Thank you brianne. Today, a judge ruled information and testimony about an alleged murderforhire plot can be used in the upcoming trial of Michael Gardner. Gardner, you may remember, is accused of molesting a young female family member. After todays ruling gardners entire defense team stepped down. Northern Virginia Bureau chief Jeff Goldberg explains. As the father of a young girl targeted in an alleged murderforhire plot dan rice has a hard time putting his feelings into words. To say its worth it doesnt come close. While in prison in 2013 Michael Gardner reached out to a fellow inmate about hiring a hitman to kill two 11yearold girls set to testify against him in a trial in which he was accused of molesting the girls. But they say gardner backed out after a prison meeting with the supposed hitman who was actually an undercover officer. Gardner reported all of this to his attorney who alerted authorities that the young girls may be in danger. Today, he and his associates took themselves off the case citing a conflict of interest while accusing prosecutors of setting them up and taping conversations without their knowledge. The best i can say is they used bad judgment and mr. Gardner paid the price. But prosecutors say gardners threats had to be taken seriously. Pointing the taped conversations with family members in which he said about the female prosecutors im going to take revenge on these women that are out to get me. Calling them an estrogen lynch mob. He has described himself as indicated, sheet of black anger and hes indicated that we things of that nature. Family and friends of Michael Gardner, meanwhile, are standing by his side. We believe hes innocent. Absolutely. So hard on the children and on robin, too. Yeah, very tragic. Gardner now has no legal representation. So the status of his upcoming trial remains unsettled. All those salt spreaders left enough salt and brine on the roads to turn the pavement white. And all that could be doing some damage to your car. And this weekend, their online video said its time for their sympathizers to target western malls including here in the united states. Outrageous video, leon. This happened after 11 00 this morning. The tanker truck was filled to the brim with more than 8,000 gallons of gasoline. Police say the 43yearold driver was navigating the on ramp just east of philadelphia and he lost control of the truck. Hit a guard rail. Overturned with the tank rupturing and igniting the gasoline. The flames ran across the ramp down an embankment and very close to the backyards of nearby homes. A second fire started in a small wooded area behind the properties. One woman said she heard three loud booms when the crash happened and thought somebody was knocking on her door. Another resident said she heard loud explosions looked outside and thought the sky was falling. The plume could still be seen miles away in cherry hill new jersey and across the Delaware River in philadelphia. Rescuers were able to pull the driver out of his truck. He wasnt hurt. And no injuries were reported among nearby home owners. Some of them did complain of scratchy throats after inhaling the smoke. By about 90 minutes later, the fire was knocked back. Department of transportation tells abc 7 news that had weekends fire on the eighth street streetcar line was actually more of a spark than a flame. Will summer of the Washington City paper took this photo late saturday night. City says power was shut down to the overnight lines immediately and the car was towed off to a maintenance yard. The streetcar line was supposed to be opened by the 1s of this year but tracks are still being tested. A full investigation is now under way and that might go even longer now. Not a pretty sight. Feels like 2 degrees above zero because of the gusty northwesterly winds. Winds will diminish as the High Pressure moves in and the High Pressure centering off to the west now. Front is east to us now. We have a storm track going to try to get active in the deep south all week but so far, fingers crossed, most of the energy should move off the coast and up and out away from the coast. However, there is a chance by late thursday, one of these impulses could push close enough to give areas south and east of the city a snow shower or snow flurry or two. I get a little unsettled when i see computer models and satellite continuing to develop storm after storm system and move it south, just got to worry sooner or later, one of those is going to hug the coast and not peel out the same. Not saying it will. Something well watch. We know this, High Pressure will drop us tonight and the core of cold air thats just to our north and west 11 in chicago and detroit, pittsburgh. In West Virginia federal officials are getting their first look at the scene of last mondays derailment. The acting administrator of the federal Railway Administration says investigators have made progress at the site. 27 of the 109 cars on that train went off the tracks causing an explosion and oil spills. Workers are making emergency repairs to the fort mchenry tunnel and i95 under the baltimore harbor. A Spokesman Says the northbound right tube of the tunnel was closed yesterday because of a blockage in the drainage pipes. Its unclear what caused that. Crews say they hope to have the repairs finished by tomorrow morning. Crews are still working to repair a huge nine foot deep sink hole in arlington that opened up on fifth place north near North Littleton street on sunday morning. The family is still waiting for answers nearly five months after that 9yearold boy was shot in the head. When gunfire erupted at the mayfair mansions apartment complex in northeast last october, there was plenty