tonight a different story than what we have heard from other jurors. crime and justice reporter joy lepola is the first reporter to talk to juror number six. >> it was very emotional for me, because she, at the end of the day, is a regular citizen like we are. >> shiron davis known to those during the trial as juror number six, said in the beginning, eight out of 12 jurors voted to con be convict dixon on theft charges and misconduct in office. >> when i went in she was guilty. >> after seven days of deliberations and a great deal of compromise. >> it was emotional. very eemotional for me. >> jurors reached a partial verdict. and it was on one lone count jurors agreed to convict on. >> one person made the difference. >> davis said it was the will of one that stood in the way of dixon being found guilty of embezzeling from the holly he trolley tour. >> one out of six, we cannot get one person to come to a consensus as a whole. >> as for whether race ever played a role. davis said it did. >> at some point, to be honest, in the beginning, i did feel, yes, it was playing a role. toward the not guilty, just strictly because of that. >> asked about the cases the two sides presented. davis has a strong opinion on both. >> the state presented a very good case. honestly do not feel the defense made any strong points. >> the only thing davis said may have changed her mind is if the mayor would have taken the stand. >> if you are an innocent person you would want everyone to hear your voice. >> as mayor sheila dixon attempts to put this trial behind her, so does davis, who admits the fact that she had to compromise, weighs heavily on her. >> i am at peace with it now. it is over. it is back to me being shiron and a mother. so it is gone. but yesterday evening, i deliberately did not watch anything after we gave our verdict. i just wanted to -- i have to deal with some things within myself. >> joy lepola, fox 45 news at 10:00. >> davis, the mother of two, said that there were times she was brought to tears inside the jury room because of the mindset of the other jurors. >> hear more from ms. davis by simply logging onto our website foxbaltimore.com/raw news. >> because of yesterday's guilty verdict there has been lots of questions about if the mayor would be removed from office, when that would happen and who would take over? an opinion issued by the city solicitor seems to be backed up by an opinion from the attorney general, more than 30 years ago. the state constitution said a leader is to be removed after being convicted. but in a 1977 written opinion, the attorney general said conviction means a verdict and a sentence. meaning the mayor could stay in office until she learns her punishment. >> i suspect the sentencing will be delayed until after the trial, of the perjury charges in march. >> well, the person that would become mayor, if mayor sheila dixon is removed from office. is the city president. that's stephanie rawlings-blake. tonight we asked her if she is ready to take over. >> i don't think anybody can live under the misconception that, you know, you don't think about those things. that being said, you know, i have been interested in politics since i was eight years old. this is not -- that part of it is taken care. >> stephanie rawlings-blake would also take over if dixon stepped down before sentencing. >> there was a call tonight from some camps that say the mayor should step-down. keith daniels live at city hall with that story. keith? mayor sheila dixon had high price suits working for her case. baltimore has no law stating when taxpayers pay legal fees for city officials. but if mayor sheila dixon brings this issue before the board of estimates. there is a good chance taxpayers could foot the bill. >> it would be extraordinarily unlikely that the city of baltimore, the board of estimates, would approve paying all or any portion of her fees. >> i don't see that paying legal fees very extensive legal bills, is even appropriate. >> the solicitor said dixon has not made any requests for reimbursement. mayor sheila dixon has been quiet and sometimes forceful talking about her troubles and in about 30 minutes hear what she said in the past and what some people say she should do right now. >> we have breaking news tonight out of northeast baltimore. police investigating a murder in the 4700 block of glen arm road. they found a man dead around 7:30 tonight. they have not said how he died. >> and 9-year-old boy is being called a hero tonight. after he was shot while trying to protect his grandmother. myranda stephens is live outside of baltimore city police headquarters with more on the heroic story. myranda? >> well, jennifer, to learn about anyone taking a bullet that may have been intended for somebody else is already amazing. but to then learn that person, is a 9-year-old boy, is pretty incredible. >> i mean, this is a wild neighborhood in some case. >> brett woodard lives two homes down from the home on north he will mont street in south baltimore where a 9-year-old boy was shot. >> for something like this to happen. somebody runs into your house and doing that? ( ding ) book now at southwest.com. >> more than half of the united states still faces wide spread swine flu outbreaks according to the centers for disease control. a few weeks ago, almost every state faced wide spread outbreaks. now the virus seems to have receded a bit. with 32 states, the ones in red. and maryland is one of them. still reporting wide spread flu activity. now even though flu activity has been decreasing for the past four weeks, it remains high for this time of year. and even though the spread of the h1n1 virus appears to be slowing, it does remain deadly. during the week of november 15, 2007 children died from the swine flu. and there is a new complication developing. karen parks joins us with more information about the drug resistance that doctors are seeing in some patients. karen? >> number one medicine frequently prescribed for h1n1. and the seasonal flu. but for two patients here in maryland, it just didn't work. >> these are my grandchildren. >> as the h1n1 season continues, kevin and amber get their shots. >> i want to keep them healthy and safe is, when they go to school they don't, you know, pass the flu around. >> today in arundel county it is one of three clinics for h1n1 vaccines were offered. >> i know it keeps the kids safe. and i love my son to pieces, he is all of my life. >> clinics fall on the day when the state health