talking about an accident on the beltway this morning. it's a crash on the inner loop lanes, it's at wilkens avenue. you can see the activity right here. they're trying to clear this one out pretty quickly. as for the delay, there's a little bit of a slow down as people look over at the actual scene. that is the look at the inner loop lanes as for the outer loop direction, from 795, to 95, that's an easy drive, right now 11 minutes, 55 miles per hour. nothing to get in the way on 95, the southbound lanes from the fort knack henr mchenry tunnel,s and southbound miles per hour. the harbor tunnel all the way toward 95, 9 minutes at 54 miles per hour there. that's a look at the morning travels, patrice, back over to you. president barack obama will address the nation about the massive oil spill at the gulf of mexico. he is returning from his 4th trip of the region. three members of the maryland's congressional delegation are also getting back. megan gilliland with hor on how these leaders are going to hold bp accountable. >> reporter: this is a live look at the mace sieve oi massin the gulf of mexico. up until last woke week some of maryland's lawmakers had only seen these images now they have a firsthand look at the smells. mulma cullmikulski and cummingso the area. they say the area impacted is as big as the region from ocean city, new jersey to richmond, virginia. mikulski has been assured that the maryland sea industr seafooy and its shores won't be impacted. bp has caused the problem. they have the capacity to respond. what government has to do is assure that the response is timely. >> reporter: bp has agreed to set up a compensation fund for the people along the coast. the oil giant says that the cost for the spill has reached $1.6 billion and that's a number that is expected to rise with the countless numbers of lawsuits filed against bp. newly released bp documents show that six days before all of this happened an engineer with the company called it a nightmare well. tonight could bring more answers with what the leaders are planning to do from here. when the president addresses the nation you can watch the speech live at 8:00 p.m. here on fox around 3:00 this morning on falls way drive. police say they found a plastic bottle filled with black powder, bbs and a fuse. the bomb did not detonate and no one was injured. we will continue to bring you the latest on this story as it becomes available. to his family and friends he is being remembered as a marine who served his country well. to many others his death has become a lightning rad with how city police handle confrontation. joel d smith is live for today's viewing of tyrone brown. the man shot 12 times by a baltimore city police officer last weekend. good morning, joel. >> reporter: good morning, patrice. brown's viewing actually starts around 8:30 and goes almost all day. a lot of time for family and friends to come here and pay their respects. they have been paying attention to how everything is being handled bit polic department. now they're happy that someone has been apprehended. tshamba has been charged with first-degree murder. he finally turned him self in after being in hiding for the first few days. his attorney addressed the first three murder charges saying tshamba was acting in self-defense. the witnesses say that the officer was off-duty when a female friend got up after being groped by tyrone brown. that is when tshamba identified himself as an officer and confronted brown. it seems that what actually happened during that confrontation, the specific will be the key to the case. >> 13 shots were fired to this victim, and that is even against our training. >> a police officer in fear of his life has to do what he has to do to preserve his life. if one shot doesn't work and two don't work, and 3, 4, and 5. if they don't work, you fire until the threat is gone. >> reporter: if found guilty t shm ba coultshamba could faceh penalty. tyrone brown family members were grateful the charges came so quickly. the viewing will be here today and the actual wake is tomorrow at morgan state university. joel d smith, fox 45 morning news. police make two arrests in the killing of an off-duty maryland state trooper and the key suspect is being held in baltimore. williams is in the city lock up because he was wanted on a violation of probation charge. williams and his friend anthony milton are both charges with murdering wesley brown. it's williams in surveillance photo. brown escorted williams out of an applebee for not paying his bill. an hour later, brown was gunned down in the parking lot. milton admitted that they returned to the scene and fired the fatal shot. the trooper friends want the gunmen held responsible. >> he can get hive in prison. as long as he doesn't see the life of day, i'm fine. i don't want him to enjoy walking the streets anymore because wesley won't not again. both suspects have extensive criminal records. the person shot inside of his car last monday in southeast baltimore works for the u.s. sensus. it happened new year hope circle, a car ran into that sign. spencer williams was found in the vehicle shot several times. he died on sunday. he was returning home after dropping off a co-worker at the end of the day. and the they say that his work is not related to his work with the census. players and fans at last night's san diego padres' game got more than just baseball. >> we're experiencing a tremor, an earthquake at the ballpark in san diego and it's very significant. >> a 5.7 ma magnitude earthquake shook the padre earthquak stadir everybody to see it. the quake could be felt as far as los angeles. fortunately, there were no reports of significant damage. the orioles are on the west coast for a series against the san francisco giants. they were safe from the earthquake but they lost again last night 10-2. a federal committee upholds the current policy preventing gay men from donating blood. the 9-6 vote to keep the ban goes to the fda which has the final say. some say the ban discriminates against gay. the red cross says the ban should be lifted. >> the testing for hiv, hepatitis and a number of other viruses is so good nowadays that after a year we have a good belt and suspender mechanism to test both for the anti body itself and the virus in someone's blood stream. with northerly flow today. 