While todays ruling came down in philadelphia, william lind was being held at waymark prison in northeast pennsylvania, about 20 miles outside scranton. Deanna durante was there as lind walked out of prison. She joins us now there live. Reporter it was less than an hour ago, monsignor william lind was able to leave the building here. The building behind me, number 14, at the prison here. A white suv arrived here around 2 30 this afternoon. Someone went inside. A man, were told, brought monsignor lind a change of clothes, and a few minutes later he walked right out of those doors into that car, heading towards the philadelphia area. Now, this is not the first time monsignor lind has walked out o prison. His case has been a long legal battle. His conviction in 2012 was overturned by a high court. It was taken to the Supreme Court allowing lind to walk out of jail today. Just this morning, he was able to make bail, post baseball and then his relatives drove from the philadelphia area in order to pick him up. His attorney said even though the District Attorney is planning to retry his client, he said the majority of his sentence has already been served. If he were to be retried and convicted, he had a 36month sentence. Hes done 33 months. The parole board granted him parole as of october. So the worst that could happen on a retrial, i mean, you know, the worst that could happen is he could be convicted and sentenced to two months. Reporter now, again, this was a historic case in the Catholic Church abuse scandal. Lind, a church official, was not accused of physically harming a child but rather knowing of an allegedly abusive priest and not keeping him away from the children. His attorney argued that lind did not get a fair trial and he was convicted on a law that did not apply to him. When he is scheduled to be retried in 2017, his lawyer tells us that that evidence that was applied in his first trial will not make it in to this case again. That story ahead at 5 00. Breaking news right now. Delawares Supreme Court said the states Death Penalty law is unconstitutional in light of a u. S. Supreme court ruling earlier this year. The law allows a delaware judge to sentence a person to death independently of a jurys recommendations. Questions were raised about the states law after the u. S. Theyve been moving straight to the south over the afternoon. You can see much of the rest of the area is completely dry. Once again, weve had a lot of cloud cover, and winds off the ocean preventing many showers from developing. But this shower, its a fairly heavy one, right over, moving into reading right now. Mulenberg getting hit the hardest. Its just starting to get harder in reading. That will continue to move south through berks county. As far as the rest of the area, we had one our two showers near delaware bay. Extreme south delaware. For the most part, it is just partly sunny. 82 degrees in philadelphia. And in wilmington, still rather humid, only 77 in mount holly. And 78 degrees in trenton. It feels a little bit warmer than that, because of the higher humidity. It feels like 84 degrees in philadelphia. 85 in wilmington. 88 in dover. But that humidity is going to get knocked out of the air pretty nicely over the next 24 hours. So we really have a pretty nice night. With that one exception in berks county that is just temporary. The suburbs, down into the low 60s. By 6 00 a. M. , lehigh valley, 62 degrees. 64 in much of new jersey. So when were talking about temperatures in the 60s, at 6 00 a. M. , in august, thats pretty comfortable. Weve had a lot of clouds. 82 degrees in philadelphia right now, with partly sunny skies. Some places still in the 70s. Its been that way all day. Delaware up to 82 degrees. But some parts of the pennsylvania suburbs only in the mid 70s. Weve seen cochranville at 79 degrees. Kenneth square 79. Mal vern, 80 degrees. St. Davids, 77. Warrington only 76 degrees. Thats awful cool without it raining in parts of the area, early in august. While we see this area of showers coming straight down from the north in berks county, and thats about all that were having to track today. And this is right over reading itself. You can see its just past mulenberg. A few minutes ago we were showing you the heaviest right near mulenberg. At least the rain is not lasting a very long time. And it continues to head to the south. You can see just how tight the gradient is. Down on second street, in the middle of reading, its not raining as hard as it is just to the north and west. It is going to be getting harder in some parts of the area. And tapering off in others. Were actually going to be drying out overall. Not only over the next few hours, theres 7 30 in the futurecast. Hardly anything on the radar. Once we do dry out during the night tonight, were going to stay dry for a while. And thats going to be a great stretch of weather for any kind of outdoor activities, golfing, or anything else, because its going