The controversy over President Trump's call to Ukraine's president continues and House Democrats are working to have the whistleblower testify on the complaint that President Trump tried to get Ukraine to interfere in the 2020 election. Correspondent Rick Des Magellan reports Adam Schiff the chairman of the House Intelligence Committee telling in d.c. Away or. The death of an infant at a 5 star child care center in the Bear area should never have happened according to experts in child care development. Reports in the 1st part of this 3 part series. Is entirely preventable preventable experts say have the little people Child Development Center adequately staffed and its policies in force Patty Daly Lewis executive director of the Beau Biden foundation for the protection of children says 4 month old Isabella told him would still be alive today had the foundation's primary principle been followed there should never be. Uninterrupted. Interaction between an adult and a child period the push for that principle came after it was discovered pedophile pediatrician Earl Bradley in Lewis was able to molest hundreds of children in Delaware he was convicted of these crimes and make sure that the policy can actually be enforced because if you have 5 rooms and you have 4 employees guess what it's not happening so they can have it in their policies but they're not doing it I just the checking like that is so important court records say Isabella was smothered to death by daycare worker 19 year old to join a Ferguson of Wilmington because the baby wouldn't stop crying the fatal assault was captured on video according to Delaware State Police who noted Ferguson placed her hands over the baby's mouth and nose for a period of at least 3 minutes the video showed the baby kicking at the beginning of the assault and not moving by its end. Cruelty. Allegation the 5 star child care facility had its license suspended after the killing but was 1st to report the suspension was lifted 3 days ago clearing the way for the center's reopening the Office of Child Care licensing says the suspension was lifted because the imminent threat to the health and safety of children is no longer present because Ferguson was arrested after confessing to the child's death they say the center is compliant with regulations and this isn't a systemic issue w. . Has learned though at this time the center is not voluntarily reopening but smak says it could do so whenever it would like when I called the center myself they said they weren't open when I identified myself as a member of the media they demanded we never call or visit and then we put them on the Do Not Call list prior to the center suspension Office of Child Care licensing spokesman Joseph smack said the center was inspected on May 17th 2019 and no issues were found. Very hard. But. Compared to take years I mean we're talking about daycare centers. We're talking about the smaller daycare centers. And you know scratch the surface. Cares where people are not registered nothing to comply with the law we have 16. We have 100 percent annual inspection rate every year we have 100 percent compliance on. The Day Care Zone or Janice Palmer didn't respond to requests for comment for this story e-mail and a telephone message left at the centers Newcastle facility it's unclear whether Ferguson has an attorney. Credible again incredibly. Kind of response a. Smack beg to differ. By property. Calls for a child care ratio for infants to one adult while national best practices from the American Academy of Pediatrics calls for a ratio of 3 to one I don't feel that it's negligent I feel that again we are not being clear enough we have said to somebody I don't get why you're not getting what I'm saying like I don't understand how you don't understand there should not be a situation where it is. Left in an unobservable uninterruptible situation with the child period the ad smack says Delaware follows the National Association for the education of young children's best practices which recommends the $4.00 to $1.00 ratio. Many actually have. Very progress but children who can't yet talk are among the most vulnerable as a mother and as a person he's been educated in providing care to children I cannot imagine why I would leave in 1000 year old with 4 children little people child development centers website claims that those working in the infant room possess no less than 3 years experience in child care the Office of Child Care licensing told that Ferguson was cleared to provide care as an early childhood assistant teacher on January 16th of this year Daly Lewis says the likelihood of Ferguson having the level of experience promised on the center's website is close to impossible I don't see how I don't see how it could be possible unless you're counting when somebody was a baby sitter I don't see how it's possible she certainly doesn't possess a childcare degree or an associate's or bachelor's degree that would be impossible at this point unless she went from high school at 16. But under Delaware law she didn't need a degree just a high school diploma or an equivalent recognised by the Delaware Department of Education she also needed 6 months of experience working with children birth through 2nd grade in a group setting she was qualified there's no doubt about that experience. Video isn't mandated in child care centers under Delaware law but daily Lewis says it should be but perhaps more important than video existing It's all finding good to have cameras but if no one's watching them that he doesn't protect your children I will find it very hard to believe that this dedicated child care worker who just suffocated a baby at 10 30 in the morning it doesn't make sense now the law does call for criminal. Background checks for anyone working with children a la daily Lewis fought fervently for during her time at the Delaware Department of Justice but she admitted remember all Bradley came to Delaware with a clean criminal background so that own takes into account criminal behavior that has been adjudicated it does not take into account things that you might not see on a criminal background check It also doesn't take into account tendencies as someone this