Reporter maurice, 20year old dj henry of Pace UniversityFootball Player, was shot through the windshield of his car as he drove away from a disturbance outside a bar in foreignwood in 2010. A police thornwood in 2010. A Police Officer knocked on his window and he yelled for henry to stop and stopped in front of the car before he landed on the hood and opened fire. The officer was hit as henry braked. Another man in the car was wounded. Cbs 2 has learned that the family of henry has accepted a settlement of 6 million from the village of pleasantville and the officer. The family is suing the town of mt. Pleasant claiming that officers failed to respond to his gunshot wounds. And last year, the attorney determined they would not file civil rights charges in the shooting. Dick brennan, cbs 2 news. They are trying to figure out how to bring a sunken tug back to the surface. Or i should say tugboat. It crashed over the weekend. Into a barge. Killing three people. Reporter a dreary afternoon on the hudson river. 40 feet under the Water Surface lies a 90foot tugboat named the state environmental crews say it spilled over 5,000 gallons of diesel oil into the water. Leakage. They have about 3,000 feet of booms put across the river at near piermont. Two days after the boat crashed into a stationary construction barge, under the tappan zee bridge, the work being done is a salvage operation. Rescue and search efforts are off. Still missing is 56yearold hernandez of staten island, working on board the specialist saturday morning when it it crashed. Two other crew members died on board as well. 62yearold paul amon of new jersey. He was found soon after the crash. And the body of 29yearold Timothy Conklin of westbury long island was recovered by search divers. The part of the three boat albany to jersey city, was supporting a barge carrying a crane. When the operation started to drift near the stationary construction barge under the tappan zee bridge. There were reports that there were radio transmissions from the tug on the right that said we are too close. We have to move left. But they couldnt move in time. Was there enough lighting . They are dealing with a sinkhole and water main break currently no water to this blank but only this block. This block but only this block. And if you thought were you having a bad monday, check out this car. Crews hoifed the gray muddied and damaged car out of the sinkhole this morning, as the cars owners watched nearby. I looked outside and saw the street was flooded and only took a few seconds to know my car was the one that had the alarm going off. They found the car this morning at 6 00 this morning, sinking further down into first street. This mornings break in the 12 inch break in the main, left several inches of water flooding the neighborhood. It was a rude awakening for many. I was parked on clinton and i had to wake up to move my car. It left some without water to get ready for work. It has been like face wipes. Thats it. The dry cleaners on the corner remained open, but not much foot traffic. Residents who point out the Constant Water main breaks in the city. Pretty frequent these days but that comes with the hoboken buildup. The aging infrastructure is partly to blame. We are working with city officials, because what we immediate to do is fix the infrastructure. So that we can hopefully get a good handle on the main break. But until that happens, we will have to monitor the situation and fix them as needed. Reporter city Officials Say about 20 years ago, they entered no an agreement with suez water. Then united water. They call it a bad deal, because it only requires suez water to spend a small amount annually in Capital Expenditures or repairs. 350,000 per year. However, most of that is spent just repairing our broken mains. And there is little left over for pro active infrastructure improvements. They are now looking to renegotiate that contract or bid out a new contract. Once again, live here, you can see crews working hard to as to what caused the break, they dont exactly know at this time. There is also no timetable for the completion, just looking at the crews there, you can see they are nowhere near close to being done at this time. The flat terrain and ranch style houses are part of the reason this woman bought a home here but the 74yearold was her home. It is a Senior Citizen development. Nobody can do stairs. We have people here over 90. I am young compared to some of the women. Like most communities it is part of the National FloodInsurance Program and residents are lower subsidized insurance rates and in order to be a part of the program, the federal government says rebuild with 50 of the home destroyed, meet new flood standards. Reporter bumper to bumper traffic in the middle of a but the weather is not monday afternoon. But the weather is not the problem. The ongoing construction on the van wyck and kew gardens queens. After 5 1 2 years, drivers have had enough. Terrible. Horrible. It is a big problem. Van wyck, forget about it. Sharon says the traffic shifts and narrow lanes and confusing signs are dangerous and does all she can to avoid the area. Hurry up and fix it. It is taking too long. Reporter the state department of transportation is spending 300 million to fix six decaying overpasses and widening the van wyck to improve traffic flow and one of the projects since 2010 is now 21 months behind schedule and more than 9 million over budget. The traffic is jammed. Reporter this man is a delivery cab driver who constantly gets stuck on the way to jfk, delaying passengers and some missing their flights. What makes it a nightmare, it is not just the van wyck expressway. The Jackie Robinson parkway, the Grand Central parkway and half a million vehicles try to squeeze through here every single day. Today, cbs 2 asked the state what is taking so long. The response . It is a complicated project. Broken into three contracts. And quote, the initial contract was awarded later than anticipated. There were complications due to super storm sandy. As well as creating a challenging struction schedule designed to lessen the impact on all users. And at least some drivers agree, the work has to be done. It is a little bit of congestion but in the long run it is done. I talked to eyewitness who tells me he saw it all as it happened. I saw a guy chasing the girl and he is shooting her in the back. And Authorities Say an innocent bystander was caught in the crosshairs. The driver of this car. Witnesses say she was parking her vehicle on the streept, heading over to the nearby light rail when the bullets starting flying, and shattering the glass. Very disturbing. Authorities say the shooter later took his own life in a park in bayonne, a self inflicted gunshot to the head. Ending a troubling day of violence. Scott rapaport, cbs 2 news. Prosecutors say the gunman and the woman killed were a couple but it is unclear if were estranged. A linden woman who survived a shooting last year is now missing. 41yearold tyrea julius was last seen being dropped off at the long branch train station last tuesday. Police say a friend took her to the station says she was headed arrived. Julius was injured in a shooting last november, and an unknown gunman approached a vehicle and shot at her and her daughter. It is unclear if her disappearance has anything to do with that shooting. Police are searching for the hitandrun driver who left a man critically injured on a queens street. The 53yearold victim was found unresponsive last night on the 21st street and 49th that is near the queens midtown tunnel. Doctors at columbia Presbyterian Hospital determined his injuries were consistent with being hit by a vehicle. Investigators are now looking at Surveillance Video that may have captured images of the car involved. The plane took off at Newark Airport today and quickly turned around because everyone detected a strange odor. The federal Aviation Administration says united flight 1704 left newark, and moved to austin, texas, at 6 00 a. M. , and it landed at newark, 20 minutes later, after the crew reported a strong odor in the cabin. The plane landed safely. No word yet on exactly what that smell was.