to be increasingly comfortable. So as we go into the evening, its only going to be feeling like its in the 70s. By tomorrow morning, feels like its in the 60s. Humiditys going to be down tomorrow, significantly. The cdc recommending that pregnant women avoid a part of miami where the mosquitoes are apparently transmitting the virus directly to humans. Weve got a wind off the beach, 76 degrees in rehoboth. This is the latest radar. And we just have basically one cluster of showers. And its moved straight to the south, which is fairly unusual for summertime showers. And its going right through reading. Remember, we showed you it was up near burn, now its moved to the south. Sot heaviest of it missed downtown reading and going straight down toward Maple Grove Park right now. And eventually new morgan. As we put the track on it, you can see going down near the pennsylvania turnpike, mile 540 in coatesville, if this holds together, in east nottingham by 6 30. A man who lived at an infamous bucks county home is back in a courtroom. 12 girls were found living in the home in june. And they said the owner raped her. Nbc 10 bo nemonique braxton was court today. Whats happening in court, monique . Reporter the preliminary hearing wrapped up about 4 00 this afternoon. The first person on the stand, that 18yearold girl you were talking about, who was found with lee caplan inside his home. She testified before a jampacked courtroom. She was frightened but confident. She told the judge during their fouryear relationship, they had two little girls. She also said her mother had lived with them since the first child was born. She also said she still cares for kaplan. Would you like to say anything, mr. Kaplan . Not today. Reporter the an hour and a half preliminary hearing, the judge ruled this case will go to trial. Vans carrying about three dozen amish started arriving one hour before the proceeding. Lee kaplan, dan yal and his wife were escorted into court by constables. In midjune, police were sent to 428 old state road. A neighbor called regarding the health and safety of children. Police found 12 females ages 6 months to 18, along with kaplan. He and the 18yearold told police said the young earth girls were their children. Police learned daniel and savillea had given their then 14yearold daughter to kaplan after he helped their financial with a financial burden. We returned to that home today. A bucks county judge recently denied kaplans request to sell hess house which had been seized by the court. But 9 judge is allowing kaplan to sell items in the home, including a valuable train set. His bond remains at 1 million. Savilleas bond is reduced to 250,000. But shes still in custody. The bond for her husband, daniel, remains at 1 million. Two investigators here in bucks county also took the stand today. But it is headed straight to the south. And if it continues, it will reach coal hill by 5 21. And coatesville by about 5 29. At least part of that storm will get toward coatesville. Its not a severe storm or anything. Weve had an onshore wind today with the clouds, keeping it cooler than average. The average high is 87. So far were only 82. More sunshine on the way, as the clouds break during the day tomorrow. Were going to see a lot more sunshine with lower humidity. But were going to start to heat up again, to near 90 by friday, and into saturday. And as we go through the night tonight, we see those few showers going down toward baltimore, or even farther to the west. And theyre out of here. The atmosphere drying out, even though we continue to have an onshore flow. And so as we go into thursday, you dont see anything. On the radar. Thursday afternoon you dont see anything. Friday morning, hey, you can go ahead and wash your cars starting tomorrow. We dont expect any kind of showers around until at least saturday. Saturday may be the only day. All right. Lynn was the first Roman Catholic official to be convicted for the handling of priest abuse scandal. Since that landmark victory, two courts determined that lynns conviction should be overturned. Now a judge has let him out on bail. Rosemary connors just spoke with the District Attorney. She joins us now with the very latest outside the office. Rosemary . Reporter keith and denise, i spoth with Seth Williams in the past hour. He did not hesitate to announce that he will retry monsignor william lynn next year. With monsignor william lynn out on bail, williams is already planning the prosecution against him. While some evidence detailing the history of priest abuse and coverup in the archdiocese may very well not be allowed in court this time around. Williams believes his team will have enough to convince a jury to convict lynn again. When allegations were made, of sexual abuse against priests in our archdiocese, how they would handle that, how they would not tell the police, how they would tell the parishioners that the priest is being moved for health reasons.
