Were told the driver of the avalanche is a man in his 20s. He ran from the scene. But was found hiding in a nearby yard. He was treated for minor injuries and is currently in custody. A 23yearold female passenger. Was also taken into custody at the scene and treated for minor injuries. The driver in the other car. Is a 47 taken to a hospital for treatment for a nonlife threatening injury. 3 also new this morning. One person was taken to the hospital by flight for life. This after a motorcycle accident on highway 164 and good hope road in waukesha around 2 50 this morning. Our crew on scene says it appears only one motorcycle was involved in the accident. A debate over fencing at sherman park leads to a special Court Hearing at the park after a tense disagreement between county executive chris abele and sheriff david clarke. Cbs 58s julie parise is live at the courthouse with the story. Kate and kyle here a special hearing was called last night to make a decision about the fencing surrounding sherman park. Ultimately a judge ruled to take the orange fencing surrounding the park down, but it didnt come without tension between sheriffs deputies and people in the neighborhood. The orange fence was put up after the unrest at the park lastth Police Involved shooting of sylville smith. Sheriff david clarke was the one who had it put there. County exec chris abele wanted it down calling it a barrier to healing in the neighborhood. Yesterday, abele showed up to take it down. Then clarke sent deputies to replace the fence and enforce a curfew at the park. Thats when things got a little heated. Abeles office called for a temporary restraining order against clarke in order to stop the early closures at the park. Around 8 yesterday, a judge ruled in and enforcing normal hours at sherman park. But not before some heated exchanges between parkgoers and sheriffs deputies. Its definitely provacative. And i think it will be a negative sight to see residents arrested for trying to reclaim a park in their neig neighborhood. 3 there were no arrests at the park yesterday. Before the evening was over, some deputies were even seen roasting marshmallows with people at the park. Coming up int he next half hour a closer look at some of the arguments between those sheriffs deputies and milwaukee jp cbs 58 the question now is. Who actually has the authority over sherman park . Park . The judge sided with county executive chris abele. On restoring the parks orginal hours. At least for now. Judge hansher ruled to uphold a temporary restraining order against sheriff clarke. The park has been closing at six pm. Instead of 10 pm after chaos the weekend of august 13th. Hansher also said that the sheriffs refusal to come contentious of civil proceedings. He said that the crimes that happened during the unrest happened near the park. But not on the parks grounds. An attorney for abele says civil unrest is happening because the park is closing earlier. Abele says while the sheriff has total control on patrolling the parks and restoring order. The hours are set by the county exectuive. 3 05 56 38;28 as of now, there has been no good reason given by the sheriff for closing the park 3 and hes not the law in Milwaukee County.
