The shooting happened in june at madison park. And following the das decision. The Wauwatosa Police department has released dash cam video of the incident. Cbs 58s Kyle Aevermann has been covering the story since the morning of the shooting. He joins us live from the Wauwatosa Police department with the video. Kyle . 28 seconds. Thats how long the video released by the tosa Police Department is. We do want to warn you thde disturbing. The officer involved activated the camera after the shooting preserving the moments leading up to the fatal shots. Investigators say the officer ordered anderson to put his hands upat first andersons arms are raised but you see his right arm go down toward the passanger seat, then back up, then down againthats when the officer fired six shots. It happened one minute after the officer initially radioed about the gun. Investigators say the gun in andersons car was a 9 mm, in the chamber. They also say anderson had a blood alcohol level of. 114 and marijuana in his system. And was in possession of 12. 41 grams of marijunana. Wauwatosa police chief barry weber says though it was justified, the shooting is a tragedy for everyone involved. 03;12;49 for anyone to lose any Family Member in any incident is horrible. Its hard on the Police Department, its hard on the family the officer involved will return to full duty. As you can imagine this was upsetting news for the family of jay anderson. Green Party President ial nominee jill stein is now asking a federal court to force a recount in pennsylvania. She moved to the feds after a state judge said a recount would cost oneMillion Dollars. Stein claims the state is using its bureaucracy to obstruct voting the recount in wisconsin, michigan and pennsylvania all need to be done by december 12 at 8 pm. The Anderson Family says they were upset after learning the officer will not face any charges. But they promise they will keep fighting. A federal investigation into the case has been granted by the department of justice. The better video than what was released by the wa believe this video police shows what really happened. West allis police say a car hit the front porch of the house. They say alcohol . Does . Appear to be a factor in the crash. We spoke with a woman living in the house. And i was just going to go back to sleep and she called and said somebody hit the house. The house was damaged. Police say they have no information on injuries yet.