department announces two cases of resistance to tamiflu, the most frequently prescribed medicine. first a sample sent to the lab where it shows the patient was not responding. >> second one identified by a astute clinician at the hospital that noticed that the individual was on tamiflu and did not appear to be responsive to it. >> health had secretary said these are two out of thousands of others, that responded well. however. >> you worry about whether or not the weapons that you have, to treat individuals who have this disease, begin to weaken. >> and back at the clinic. >> at this point i would rather take that chance. >> you have to take chances. i am confident that they will be fine. it is better to be safe than sorry. >> despite being resistant to tamiflu, both patients survived. more than 50 resistant cases reported since april, including 21 in the u.s. u.s. >> debate continues in the senate over the very costly health care measure. democrats and the aarp are now in favor of $460 billion in medicare cuts. senior citizens lobbying organization said the cuts could pay for the legislation but republicans say that's a bad idea. >> paid all of their working lives into the medicare trust fund and now in danger of having $483 billion cut out of it. which would eventually lead to rationing of health care. >> meanwhile, the white house budget director warns it could take decades to see major changes even if congress passes a bill. >> and new concerns tonight about health care reform. critics claim it would force younger people to pay the premiums for older citizen. is it social responsibility? ( ding ) book now at southwest.com. ♪ tell me who's watching. ♪ i always feel like somebody's watching me. ♪ (announcer) it's right here. it's easy. ♪ i always feel like somebody's watching me. ♪ it's the money you could be saving with geico. >> good evening folks. looking at heavy rainfall making the way through maryland. and continue to see the shower activity over the next several hours. in fact, going right to the hd skycam. looking downtown. this kind of hazy mystical view here. looking at the drops on the lens. it looks like we will continue to see that shower activity coming down with that little mist and fog, and rain. it will be kind of a nasty night. and camera is jiggling because the winds are decent out at 14. and this is a factor here. temperatures are actually increasing over the next couple of hours, getting into the lower 60s as a warm front pushes up out of the south. area of low pressure over the midwest, and also have the colder air back to the northwest. that will be joining us this weekend. so a lot of activity out there to work with. as we see the activity pushing through the state. in fact, looking at the temperatures. wide distance of what the temperatures are. looking at 61 in richmond. so the warmer air is pushing up out of the south. 57 in baltimore. 54 in harrisburg. 51 in pittsburg. then temperatures drop off as you get toward indianapolis, chicago. down to the 30s. this is what is waiting for us. this colder air is moving in behind the area of low pressure. here is what is happening right now on the bigger picture. warmer air moving up ahead of the area of low pressure. and creating instability in the atmosphere. and seeing showers and is thunderstorms moving along the front. and then back west we're still seeing another wedge of rain that probably gets through later tonight, around one or 2:00 in the morning. we will see that line. and then things breakup as the low travels more north. the danger with the storm is that we have the warm temperatures coming up out of the south. and then we have this slow level sheer overriding it. and that creates rotation so actually seeing rotating in some of the thunderstorms, as they are crossing the bay. that's why there is a tornado watch out from the national weather service over parts of virginia, down toward norfolk and richmond. and over towards worcester county. until 4 a.m. as the strongest storms push east. so we have to kind of keep an eye out for that, for the central portion of the state. in the form of rain mainly. and flood watch until 7 a.m. because we could see anywhere from an inch to 2 inches of rain coming down across the area, as we see that activity pushing in. now it looks like the heavier amounts are to the south. around our neck of the woods, looking for an inch, inch and a quarter through the overnight. and once again what is causing it is this area of low pressure. ahead of it the warm front. and temperatures dropping through tomorrow. and colder air comes in behind it. joins us toward friday, saturday, sunday. and high pressure is right behind that. that means we will get clearing with this. but none of less, it will be a chilly one as we get toward the week. so rain leaves us by tomorrow. and we will see the clouds breaking mid-morning, afternoon. with sunshine. 61 with temperatures falling through the afternoon. and winds out of the west at 15 to 20. and your five-day forecast. shows much different temperatures by friday. 48, with partly sunny skies. looking at rain, maybe a chance for snow. on saturday. and looking at 40 degrees. and then on sunday looking at 45. clear skies. monday 47 with plenty of sunshine. fox 45 sky watch weather is at your fingertips. i-radar is available at foxbaltimore.com. you can use fox 45 powerful doppler radar, to track coming storms. interactive tools lets you see when rain or snow is over your house. go to foxbaltimore.com/i-radar. >> more charges tonight for the man accused of opening fire at fort hood last month. army has now charged major malik nadal hasan with 32 counts of attempted premeditated murder. charges are for the 30 soldiers and civilians injured in the deadly rampage. major malik nadal hasan also faces murder charges. and tried in a military court. >> less than a week after tiger's accident, he said he let down his family. he said i have not been true to my values. it came after us magazine alleged a cocktail waitress had an affair with him. and she said she has the evidence to prove it. >> hey, it is tiger. i need you to do me a huge favor. can you, please, take your name off your phone. my wife went through my phone and may be calling you. >> the 24-year-old said her affair with tiger woods began back in april of 2007. >> the results are in tonight. google is announcing the most popular search of 2009. >> judy kurtz reveals who is number one in tonight's "word on the web". judy?