young people need to be disabused of the fact that if everybody has a criminal background check we don't have to do anything else a criminal background checks are just the 1st step to weed out the obvious she says Ferguson the level of training as well as observations of her behavior are pivotal unknowns in this scenario and if this woman was so stressed out by an infant crying she didn't belong working in an infant room she should have gone to get help and sadly help should have been right there daily Lewis called her additional training for all early childhood education workers the same child abuse prevention training that's now required by law for teachers following the Bradley case isn't required of early childhood workers but daily Lewis would like to see it mandated I think that they should be trained in detecting child abuse in. Detecting grooming in child abuse generally responsible to report child abuse what their obligations are you know I think if you go back over child homicides records you will find that this is not the 1st one that's happened in a daycare that's happened at a daycare had an indication there was something wrong and didn't report it we need to do a better job in training on what is child abuse how do you report it what's the standard it's not you're able to prove it it's whether or not there is a reasonable suspicion but in this case suggests. The policies and procedures and training what they should be to protect a newborn baby. Smac says that's not exactly true he talked about what training is required for those working at least 25 hours per week in a child care facility. For employees they do have to go through child abuse and neglect training and they are required to do or fresh air every year and that's part of the health and safety member who works more than 25 hours a week is required to do 18 hours she was qualified there's no doubt about that and she had the experience the age the training those who work less hours have less hours of training to complete when asked what training Ferguson specifically had snacks said. I don't specifically have that but as part of her orientation she should have had training on match situation. Practice. Which you know crying recently daily Lewis said the foundation stewards of training was recently brought to a Head Start child care facility the training cost $10.00 per person but financial support is available upon request and proof of need for retraining is also provided in April during Child Abuse Prevention Month so we have been. I mean we have not focused as much on children as we have on school aged children I think parents need to be better educated from the time a child is born they need to be trained about leaving their children their children and who they leave their children daily Lewis is also in talks to bring the training to the Delaware Department of Corrections facilities 1st to the process because a lot of these. Are going to be the primary caretakers of their children and let's talk with a bat out how they can protect their children so I think it's a combination of parents and statutes daily Lewis called it impossible to ensure that no child is ever killed again at a Delaware daycare but she said the tragedy highlights the state's need for improvement after Bradley. A lot of statutes changed and. The pushback from people to sponsors too much time that you know why we saw holes in the system I just can't conceive of a 19 year old that should be in that situation again she can be Did he has earned have gone through high school and college but and I know that the system can't afford college educated people working at a day her childcare center should never be a person's last ditch option for getting a job she looks forward to seeing the child protection accountability Commission and the child death near death in stillbirth commission's report and recommendations in the wake of Tolkien's death but in addition to improved statutes and regulations daily Louis Freeh stressed the need for increased oversight and better training for parents but the bottom line though is if there were 2 people in that room Isabella would be alive today or if there was a person who made sure that every 2 minutes as a fellow would be alive I don't know what you can say to people that have suffered that kind of loss except that situation should never happen again and if we had no unobservable uninterrupted full contact it would have happened it would not have happened it would have been a place where a child was safe and I know people say you can't do it you can do it just takes some artwork Friday on Delaware will take another deep dive into this important issue including what additional training experts would like to see mandated and strategies to cope with crying Amy Cherrie w d e l Delaware's news radio when the op is football all of its ally with the w d l but bad poll it is. And into killing at a Bear area daycare exposes the need for strength in child care laws and expanded training for early childhood workers of all kinds in Delaware According to child care experts. Takes a deeper look into what kind of training could have prevented. A little Isabel is death. That's what it's like to have an infant at times the crying can be constant some people have the mindset oh I could never do that or I would never hurt a baby but it's interesting because I make it through a crying. Day and you can watch people start to squirm and start it because it is a really horrible sound to hear after several minutes but babies cry all the time and Patrick executive director of the Delaware child death review committee. Says in most cases it's normal between the week the data shows but that is when. Her office has developed All babies cry training which is provided to all birthing hospitals in the state because it's not just for parents but it's I think it any Kara cake or whether it's the babysitter the aunt the child care professional anybody that has to care take a baby I think you're kind of shocked about the fact that this you know that a baby could cry that 30 seconds of crying piece that we opened with Patrick says was part of a media blitz in one market you driving in the car and