. The Service Person came they cut things. They did things. They didnt fix the problem and ever since then its gone downhill from there. To the point now im not even getting a spark. Where the unit doesnt work at all. Kaufman says a repair person has visited his condo at least once a week trying to get the heat flowing. Theyve replaced parts, pipes and even the entire unit but nothing has worked. Fed up and weary of suffering through the cold and bathing at neighbors homes we walk outside in this weather and we have our backpacks on our back and we get our shampoos and our soaps. A representative told us theyve been working to fix the problem and the heat he insists have been on intermittently and the real problem is with the manufacturer of the unit. 6 1 2 weeks, the apartment is still cold and theres still no hot water, kaufman says a representative from the manufacturer of the heating unit is going to come out here at least has promised to and take a look to see whats wrong. But with temperatures above freezing at Reagan National and at 34 degrees everything that hits the ground as long as its rain and needs to stop freezing. However, the further north and west you go of d. C. Up towards the Baltimore Area thats when we still have a little bit of freezing going on. Thats going to quickly come to an end over the next couple of hours or so. Look at the temperatures. Above freezing at dulles. Now 28 degrees gaithersburg. Right at freezing in frederick. B. W. I. You can see the warmer air thats trying to advance from the south where you have that process over from the freezing drizzle over to all rain around the capital beltway. But like i said the bigger problem as you head up towards b. W. I. And towards aberdeen but all that is eventually going to turn green as they prove through the evening hours and waking up tomorrow morning, wouldnt be surprised if we have temperatures that will approach close to 40 degrees. This is what we have in terms of the latest advisory that Winter Weather advisory. A lot has been shaved off, especially off to the west of us. Still includes the district and southern maryland. This is set to cancel at 10 00. Look at the warmer air thats trying to move in from the south. 63 degrees in charleston. 5 51 in asheville. This is part of that warm front thats going to move overhead. Temperatures will not be that warm but still well above freezing. We have highs tomorrow that will approach 50 degrees. Look at the temperatures we will increase. That warming trend will continue through the Morning Hours tomorrow into the early afternoon. At that point, a cold front off to the north and west of us, that will signal big big changes for us. Heres the cold front, and it extends well well to the west of us. Well widen the view out a bit. Biggest concerns is oklahoma and into the deep south. Were not the only ones dealing with the winter storm watch for tomorrow night into thursday. More than likely all the areas shaded in blue here will convert over to a winter storm warning and look at the warnings already beginning to pop up. Little rock and nashville, this is where theyre expecting significant snowfalls. For us, though we are going to call for rain tomorrow morning for the Early Morning rush hour commute and it continues all day long but then as we move through the overnight hours into early thursday morning, that transition from rain to snow may become heavy at times early thursday morning before finally moving on out of here. Department of transportation and said the city has filled 80,982 potholes since 2013. 7600 were in the first few months of this year. Typically the city offers the annual effort to fill potholes dubbed the pothole palooza in march. No dates have been set for this years pothole palooza. In this case, not a pothole but massive sink hole causing problems in northeast d. C. Tonight. It opened up along 13th place between faraday place and faragut street. Brad bell live on the scene with a look at the repairs there. Potholes everywhere and things like that. Water main break is the cause. Water main break under the street opened up at 11 00 this morning. Theyre working on it now. I want to walk up here a little bit closer because, you know, a lot of times when you see these things on tv its difficult to really get a feel for just how big these holes are. Well take a look at this. Look at that excavator bucket down there as it goes up you can see that big dumptruck. This sink hole is so big that it could and in fact did swallow a car. We can show you some video of what it looked like when we first got here. Car had already been removed from the hole. The hole was filled with water. But what were hearing from neighbors is that there was no problem here and all of a sudden, the car drives down the street and the road opened upderneath and it went in halfway. One of the neighbors tells us that his car barely escaped. I got a call from my neighbor saying you need to get home. Your car is about to sink. And i said youre joking. She said no you need to get home and then my next door neighbor called, yeah i need to get home. Well back live now, you can see they got a lot of work to do here and theyve just started excavating. They have to get down