baltimore city police officer is in a lot of trouble tonight after pulling his gun on an actor, at a haunted house. >> it all happened last night at the house of screams. east point mall. witnesses called 911, now the off duty cop is facing criminal charges. the city police officer was touring the haunted house with a friend and 9-year-old daughter. witnesses say he appeared to be drunk. but it wasn't until the end of the tour, that the actors became frightened. >> one of the actors was portraying a character from the texas chainsaw massacre movie. one of the final scenes, the actor then follows the visitors out the exit door. but last night, as the actor was heading back to the building, he said a man pointed a handgun at him. and he later learned, that man was off-duty city police sergeant eric janik. >> i shut the door behind me. as i shut the door, he came up and said he was a cop. but never showed id or nothing. >> some of the witnesses say he was intoxicated. and when our officers were dealing with him, towards the end, they said he seemed to be mildly intoxicated. speech slurred. attitude was not quite right for the nersness of the situation. >> baltimore county police responded and charged janik with assault. more charges pending. and he has been suspended from the city police department. we should mention that the chainsaw used as a prop does not have a chain or a blade on it. and when police questioned janik about the the incident, he said he knew it was just part of the show. the haunted house will reopen wednesday. >> a man is locked up tonight for a deadly hit-and-run but he does not face manslaughter charges. thomas meighan had a bail review hearing and the judge denied bail. police arrested him saturday. charged with 17 different traffic violations and prosecutors say more charges could be pending. >> when the case is under investigation, we don't reveal all the details that we do know. or the information or evidence that we have gathered. all we can say is that it is an open investigation. and we, don't comment, until official charges are filed. >> court documents indicate that the charges meighan faces are connected to several incidents over a five hour span, on october 16. that include the fatal hit and run of a johns hopkins students. student. >> new information about a deadly shooting in baltimore county. police identified a man shot to death in lansdown on sunday. 27-year-old tracy bowers was discovered in the 3000 block of bureau road. he died at saint agnes hospital. so far no suspects, nor a motive. >> the president declares a h1n1 emergency. and tonight, we have learned maryland state officials have made a record request for doses of the h1n1 vaccine. the state has asked the federal government for another 70,000 doses. meanwhile hospitals are taking precautions to stop the spread. tomorrow new visitors policy goes into effect at the university of maryland medical center. the hospital is trying to vaccinate staff members. who come into direct contact with h1n1 patients. >> want to make sure that we get our pregnant health care workers. because they themselves are at high-risk for complications. >> maryland has received 350,000 doses so far. but expects another 70,000 as early as wednesday. if you are still trying to get the h1n1 vaccine. there is a clinic scheduled this week is on the way. >> chief meteorologist vytas reid is here with a first look at the sky watch forecast. >> changes coming our way. sunshine out there. nice temperatures. decent day all and all. but get the umbrellas ready. some folks in virginia are hearing thunder right now. go to it. lightning date that, in the last hour, they say 10-to-15 lightning strikes around the northern suburbs of richmond virginia. so you can see decent cells moving along the system as it heads our direction. now look at where the rain is. you can see down around richmond. some heavy downpours of rain. continuing to move along 95 corridor. putting this in motion. you can see the shower activity working north. by tomorrow morning, probably get the activity starting to come down. around our area. probably late overnight tonight actually. so the ground should be wet. and you may run into showers for the morning commute. down south. more activity to work with. as that heads our way. so we will see decent rainfall for the next couple of days. here is how it plays out. cloudy skies tonight. showers move in for the morning commute. scattered rain. temperatures around 46 by the afternoon. still more rain showers. i will have a look at how long the rain sticks around and how much we could get, coming up in the seven-day forecast. >> okay vytas. governor o'malley supports a deal between constellation energy and a french firm with a caveat. the governor backs regulatory approval of constellation's bid to sell half of the nuclear operation to francis epd. only if the company agrees to a credit. one time credit. of $200 for bge customers. the governor wants constellation to help low income residents pay their utility bills. >> it is a baltimore non-profit with direct ties to city hall. and tonight there are calls for the baltimore city foundation to be audited by the city. it comes in light of a report which questions how the foundation spends its money. john rydell has more. >> baltimore's board of estimates approves city contracts and other major expenditures. but the city also receives a big financial boost from a relative obscure non-profit organization. it is called the baltimore city foundation. >> pretty sure i was vaguely aware of the existence of something called a baltimore city foundation. but i had never had any kind of briefing in how it was set up. >> the foundation was created 30 years ago. to help supplement public funding for programs like summer jobs for youth and smoke detectors for needy families. but the sun reports, some of the funds have been used to pay for other events. like activities connected to mayor sheila dixon's inauguration. >> how, if the foundation is set up such that who does have to 52 for it. >> we cannot give them building