73 degrees in baltimore and 71 in salisbury and the same for hagerstown. the temperatures do not climb a whole lot. the stationary boundary has been to the south and out of our way. it's allowing for the cooler air to move in today. it will feel better with drier conditions before the showers move in terms of moisture. again, the humidity value is not high. the warm front will return further points north by later tomorrow and then the cold front follows bringing us shower chances overnight tonight and then the thunderstorm chances really increase as the cold front follows tomorrow. then we dry out behind that front as high pressure builds in. here is what you can expect door food. if you're in the eastern shore, 78 degrees for high, definitely cooler than it has been. 10-20-mile-an-hour wind for the central part of the state. a chance for a stray shower but the better chance comes later tonight, with a northeast wind at 5-15 miles per hour. further point west, looking at a high temperature of 81 degrees with a chance of thunderstorm, northeast winds at 5-10 miles per hour. as we move through the day, 78 degrees at noon, topping ought at 82 about 3 to 5:00 afternoon and the evening, and at 6:00 p.m., could be a light shower in between but the better chance of showers and thunderstorms comes later tonight and 66 for the overnight low. tomorrow early showers and afternoon thunderstorms, 83 for the high is still cool. 87 on thursday, mostly clear, 89 and clear on friday, and then temperatures and 90s saturday and sunday as the humidity dropped 10 inches of rain, it flooded homes and washed out roads. another two inns of rain is -- inches of rain is expected today. sandra endo reports on the recovery efforts. >> reporter: once the water receded yesterday, this is what many oklahoma residents came back to, water logged homes. the owner of this home said he came back and waited through chest deep water to get to his wife and son. now he is throwing out damaged clothing and insulation and drywall. for hours 10 inches of rain fell leaving residents caught off-guard. roads and cars and even entire neighborhoods submerged in water. the teenage girl was clinging to trees at the fast moving water surrounded her. >> the currents got stronger and the water got deeper. >> reporter: they pulled her to safety after what she says was a two hour struggle to survive. >> i was shaking really bad when i was swimming and i thought i was going to pass out and i thought i was going to die. >> reporter: the storms caused flash floods leaving thousands without power and many injured. the state of emergency has been declared in 59 of oklahoma's 77 counties. authorities are urging people not to drive through water covered roads. >> at one point in time, we had almost two dozen calls of people that were trapped in vehicles due to high water and at least half of those were considered high priority requiring immediate rescue. >> reporter: some residents say they didn't think they would ever need flood insurance. >> this area hasn't flooded in about 20 years or more. with our retaining wall that we had, we thought we were safe, but it was a big mistake. >> reporter: residents aren't in the clear yet, a severe thunderstorm watch remains in effect in parts of oklahoma today and a flash-flood watch is extended through and temperatures will climb today. it will be in the 90s, and that is why the humidity will drop a little bit, too. that should be welcomed. take a look at where we start. we are at 73 degrees, and d.c. the same and the same in salisbury and the same in hagerstown. definitely warm with the low 70s but we are climbing into the low 80s today. a couple of showers moving into the western most counties. we will see a couple of scattered showers into the afternoon for the rest of us. a better chance of thunderstorms comes tonight as the frontal boundary approaches. that will be with us for tomorrow, too. 82 degrees for the high, definitely cooler with an northeast wind at 5-15 miles per hour. now with regard to what is happening on the roadways and your commute this morning, candace dold is here with the traffic edge. >> reporter: we are checking in on the roadways and looking at 95 for you. it's starting to accumulate with the volume on the northbound and southbound lanes of the without bail. he is accused of killing a former marine outside of a baltimore nightclub. their confrontation resulted in tyrone brown being shot 12 times. joel d smith is at the match funeral home for brown's viewing. this all comes a day after the officer's attorney claims it was just self-defense. probably not what the people coming to the viewing want to hear this morning. >> reporter: not really but they are glad that this process is moving guard. we are here at the marsh funeral home where the viewing takes place from 8:00 this morning to tonight. as you said a lot of those people will still be talking about who killed him as well. the shots fired by officer tshamba. look at what happened in the aftermath of that. he has been charged with first-degree murder. it took him a while to turn himself here. yesterday his attorney addressed the first-degree murder charge saying that tshamba was acting on self-defense. a fe female friend was groped by brown. the officer's attorney claims there's more to the story than police are sharing. >> he is being served up on a silver platter. i think the police department is using him as purell to say we're using him to wash our hands of all of the other misdeeds of anything else that the officer has done in the past. they are using him to credit with the public. >> reporter: blown' brown's fy was critical of brown taking so long to turn himself in. the attorney said he was afraid for his