to figure out what they need to do to replace it. As we take look around here at the rest of the road in this area, its all undermined and its all buckled. Researchers in australia say that taxing nondiet soft drinks and fruit drinks on the quantity is more effective at reducing how much people drink than taxing the price of the drink. The study is published in the Magazine Health economics. A proposal to pull sugary drinks from kids menus is in the works in maryland. Montgomery county Council Approved the bill expanding the ban on smoking in Public Places to electronic cigarettes. The legislation goes to the county executive for his signature. If it becomes law, smoking e cigars e hookahs and pens would be illegal in places where smoking cigarettes are banned. A bill hoping to crack down on puppy mills. It prohibits a retail store to sell kittens or puppies from the puppy mills. They have to obtain the puppies from an Animal Care Facility or nonprofit rescue organization. A dog in colorado is back home tonight after he was held hostage by a neighbor . Thats right. It all started when henry ran away from home after hours of searching his owner received a phone call from a neighbor saying henry was, in fact safe. However, because he attacked the neighbors cats henry would not be coming home right away. I absolutely volunteered to take care of the vet bills and he said thats good because youre not going to get your dog back until all the vet bills are paid for. So the owner bill feldman eventually called police and they brought henry home. Police did not charge the neighbor because he gave henry willingly to the officers. Cat, the vet bills were paid and he too is back home. Neighbor is lucky he didnt call liam neeson. Could have been ugly. Exactly. A little heavy handed. All right. We got some weather coming in here, steve we are not going to enjoy. Another round. Here we go again. At least this evening didnt turn out as bad as originally thought. The Winter Weather advisory still continues for much of the area. More on that in a second. But take a look at whats going on. Satellite and radar, this is actually our storm scan. Most of the wintry weather, frozen precip moving off towards the north and east. This is good news as the temperatures begin to rise. Temperature now 34 at dulles and Reagan National airport, above freezing or at freezing for andrews. Above freezing at quantico and fredricksburg. We get the point and we can see whats happening, that warmer air beginning to filter in from the south. Heres that Winter Weather advisory, its until 10 00 tonight, but i suspect parts of it if not all of it will cancel out a little bit before then as we move through the evening hours. This is what we expect temperatures will increase waking up tomorrow morning around 40 degrees and i dont foresee any big problems for the morning rush hour commute. Come tomorrow night at 7 00 winter storm watch goes into effect. This watch will likely be upgraded to a warning. That has not happened yet. When it does, well keep you updated here on abc 7. The letter that may have helped bring a hockey player home to his family. Until the nhl trade deadline Jordan Leopold played for the columbus blue jackets. Then this letter from his daughter went viral. Leopold played for the Minnesota Wild before being traded to columbus last november. His family stayed in minnesota and his 11yearold daughter wrote the wild a letter asking for them to get him back. The letter was never actually sent to the team but leopolds wife posted this photo to her Facebook Page and it went viral. Theres a human side believe it or not it our business too. So i think its great that he can go home and join his family and see that letter is pretty touching. He was traded just before yesterdays deadline but both teams say it was in the works before they ever saw the letter. Believe that . I dont know. New video obtained by abc news shows him before he was shot and killed arguing with a person inside an orange tent. Surveillance video shows him being questioned by police. He ducks into a tent when police pull him out, he starts swinging eventually as the now viral video shows officers shoot and kill him. While police and the city of los angeles are vowing full investigations, critics are speaking out. We got to fix this the l. A. Police chief said the photos taken of the officers gun after the shooting shows he had the hand on the gun oochlt. This is indicative of a struggle over the weapon. Two of the officers were wearing body cameras which l. A. s mayor is hoping to provide clarity. The murkiness should be cleared up by body cameras more often than not. Nobody should depend on cameras by themselves. As the investigation continues, three officers remain on administrative leave. Meanwhile, theres another protest scheduled later tonight. Anything thats frozen precip will change over to light rain and may see a little bit of light fog but nothing thats going to cause a lot of problems at least as we move through the overnight hours into early tomorrow morning. Investigators say the bandits is becoming more daring with each successful robbery. As Brianne Carter reports, thats a cause for concern. These are called bank takeovers.