every station has a crying baby and they had so much outrage from the public but at the end of that crying there was a p.s.a. Fading no matter what it's never Ok to hurt a baby put the baby down walk away seek help in the wake of 4 month old Isabella tall tins death by smothering at Little People child development center in bear you know I'm hoping that they'll take advantage of that police say 19 year old to join a Ferguson confessed to placing her hands over the baby's mouth and nose because she wouldn't stop crying she faces a murder charge in connection with a fatal assault the police say was caught on video Little People child development centers owner didn't respond to requests for comment for this story their license was suspended immediately after the baby's killing but w d e o was 1st to report it was reinstated about 4 days ago after the Office of Child Care licensing says the imminent threat to children safety was removed they add the center's issues aren't systemic has learned the center has chosen to voluntarily not reopen at this time but it has permission to do so at any point the Office of Child Care licensing says Ferguson was qualified to be an early childhood assistant teacher she only needed a high school diploma or equivalent thereof recognized by the Delaware Department of Education according to the office of childcare licensing spokesman Joseph smack talks more about what training he says Ferguson should have had. Are required to go through orientation they have to go through positive behavior management of children face procedures shaken baby syndrome. Procedures routine emergency health care prevention in response to emergencies child acts procedures and the Big One of course is the recognition of the symptoms of child abuse neglect child abuse or neglect reporting requirements and also familiarize themselves with their Center's procedures for reporting abuse and neglect can you say whether to join a Ferguson had training in crying infants. I don't specifically have that but as part of her orientation she should have had training on that situation that's like Isabel as are rare in Delaware Patti Daley Lewis is the executive director of the Beau Biden foundation for the protection of children child homicide 80 percent of all children are killed by their parents so it's a much smaller percentage I think it's 15 or 13 percent are killed by caretakers. I understand that but. A caretaker we do this to a child but with the kind of training deaths of babies could be prevented. It's not a matter of who will but it's a matter of you know if you're looking at well what's the difference between person a person b. They just don't do it that they don't they don't reach that point of control and it really comes back to coping mechanism coping. Education education I don't think anybody I think prepared for that level of crying. Or training is free in person or online using Access Code Delaware at all babies cry dot com She hopes daycares take advantage of it while developing safe sleeping infant programs to train day cares at the University of Delaware she learned a lot of daycare providers could never even fathom that this could be an issue with them so you know they're focused on making sure that the baby in the kids have good nutrition and everything is clean and sanitary and they know the p.r. So you know it kind of falls off people's radar because they can't imagine it happening. Used to investigate cases of abuse in children says she didn't even really get it until she had a child of her own you know my son went without sleep for 3 days because he had reflux and it wasn't until 3 days of no sleep watching my poor son cry out in pain because he had reflux I get the crying and I I had the resources to be able to say to my husband I'm taking the kid to the doctor right now the baby needs to be seen by the pediatrician there's something wrong but I got it at that moment I got it and I understood what would it be like for somebody who doesn't have the knowledge to put the baby down and walk away or what is it like for somebody not to have a supportive caregiver before that baby is born and then you can start. Her can start at the hospital you need a supportive person somebody that's going to be there at 3 o'clock in the morning when you feel like you're going to pull your hair out it's kind of like a phone a friend and I need help but to put the baby down I'm going to walk away but I need somebody to come help me and a lot of people are willing to do that or they don't have anybody to do that so that's a significant gap in our country as a whole without that lifeline she says to many moms experience fatigue and exhaustion tends to lead to poor choices that's why many women also bring their babies into bed with them for bed sharing and are dying because the baby is crying and they're exhausted and they bring the baby and a breastfeed or just to comfort the baby and the baby dying from unfaith leaping she'd also like to see home economics and health classes refocus on child care some wonderful school district that make you take that of noxious crying baby home like you are great for health I think it should be a Band-Aid because we know that most of our high schoolers are going to grow up and have babies or be around babies we did a Girl Scout program Francais sleeping but what about all the Girl Scouts also learning about crying and not to hurt a baby but that's a model throughout all of the I think it would be something that I think would benefit not only the female caretakers but also the male because they're going to grow up to be dads and boyfriends and part. You know and have children but the biggest take away from her training no child had ever died from crying no infant had ever died it's Ok to put the baby down and walk away and go seek help Amy Cherry Delaware's News Radio. Show with local parents trust in child care shaken in the wake of that killing. A child care facility in the Bay Area trust gains. And should a center be run. Something. Took a different look at. Dropping in. Care with strangers is one of the most difficult thing for a new mom or dad will ever have to do in their lives parents need to feel a sense