The Supreme Court banned the Death Penalty for juveniles back in 2005. That left life without parole as the harshest possible sentence for people under the age of 18. Then in 2012, the court banned mandatory life without parole for all juveniles. Earlier this year, the court made sure that included a review of all past life sentences. We were there when jones walked out of prison in september and ive been following his progress ever since. Hes now 60. I recently met with him again to see how hes adjusting to life outside the prison walls. Come here. Come here. He still getting used to the grass under his feet. The clouds above and his freedom. Your wholj life is controlled and programmed. The transition to freedom comes with challenges. Went to prison in 1973. No cell phones, no tv remotes. Timed coffee makers. The learning curve is steep. Things like making a cup of coffee, using a vacuum cleaner, going to wawa standing and waiting for change. I dont know the change right there. You know, still stuff. Im just watching. I look and say wow, i missed all that. I missed all that. I asked about Technology Like his new cell phone. Technology, wow. It may take a little while to comprehend. I know somewherenr down the lin ern he has guid sister and brotherinlaw who he is living with in chuster county. His to do list including getting a permit and he wants to work, putting his electricians license to good use. Id like to settle and start a family and start paying bills. Get 5 00 low mated to society. I want to do. That i want to do it one step at a time. Now we should add that the victims family didnt have any objection to jones patrol petition and expressed concern about the validity of the underlying conviction. And jones lawyer says theyre in the process of working on a pardon to exonerate him. The big picture, the philadelphia Districts Attorneys Office tells us of the 300 juveniles in the city serving life 65 offers have been made to reduce sentences, 26 have xensing hearings scheduled and seven sentence hearings have been completed. The da says it could take as long as three years to get through all the cases. Now with me now is tyrone jones and from the Pennsylvania Department of corrections, deputy secretary michael wanirowitz. Thank you both for joining me. Mike, talk to me about what you had to do as a Corrections Department to get ready for people like tyrone and the other juvenile lifers who will begin to be released. One thing we want to be very pro active and try to get ahead of the curve. One thing we did is we took all the juvenile lifers in our facilities across the state and had videos with them through our Central Office to go over their issues, potential concerns. There is the public associations to address legal concerns. There is a the love legal questions that go with the juvenile lifers. And some of the things that came out of those meetings, you know, we want to make sure that every juvenile lifer is processed for nondrivers id, a birth certificate, a Social Security card. So when they are released it helps them with the employability. We want to make sure they have Health Care Benefits when released. We also try to process were in the process of the come pass application system so they can get health care f any of them are on medication, were releasing them with 90 days supply of medication to get started. So theyre not behind the eight ball with medication. We kind of made them a priority for placement into the programs. A lot of people, we think, when someone is told and tyrone, i want you to jump in on. This when someone is told you get to release, that tl is a lot of excitement. Im sure that is a case. Im sure there is a lot of anxiety with what the process is going to be like and whats it going to be like whether i get on the outside . Did you have that when you first heard you were going to be released, tyrone . Somewhat. Whether the decision came down, i was preparing myself just in case things were going go my way. You know, if i was going to go out on parole or get my spence reduced or whatever. I had thinged planned. I already had a family. I have a place for me to stay. You know, they support me and everything like that. But a lot of guys didnt have that. The opportunity came now. So they were like, well, some Family Members are gone. Some dont have any Family Members. They dont have nobody there. And what would it be like for them just to go out there and dont have nothing . But i was, you know, fortunate enough. I had my sister and they were still around and everything. Youre really fortunate. A lot of the juvenile lifers will go to halfway houses. Youve been trying to help with that scanning zanxiety. We ease the stress that juvenile lifers are going through f theyre placed in a kbhunlt correction centers, they can actually see ahead of time where theyre going, the layout of the facility, the layout of the community before they even get there. To address those concerns. We go over concern and talk about the reentry hurled lz that were mevengsed before. So were a little more pro active with that now getting families together. Were still in that process of trying to find them a home plan. You make a really good point. There are a number of reentry programs to help inmates reacquaint, get out into the community. But that may be after theyve been in prison five, ten, 15, this is an entirely different animal. Correct. Right. You have to get readjusted. You have to get a Social Security card and birth certificate or try to get a job. Reentry is real important. Like some of the program that you mentioned, i took a couple of them to prepare me for when i got out. I took the money smart program, victims awareness, character development. These things. They helped me to when it was time to go to parole board or prepare myself to go out in the street, i already had everything done. Mike, is there anything the department hasnt anticipated that you have run into . This is going to be a long process if it takes three years to get through the cases just in philadelphia. Is there anything that you already learned or that youre going to change around or tweak . I think were always going to have hurdles. One struggle we have is developing a reentry plan. Some folks are going back for resentencing now. They may get time served and get released directly to the street. That hurts our reentry barriers with them. We wont have the opportunity to put them in a transitional housing to help them get ready for release because theyre being released directly from the courthouse. That is a concern for us. Right. Because that is thats well, you walked