city. it is the latest chapter in the legal fight for the city to try to win to get gambling in baltimore back on track. jayne miller has the story. >> with first reported about this legal fight three weeks ago. while the city and developers let it out in court, the slots commission itself says it is doubtful the group could ever show it has what it takes to hold a slots license. this late slot commission -- state's laws commission rejected the bid of the group in december. the group was the only bidder for the city site, just out of the football stadium. its bid was thrown out when it failed to pay nearly $20 million in licensing fees. they are appealing the decision, but an affidavit filed this week in court suggest that even if he prevails in his appeal, it is unlikely he could regain the commission's confidence. the affidavit says there is doubt as to whether bceg could demonstrate its qualifications to hold of slots license in baltimore. new mexico had moved to take away his gaming license their because of missed deadlines. the maryland affidavit says financial if permission does not yet established either the financial stability, integrity, and responsibility to find and sustain a viable facility in maryland with only 500 video lottery terminals. that is the number of slot machines listed in the original bid. talk of a bigger bid for 3700 machines never materialize. the state is now completing a background check because the one it had been doing was suspended when the bid was rejected. bceg was supposed to pay for the checks, but the affidavit says