of reassurance and trust in their daycare that trust was broken in local moms and dads after 4 month old Isabella toileted was smothered to death at Little People child development center in bare police say by day care worker 19 year old to join a Ferguson for a long time somebody. That was the kind of attention to detail you could come to expect at the child care center run by Eddie Ashby with 30 years experience in the field she served as a teacher and child development director at the downtown Wilmington Y.M.C.A.'s child care center for 18 years Ashby is now retired but she was charged with creating a safe space that for her began with the notion that. She said The more eyes on children the better because child care is like a village where everyone plays a pivotal role if Mom can't stop and maybe grandma can Ashley took extra steps to build trust with parents if. I would encourage the baby. For 5 minutes she also pointed to creating a loving and nurturing environment where staff understands the child development process. Expectations. But the most important aspect for her was to ensure staffing was not just that adequate levels but extra levels she stressed the importance of always having backup when I've tried everything I think. And sometimes. That's why. Smart child. And I can't tell you how many times I was. The teacher for the day she had retired women service foster grandparents who could also rock or give a bottle in the infant room providing much needed extra help Ashley said it was important to ensure that staff working in the infant room didn't always have to deal with constant crying but we had lots of opportunities for the staff to just rock and off the previous not necessarily always doing something and not sort of self soothing soothing for us a person staff need to know themselves but the director needs to know them better if you bring your life into into your program with you I always told the staff I said your family is just as important as these children so if you have to do something for your child or you have to leave you do what you need to do you know we'll work it out after a remodel the Wilmington y.m.c.a. Child care center had cameras in classrooms which could be used for surveillance but Ashley also use them to observe to see how she could help facial expressions everything and I had the monitors in my office and if I thought there was a particular shot I would I would watch and if I saw you know a staff a need you have to go in and help out some described Ashley as having a 6th sense she balanced her observations with a sense of nurturing of her own staff you could have a particular child in a classroom that was crying the teacher just just was that particular child's personality and the teacher was frustrated you needed to make sure you were available not sit she couldn't do her job or that you wanted to show her you support sometimes I'm going to take 2 year old child out of the classroom and just go walk around sometimes the teachers need that as well as the children she feels video should be mandatory in child care centers under state law with recordings ongoing so problems can be reviewed Ashley knows other centers aren't as equipped as hers was she found that out when she searched for daycare for a child she had adopted quite frankly it made me cry it was really sad they had people who were supposed to be taking care of the babies and they had toddlers mixed in and they were in the kitchen too and dishes she tells w d e o that she wishes more center directors of deserve their staff she'd like to see that mandated to all the director. Level if I'm observing a person who just is quick to. Put a baby down or you watch facial expression sometimes you can pick that kind of thing up and I have moved teachers from one classroom to another and said I feel you more effective to work with the preschool kids because I think you need them to conversation back with you the Office of Child Care licensing said the child care industry is in a hiring crisis due to low pay long hours and the overall stress of the job oh c.c.l. Spokesman Joseph Smarr where the average child care worker is making $10.21 an hour in the state and are get is paying $15.00 for many child care work and be a last ditch attempt to find a job with a college degree not required for most positions and pay for childcare staff it's very. You either have teachers who don't really need the high income so they're working for center as a teacher or you have staff that they are a single parent with 4 kids in their own home at Ashby's facility they always had a max of 8 infants with at least 2 child care workers present meeting the 4 to one ratio required by the state which the Office of Child Care licensing stands by as a national best practice but the American Academy of Pediatrics calls for a ratio of 3 to one she said any lead teachers had between 5 and 8 years experience it was that person's job to monitor other teachers in the classroom budgetary things for telling one person you really can't manage yourself Well Ferguson was alone in the infant room at Little People Child Development Center which the Office of Child Care licensing said had 3 infants there at the time when police said she was caught on camera committing murder but extra staffing and training and monitoring of a classroom on both the teacher and director level Ashley said could have stopped Isabella from being killed. If you had to turn your backs always be against the wall so that if you were changing. The law also while you were doing something you couldn't serve the other staff and the children the same time and things like that are really important I think despite it all though we return. To the bottom line if 2 people were in that room Isabella would likely be alive today if somebody else whether she was a young woman and I my opinion I would I personally would never have left and find that angel and Chris suppose I'm most frustrated and I get to the point that that young lady did you have a staff person who recognizes some of that and can say why don't you go take a break you know let me take this baby from you so that is programmable Amy Cherry w d e l Delaware's News Radio.
