You heard from witnesses who watched this all unfold this morning. Reporter yeah, lots of them. This neighborhood here is still jammed up with police, but neighbors say after what happened at the baseball field this morning, they are happy to see so much Law Enforcement. The man walked up to a congressman, asked if the team was republicans or democrats and a a few moments after learning they were republicans, he started shooting. You usually hear things like this happen very quickly, but witnesses say this today seemed to last an eternity. Heard people running. Thats not fireworks. We have one in custody. One shooter. Reporter joe barton is the manager of the republican team. He and his sons took cover when the shots were fired. Barton got a look at the gunman. He had a rifle and i think he had an automatic pistol. There were dozens, if not hundreds of shots fired. Even as James Hodgkinson was shooting theres a victim down in the baseball field. Reporter senator flake made it to Steve Scalise who was bleeding heavily crawling toward the outfield. He was coherent and was asking for water. I dont e know if any specific members were targeted. Its hard to imagine he didnt know what he was doing. Reporter a police Team Assigned to scalise was there at the field. This all could have been a lot worse. The security detail saved a lot of lives because they attacked the shooter. The hero are the Capitol Hill Police. Reporter shots also hit the ymca nearby. The bullets ended up on the bottom of the indoor pool. One woman just told me a few minutes ago she was in bed and heard she thought it was an Early Morning fireworks show. She said it had to be at least 100 shots. Tim furlong, nbc 10 news. Two congressmen from our area are on that republican team. They were not at the practice at the time. Reporter yeah, and then i headed here to capitol hill and i can tell you that members here are shaken. One of their own was hit. This brings up memories of when gabrielle giffords, the congresswoman from arizona, when she was shot. I spoke with one congressman from our area in pennsylvania who was supposed to be there. He missed his ride ask when he couldnt get another one, he went back to his office and started watching tv. He saw the report and look ed u and realized that this was the baseball field where he usually practices. About three times a week. But not today. Some minutes im able to deal with it. Others, im not. Congressman costello trying to come to terms with what happened this morning at a baseball practice with colleagues. And how close he came to being there. If i wasnt two minutes late for my ride, i would have been right in the thick of all that. Reporter he missed the practice where his colleague congressman Steve Scalise was shot. Costello usually plays shortstop. Steve plays second. And the gunman, the shooter was on the third base side firing across third base, shortstop and second base. So i would have been right in the line of fire. Reporter members of congress with grim faces briefed on the shooting and talking about their own vulnerability. The public neness of their publ jobs. Hes reassuring his wife and mom and coming to grips with what happened and what didnt. Thats the scary thing when you realize because im a member of congress i could have byebye on a baseball field where somebody would have just did what they did. Not an easy day here. Not an easy day for me. No, its not. Reporter it was an emotional day for him today, but he says he feels better knowing that those who were injured today are doing okay and that that makes him feel okay about playing in that baseball game tomorrow. We are on verdict watch at the bill cosby Sexual Assault trial as the jury comes back late this afternoon with a big request for the judge. Im Jim Rosenfield live again, deliberations into their third day now as jurors wait charges that could send bill cosby to jail possibly for the rest of his life. The jury came back to the judge with a question just within the last few hours. They wanted to hear all of Andrea Constands testimony, thats about 300 pages worth of testimony read become to them. But the judge limited that request. So far there have been five jury questions during the deliberations over the past couple days and Deanna Durante was in the courtroom for this latest request by the jury. What are you learning about how that request played out . Reporter Andrea Constand was on the stand, the witness stand for a period of over two days, more than eight hours she testified. The judge said as you said that that testimony typed out was 300 pages or longer. So he and the lawyers limited what the jury would get in that request. They put down that they would hear just the direct testimony from Andrea Constand, what the prosecutors asked her about that night and she recited bill cosbys own words, what he has said in his 2005 deposition, put them down, they will help you relax, referring to the three blue pills she says she voluntarily took when bill cosby handed them to her some time on a winter evening in 2004. Some time between january and midmarch, she told the court. Last week when she testified. One thing in this case, the testimony between bill cosby that we heard read aloud, sometimes at the request of the jury, and Andrea Constands own testimony that she delivered in pesh very similar here. They both talk about that evening. They talk about how she was struggling with a personal decision. She was suffering from some tension and bill cosby offered her those pills and gave her those pills and she took them