safety. trial will begin soon. if found guilty, tshamba could face the death penalty. the wake is today here at the funeral wake, and the funeral is tomorrow. retailers in baltimore are standing together against a proposed bottle tax. at a rally those opposed came together at a the supermarket. it would ad amount to tra costs their business -- extra costs that their businesses can't afford. >> we are in the middle section and the middle people, just like a lot of folks in the middle-class are feeling that crunch. >> the city council is considering the tax as a way to help close the 121 merchandise deficit. while debate over the bottle tax continues, the city council did give approval to other tax hikes and fees. some of those include raising the parking tax, the hotel tax and an energy tax. >> we have to raise these fees and these taxes or else you are going to see rec centers closed. you are going to see police lese officers and firefighters on the street. >> the council approved a tax on vacant properties, outdoor advertising and telecommunications, meaning your cable bill could go up. the council also gave preliminary approval to a proposal that will drastically reduce pension pay outs for police and firefighters. it would increase the retirement age for few you ar future hires. they clean na they will be affected. >> they are not looking at lessening the impact of our pension system. they are looking to strip benefits away. >> the unions have already filed a lawsuit to stop the changes. what would shot of the hunt valley golf club on this tuesday morning as we take a look at a place where i would spend a slot -- a lot of time looking for my ball in the waterment let' wate. let's take a look at what is happening on the hd radar. we're not talking about rain at this time but we may be talking about later today and overnight tonight into tomorrow. let's take a look at the sky hd radar as you put things into motion, you had showers moving to the south as you move east. back to the west, a couple showers moving in now. we will talk about increasing chances overnight tonight as a front moves from the west. city degrees is the temperature at the inner harbor. mostly cloudy skies and 76% relative humidity. 29.98 and rising, 65 degrees is the dew point so for the time being still a little bit humid but that value should drop a little bit through the day. 73 degrees is the temperature at baltimore and d.c. we got a couple of 71, and oakland cooler at 63 degrees, but again, these temperatures won't climb as much as they have. stationary boundary again to the south is going to allow for cooler air to move in from the north and east. that cooler air is going to be bringing us a little bit drier conditions, too. the humidity value should drop a little bit, too. the stationary front sags to the south around the virginia, north carolina border until it moves to the north now and it begins to bring us shower chances for later in the day. i think the best chance as they said will be overnight tonight as the warm front approaches and into tomorrow morning the cold front advances. that cold front could bring us thunderstorms that could be on the strong side in isolated locations tomorrow afternoon and evening especially. behind that, we dry out nicely as high pressure builds in and we shape up pretty well for the end of the week. 78 degrees should do it for the high today. obviously much cooler than yesterday when we got to 90s. the central part of the state, we expect to see temperatures climb to 82 degrees and also that chance for a shower in the afternoon. east northeast winds at 5-15 miles per hour. back to west, a high temperature of 81, a chance for a shower or thunderstorm there. as we move through the day today, 78 degrees at noon, and 76 after getting to the high in the afternoon at 3 or 5 this afternoon. that could be the shower around. tonight a better chance of showers and thunderstorms overnight. 66 degrees for the overnight low, morning showers tomorrow followed by thunderstorms with a high of 83. we stay cool and 87 degrees, warmer on tuesday but the humidity still not a huge deal. mostly clear skies and the humidity starts to climb later on friday, a high of 89 with sunny skies. mostly sunny on saturday and the humidity impacted whitemarsh. we definitely have a lot of cars there, but then it's 62 miles per on 95 traveling at 395. we do need to talk about the beltway, though. we have been monitoring conditions, we can show you what it looks like on the inner loop lanes right at wilkins avenue. we had an earlier accident. there's one vehicle there and a few cones. so it at least grab your attention, but as far as the volume, it's just reduced speeds there. no significant back-ups as of right now. pretty much the same conditions, both the inner and outer loop stretch. let's check out the beltway farther up moving at frederick road this morning. that is going to be a breeze on the outer and inner loop lanes up toward the triple bridges. further up on the top end of the beltway, we are in the green traveling from 795, near reisterstown road through greenspring avenue and eventually up toward the 83. speaking of 83, let's check it out, just above the beltway, it's going to be a beautiful picture there, facing charges in connection with james privot. a 3rd man was found guilty last year. the man convicted of shooting a little girl in the head during a street gun battle last summer will learn his fate today. sentencing for lamont davis is scheduled for morning. dah vis wadavis was convicted ad murder after he shot wyatt in the head. he faces up to 61 years in prison. bail is denied for a police officer who is accused of shooting a marine 12 times. officer t sh tshamba is chargedh first-degree murder and will stay behind bars until his trial. the first-degree murder trial makes this the. we take a look at the closer look at the death penalty. >> the reason this is being considered is because this is a first-degree murder case? >> that's right, because you can't seek the death penalty