right out and you yeah. You went right to a restaurant and had to order breakfast which making choices, you hadnt done that in a long time. Just like you say, just release from the courtroom, they just throw you out there. You have no reentry skills or anything. You dont have a birth certificate. Youre just stuck there. And i think reentry is the key. Most of the guys, like we say, theyll remember leased. But hopefully theyll have a Family Member or somebody there that will help them, you know, get adjusted. So even though they didnt have an opportunity to take any of the programs or anything, theyll get readjusted back to have somebody there that will help them with each step as far as, you know, becoming a citizen again. You were in prison for more than 40 years. Is there anything that you miss . As far as prison . Yeah . Thats what you knew. Youve been out for you can say sluabsolutely not if you wa. To. I cant say. That because like i said, i spent half of my life. I met a lot of guys in there. Supervisors that work for some of the correction officers there. I had conversations. But i have to stay focused on what im doing now and, you know, look back at times that i was in there. Saying that, you know, hopefully the guys that i was associated with. Theyre in the same situation as i am. They come out. Mike, you stha is a good scenario. He took some of the perhaps while he was still in prison. He was lucky enough to go home to his family that are helping you adjust. Correct. Now youre looking to get a job, right . Yeah, get a john right now. Thats in the making. You know, get my drivers license so ill be able to travel back and forth to work. Just tackle this cell phone and all the technical things and tackle all that. Everything is going good now. There has been a big challenge, yeah. Now they have another guys that actually getting resentenced. So you have another juvenile lifer that is getting ready to come on out. We brought the community lifers before and just talk about their experience so they can runni for it. So they could get some help too. Thats what i was trying to put together to see if i can come back in and speak to some of the guys and let them know what is going on out here. The juveniles have an inability to assess consequences are often rash and prone to risk taking, things that should be considered when sentencing. Joining me now is marcia levic. She served as lead counsel in the montgomery versus louisiana case which was the 2016 ruling. Thank you for being here. Thank you for having me. Help us understand what is behind the rulings that a teens brain is not fully developed enough to understand the consequences. What they said is children have immaturity of judgement and susceptible to peer pressure and often negative peer influences and if they have a uniquely develop mental capacity for change, rehabilitation and those attributes of adolescence and youth are really coming from research, both develop mental research and other science. And the court identified those attributes as leading to really lesser worthiness, lesser culpability for kids and therefore came to this conclusion that is really premised on the eighth amendment that we cant sentence them the same way we sentence adults. Are there any case thats stand out that you keep with you all the time . Ive been in involved in so many so i will say know. What weve seen coming from the Supreme Court has been remarkable and really upended how we think about kids under the constitution. And i think that the Supreme Court has laid out a blueprint for how we should think about their criminal offending and how we sentence them in ways that are more humane and reflective of their developmental framework. What about the victims families . When we first aired tyrones story, we heard from people who say hes out but what about the person who died . The person who was killed . And his family . And im glad you ask that question. We can never forget the victims. Nor the victims families. They are very much part of a narrative. They have a voice in what happens. They had a voice certainly a trial and we always want to hear certainly the victim impact that occurs in these cases. But i think that what the Supreme Court has said that with all of that information and recognizing that were talking about individuals who have been convicted of homicide. The constitution nevertheless requires that we treat them differently. And i think that all of the stake holders and all of the parties, everyone who is a participant in these cases, we need to recognize that the Supreme Court has really laid down a different rule that we need to be applying. Base ond that rule, do you think cases are reconsidered the same way across the board . Are all judges responding to that ruling the same . Not at all. Not at all. The devil is in the details. We have an extraordinary ruling from the United States Supreme Court that said not only that mandatory life without parole sentences are unconstitutional for children convicted of homicide, the court also said the sentence should be rare and uncommon, that it should only be imposed in cases where the Young Persons crime reflects permanent encourageability. But were not seeing that sentence reflected in the responses from both courts and prosecutors across pennsylvania and, frankly, across the country. And what you are doing to change that . Well, were vigilant, you know, i think that unfortunately we heard that it may take as many as three years to against throughout sentencing of the cases here in philadelphia and pennsylvania. That same time line will play out across the country. And i think that we need to hold i think prosecutors and judges feet to the fire if terms of making this a rare sentence. Fit turns out that substantial numbers of juvenile lifers are resentenced, well surely be back before the courts. Is the Supreme Court has more conservative appointments under donald trump, is there a possibility that things can change . I think thats a question that were all asking ourselves, of course. And the strength of these decisions is that we have three of them. And the court has repeated its findings and underscored the findings about the differences between kids and adults in term of criminal offending and culpability repeatedly over the last ten years. I think that the core of those holdings is safe. One should never overly anticipate what might happen in the future. But again, it really depends on how the decisions are implemented day in and day out in the trial courts across this country as the individuals are resentenced. Thank you so much. Thank you.