voluntarily. What they both disagree on is whether or not that activity, that Sexual Assault was consensual and thats what the jury appears to be struggling with tonight. What do make of that request . E we talked about this. When you have two or tla three statements from the main witness in the case and credibility is such a big part of the case, they are looking at every single statement she made to look for consistencies or inconsistencies. If theres inconsistencies, they are going to determine whether its a a matter of importance or unimportant detail. This is something that they need to do, they are doik meticulously. They are doing it methodically and i think its good that they are asking these kind of questions. It means they are honing in now, they are honing in on her testimony and the consistency of her testimony in the case. We dont know at this point how this ties in with the group as a whole. Are some of them still deliberating and questioning, have some made up their minds, no way to know. But how does todays question tie in with the question asked yesterday about cosbys deposition. Does that give us any clue . The biggest clue that it g e gives us yesterday, if if you remember, they want. Ed the detectives testimony read back, who was the first person to speak with Andrea Constand in canada. They are taking that first statement that she gave and now today they want her trial testimony. That tells me they are locking maybe line by line and item by item at her testimony, just what we said, to see whether it is totally consistent or whether or not its inconsistent if its something major or something minor. So i think that they are taking that, they are tieing it in with mr. Cosbys deposition testimony and trying to sift through all this evidence to see in the end who they think has been credible. And so the process continues as they continue to deliberate now after getting that testimony read back to them. Judge, thank you for joining us once again here on nbc 10. We appreciate it. It happened this morning. Hodgkinson was shot and killed by police but not before wounding five people. Among the five are high ranking congressman Steve Scalise, who is in Critical Condition. Florida congressman rhonda san tez says he interacted with the suspect this morning when he left the ball field and hodgkinson asked him who was playing. I saw his picture ob his twitter account. I spoke to my colleague jeff duncan in the car with me and both agreed that that individual who came up to us and asked if it was republicans or democrats, thats the same individual police have identified. That picture is the same guy we saw. Witnesses say they recognized him from the ymca near the ball field. He selled that membership just back on monday pd. People find themselves asking what if. One of these people is but he missed his ride by two minutes. He would have played right next to Steve Scalise. I play shortstop. Steve plays second. It hits home like nothing ever has. You seem shaken. The other thing to note is theres 15 to 25 members on any given mork. Theres 10 to 15 staffers. These are young guys that work on the various committees im speechless. Here at home, Law Enforcement has been monitoring the situation. Philadelphia say they are working with local, state and federal partners. Nbc 10 spoke with congressman bob brady who are has been receiving updates from the Capitol Hill Police department all day. Police called bob brady not long after the shooting. They are heroes. They could have been so much worse. As a ranking member, he overcease the operation of the capitol Police Department. If they werent there and scalise wasnt there, there would have been nobody there to protect those men ask women and staff people and members of congress that were practicing for the baseball game. Reporter representative brady was home in philadelphia at the time of the shooting. He said philadelphia stopped by his house and office earlier this morning just as a precaution. Does this change your movement . Not at all. Staffers were out early just a few miles from capitol hill to practice for tomorrows baseball game. While their opponents on the field are democrat, the spirit of the long standing tradition is meant to show unity. So far we havent heard any word from this pabl that they are in any way dead locked. They are asking pointed questions. Can we take away from this that are still making progress. Its important to remember theres three charges. They have to come to a decision on each and every charge. There could be a situation they have a decision on the charges and st still working towards a third charge. The good sign is so far they have not indicate d to the judg that they are at an impass or not getting along. They seem to continue to work through it. They could have a partial verdict and still that verdict will stand and the other charge or charge cans on which they potentially are dead locked would be up to the da down the road whether to retry on that. Theres three charges. Each has a maximum penalty of ten years. If theres a partial verdict and they acquit or find him guilty on one or two charges that it wouldnt make much sense at his age to continue to retry him in this case. Lets talk about the judge and reading this panel. A point where you can expect the judge to call him in and st if they are continuing to make progress . Or he will let them go . Each time theres a question, the judge, the jury and the prosecution have to go in the baa and can talk about what the jurys question is and how they want to answer that question.