unless you are being charged with first-degree murder. that is the only reason. >> do the circumstances rise to the level that he would be convicted and given the death penalty. >> certainly that remains to be seen. we don't know what all the evidence is. at the first, look, i would say no. there's a certain number of staturstature tory requirementst is called aggravated circumstances. >> what is an example. >> for example, you have committed first-degree murder and have killed more than one person or in the commission of a violent crime. they are stature forly set forth. the state has to demonstrate there's dna evidence connecting him to the crime a video confession. if it's relying on eyewitness testimony, no death penalty. >> his lawyer says this is self-defense. how could he argue that? >> certainly the defense is going to do anything they can to plant in a seed in the potential juror's mind this doesn't warrant a first-degree murder conviction. the etcredibilit credibility is. it doesn't take 12 bullets to neutralize a person. >> he is charged with first-degree murder but could he actually be convicted of something lesser than that. >> second-degree murder. i think it's unlikely, but possibly manslaughter and a defense attorney is going to work and that is what is going to happen if there's a conviction. the circumstances, thus far don't seem to merit a first degree pretty busy out there, so far no significant delays. we like that. inner and outer loop lanes, again, just a lot of volume that you will have to deal with. so from 95, all the way down toward 83, it's a 12-minute ride. 51 miles per hour, things look much better traveling through baltimore, though. the southbound lanes of the 95 and the fort mchenry tunnel around the beltway, 8 minutes at bief mile55 miles per hour and a southbound 895, from the harbor tunnel all the way down toward 95. that's a look at the morning travels, patrice, let's turn it over to you. president barack obama will address the nation tonight about the massive oil desaster in the gulf. he is returning from his 4th trip to the region and he is not the only one checking things out in person. three members of maryland's congressional delegation are getting back. megan gilliland is live with more on how these members will hold bp accountable. >> reporter: this is a live look at the spill spill pushing -- oil spill gushing into the gulf of mexico. now the maryland lawmakers have had a first account of the sights and even the showndz of what asounds ofwhat they call al desaster. barbara mikulski, and ben cardin, and elijah cummings got back from the gulf. they say it could take another two months before it's contained. the area impacted as as big as the region from ocean city, new jersey to richmond, virginia. mikulski has been assured that the maryland seafood industry nor its beaches will be impacted. bp oil must be held fully accountable. >> it would be outrageous for any government bail out of bp oil. they're the ones that caused this problem. they have the capacity to respond. what government has to do is make sure that response is timely. >> the white house says that bp has agreed to set up a compensation fund for people along the gulf coast. the oil giant says cost for the spill has reached $1.6 billion. that's a number that is expected to rise with the countless number of lawsuits filed against bp. nearly released bp documents show that just six days before all of this happened, an engineer with the company called it quote, a nightmare well. tonight a could bring more answers to what our leaders are planning to do from here when the president addresses the nation. you can watch his speech live at 8:00 p.m. here on fox 45. megan gilliland, fox 45 morning news. to his family and friends, tyrone brown is being remembered as a marine who served his country well. to many others, his death has become a lightning rod for how city police handle confrontation. joel d smith is live at baltimore for the viewing held for the man who was shot by police officer last weekend. >> reporter: a lot of time up until 7:45 tonight for people to come here and pay their respects for tyrone brown the exmarine they're talking about. they're going to talk about the person who ended up killing him. that is officer tshamba who is being held in prison for first-degree murder. police and witnesses say the officer was off-duty on june 5th when a female friend got upset after being groped by brown. that is when tshamba identified himself as a police officer and confronted brown. a confrontation that resulted in brown dead. what happened in that confrontation is what is being disputed. >> 13 shots is even against our training. >> a police officer in fear of his life has to do what he has to do to preserve his life. in one shot doesn't work, and if they don't work, you fire until the threat is gone. >> reporter: if found guilty tshamba could face the death penalty. as a vigil the past weekend, family members of brown are grateful that the charges came so quickly. many are at the viewing today and the funeral is at morgan state university tomorrow. baltimore. we're in the low 70s all over. it's not going to climb a whole lot from here with the stationary boundary to the south. it's allowing more northerly winds in that will keep us cooler today. it will allow for drier air to move in to less humid too. the frontal boundary is going to return as a warm front as we move through the day. look for it through tonight and into the early morning when we could have showers and maybe even thunderstorms, but the increasing chances of thunderstorms comes with this, the cold front that follows for tomorrow afternoon and into the evening hours around 5:00 you saw there prime time for some of those showers and thunderstorms. behind this, drier air and we look a whole lot better by the time we get to thursday and friday. today, 75 degrees is all for the eastern temperature. and could see an isolated shower but 82 degrees should do it for the high temperature here. a 5-15-mile-an-hour wind. 81 with a better chance of a thunderstorm and generally we're looking at increasing chances for the showers for the afternoon but more so tonight, overnight. 