Tonight a Clermont County student is speaking out supporting her teacher who is accused of slapping another student in the classroom while trying to break up an argument. 9 on your sides ashley zilka is live at live oaks and tells us why the student says the ordeal has been blown out of proportion. The slapping happened here at live oaks last thursday. The teacher in question is on paid administrative leave while an investigation takes place. But i spoke to one student who says her teacher did nothing wrong. The incident occured when two girls got into an argument in a cosmetology classroom. The teacher stepped in to break it up and thats when the alleged slapping occurred. The students family says the teacher slapped her once in the face, then apologized, saying her motherly instincts kicked in. The district removed the instructor from the witness also says her teacher was very apologetic and even cried after the incident. When Shayna Hubers was found guilty of murdering ex boyfriend ryan posten, no one realized that one of the jurors who convicted her was apparently a convicted felon. That came to light when hubers current attorney, Deanna Dennison recognized the name of juror number 483 as a defendant she had represented. Now. Dennison is calling for a mistrialarguing the conviction be set aside and the case be retried. We asked attorney Mark Krumbein how likely is that to happen . One one hand you cannot be on a jury if youre a convicted there leeway here to say, well, the law was broken, but well ignor it . i think there will be, in this case. Krumbein sat in on portions of the hubers trial. He thinks the error is irrelevant to the verdict. I dont think the courts would allow an entire verdict to be thrown out unless they could show some harm to the defendant. Shanno n hubers was convicted, but we dont have any way of knowing that this was because that juror was a convicted felon.
