As daylight spread across the horizon, snow flurries arrived in conshohocken along with the white flakes came gusty winds. Authorities in philadelphia are announcing charges against two Police Officers following a grand jury investigation. Theyre accused of beating an innocent man. Well listen in now on d. A. Seth williams. They saw him lose control of his scooter, and fall to the pavement. When they tried to apprehend him, he grabbed one of the officers, threw him into a brick wall repeatedly elbowed the officer in the face and tried to slam the officers head into the wall. That was their story. In order to subdue the suspect, the other officer had to use his baton on riveras body. And when rivera tried to grab the baton, he was hit in the face. Based on this information from the officers rivera was charged with resisting arrest and aggravated assault against the Police Officers. But before the case got to court, a new piece of evidence emerged. A video from nearby store. The video undermined every, every aspect of the officers account of the incident. As a grand jury found none of it was true. Except for the blows inflicted on najeh rivera. In reality, rivera didnt just fall off his scooter as the officers approached in their patrol car. Instead, one of them actually reached out of the window and clubbed rivera in the head. The car bumped the scooter and rivera fell to the ground. Both officers then got out and immediately placed rivera in their control. He never resisted. He never struck them. He never fought back. They just started hitting him. First one held him against the wall while the other beat him with a baton. Then they held him on the ground and beat him some more. With both fists, and baton. There is no doubt that the blows were connecting because the video also had audio. And you can hear mr. Rivera from the time he fell off his scooter writhing in pain screaming for help. After the beating, the officers handcuffed revar why who was still on the ground and for several minutes they kept him there while he was bleeding and they were standing on him with foot on back. Information provided to the grand jury by another officer, another officer arrived at the scene, had thought that mr. Rivera had been shot because there was so much blood on the ground. Hospital records show in addition to extensive lacerations, the beating fractured rriveras orbital bone. Staples were required to close the wounds. Here is a photo of what he looked like. In light of the new evidence explaining riveras injuries the charges against him were dropped by my office. And the investigation turned to his accusers. Rivera was not immediately able to testify as we were advised. He was still recovering from the trauma of the attack. Once it became available, all the evidence was presented to the grand jury and presentment was returned. The charges against the officers arrives from the beating itself and from the numerous false reports that both officers made in violation of their duty and law. Two weeks ago, in this very office, i hosted a meeting of elected District Attorneys from around the United States that, like myself were all africanamerican. We met in light of the National Discussion regarding the use of grand juries and prosecutors handling the investigation of the excessive use of force by police. The consensus was that it is our responsibility, not only to work with police day in and day out, but also to hold them accountable on those particular occasions when the officer does wrong. The man had his hand inside his pocket like he had a weapon when he demanded money from an employee one night last month. He got away with an unknown amount cash. No one was hurt. A man charged with a rape with raping a woman in a philadelphia parking garage on new years day is scheduled for a preliminary hearing today. Steven woodson is charged with attempted murder and robbery. Police say the attack happened inside a parking garage at 17th and callowhill in spring garden. They arrested woodson within minutes thanks to a couple of witnesses who a couple who witnessed the attack. A new report puts two cities in our area at the top of its list of 100 most dangerous cities. Neighborhood scout ranks chester, Delaware County number two, but camden new jersey was name the number one most dangerous city when population is factored in. According to the report camden had nearly 1900 Violent Crimes last year. That includes murders, rapes, robberies and aggravated assaults. And here is a look the at the top five cities on this list. This morning, rescue workers continue to search for missing passengers and crew members on board the transasia plane that crashed into a river shortly after takeoff on wednesday. In an audio recording from the cockpit, one pilot said may day, may day, engine flameout and contact was lost. 31 people were killed. 15 survivors were hurt in the crash. Also today, family members of the victims gathered at the crash site to identify passengers belongings. Rescue workers arranged luggage and purses recovered from the wreckage along the bank of the river. Around ten family members walked through the items trying to find those that belonged to their loved ones but half of those killed in the crash were chinese nationals. Taiwans president met with some of the injured survivors earlier this morning. This is video from the hospital in taipei where those people are being treated. The president handed some of the survivors money to compensate for their injuries. The cause of the crash is still under investigation. This is the airlines second plane crash in the past seven months. And new video in to nbc 10 this morning. The faa is investigating this crash of a small plane into the transmission tower of a texas tv station killing one person on the plane. The crash collapsed the tower and cut power to the station. No one inside the tv station was hurt. And this morning, federal investigators looking into the deadly train crash in new york are focused on why an suv driver ended up between two crossing gates. The ntsb is examining the tracks interviewing the trains crew and trying to determine if there was a data recorder inside the suv. Metro north plane slammed into the car tuesday night, killing the driver and five train passengers. Happening today in texas, jury selection is scheduled to begin in the trial of a man accused of killing american sniper chris kyle. Cant see him, i cant shoot him. The movie based on kyles life has already grossed 250 million and nominated for six oscars. The judge is expected to ask potential jurors if they have seen the film. Prosecutors say Eddie Ray Routh shot and killed kyle and another iraq war veteran at a shooting range in february of 2013. And later on during the night, the winds will diminish so the windchill isnt going to keep going down but will stay low all the way into the morning. In some cases a little below zero especially to the north and west. So we have some really cold air ahead for a while. It has been one year since an ice storm downed trees and power lines and knocked