78 for noon as the temperature, and 78 degrees for 6:00 p.m. after getting to the high completely shutting down 35th street at old york road. you will want to use 34th street. we also have utility work that shuts down two lanes of southbound harford road after hamilton avenue. a busy area there so avoid all of the activity, you will want to use bel air road as the alternate route. on 95, this morning, checking it out near the stadiums at 395 the coast is clear, we're loving this ride in both directions in fact. it's up to speed. 95 through baltimore county, we have seen our fair share of volume and that continues to be the case. so reduced speeds there from whitemarsh all the oklahoma where people are cleaning up this morning and even bracing for more rain. good morning, sandra. >> reporter: that's right, patrice. after the water receded this is what many residents came to water logged homes. the owner of this home said he had to wade through waste deep water to get to his wife and son. now he is throwing away ruined clothing is insulation soaked in water and drywall as well. almost 10 inches of rain came through this area and a lot of residents were caught off-guard. even entire neighborhoods submerged in water. this teenage girl was clinging to trees as the fast moving water surrounded her. >> the current water got stronger and the water got deeper. >> reporter: they pulled her to safety after what she says was a 2 hour struggle to survive. >> i started shaking while i was swimming and i thought i was going to pass out and i thought i was going to die. >> reporter: the severe storms caused flash floods leaching thousands without power and many injured. a state of emergency has been declared in 59 of oklahoma 77 counties. authorities are urging people not to drive through water covered roads. >> at one point in time we had almost 2 dozen calls of people that were trapped in vehicles due to high water and at least half of those were considered high priority requiring immediate rescue. >> some residents said they never thought they would need flood insurance. >> this area has not flooded in about 20 years or more. with the retain tanning wall we- retaining wall we had, we thought we were safe but it was a big mistake. >> reporter: oklahoma city residents aren't in the clear yet. a severe thunderstorm watch remains in effect through parts of the state today as well as a flash-flood watch. that has been extended through later this morning. live in oklahoma city, i'm sandra endo. patrice, back you ons to sandra, what are the residents there doing. where are they staying now that the floods have come through especially the person that lives in the house behind you. >> reporter: luckily for him, he has friends that he is staying with as well. the red on cross is seeing on providing emergency shelter for the residents this morning at falls way drive at carafe ton. polic-- crofton. the bomb did not detonate and no one was injured. if you have any information about the device, you are asked to call 410222-tips. a baltimore police officer charged with first-degree murder is ordered held without bail. he accused of killing a former marine outside of a baltimore nightclub. their confrontation resulted in tyrone brown being shot 12 times. joel d smith is live at the funeral home for brown's viewing and this comes after the officer's attorney claims it was self-defense. >> reporter: interesting timing in all of this. it starts at 8:30 this morning. and it goes all day long. a lot of time for people to come and pay their respects to tyrone brown. because this happened yesterday, no doubt they will be talking about that as well. of course, we're talking about the shots fired from the gun of officer tshamba, a man you see right here. he is being held in prison without bail. yesterday for the first time his attorney addressed the first murder charge saying that tshamba was acting in self-defense. witnesses say that the officer was off-duty when a i female friend of his got upset after being groped by brown. that is when he identified himself as an officer and confronted brown, a confrontation that result ended 13 shots fired and brown dead. what happened during the confrontation will end up being thety tthe key to this case. >> i think the splee police gar- department is using him as p urell to earn credit with the public. >> it's a quick . >> reporter: if found guilty tshamba could face the death penalty. at a vigil this past weekend, family members were happy that had happened so quickly. the viewing goes until 7:45 tonight and the wake is tomorrow at morgan state university. we're live at northeast baltimore, jolt d smith joel d . fox 45 morning news. police make two arrests and the key suspect is being held in baltimore. williams is in the city lock up because he wanted on a violation of probation charge. williams and his friend anthony milton are both charged with murdering trooper wesley brown. they say trooper brown escorted williams out of an applebee's restaurant for not paying his bill. half an hour later, brown was gunned down in the parking lot. milton has admitted that they returned to the scene and fired the fatal shots. now what suspect pulled the trigger is not clear, but the trooper's friends want the gunmen held responsible. >> as long as he doesn't see the light of day, i'm fine. i don't ever want him enjoying walking these streets anymore because wesley will never be able to. >> both suspects have extensive criminal records. grocers and retailers in baltimore are standing together against a proposed bottle tax. at a rally in northeast baltimore yesterday those opposed to the tax came together at the buy right supermarket. they say the 4-cent tax added to bottle drinks will amount to extra costs their businesses cannot afford. >> we are not large so we don't get any of the benefits that very large grocers get nor are