Right now on nbc 10 news at 5, a rape investigation. Philadelphia police were called to a parking garage where a woman says she was attacked this morning. Detectives have been on scene now since the call came at around 11 00 a. M. Within the last hour, we Learned Police have a person of interest in for questioning. Nbc 10s Harry Hairston is live in Spring Garden and joins us with more. Harry . Reporter right now, police are talking to a person of interest at the special victims unit. Im also told sometime after 6 00, police will make some type of formal announcement. First take a look behind me at the parking garage. The second floor is where the crime allegedly happened according to police. We have fresh video from inside that scene that i want to show it to you right now because the crime unit has now finished processing that area. This happened right between two vehicles. Its right near a lexus that youre looking at. The white lexus and a fusion car. And they say thats where the woman was about just before 11 00 this morning when the alleged rape happened. Police have been there for hours collecting as much evidence as they can. Im told some articles of clothing were taken and also it appeared as though there were a pair of sunglasses that were found just outside the garage as well. Just minutes before going on air, the crime scene unit they did come out with bags of evidence that they put in to take back to the lab for more processing for this case. Now, moments ago we also talked to a neighbor who lives across the street and she said shes completely shocked by what happened because they have good security here. Because i do know that the security guards that sit at the front desk in our building are always aware of whats going on. We also have two guys 24 hours that walk around the parking garage all night, all hours of the night to make sure that everything is okay. And im really surprised that something could go down like that. Reporter now, again, the neighbors do say they have good security here, but i did talk to some neighbors who say they are going to be more cautious in the future because of this incident and they will not be going in and out of this garage alone. Kenneth square. 37 degrees, washington township. These are actual temperatures. These are not the feelslike temperature. Ill show you that in just a second. Through the Lehigh Valley were in about the mid 30s. 29 mt. Poconos. 36 degrees in pottstown. South jersey and delaware temperatures near are right around the 40 degree mark. Millville, dover, even mt. Holly coming in in the upper 30s. Now, heres the feelslike temperature because its still pretty breezy outside. Feels either at or below freezing for most of the area. Mast what 29 allentown and trenton. Feels like 31 degrees in philadelphia. Feels like 33 in millville. So, again, if youre heading out, bunding lle up. Coming up ill show you how cold it will be through tonight and rain for part of your weekend. Cold air or not, the mummers are still doing their thing and broad street in center city. The new years day tradition lives on with the annual parade. Not everyone is happy with the new shortened route. The 114year tradition holds its roots in south philly. This year the mummers parade kicked off well north at city hall. Well have more on the parade in a live report at 5 30. And some reporters decided not to go to the parade at all in protests over the new parade route. What do we want . The parade back bring it back they say they protested at broad and oregon shouting to anyone that came by that the parade has been taken from them unfairly. They say the parade was moved for no apparent reason. This years route started at city hall and made its way down to washington. Essentially skipping the south philly neighborhoods long considered its home and birthplace to the mummers. It belongs to south philly. We support them. We do everything we can for them. And they took it away from us. It does not belong in center city. It belongs back here. As she just said, the protesters say the parade started in south philly 115 years ago, it belongs back at its Traditional Home they say. With the new year comes a brand new law designed to protect people from becoming the victims of cyber crime. Its now on the books in delaware. Nbc 10 Delaware Bureau reporter tim furlong is live. Tim, tell us about the law. Reporter the responsibility is going to fall on the businesses. If one of their businesses becomes a former customer the company had better destroy their records properly. When the clock struck midnight delaware got a new law that will also try to keep your private information safe. I really think it is necessary to do that. Every day you hear something about the Bigger Companies being compromised on their data. Reporter delawares new Data Destruction law tells delawarebased companies with delaware customers they now have to go the extra mile to guarantee customer information is destroyed when its no longer needed. Under the law, data must absolutely be destroyed when a customers name is present combined with their signature, birth date Social Security passport or drivers license numbers or any information from their credit cards or medical records. Its going to take some time to see if the law is effective, but everyone seems to agree its a good idea. The criminals work 24 hours a day. And the guys putting the things in place to protect us work eight hours a day, you know, so i think the more they can do and the more they stay on top of it the better its going to be. The new law doesnt cover big banks already covered but covers electronic data and allows the Delaware Attorney Generals Office