out electricity for hundreds of thousands of homes in our area. Nbc 10s jesse gary reports on the complaints and pecos plan for improvement. Reporter i asked peco manage about the possibility of putting above ground lines below ground. And here is what they told me. It will cost a Million Dollars a mile to move those lines under ground and then the increased repair costs if something goes wrong. Instead of using cherry pickers to go up and reach the damage crews would have to cut into the pavement or earth, make repairs and patch the hole. Some residents might be willing to swallow part of the considerable financial cost after last winter. Almost three quarters of a million customers lost service during last februarys ice storm. Malvern was hard hit with Hillary Smith and her family forced out of their home due to six days without service. I would just like to know where the damage is and a realistic estimate of when it would come back rather than just keep putting pushing the time back and back. Continuous improvement is something were always looking at. Were working with utilities across the country to determine what best practices are for communicating estimated restoration times for customers. Nbc 10s Christine Maddela has been sitting in on the News Conference and is live now at center city with more on the announcement. What can you tell us . Reporter i just walked out of the District Attorneys office along with the Police Commissioner charles ramsey. And they announced that two philadelphia Police Officers are now charged with beating a man. Take a look at their pictures. Police officer Shawn Mcknight, and Kevin Robinson. Those charges against both of those officers include aggravated assault, criminal conspiracy obstruction and five other charges. Now, they are accused of beating up a man named najeh rivera. This happened in may of 2013 near north seventh and somerset streets in north philadelphia. The District Attorney and the Police Commissioners say the two officers lied about what happened. They say rivera tried to assault the officers. But in reality, camera surveillance cameras showed the two officers knocked him off his motor scooter and then proceeded to beat him with their fists as well as a baton. And so the District Attorney as well as the Police Commissioner say there is no room for police brutality. Same rules should apply to everyone, rich or poor black or white, or sworn officer with a badge. Reporter now the charges against rivera have been dropped. As for the two officers they were suspended for 30 days with the intent to dismiss from the force. Well stay on top of this story and bring you the latest here. Reporting live in center city Christine Maddela, nbc 10 news. Eight people remain hospitalized this morning after a deadly Commuter Rail accident in new york. Right now investigators are at the crash site, trying to determine exactly what caused the crash. Nbcs tom costello reports. Reporter it took nearly 24 hours for crews to remove the suv that had been virtually impaled on the front end of a metro north commuter train. Witnesses say the driver 49yearold ellen brodie may have been caught on the tracks in a traffic backup tuesday night. Right behind her, in traffic, rick hope who saw brodie get out of her car, after the crossing arm came down on the suv. She looked at me i gestured for her to come back i back up again further to even indicate there is plenty of room to back up, and she turned walks and gets back in the car. Reporter instead of backing up, she pulled forward, right into the path of an oncoming train. In a massive fireball the train carried the suv a thousand feet down the tracks yanking the electrified third rail out of the ground and driving it like a spike right through the floor of the first train car, and part of the second. Already ntsb investigators have recovered data recorders from the train and the crossing signals. Two big questions, why was the car on the train tracks and what caused this accident to be failed for occupancy of the train. Reporter ellen was married with three daughters. She worked at a nearby jewelry store. She was the most warm person. She was kind. She was a great mom. She was a great wife. Reporter her husband alan posted on facebook thank you to those who shared their condolence for the terrible tragedy that took my beloved wife ellen who so many of you knew. It is important that they seek professional Services Examinations and cleanings and fluoride treatments fluoride water here in philadelphia and thats a big help. Are there other programs planned for kids for dental care . Really, you talk about kids in the suburbs typically theyre going to be okay but kids in the inner city disadvantaged children, those kids dont have the get the dental care they need, do they . It is definitely a challenge for children in disadvantaged and underserved areas. This is why this program is so exciting for us. It is dedicated it is a nationwide event. Theyre estimating about 350,000 children will be served. They are we have 1500 sites throughout the nation. There are numerous ones here in philadelphia and in south jersey. And then we have some future weather troubles perhaps starting before the weekend is over. And going into early next week. Flag blowing pretty hard as the northwest winds come in and make it colder and colder. 31 degrees. We have a 24mileanhour sustained wind gusting to 33. We already have gusted close to 40 miles an hour. Feels like 17 in philadelphia now. You can see the flow out of the northwest, bringing the colder air down from canada. And the windchill, the way it feels on your exposed skin down close to 10 already in allentown and below zero already in the poconos. How low is it going to go tonight . The actual air temperature down to about 4 below in the poconos, 4 in allentown, 6 in quakertown and in reading. So places with the deeper snow cover, really are going to get colder tonight with the clear skies, light wind and low humidity. 10 in trenton. 11 in northeast philly. Mount holly, 9 in vineland. 12 in atlantic city. 13 in dover. 10 in westchester and also in glassboro further away from all the concrete of the city. We had a little band of snow showers, snow flurries moving through a couple of hours ago north and west. Got a little bit more. But there may be a couple snow flurries coming down from the great lakes, but doesnt look like much. What will be more significant will be developing later on during the weekend. And by monday morning, an area of low pressure to our south, it may be enough warm air so that this starts off as rain from the philadelphia area southward. Eventually, this low moves off shore, it will pull down some colder air and the colors indicate the general amount of snow. By the time this is over with on tuesday. The heaviest snow once again looks like it is going to be up in Central New York and toward boston. Theyre going to get hammered again. And in our area more snow in the poconos, Lehigh Valley and practically none or very little in southern delaware and extreme south jersey.