we very, very small. we're in the middle section and the middle people just like a lot of folks in the middle-class are feeling that front. >> the city council is considering the tax as a way to help close the $120 million deficit. while the debate over the bottle tax continues, the city council did give approval to other several tax hikes and fees. some of those include raising the parking tax, the hotel tax and energy tax. >> we are to raise these fees and these tax or else you will see rec centers closed. you will see less police officers and firefighters on the streets. so we have to do it. >> the council also approved a tax on vacant properties, outdoor advertising and telecommunications, meaning your cable bill could go up. a federal committee upholds the current policy of preventing gay men from donating blood. the 9-6 vote to keep the ban goes to the fda which has the final say. some say that the ban discriminates against gays. the red cross says the ban should be lifted. >> the testing for hiv and help diets and other viruses is so well that after a year for governor is starting to get interesting. the latest rasmussen poll shows o'malley and ehrlich in dead heat with 45% each. since february ehrlich has made slow steady gains while o'malley has been on the decline. kurt anderson and pat mcdonough join us today for the spotlight. >> good morning, gentlemen. >> is it too early in the campaign to say they're in a dead heat. the election is still a ways off. how significant is this? >> i don't think it's anything unexpected. the last time pat and i viewed at this particular question. pat and i agreed that there's 45% of the vote who will always vote for ehrlich and 45% who is going to vote for martin o'malley. the question is how about the last 10%. they're the ones that are going to swing this election. >> but it didn't start this way, since we asked the question last time. governor o'malley was well in the lead with 50%. >> you have to go back historically for all of the elections for governor, the last three, and with ehrlich and you will see that there's a very small percentage of folks that swing the entire election. i think those percentage of folks are in baltimore county. >> delegate mcdonough, let's bring you into this. is this significant or is it normal fluctuation. >> it's a significant, but i agree with kurt that baltimore county is going to play a role particularly my district. for any governor to be below by percent, we understand that's a problem, that's bad territory for an incumbent governor. secondly, ehrlich has steadily increased despite a great deal of criticism by o'malley sources, which was early paid radio advertising and during that period of time, ehrlich has increased. these are not good signs for governor o'malley. this is going to definitely help governor ehrlich's fundraising. there's no question about it. this indicates that he is moving in the right direction and o'malley is moving in the wrong direction. >> what is it that former governor ehrlich is doing right and how does he keep that momentum. >> let's be fair about it. there's antio'malley, and antidemocrats just as george bush harmed the republican brand. obama is harming the democrat brand. there's a lot of negative talk and ehrlich is benefiting from that, but in addition to that, he has said he has new ideas including small business and the economy which is important to people. >> delegate anderson, i think you want to get in on this. what does governor o'malley have to do to pick up some speed? a a lot of it depends on what happens in the country with our economy in the future. right now the economy seems to be leveling off. it's not getting any worse and there's some indicators that say it's getting better. if that happens, i think that o'malley probably will win the raise handily. but he still has to do all of the other things that -- >> like what? n he has got to campaign and get out and knock on doors and kiss babies and go to the various fares, and get his commercials and campaign together. >> he has the share of the money. can he spend more to do that campaigning. >> right now it's early in terms of spending money. you usually want to spend money on things that will hit the vote voters just before the voters go to vote. >> all right. >> in this particular case you want to spend the machiney probably not until october or so. >> i want to mention, as i said before, patrice, he has toward 83. we're in the green with a lengthy 24-minute ride at 25 miles per hour. but then, doing much better through baltimore. southbound 95 from the noter fot mchenry tunnel, 54 miles per hour with a 9-minute drive on southbound 895 from the harbor tunnel all the way toward 95. that's a look at your morning travels, patrice and megan, bako over t-- back over to you. president barack obama will address the nation tonight about the massive oil desaster here in the gulf. you can see the oil still gushing out there. he is returning from his 4th trip to the region and he is not the only one. three members of the maryland delegation made the trip, barbara mikulski, and ben cardin and elijah cummings say that i it could take two months before it's contained. the area impacted is the area between occasion city, new jersey, and richmond, virginia. as estimates continue to skyrocket, they say bp oil must be held fully accountable. >> it would be outrageous for any government to bail out bp oil. they're the ones that caused this problem. they have the capacity to respond. what government has to make sure is that response is timely. >> the white house says bp has agreed to set p a compensation fund for people along the gulf coast there. the oil giant says costs for the spill has reached $1.6 billion. a number that is expected to rise with the countless number of lawsuits filed against bp. again, the president will address this issue tonight. you can watch his speech live at 8:00 p.m. right here on fox 45. police discover an explosive device at a home in anne arundel county overnight. it happened around 