to hold Delaware Companies accountable should they accidentally leak customers information. Live in wilmington tim furlong, nbc 10 news. Tonight police are looking into the murder of a woman found inside a bucks county home. Police say the 22yearold woman was shot inside the home on whittier avenue in bensalem. Police are investigating the death as a homicide. A man inside the home at the time of the shooting is cooperating with investigators. The mayor of bridgeton is asking for calm and patience in the wake of a Deadly Police shooting. This shows Police Searching a car after 36yearold reid was shot and killed, a passenger in the car when police pulled it over tuesday night. Investigators still havent said what led up to that shooting. Witnesses told nbc 10 that reid had his hands up. Mayor albert kelly is asking the community to let the Justice System do its job. I as the mayor, will lead in the charge of transparency so they can see everything that happened and didnt happen. Police say they did find a gun at the scene. Both officers involved in the shooting are on leave during the investigation. Meanwhile, tonight, family, friends, and neighbors will honor the memory of a 10yearold boy in Gloucester County, mad youmatthew was killed sunday night after hit by a police car in franklin township. The Gloucester County prosecutor is still investigating the crash. The police chief has also met with the boys family. They told him matthew wanted to be a police officer. Tonights vigil starts at 7 00 at the frank Lynn Township sports complex. An old warehouse in south jersey went up in flames this morning causing part of the building to collapse. Wow. A Burlington County firefighter took this video of the flames in mt. Holly. The fire started early this morning at the former warehouse for arrow safety device. Skyforce 10 was also over the scene as smoke and flames filled the sky. That fire burned for more than four hours and took more than 100 firefighters to get it under control. Investigators say leftover oil and wood inside the building helped fan the flames. And the cold weather also caused problems for firefighters. A heating tent was set up to keep everyone warm but the water from their hoses caused an icy mess. No one was hurt. The cause of the fire is under investigation. The new years eve fire claimed the lives of three people in a queens new york, highrise. It started yesterday just before midnight at a ninth floor apartment on 57th avenue. Firefighters arrived to find two women and a man dead inside that apartment. Five firefighters had to be taken to the hospital for minor injuries. Theres no word yet on what sparked the flames. And take a look at this scene out of wyoming earlier this week. Firefighters battled both flames and as you can see, sub zero temperatures tuesday night into wednesday. Fire destroyed four Historic Buildings housing more than a dozen businesses. Many firefighters were coated in ice as water from their houses froze in the 25 below zero weather. Gift cards never showed up for christmas, and now u. S. Postal workers are under the spotlight just outside of washington, d. C. The feds say they recovered a razor blade and hundreds of sliced envelopes inside the mail distribution area in capital heights, maryland, and say 9,000 in gift cards are missing. Special agents are now focusing on two employees at the distribution center. The same mail center was the focus of a separate theft investigation last year. No charges were filed in that case. The u. S. Coast guard spent the day offloading thousands of pounds of marijuana seized on christmas eve. The coast guard intercepted a speedboat south of jamaica last week. They found more than 4,000 pounds of the drug on board worth more than 3. 5 million. Coast guard Officials Say an aircraft actually spotted the enormous stash from the sky. Thats when they sent a Fast Response cutter patrol boat to the area. This is the largest marijuana bust done by a cutter since theyve within commissionbeen commissioned. Officers arrested three people on the boat and the coast guard off loaded 320 million worth of marijuana last year on miami beach alone. As you can see, the rescuer was able to put a net over the hawk and capture it with his hand which look at that he posed for pictures right there before leaving to nurse the hawk back to good health. And this is not a day where you want to get cold and stay outside because it feels a lot colder with the wind than it actually is. Now, as we end out the week it will stay cold for tomorrow. Its not the same. Reporter the new shorter parade route definitely has its critics who say theres just not enough time to get pumped up. The longer route is better. This comes amid a sea change of demographics and rising parade costs, while participant numbers are slowly dwindling. I realize everything is getting smaller and the fact that you know they have to shrink it but i dont think going the opposite way and shrinking the whole entire thing down is going to be the answer. Reporter working as a special education teacher, edward says he saved for a decade for the nearly 20,000 down payment he made on this home. My vision was a new home. Maintenance free. Reporter but four years later, edward is still living in his old house with a broken furnace and no airconditioning fighting to get his life savings back. It doesnt make any sense. Reporter tasha brown, a Real Estate Agent living with three kids and grandchildren says she, too, lost her entire down payment when she tried to build a custom home in prince georges county. That 52,000 could have put my daughter through college. Reporter both signed contracts with Toll Brothers