She said he was unresponsive, and she saw him both times lying on the floor of a padded cell, banging his head against the floor. Now, this is all taking place during jury selection. Jury selection is now halted, and all of this could seriously delay the start of testimony. Accused teen kyleer Phillip Chisholm, may mount an insanity defense when he goes to trial for the murder of Danvers High School teacher, colleen ritzer, but already, Phillip Chisholms Mental Health is center stage and threatening the start of his trial. Jury selection halted, as several times throughout the day, Phillip Chisholm was observed banging his head against the floor of first the conference room, and then later a padded cell. A court psychologist said Phillip Chisholm was unresponsive, when she twice tried to conduct a Mental Health evaluation. Phillip chisholm was 14 years old when he was arrested for the murder of colleen ritzer, the d. A. Says ritzer was raped, strangled and her throat was slashed. The murder, prosecutors say happened in a school bathroom. Ritzers body was discovered if woods behind the school. Phillip chisholm is charged with first degree murder in adult court. The trial judge is ordering another Mental Health evaluation wednesday morning. It is possible he could be ordered back to Bridgewater State hospital for 20day Mental Health evaluation which would delay the start of this closely watched trial. Now, all of the potential jurors who were called to the courthouse, they were hall sent home this morning, and told to stay there until they get an email telling them to come back, so we dont know when jury selection in this trial will resume. An investigation into where that threat came from is now ongoing. Town of North Attleboro is working to improve school safety. The sun chronicle reports about 60 School Staffers will be trained to use 52 new radios that will allow them to directly connect with First Responders in the event of an emergency. Nashua man is under arrest charged with stealing someones car. 52yearold man allegedly test drove someones car last month and then never brought it back. On friday night, officers got a report of a suspicious person in a local parking lot. There they found the man and the stolen car. Tonight, we have obtained emails and that scathing note between the medical examiner the email between the medical examiner and prosecutors and a scathing note written by a medical examiner acougars her office of accusing her office of bullying. Marian ryan is defending her office from accusations made in this scathing note we obtained, written by a medical examiner who says her office tried to bully him in to not reversing his findings in the death of a 6monthold maldin boy. I am puzzled by that. No bullying from your office . I think if i i think that we were asking the appropriate questions, and we asked for second opinion. The reporter ryan sat down with me and explained she was just asking questions when it came to medical examiner peter cummings, wanting to reverse his findings of shaken baby syndrome in the 2010 death of nathan wilson. Wilsons father jeffrey had been charged with murdering the boy. Those are hard questions that are being asked. Theres a request to have the do i understand how people can be disgruntled by that . Yes, i do. The reporter emails we obtained showed cummings in september of 2013 wanted to change his ruling to undetermined after the defense found new evidence. Even saying, i think their case is compelling enough, that i am willing to at least go undetermined at this point. Cummings note in the file reads, i told them i felt bullied and at times, i thought i was being forced to sign the case out, no way i did not think was honest. It goes on to call her office unethical and unprofessional, in the way it dealt with the case, and accused her of medical examiner shopping by seeking another opinion. The note calls your office unethical and unprofessional. The only thing that would be unethical is for us not to follow the evidence in a responsible way. The reporter charges were dropped and the wilsons have now hired interne to look an attorney in to what happened. If it feels a medical examiner feels the communications crossed the line and entered the realm of bullying or undue influence, then thats not how this process is supposed to work. Three people have now been arrested in the death of robert mckenna, found inside his home and tonight investigators say more arrests could be coming.
