Good evening. I hopefully will be brief because you have a lot of permits this evening. Wanted to update on couple things on legislative and policy. The first is i continued to and spent two hours last week meeting with [inaudible] and associates on trying to create best practice for sound studies. The two of you that were at the rdr Committee Meeting tonight know how important these sound studies are and having to speak to developers over and over about going back to the drawing board because they have done the least amount of work possibly opposed to what the commission is looking for is becoming a problem. Im work wg actually [inaudible] pauley as well to craft something that isnt per cryptive because i dont wantsomething that we can guide people and then get a really good product out of. As soon as i get something you can actually read, ill present it to the commission more formally and will want your feedback. It gets pretty technical, but so be it, you will do your best. Im learning so you can too. The other thing i wanted to make her the commission knows is we havewe were asked by the goldengate Restaurant Association a couple weeks ago whether we wanted to do a workshop on performing rights organizations. Those are the organizations in america, there are 3, bmi [inaudible] they are organizations that represent like song writers and host of complicated issues around copy write and paying out performers for their music and every year nigh businesses open and every year people get letters from these agencies telling them they have to pay license fees and think it is a scam and through these pieces apaper away and it gets to a opponent they were threatened with lawsuits so restaurantss and places of entertainment get these letter jz tried to bring these agencies together but long story short, the [inaudible] asked us, us being this commission as well as the Mayors Office of economic and Workforce Development to put together a wub workshop so they secured a attorney who can hopefully in easy english explain to the business operators who really dont understand music and song writing, nor should they, why this is legitimate and important and hopefully well record it and wont have to repeat it over and over. I got a [inaudible] at the main library, so you guys are invited to come, it is august 16th. I think we set from 2 30 to 4 30 probably wont be that long and will send out aswy get closer email invites. It is sort of interesting if you dont have a basic understanding you probably should because it does come up every year and any time a new business we are approached by all these agencies and dont understand why they are responding their money on. I want to [inaudible] summit which is october 3 and we are working on try to fill out content because we always want to be as relevant as possible so not prepared at the moment to tell you what it is all about but as we get closer we will make sure it is in your calendar if you are interested being involved in that. Way more important is this fellow sitting here, this is introduction to dylan rice and didnt bring his resume. I talked to you guys all most two years about hiring a employee to work on Outdoor Events and issues around amplifyed sound and isues around the trials and tribulations of producing a event in San Francisco. There is a Tiny Community event you dont have the money for any services or big one like pride. We finally got someone to work on this stuff and if you want to say a few words. This is my first meeting, pleasure and honor to be here and excited to work with the community of event producers and all the other stakeholders. I have a background in music. Im a singer and song writer and recording aal bms and tured and done Event Production in private and public spaces and my most recent gig is city of chicago cultural affairs. I did Music Industry development work. Yep, so he will be a great asset. He also brings zero baggage around San Francisco and all its ups and downs, which is great. We have someone who doesnt know who anyone is yet. Nobody screw that up. So, the last thing i want to say is when we publish this agenda there was nuther to report under corrective actions and dont have anything formal to report but oferk the weekend which is past the point of this agenda publication, there was a homicide in proximity to [inaudible] on geary street. We havent gotten paperwork because as you know the Police Department doesnt allow aus to see the reports especially in the case of a homicide so we rin the midst of planning a sit down and have spoken to the operator of the venue already. They are permitted, they were permitted a very long time ago by the Police Department which is still a valid permit but to come up to speed as far as Entertainment Commission Good Neighbor policy squz security plan so working with the police to find a meeting time that works early next week and we will be going over all those issues to bring that file to date. Again, i cant speak to necessarily any breach in particular until we get our hands on more information, but i thought tfs important to bring it to you guys just in case you get a question. We are working on it and it is unclear the nexus so i cant say what will happen or any corrective action but they will come in and try to figure this out. Do you know at least if it was a patron or a couple patrons involved . We know the victims were patrons. It is unclear whether the perpetrator was. Alright. Thank you for that report. Welcome aboard