3:00 this morning at fall ways drive at crofton. police say they found a plastic bottle filled with black powder, bbs and a fuse. the bomb did not detonate and no one was injured, but if you have information about the device, call 410-222-tips. to his family and friends tyrone brown is being remembered as a marine who served his country. to others, his death has become a lightning rod of you on the police handles con forgotten co. >> reporter: good morning, joel. >> good morning, megan, and technically the viewing begins at 8:30. i was inside talking with funeral home personnel. they're open right now in case someone wants to come by and pay their respects. they don't expect brown's family to be here until this afternoon. whoever is going to be here, they will be talking about the murder charges against the man accused of can go brown. -- killing brown. tshamba is being held in prison without bay. for the first time his attorney addressed the first-degree murder charges saying that tshamba was acting in self-defense. witness say the 15 year veteran of the force was off-duty when a female friend got upset after being groped by brown. he identified himself as an officer and confronted brown, confrontation that ended up with 13 shots being fired, 12 hit brown and he died. what actually happened during the confrontation, the specifics will end up being the key to this case. >> 13 shots were fired to this victim and that is even against our training. >> a police officer in fear of his life has to what he has to do to preserve his life. in one shot doesn't work, if they don't work, you fire until the threat is gone. >> reporter: if found guilty tshamba could face the death penalty. a vigil was held this weekend. family members of brown are grateful that charges have come to quickly in this case. once again at the marsh funeral home in east baltimore this is where the viewing has begun. the wake for tyrone brown is tomorrow at morgan state university. live in east baltimore, joel d smith, fox 45 morning news. police make two arrests in the killing of an of off-duty maryland state trooper and the key suspect is being held in baltimore. williams is in the city lock up because he was wanted on a violation of probation charge. williams and his friend anthony milton are both charges with murdering trooper wesley brown. williams is the one seen in the video photo. brown escorted him for not paying his bill. half an hour later brown was gunned down in the parking lot. charging documents say that the milton confessed that they returned to the scene and fired the fatal shots. who pulled the trigger is not clear but they want the men to be held responsible. >> as long as he doesn't see the light of day i'm fine. i di do not want him to enjoy walking the streets any wro, an, never again. >> both suspects have extensive criminal records. players and fans at last night's padres' game got more than just baseball. >> we are experiencing a tremor, an earthquake at the golf part in san diego examine it's very significant. >> a 5.7 magnitude earthquake shook the padres' stadium enough for everyone to feel t you can see the south polls and the light polls swaying back and forth. the quake could be felt as far away as los angeles. there's no reports of significant damage. the orioles were on the west coast for a series of the giantsment they were not affected by the earthquake but they did lose last night 10-2. police make a discovery at a dui checkpoint in virginia. they found this goat bound in the trurve trunk of a car. when they pulled up deputies heard noiseses and they admitted to carrying a goat in the trunk. the temperature in the trunk was 94 degrees. she was accused of animal abuse. she was released and is due in court next month. it's a coveted job that goes back centuries. the testers endure a grueling several rounds of testing. people came from all around the world to apply but in the >>the main sign you want to look for, is if you're not actually drinking enough water and your body starts sweating and you start getting confused. that's a big sign of heatstroke or heat exhaustion. you want to make sure you are drinking plenty of water beforehand, during the workout and afterwards to make sure you're cooling the water because temperatures are over 80 degrees and humidity is at 60% or higher. that is when you are running the high risk. >> you're are going to feel that. in addition to that, can you change your workout. if you're used to doing one thing what can you do instead? >> you want to make sure that you're toning down your exercises outside. your body cools down with the evaporation of sweat. when the humidity is at higher levels it's harder to cool down. to say, if i'm working out outside, i do a lot pile owe metric workout. >> while i'm standing in at one time. jump lungeing, instead of doing something like in those kind of temperatures, instead of a plyo lunge, i could a walking lunge instead of jumping up and putting more force into it. you want to make sure you are relaxing your body less. make sure you workout in the shade as well. >> what about running and when it's this hot outside. should you not do it at all? n if you have been running, you want to make sure you have been working out in an exercise program. if you have been, tone it down a little bit. if you're running for an hour straight, maybe you run maybe a half an hour and take the rest to a jog or a little bit of a walk. listen to your body. if you starting to get signs >> the answer to that is a resounding yes. there's compelling research evidence now that even individuals with a severe stroke can participate in regular cardiovascular style aerobic exercise on a treadmill at low speed with a harness support? and how -- >> sph addition we havin additid functional mobility exercises with italian health authorities and these sort of programs, these exercise classes appear to be very robust to improve function, including walking and balance. >> i was going to ask you, what is the benefits of those exercises but that