of evidence left behind. Evidence that sources, tell abc 7 news was held up at the citys crime lab. In the District Of Columbia or any state, should not take four months to get evidence back on who the shooter was. If Monique Nichols sounds stunned, its because one of those bullets struck her 9yearold son jaden in the head. He was playing outside at the time. Four months and three weeks later, that bullet is still lodged inside his brain. He had his skull replaced they had to replace reconstruct his right eyebrow. In all of that time jaden has regained sight. He taught the left side of his body to move again and learn to walk again. Meanwhile, as detectives opened fire that night, sources tell us frustration kept mounting because ballistics tests were still not finished. You have gun and a child with a bullet in his head. You can look over my shoulder on the sidewalk you see what looks to be like a van. It apparently went out of control, wound up on the sidewalk there. We do understand at least several injuries. The people here at the scene are telling me that there were ambulances here. One of the people who worked here at the Government Accountability office says that debris flew all the way to the top floor. He saw it out of his window after he heard the crash. And right now, a protest is under way to try to regain control there. D. C. Bureau chief sam ford is live outside of Dunbar High School tonight. Sam, explain this one for us. Well leon a number of parents and alumni are calling for protests because they say the school is being allowed to go down from bathrooms lacking toilet supplies to unchecked violence. This video on you tube calls a riot at Dunbar High School from last september shows students jammed in a hallway screaming, throwing schoolbooks, this and other incidents have gotten attention in the community. They are really concerned about what is happening over there with the students. Its been a lot of ruckus. Its been mayhem. Dunbar is the 122 Million School built from the ground up. Alma mater of such notables as the d. C. Congresswoman Eleanor Holmes north on vincent gray d. C. s Academic High School during the years of racial segregation, they gained attention last november when a coach and teacher Charles Young was arrested accused of sex abuse of two young males and of late, students released alumni videos like this, students fighting in classrooms and another involves the principal Steven Jackson tussling with a young male and another School Administrator getting involved. They do not have control. They do not. They do not have control. A number of parents were at the school today for teacher conferences. Its been so many fights. Hes like mom, theyre always fighting. So i say where are they allowed to come back to school . Yeah. They just sit them down or whatever. There is some of the parents there that are getting ready for their protest. One of the complaints is that often, the parents do not know what is going on. Maybe a few clouds south of town during the afternoon as one little disturbance moves off the carolina coast but as youll see, thats expected to head out to sea as we head through the day on wednesday. Thats where a little wind change may get as close as 40 with some sunshine. On thursday, looks like the next system may be close enough. It may turn the winds to the northeast, make it a bit cooler. The 19yearold murder suspect appeared in court today. Ted rollins explains why his lawyers say that police mischaracterized incident as road rage. Standing in shackles erich nowsch didnt speak during his First Court Appearance in las vegas monday morning. Erich nowsch is accuse of killing mother of four tammy meyers in which police initially described as a road rage murder. Erich nowschs lawyer in an exclusive interview with nbc said thats not what happened. There was no original road rage situation between tammy meyers. They believe meyers was in a fight with another man and erich nowsch. Tammy meyers went to get her son to track down nowsch and the other man after the initial encounter. Nowsch was shot in the head in the culdesac in front of her home. The facts seem to point to selfdefense in this situation. It seems to explain the facts that we have in front of us more sensibly than any other explanation. Nowsch is facing several charges including murder and attempted murder didnt enter a plea on monday. The judge scheduled a preliminary hearing in the case for more. Ted rollins, abc 7 news. Abc 7 news at 6 00 starts right now with breaking news that breaking news comes from northwest washington where several people are hurt after a car crashed and rolled over on to a sidewalk at the corner of fourth and eighth streets northwest. Stephen tschida was the first reporter on the scene. Stephen, what can you tell us about this . Maureen, we can show you what happened. About an hour ago here on eighth street, fourth and eighth, you can see what appears to be an s. U. V. It has flipped over it has crashed. It is on the sidewalk. Now, we do understand from authorities here that at least several people were injured. At least one of them very seriously injured. We did talk with the people right across the street at the c. V. S. Here on eighth street. They saw it happen. They tell me they heard what sounded like fireworks going off. They looked out and saw this s. U. V. Somersaulting, flipping over down the street and then coming to rest there. Now, the injured were taken off to area hospitals. No word on their condition at this point. But we can show you some from another Vantage Point what this incident has done to traffic down here. It is backed up around this h street closed down. Fourth street here closed down as well.
