The latest motions filled by sacks claim that burfoot was entrapped by federal prosecutors. He asking for perjury charges to be thrown out. Heres why they feel that way. Burfoot was a defense witness during the bank of the commonwealth trial in 2013. Sacks says when burfoot took the stand under oath federal prosecutors cross examined him and asked him questions they knew he would lie about. Questions like has he ever taken a bribe, specifically did he take a 25,000 bribe which at the time had nothing to do with bank of the commonwealth trial. Burfoot of course answered no. Prosecutors are now using his oath against him. The feds say burfoot received at least 475 thousand dollars in bribes and kick backs during a four year period. They say he accepted the money and gifts in exchange for votes. They claim he also did accept 25 thousand dollars to give to an exgirlfriend. Sacks says since the federal prosecutors cornered burfoot on the stand the perjury charges should be thrown out. Burfoot is facing eight federal public corruption and perjury charges.
