Investigators said, quote, the physical abuse consisted of victim number one and other children in the home being punched, slapped, thrown over a banister and shot repeatedly with bb guns all over their bodies to the point that it left marks, scars and causing at least two of the children to plead. Were told it took place between march 1st and may 9th of this year. All of the defendants facing a multitude of charges. They will face the judge just a short time from now on december 10th. That is coming up next month. Neighbors tell us they had no idea what was happening behind closed doors, but they are sickened with what we are sharing with them. A mistrial was declared this morning. Prosecutors say they will retry the couple. They are charged with abusing their three children. One of the witnesses testified that one of the children died. The judge ruled before the trial that jurors should not hear about that death. To developing news right now, the owners say it will close december 12th. Thats according to a filing made today with the delaware bankruptcy court. Just yesterday, we told you the company had threatened to close by that date if its main union failed to drop an appeal. Also developing this afternoon, police say the driver of a bmw was at fault for tuesdays bus accident. He is charged with careless driving and failure to keep right. He crossed over the lines and hit the bus heading south. The impact sent that bus flipping onto its side and several people were hurt. The doors will close at another philadelphia Charter School. It leaves some middle School Students wondering where theyll go next. And money problems are to blame. Weve been out all day getting reaction. This is the second City Charter School to face financial troubles. Whats been done to place the students of this school in new classrooms . Reporter they say they have room for the students that attend here and its understanding parents to gather up the student information. If they want to get into a Charter School, begin that application process soon. Just learned off of facebook and its horrible. Reporter she says her daughter shouldnt have to finish out her year in a new school, but shes going to have no choice. Theres a very good school. I dont understand how theres no funding for the schools but theres funding for prisons and everything else. Reporter no one at the school would comment as to why but one board member told me it was because of declining enrollment. He said efforts have been made to boost enrollment, but it still continues to wall. The vice chair says they couldnt afford to stay open until june. Well, the options are there is space in our traditional Public Schools and well be reviewing what space is available for students. Were actually going to put together an online application process for parents. Reporter they say parents are going to need to decide where they want their kids to go. The first thing the parents should do is contact the school and make sure they understand how to get the transcripts. Reporter now, some parents tell me theyve already been able to enroll their kids in other Charter Schools, getting them in there by monday. So actually withdrawing them today from school. The teachers will be out of a job and will not be getting any severance. Nbc10 is there as the suspect at the center of a highprofile kidnapping goes to court today. Delvin barnes pleaded not guilty. Hes accused of kidnapping a 23yearold woman before he was captured and the woman rescued days later in maryland. We were in the courtroom with barnes. You learned new information. Tell us about it. Reporter renee, in the detention memo to the judge, prosecutors said carlesha was bound and forced into the cold trunk of barnes car where she was held after the kidnapping. Its one reason prosecutors argue that barnes is a danger to the community. His District Attorney did not even try to fight it. Standing in his green prison jump suit before a judge for the First Time Since his formal indictment yesterday, Delvin Barnes almost mumbled his not guilty plea. He will be held without bail awaiting trial. A condition the federal prosecutor believes was essential. Hes clearly a danger to the community and his exposure in terms of his sentence is significant. So he would be a risk of flight. Reporter his publicly appointed District Attorney did not even try to convince the judge that he deserved pretrial release. Prosecutors said there were no serkss that barnes could be safely release. He faces life in prison, plus he was already on probation and being sought in an unrelated crime when he kidnapped a stranger off this germantown street. There was a period of time during her abduction where she was forced to remain in the trunk. And she was also restrained. Reporter watching barnes in person in court today, he looked uncomfortable at times. This case will now move before the judge where a whole new round of motions and hearings will soon begin. The victim is 57yearold donald smith of wilmington. Hed been strangled. They tracked down suspect marcus cruz. Want to take my hat off to these individuals back here. Theyve shown the true side of being a homicide investigator. A homicide investigator never sleeps, works around the clock, gets all the evidence and they work relentlessly to go after the suspect. It was created in october. There are four detectives, a supervisor and two agents from the atf. A 45 million for a Woman Held Captive for a decade in a philadelphia basement, that was the award today. She said she and others were abused during a scam to steal the victims Social Security checks. They tell nbc10 they know the accused may never pay up, but they believe this verdict sends a strong message. A criminal trial is expected next year. We could be just four days from learning in philadelphia will get a second casino. While theres some opposition in the city, people in the suppose bush suburbs are weig in. Reporter this is one of the spots where a new casino could go up right here in south philadelphia. Such an idea has drawn opposition, but now it is getting pushback from another county. This was the scene wednesday night when south Philadelphia Residents voiced outrage over a possible casino. But miles away in ridley township, members put their chips on the table. All it will do is cannibalize the revenues from the other gaming facilities. Reporter mainly they say harrahs. They argue it is not about competiti competition. We estimate they had a loss of revenue of over 30 , which would be devastating to the casino in chester and a threat to the jobs there. Reporter Union Leaders argue that construction of another casino would increase jobs. Delaware county has been on the receiving end of more than 80 million in gaming funds. But that money is fading, they say. I pulled up reports from the pennsylvania gaming control board which shows theyve seen revenues drop by more than 36 million in the past year. Counties tell me they dont want another situation like the one in Atlantic City where four casinos have closed so far this year. What were seeing happen, thats going to be a much greater decrease in the revenue and that would be significant. Reporter so the Council Leaders in Delaware County want the gaming control board to reconsider issuing another license here in philadelphia. A hearing is scheduled for tuesday of next week. Schools can get up to 60,000 for a resource officer and up to 40,000 for a School Police officer. Schools that get the money are required to keep the position for at least two years. The money will go to schools in philadelphia and the counties of chester, montgomery. A new jersey senator is calling for a crackdown on Insurance Companies. That issue, lowbalancing victims of super storm sandy. He says Insurance Companies need to be more closely watched when they handle flood damage claims. They found evidence that companies are altering damage reports. Senator me mendez wants the federal Emergency Management to investigate this. He believes hundreds of homeowners could be victims. Engineering reports which drive the claims process were deliberately manipulated so that damage from sandy would no longer be covered significantly reducing payments. The competition kicks off tomorrow. 15,000 people are expected at the expo Center Saturday and sunday. They will reconstruct beaches and dunes. Work begins this winter. Its all part of new jerseys effort to widen beaches along the entire coastline, also to build protective dunes along the beaches here. The work was authorized in 2007. Well, the beaches may be the only place that doesnt get down into the 20s tonight. It is going to be the coldest night so far this season with even Colder Weather coming next week. Reporter Delaware State Police are still investigating a state Police Involved shooting here. You can see there are several emergency vehicles still on scene. A portion of harvey road is shut down as this investigation continues. Now, as we zoom in a little bit, this looks like what appears to be the suspects car. What were told is that a Police Officer shot a suspect and this looks like it could be the suspects car as we take a closer look. I spotlight the rear of the car. It looks like the back window is shattered and what appears to be bullet holes in the drivers side rear door. Police still have this area blocked off. We are told the male suspect shot by the delaware state trooper is now in Critical Condition. No troopers were injured in this shooting. Reporting live, nbc10 news. Ill tellou
