And just above is where investigators say the boy suffered extreme abuse and died at the hands of his mothers boyfriend. Excruciatingly painful. Reporter from her home dr. Patricia sutton choked up when she described trying to save the life of a 2yearold boy above her practice. Her mothers boyfriend was babysitting him yesterday in their upstairs apartment when he rushed into the Doctors Office in a panic. The toddler limp in his arms and bruises all over the boys face and body. He said the boy fell in the bathtub. She took over from there, performing cpr. His color was bad. His color was poor. His pupils were dilated. Reporter 31yearold daniel graphton told investigators he was bathing the child, stepped away for a few minutes and found the toddler face down in the bathtub. According to the affidavit, it took graphton an hour to seek help from the time he said the toddler fell. The condition of the child was just mind blowing. Reporter neighbors who didnt even know the 2yearold say theyre angry and feeling the loss. Its devastating. I dont understand how anybody in their right mind could hurt a child. Reporter dr. Sutton who hired the toddlers mother when she was pregnant with him, wishes she could do more. Its going to be hard to go back to that same place. Reporter graphton who is not the boys father is charged with endangering the welfare of a child which could be upgraded once an autopsy is complete. Nbc 10 news. All of interstate 76 is back open tonight after this accident in upper marion. A tractortrailer toppled near the 422 exit. It caused big problems in the westbound lane during rush hour. Crews cleared the wreck around 8 00 tonight. A man is under arrest tonight after exchanging gunfire with a Philadelphia Police officer in kensington. The officer was running after the suspect along somerset street because he believed he had a gun. The suspect fired several shots at the officer. The officer fired back. No one was hit and police took the man into custody. New at 11 00, were hearing the first police calls after a man killed a wouldbe robber in Delaware County. Reporter the 67yearold man was rushed to the hospital after suffering chest pains, this after police say he struggled and fought with that suspect before shooting him. An upper darby Police Officer moments after he arrived on the scene of a Deadly Shooting Police are calling selfdefense. Detectives say a 67yearold man took on a robber and things turned deadly. You saw somebody laying in trail. Reporter saul lives across from the park where the shooting took place. He had just gotten home when he noticed a mans body sprawled out on the ground. I called the r. A. Hes not saying anything. So i called the police right away. Reporter it all happened around 2 30 this afternoon in cobbs creek park. The 67yearold man was walking along this trail when a masked man wielding a gun and a stick ran up and demanded money. Police say the suspect put the gun in the victims face and thats when the victim who was licensed to carry pulled out his own handgun and shot the suspect once in the head. The older guy didnt get hurt. He did the right thing, protecting himself. Its a very dangerous park down here. Reporter police eventually learned the gun the suspect used was a pellet gun. They say it doesnt matter because the victim rightfully believed his life was in danger at the time. I personally spoke with him. He was very upset that this incident happened. But at the end of the day, i dont see any criminal charges whatsoever. And to be quite frank with you, i think he did what he had to do. He had a real gun, the bad guy didnt have a real gun. The victim won. Reporter now, tonight were told the 67yearold is expected to be okay. Meantime police say the suspect is in his late teens or early 20s. However, they have not released his name. That is the latest from upper darby, nbc 10 news. New at5 en 11 00, more trouble for the former Delaware CountyPolice Officer two years after losing his job. Police say trevor parhan told him he was still a Police Officer when they pulled him over in lower marion back in october. The collin Police Department has fired parhan on two different occasions, once in 2013 after he tasered a 16yearold boy who was shackled to a bench in a holding cell. Tonight hes charged with impersonating a public official in lower marion. Two former Philadelphia Police officers know the price theyll pay for robbing drug dealers while on duty. Today a judge sentenced Jonathan Garcia to more than 17 years in prison, his onetime partner joannis could serve more than five years. They faked arrests and ripped off cash and drugs from dealers. A south philadelphia family is in the middle of a deportation battle. Immigration officers detained jaime on january 14th. It stemmed from a dui arrest a year ago. He was taken to the pike county detention center. His family is working to free him. He has four children who are u. S. Citizens. His wife suffers from Health Problems and the entire family says its suffering at his loss. Theyre now working with a nonprofit to get him out of custody. George, the number of oil trains growing . Reporter jim at a Community Meeting tonight, watchdog said theyre now counting between 15 and 20 of these oil trains passing through our area each week. Each of those trains potentially dangerous, and each one passing not only the densely packed areas in the middle of the city but also miles and miles of our suburbs. Last night the new york train crash looked like a fireball. Three days earlier in south philly 11 oil tanker cars derailed. Two unrelated incidents, tonight highlighting vulnerabilities on our rails. What happened on saturday in philadelphia what happened in new york last night are reminders of the risks. Reporter activists like michael said its especially alarming across our region because so much train traffic in this energy hub now involves these potentially highly flammable oil tankers. Mark williams of frankfurt is noticing more of the oil trains but doesnt know what to make of them. I know theres no passengers being carried on those trains so i know theyre transporting something. Reporter nbc 10 first exposed oil train concerns a year ago after this tanker dangled over the Schuylkill River for days explosions as bad as this one in canada or this one in north dakota. The impact zone here would be broad. This is tens of thousands of people. Reporter insisting neighboring communities need to be informed. A meeting tonight led the effort to do just that. Last year Industry Leaders acknowledged safety must be a top concern. Everyone involved wants to have you know safe transportation of this vital energy source.