dylan. We are excited to have you. I think live event have been a really important part the commission, but with no one being able to hold the flame. You named some existing events but things like holloween and things not so organized need leadership around that. Glad you on board. I want to Say Something about the sound study best practices. I look forward to seeing that because i think there is a need not only for the residential developments that are learning about that but also our poe holders because not all them are completely sound proof and think there is things that they can do as well and for existing ones and future ones so think that will be helpful. Any questions from commissioners for the drerkts report. Commissioner thomas. I notice the daw dada bar is running into Community Opposition concern about the move to the mechanics institute. Do you have update on how that is going . Well, the hold up now is own the Liquor License, so i guess i believe it went through the pcn at the board and that was passed and approved, but there are appeals potentially pending. Again, this is around the abc license. Entertainment probably didnt get appealed. We will not issue anything until there is a active operation there but i dont have anymoreit could take a while obviously if abc and there is a state level sort of action. Got a little political, so well see. All knroe is what i read in the news accounts of the hearing. Yeah, right now the arena sitting in is around the Liquor License so im hands off in that regard. Few items to note a couple made complaint at venues, two of which maybe you havent heard of and one who we talked about before. Place of entertainment [inaudible] 144 taylor i have been under the impression they have done a lot of feeder base spoken word events towards the bake of their space and based on the recent complaint it sound like they may have started booking live bands in the front room. In my experience after taking a walk through there early on during the construction phase, they got a big glass window that faces taylor and the stage is directly in front of that so think it will require upgrade and maybe sound curtain. The stage itself can transfer vibration, not sure but the complainant is across the street so think the sound is going through that window and disturbing the Apartment Building across the street. I have yet to go on site and hear live bands. I plan doing that this weekend. We got a report about a business later on in the evening having karaoke nights and have yet to put ears or eyes on this particular place. It looks closed when i go by, it is dark and i cannot hear a thing, so im going to continue to swing by 431 eddy. The past weekend with west bay conference center, the place that came up before hereby. We havent heard from this complainant quite a bit and after stopping by late sunday i learned this past weekend their air conditioning system had failed, windows were open to accommodate over heated guests for a Wedding Party and that led to a little bit of a storm of sound iminating from the room. The citation will be issued and have a chat to see how it can be prevented in future. I let the complainant know the earlier we know the quicker we can address it. They are not like our typical night club, so what are they holding just weddings . They have come up a few times. Generally birthdays and weddings and family reunions. It is a event space people can rent out. I think they did a good job tightening up closing windows and put foam board in windows and sound curtains overthe foam board and were looking good for a while and the past weekend there was a malfunction of equipment that led to drastic measures being taken. Pardon me. Maybe a little of over kill in the next category, but wanted to give a perspective how active we are on weekends where the city has larger events. Im not sure if we had discussed necessarily because of the july 4th hearing was canceled but pride went off basically from a venue standpoint without a hitch. There were a couple events that we were a bit concerned about, some out of the ordinary things especially across the street from the eagle, they had a permit for a outdoor event and there was unexpected crowd but the numbers were low and security was well manned. All the usual folks, folsom were well staffed. That was the first weekend and [inaudible] reopened and visited them a couple time squz all the conditions in place by the permit on staff were abided by. They were using wands, id scanners, sfpd expected the new Security System so everything was looking really good. I think that wraps it up for me. Happy to answer any questions you might have. Um, in terms of Civic Center Plaza knroe there was increased security, did you hear from police how that went . Everything time i stopped that weekend i try today check in with police. I didnt hear a single thing about anything really out of the ordinary. Most of my focus when it comes to the patrols for things like that are sound based. I do try to keep a eye especially when i see pd outside the eagle, there was some sfpd posted and checked with them, how are things goingi didnt see anything out of the ordinary at civic center. I saw people going and was there for a hour and half and parking here and there. Great. I did want to let you know item a on our agenda, i have been involved in for quite a while so if there are any questions when that comes up great. Alright. Commissioners looks like we are happy with the report. Any