which lists itself on its website as americas leading builder of luxury homes. Federal mortgage data shows it sells more homes here in the d. C. , maryland, virginia region than anywhere else. It also owns its own mortgage company, tbi mortgage. Edward and tasha say they could have used another lender but decided to go with tbi because they were promised free upgrades. If you do not take their Mortgage Lender you lose all the goodies. So you lose the chefs kitchen, you lose the finished basement you lose whatever theyre offering in closing. Reporter but after signing contracts, tasha and edward were told they didnt qualify for their original financing offer. Instead, they say they were offered loans they couldnt afford or no loan at all. Meaning they lost their dream home and their down payment. I was told that my debttoincome ratio was too high. After you had signed the check . After. Reporter edward and tasha say they were never preapproved for a loan and the news 4 iteam found theyre not alone. According to federal mortgage data tbi never preapproved a loan in the last five years. But the companys Financial Statements show it reported more than 125 million in revenue since 2006 by seizing down payments from canceled contracts. A classaction lawsuit against the company even alleges Toll Brothers made more money canceling contracts than selling houses after the Housing Market collapsed. In a statement, Toll Brothers tells us in each of these instances we retained the original buyers deposit to mitigate the actual losses we incurred but only after many attempts to work with those buyers to save their deals. Ultimately, the retained deposits were not enough to cover those losses. And reported revenue where gross amounts that do not reflect the losses the Company Actually sustained. Toll has a mortgage contingency clause that is really different. Reporter he is a real estate lawyer who teaches other attorneys on how to protect clients from losing down payments. He says Toll Brothers has one of the most confusing contracts in the business. When i have a buyer thats buying a Toll Brothers home i spend about an hour explaining paragraph 4. Reporter he says many of his clients mistakenly think it says if something goes wrong with their loan they can get their down payment back but in reality, he says the contract allows Toll Brothers to seize the down payment even if it changes the terms of the tbi loan. If you look at the toll cases, theyre all people who have saved money and are trying to invest that money in a home. These are all really responsible people. Reporter in its statement, Toll Brothers says our success drives from selling homes to buyers who actually close, not retaining deposits from people who dont. The company says edward and tasha walked away from their agreements and that they commit valuable land and invest hundreds of thousands of dollars and resources into its custom homes. My client, 45,000 in legal fees. Reporter he has gotten some of his clients their money back but only after a long and expensive legal fight. Both tasha and edward have reached out to the government to try to get their money back. So how can you protect yourself as a home buyer . Well the key is securing a mortgage before signing any contract or even walking into the sales office. And always seek legal advice before signing anything. Theyve also identified the first victim as an indonesian woman who was a passenger on board that flight. Her body was turned over to her relatives at the Police Station in surabaya. There was a brief ceremony a very emotional scene with her relatives and her remains were then taken back to her local village and she was buried tonight. In terms of the search searchers are focusing on the theory that the main fuselage has either held together or is in the same area. So theyre looking in the spot in the east java sea where a plane spotted something, a shadow an image of some sort going on the notion that perhaps that is the main body of wreckage. But they have nothing definitive yet. Theyve brought in all sorts of equipment to try to help them answer that question and potentially send down navy divers to verify. They have an unmanned underwater vessel metal detecting equipment, 3d mapping, seafloor mapping. But as yet havent been able to decisively say that is the main body of wreckage. Of course, once again, theyre battling the weather. The high seas, the choppy waves, high winds, and heavy rains have all come back and thats really hampering efforts. There are still some ships involved in the search overnight, but the aircraft are grounded. The divers didnt get out today. They werent able to go down and check anything out. That may be the case again tomorrow. They also now have equipment out searching for those pings, listening for the pings of the black boxes and so far have not heard anything. Today, one investigator said it may be a week before we find those black boxes. Back to you. We are starting 2015 with temperatures in the 30s for most of the area but actually it feels a lot colder when you factor in the wind. Cold and dry as we end out the week. It will be staying dry as we go into your friday even dry to start the weekend, but we will have weekend rain moving in. Also some areas north and west could be seeing some sleet mix. Possibly freezing rain with that. Ill show you that in just a moment. Then its much colder as we go into next week. So if you think today is cold next week is actually going to be colder. Heres a live look out at Blue Mountain ski resort. A lot of people out there today. Lot of people have the day off, too. So we are looking at nice conditions for the ski resorts with those colder temperatures. In mt. Pocono, this is the coldest spot on the map. 29 degrees, actual temperature. With the wind feels more like 19 degrees. The wind is right around 15 miles an hour for most of the area. North and west right now, through the Lehigh Valley mid 30s. 40 degrees, philadelphia. 