sounds like that is at least some of them? >> well, there's a number of health benefits that come from structured and supervisorred exercise after stroke. the aerobic exercise training not only improves fitness and walking function, but it appears that we may be even able to reverse diabetes and the prediabetic state. our research studies now show that 3 out of every 4 strike survivors have a prediabetic includglucose tolerance and the aerobic training in six months appears to reverse this in over 46% of people. >> are there patients that benefit from these techniques or do you recommend it for all of your patients. >> one of the most common myths is that the game is over several months after the stroke. we know that is not true. these exercise programs can improve physical function and health even years out after a stroke. for any individual that still has walking and balance programs that are still present after they finish their conventional physical therapists, they should check with their doctor and therapists about getting involved in an exercise program to improve walking function even a decade after the stroke. the truth is, it's never too late to cart. start. >> you just made a lost people smile. thank you for joining us. great information this morning. >> if you would like more information log on to foxbaltimore.com/and click on your health matters. we have had hot and humid days, will we see any relief? meteorologist steve fertig is here with those answers. hi, steve. yes, in a word. we start off warm, guys. it's 70s out there this morning but it's only going to climb into the low 80s today. take a look at the sky hd radar and it looks good for now though there could be shower chances moving into the central part of the state later for the afternoon. seeing a few showers to the west but it's on the light side. we will talk about the chance of thunderstorms overnight tonight into tomorrow, more so. 76 degrees right now, mostly cloudy skies, not the prettiest looking day but it feels okay. northeast wind has pick up a little bit and the barometer is on the rise. dew point at 62, means still a little bit humid but the humidity value should drop through the day. 76 degrees is the temperature right now, the same for salisbury. definitely a warm start, 73 degrees for the start. it looks like with the temperatures we warm up quite a bit today but because we have the stationary boundary to the south and we're getting more of a northeasterly flow of air it's not going to warm as much. we get into the low 80s instead of the 90s we had recently and that frontal boundary as a stationary boundary to the south will return as a warm front. that will bring the warm temperatures back into the forecast later but not for a couple of days. ahead of, we will see a chance of showers not just later today but especially tonight into tomorrow. could be early morning showers tomorrow and as the coal front follows up -- the cold front follows up, we look for a chance of thunderstorms that could be on the strong tomorrow evening. behind that high pressure builds in is shapes up early for wednesday and 90. the humidity will return also as we get deeper into the weekend. 78 degrees for the high temperature in the eastern shore. a little breezy today but it will be a cooler breeze with the temperatures that climb to 82 for the central part of the state. again that chance for a shower already seeing some showers in the western part of maryland that could be a little thunder mixed in too, 80 degrees for the high. you will be closer to the stationary boundary. that's why the better chance of a shower or thunderstorm there. 70 degrees for the noontime temperature, we almost already at the noontime temperature. in between we will get to a temperature of 82 at 4:00 this afternoon. then a better chance of showers and even thunder possible as we drop to 66 degrees. tomorrow another cool day or really seasonal day compared to what we have seen as cooler, 83 degrees for the high and the thunderstorms moving through. behind it higher pressure will bring us a drier day. 89 on and sunny on friday. here comes the humidity and the heat, 89 degrees on saturday. the next one brings a thunderstorm chances on sunday afternoon and 89 and partly cloudy for your monday. fox 45 sky watch weather is available at your finger tips. i-aid rather is available at foxbaltimore.com at baltimore.com. you can use the powerful doppler radar to track incoming storms. go to foxbaltimore.com and click on i-ai iradar. we will take a look at what is happening on the roads. here is candace dold with the traffic edge. hi, candace. >> reporter: we do want to wrap up this commute. it's not been a fun one for many people out there. 30 miles per hour at catonsville and at 30 miles per how near liberty road. it's still going to be a sluggish ride. the top end of the beltway is a greated commute. this morning it was complicated even more because of an accident on the out loop lanes right at del a adulaney valley road. look at harford road, an annoying morning, a parking lot from harford road making that push all the way down nearing perring parkway. on 95, checking in through baltimore county on whitemarsh on the southbound lanes, we have had our fair share of delays. let's see how things are shaping up now. things eased up so this is a bright spot for us, both the northbound and southbound lanes toward beltway. as for 95, making the commute through baltimore, checkin checn at the fort mac mchenry tunnel there. northbound lanes is going to be an easy drive all wait up toward the toll plaza. that's a look at the roadways. family guy is in repeats for the season. family guy volume 8 is now on video starting today. it includes extended uncensored versions of the show. 20th century fox sent us copies to give away to you today? >> they are nanos and they're able to maneuver their way through the course. because of a loc lock motion, ly appear to be bouncing off the edges. >> kids will learn how that happens and thousan how they cap make it happen?