Public Comment on either director or inspectors report. Dont see any. Item 4, Police Department comments and questions. Anything the police want to talk about today besides permits . Nope. Alright. Well move along to item number 5. This is a hearing and possible action regarding application for permits under the jurisdiction of Entertainment Commission. We have 5 tonight that are all a little different and the first is chamber eat and drink for a loud speaker permit. I will start you off and then well roll into i guess maybe the permits applicant and or sean depending. What is before you is loud speaker permit for something that ends before 10 p. M. Administratively we typically handle these things in the office, but it has been a practice to bring them to commission if we had complaints over a period we couldnt resolve through any methods we use so that is why this is before you. There have been quite a number of these applications through the office in the past. This one in particular is asking for similar amplification in the courtyard of the Phoenix Hotel this sunday from 12 p. M. To 7 p. M. And as far as what they are doing and how they are doing, the applicant is here. Hopefully i believe and we invited the neighbor who had a ongoing sound concern to come speak on his own behalf, but as i said, we tried to work through and use sean quite a bit to try to find a common ground, which we havent been able it do so are here today to ask you to help us do that and hopefully consider more than just this sundays permit which is before you but given direction to staff Going Forward how to deal with any other future permits that we do expect from this location. Hi, im Isabel Manchester and a partner at the Phoenix Hotel and chambers and like jauslen mentioned we are here to talk about the permit that we submitted for this sundays party and whatwy do on all events we have i can talk about but this sunday is a event cohosted by anderson [inaudible] which is a Business Owner in the city and we host an event that has incorporates a dj. This weekend it is pool side who was a band that originated from San Francisco but doing a dj event only this sunday and host the events from 12 to 6 on the weekends. I pull the permits from 12 to 7 because i like to give a little time for shut down and thats pretty much the basis of the event. Great. From what we understand there has been complaint from at least one neighbor, can you tem about the history trying to work with this person and any other neighbors that may have been effected . The Phoenix Hotel has been there a long time and the history of daing events in the courtyard is a long timeyism have been a partner in the business 5 years and have been doing events throughout thewe use the courtyard for a number of event whether weddings or Fashion Shows or these dj events in the summer time. It wasi dont know how long but heard complaint from one neighbor, as far as i know there is only one neighbor. We reached out myself personally and other partners reached out to see what we can do and maybe invite this neighbor to see what we are doing here and see if we can fine a solution to find a common ground. I know recently we didnt hear too much back from the neighbor himself in trying to sort of work with us, so we did start working a little more closely with sean to have come by and take a look at the situation to make sure we were working within the sound ordinances. We now have decibel levels we work with and decibel meters on property. I work every events so very aware of the neighbor complaint and want to work with him to try to find a solution to not be such a nuisance, so im there walking the property, myself, turning the djs down. Anybody that work would a dj knows that is a constant struggle and take as lot of attention, so that islike i said earlier, another thing we have been doing is i pull the permits from 12 to 7, but try to end events at 6 oclock because i do aware of the time. We also even though we pull them at 12 events generally start at 1 oclock so we are kind of minimizing the amount of sound in the courtyard. Are you notifying at least this one neighbor or other neighbors when events will come and with advance notice . We have done a numberwe have done athe hotel sen out an email to hotel guests mpt i did start off by letting the neighbor know as much as i could in advance about the events. When emails came back not as positive and felt it was hitting a wall, i did stop on a certain occasion for little time. In talking to sean and figuring best practice we started again. The neighbor does currently know all of the events we still have scheduled for the rest hof the summer and so our plan moving forward is always let him know whatever we have planned the times of it and so he has is fully aware. Great and then so you mentioned decibel meters. Are there other sound atinuation techniques you tried to not have the same sort of impact on this particular neighbor . Um, well im not necessarily sure and understand the question. There are ways there is base is i think it is probably more bothersome so we keep the base at a certain level. We tried different speaker the way we position our speaker throughout the courtyard and found having 4 corner speakers is better because it keepathize sound in the courtyard versus everywhere else so we have been trying a number of different methods relying on people like sean to let us know what works and doesnt work and completely open to whatever the suggestions