36 pottstown and westchester. If youre heading out any time soon, these are the actual temperatures, but it feels just about 10 degrees colder with the wind. 37 degrees in glassboro. 38 in dover. 40 degrees right now in stone harbor. So across the area we are looking at dry conditions. Just those cold temperatures. Some clousdsds trying to move through. No rain with any of this. The rain wont bele coming until this weekend. The rain moving through parts of louisiana, parts of tennessee right now were seeing the rain. This is all moving in our general direction. So as we go into the weekend, we will start off dry. Your friday is going to be dry. So is the first half of saturday. You see clouds increasing through the day saturday. By noon dry, but then well be seeing mostly cloudy to overcast skies. Afternoon on saturday even into the evening, rain moves up areas of sleet with maybe a wintery mix or even some areas of freezing rain through the Lehigh Valley especially the poconos. This quickly changes over to rain, though as we go into sunday. Temperatures warm up quite a bit. So we will see that transition over to rain. And we could even be in about the low 60s, believe it or not, with the rain in the area. Mostly clear and cold for tonight. 28 for the low in philadelphia. Low 20s north and west. So another cold start tomorrow morning. Cold afternoon. Mix of sun and clouds. Temperatures anywhere from 41 to 44 degrees. But we will be ending the week on a dry note. Starting off the weekend dry, but then in the afternoon and evening hours on saturday thats when we expect the wintery mix. Mostly north and west. Some sleet, again, possibly sop freezing rain. But its not going to accumulate to much because once those temperatures warm up sunday 63 degrees, its all going to turn over to rain. So sunday will be a warm but rainy day. Then we are much colder next week. High temperatures will be near freezing for most of next week and in the Morning Hours well be in the low 20s, possibly even the teens in philadelphia. Sheena thanks. Investigations involving the Philadelphia Veterans Affairs office are Digging Deeper into allegations by employees. According to the Philadelphia Inquirer the results of the investigations by the vas office of Inspector General are not expected until late february. Those results were initially supposed to be released last fall but after a string of whistleblowers came forward, the investigation got bigger. Some employees claim mail from veterans inquiring about delays in their benefits was shredded and records were changed to hide the backlog of patients. The facility serves nearly a million vets. Officials there deny any wrongdoing wrongdoing. And delawares Supreme Court may soon decide who will be kent countys next recorder of deeds. The race between lamar gunn and Betty Lou Mckenna has been through four recounts. First the candidates were separated by just two votes then there was a discrepancy about an absentee ballot. And while its now too late for help to arrive the message is resonating with people all across the country. Leelah alcorn was a 17yearold transgender whose family called her joshua. She committed suicide by stepping in front of a tractor trailer four miles from her home outside cincinnati. Her suicide note was full of anguish and despair, her inability to get the help she wanted and the sense of being a girl trapped in a boys body. Dr. Robert garafalo who works with transgendered youth says the lessons from alcorns life and death could help. Light shone on it and the challenges she went through is going to help make somebody elses journey a little easier. Shortly after her death, social media lit up with support for the teenager. More than 40 of transgender youth who responded to one survey said they had attempted suicide. Philadelphia police and Police Departments around the country have warned against gunfire celebrations on new years eve, and a news crew in kansas city found out why firsthand. Right now at 6 00 a woman cornered and attacked inside a parking garage. Police are questioning a man in connection with the rape on this first day of the new year. A 33yearold woman was seriously injured during the attack in broad daylight while locals and tourists headed to several new years day events. The attack happened in a parking garage near 17th and callowhill streets not far from the Community College of philadelphia. Nbc 10s Harry Hairston is live in Spring Garden. Police hope some clues left at the scene will lead them to a suspect . Reporter yes, they got some clues and articles from the scene here that helped them go after this person of interest that they are now talking to at this moment at the special victims unit. While that is going on some people in this area ive talked to say the incident has left them shocked and disturbed. Im very surprised because ive lived here 3 1 2 years, ive never had an issue. I feel very safe in the building and parking lot. Reporter police tell me between these two cars is where a man raped a 33yearold woman just before 11 00 this morning. Reporter police would not say much about the case atother than the woman suffered multiple injuries and is at Hahnemann Hospital in stable condition. Police sources tell me investigators are questioning a person of interest and police will officially release more information about the case later tonight.