in this rough economy, people do other things with their money. if they are not confident in where the money is going. and it is going for the intended purpose. >> if an independent audit is conducted. it would likely examine whether some of the money ear marked for charitable causes was used instead to spend on on events considered political. that may be a violation of irs guidelines. >> so city council president stephanie rawlings-blake wants the city to conduct an independent audit of the foundation. >> the baltimore jewels, as far as the ice skating, all of that is a week of events, free to the public. >> the mayor said many corporations who funded inaugural activities, preferred to donate to the private foundation, since contributions are tax deductible but other officials want to ensure that the foundation has complied with state and federal law n baltimore, john rydell, fox 45 news "late edition". >> fox 45 contacted the office of lynwood ivy, president of the foundation, for comment, we were told he was not available. but ivy has told the sun, it is the city's responsibility to make sure that foundation money is being properly spent. >> teamwork is key naval personnel, at the florida base that he will never rush a decision to send troops anywhere into war. >> two northwest airlines pilots say they were going over schedules on their laptops. when their plane over flew their minneapolis destination by 150 miles last week. both claimed they did not fall asleep. but the question still being raised by aviation officials tonight is why the pilots did not respond to repeated efforts by air traffic control to contact them. >> one of six harvard medical school researchers that became very ill after drinking coffee laced with a toxin cannot see how it was ever accidental. the scientists immediately noticed a weird taste when he siped the espresso from a coffee maker near the laboratory. and within moments all six were dizzy and had a rapid heart rate. they are doing okay tonight. meantime harvard university police are investigating. >> new figures show the decline in u.s. newspaper circulation is getting even worse. experts blame the decrease on the availability of free internet news, and falling ad revenue. new report shows the average daily circulation dropped more than 10 percent between april and september. some newspapers are now considering charging people to view their articles online. >> rain clouds will soon be moving in. >> too bad. chief meteorologist vytas reid is here with the forecast. vytas, i liked today. >> simple and sweet. i like it. too bad. we are going to see showers building in through the late overnight hours. through tomorrow morning, into the afternoon. picks up a bit. right now, relatively quiet conditions out there around baltimore. hd skycam inner harbour shows nice quiet conditions. 53 degrees. few clouds starting to filter in. winds out of the east at six. and humidity levels at 83 percent. now those temperatures are going to be fluctuating as well. over the next couple of days. in fact, look at the temperatures right now across the region. 55 baltimore. 46 in harrisburg. cooler. and 53 in new york city. 47 in boston. down in richmond looking at 54. where they are actually seeing rumbles of thunder from thunderstorms making watt through some of the northern suburbs and that's a hint of things to come. as we look at some of the cloud cover moving here on the regional picture here. see some of the heavier downpour of activity. west of norfolk and over richmond. so heavy downpours of rain, and more beyond that in parts of the carolinas and that's heading our way for the first round. because there is another round behind that. so colors look. you can see how the showers are kind of picking up to the south of us. along i-95. and moves toward dc. and then in baltimore through late overnight tonight. and tomorrow morning. so roadways could be wet. and remember the leaves are coming down. so intersections and roadways could be slick, with combination of moisture, and the leaves. kind of causing bad accidents out there. so drive carefully tomorrow morning rush hour. future scan shows precipitation is building in. by the afternoon, looking at the timing of this activity through the area. as we get into the evening. i think. second storm builds in from the southwest. and overnight, on tuesday night to wednesday morning. that's probably when we get the brunt of the heavier downpours of precipitation. especially on the eastern shore. that is right now where the model data is showing some of the heaviest rainfall concentrated. in fact, looking at the future scan predicted rainfall. model data shows two, 2 and a quarter inches of rain toward salisbury, on the eastern shore. and in our neck of the woods, anywhere from half an inch to about three quarters of an inch of rain, all riding along the frontal boundary. we have a coastal low wrapping in moisture. and then the secondary low is riding along a front that actually drags up the gulf moisture. and that's where you get the heavier rain. wednesday night it is out of here. and high pressure builds in thursday and friday day. giving us drying conditions. rain tomorrow. and win out of the north at five. and five-day forecast shows 62 for the afternoon, with the showers through the morning into the afternoon. tapering off. and more sunshine thursday and friday. mid to upper 60s. and halloween, 68 degrees. and we have to deal with rain potentially around the area. jenkins said he doesn't think the public should have to support the bad guys. and in his words. so he wants inmates to do it themselves. jenkins wants to charge inmates $10 a day for time spent behind bars. he also wants to charge inmates for things like medical services, and geds. he said his plan could save the county $1 million a year in the least. >> now that brings us to the question of the day. should inmates be forced to pay for their time in jail? at last check, 70 percent say yes. 30 percent said no. on facebook, joe said, that is a great idea. the taxpayers are paying for those that