are. Okay. Great. Ill open for other commissioners if there are questions or thoughts. Commissioner frost. How long have you been using the decibel meter . Um, well thiswe used it this year in the past we usedwe have always used a decibel meter but this year we had sean come down and say here is where you want to stay within the levels to have the number is this year. So, you have used it for the last few events . Uhhuh. Okay. People that are having issues with the noise do they have your number or number of somebody on site they can call during the events . I supplied my phone number a number of times. We emailed a number of times throughout the course of the day. As soon as the events does start he generally reaches out and asks about the timing of the event and how long it will last. There is a lot of dialogue. He certainly could get a hold of us when he would like to. We would encourage that. He has a phone number to the hotel as well. And then you say that you generally dont start at 12. When people are setting up, are they doing sound checks . Sometimes but not before 12 . No, which is also something we need for the hotel as well. Thank you. Hi isabel, how are you . The speakererize pointing toward the middle of the courtyard . Uhhuh have you tried a configuration so none are facing your neighbors . The actual apartment. Well, the neighbor to my understanding and i dont exactly know where the neighbor lives by my understanding is the neighbor is above and behind so it is hard to comment on that because i dont know where he lives. I do know after speak to a lot of sound experts this is the best way to control sound is have them all come in to have the 4 corner speakers. Okay, thank you. Commissioner caminong. Can you tell how men events occur during busy season and how soon do you notify the neighbors an event will be occurring . Throughout the course of the year, we do a number of events. Busy season is often times dictated by so many Different Things but the events now we are doing a lot more weddings than we use today do. December well pull a number ofwe do weddings and corporate event and Fashion Shows and summer sunday series between june and generally late september. Throughout the course of the year we ask for 15 permits for sound and pull a sound permit for anything that requires a loud speaker so even just a wedding in the courtyard and exchanging vows we pum a permit. During the summer sunday series which is one we have this sunday, we try our goal is limit to two a month so two in june, two in july and two in august and two in september and try to do them so they are not back to back. Sometimes it doesnt work out that way but that is our attempt so probably throughout the course of the summer 8 and then the rest peppered throughout the year. How soon do you notify neighbors . In the past we submit for the permit and then wait for the permit approval and that is when we let the neighbor knows so often times it is dictated by that. Generally around i wouldsometimes it has fallen through the cracks and have maybe email was queued and only been a few days before, which is not what we like it to be but normally i would say about two weeks. Currently because i wanted to let this neighbor know what we had planned, he has the schedule through october. Thank you. Commissioner lee. When you got the sound meter and didnt have it before the first time uuse td did you realize you have to bring the volume down when you first started to use it or did you find that the way you have been using it all along falls within the inspectors range . You know, we actually found for like i said, i have always worked these events and been on property for everyone and found the range we normally were playing in was within the range he asked to be in. I walk the perimeter outside because i have been in the industry a long time and recognize the complaint so when we start an event i go outside and see what it sounds like before the event starts and go out and check and go out and sense it is too loud i run in before the meters run back in and say, time to turn it down. But i did recognize or find that we were generally within those volume levels. I walked by and been to some the engagements there and think it is not a huge ridiculously uncontrollable amount of sound but the tricky part is you are outdoors and given the way the phoenix is positioned you basically have 4 walls around you that go up 8 plus stories. Im curious for most permits for place of entertainment they have 4 walls we can contain but in this situation you cant contain the sound as well. I think you trying things like the [inaudible] and speakers. Im curious how open you would be in other situations where we outdoor event or people that want to do Outdoor Events next to residential propertys there have been improvements made whereimably double pane windows or added or sound curtains, is that something you are open to or exploreed . We would certainly be open to it. We havent exploreed it. In a course with the email dialogue with the neighbor we did sort of ask our suggest we would all be aloud including maybe a commissioner to go into the property and see what it sounded like to see if we can come up to something so we are open to that for sure. That is helpful to know because i think without being able to build a wall and ceiling above your courtyard and think we want to think about what we can do for the residents. Other thoughts from commissioners . Why dont you have a seat and see if inspector burke has thoughts on this. Do youment want to speak to the cument plaint or efforts we tried to mitigate them . Yes. Inspector sean burke. I think that you hit the nail on the headism we are in a space that is difficult to contain sound in. I have been to the venue on many occasion and did want to clarify that the conversations that is the one i had about sound and levels did happen prior to me entering the residence of the complainant of the first time. Being able to directly in contact with the complainant does open up avenues for further investigation. At this point i have been able to establish inside his dwelling but have yet to be able to follow up during an event. I think the route that you suggested is definitely something to consider. Like you had mentioned, the we have a small space with no roof and short walls and we have a whole lot of buildings in that neighborhood that all most incompass fully the venue itself so they all most act asthey are playing a game with the sound coming out of that venue and it shoots around the neighborhood. You can walk in front of the entrance and not hear a whole lot, but you go down a block or two and you can hear reflections off other buildings sometimes. The sound does tricky things. By the time you get out and hear something and say this is a little loud, by the time you get back to the dj and say to turn it down, the song changed, so it is a very tricky endeavor. I think it requires thinking outside the box and i think there is a lot of variation in the venue itself so maybe we remove and focus on the resident. Alright. Okay. Now that i heard what is said so far i will throw out my notes. My name is steve himeerly and live at 640 polk street so live on the same block as the phoenix but the western entd. I lived there for 16 years so experienced a lot of phoenix events. The worst used to be new years eve when at one a. M. My windows were rattling. Not kidding. I had a lot of experience and over time i internalized a response to this. Not only to receiving information about upcoming events, seeing it on the Facebook Page or whatever, but as soon as i hear something in that direction, my mood changes and i leave. Thats my internalized response over time. I work in fundraising for a non profit and have for 20 years. My job is stressful, so my weekends are really pressure. Im a artist and photographer and do Family Research so sundays are a sweet time for me. Now i cant function in a way that allows me to do that when anything is going on at the phoenix. It doesnt matter what type of music, it can be moody or thrumping so when im aware of something happening or coming up, i just am not in my apartment. Given what i else i heard what i wanted to mention though is that out my kitchen window, i can see over the roof of the phoenix, it is probably 60, 70 feet away and can see a little into the courtyard. I can stand in my kitchen at the sink or at the counter and work on a project or sit on at my computer and the base hits my feet and throughout my chair. Im 70 feet up in the air on the 6th floor. Commissioners, there are two there is one permit in front of us and the director also asked for direction how to handle future permit applications like this. What do you guys think . It seems like we have a number of things that we could do to try and address this and come up with something that will help mrs. Himeerlys ability to stay in his apartment on weekends. While continuing to move forward with these permits. I like us to look at the additional conditions. I think the suggestion of trying to make physical changes to the windows and sound proofing if that is something that he would be interested in would be one step to put more physical barrier between him and the sound since the permit applicant indicated she was willing to do that. I wonder if that is something that mr. Himeerly is also willing to investigate whether putting in mew windows, double pane windows and sound curtains may be a option. He isnt on the record. If you want to ask him a question he needs to come back to the micro phone. It sound like a number of things have been tried on the chambers but we dontand we know that inspector burke wants to figure if we can do measurements in your unit while an event is going on so we can figure what the base measure is there to try and mitigate that. And then the question of potentially putting in double paneed windows or making other modifications to your unit, is that something that you think might help mitigate the sound issues you are having . Um, i do have double paneed windows now. I think thats less the issue than the basis frankly. The inspector and i have been interacting when events are coming up. We interacted over memorial day. There were two events on memorial day and interacted how is the this feeling and is this a good one to test and decide not to. We will find one, because i do think that is important measurement to take because the base is the weird element in this i think. Base is very hard to contain so think that is not a unique problem, that is just sound and mechan recollects mechanics of it. There are other ideas we can explore. I think commissioner lee had a question. So basically is the base that is bothering you and you seem to be close to had roof line which a lot of the music travels and it is a very difficult thing to put on a roof to hold in space. Was there any time with the inspector when he adjusted the base it was okay or is it something that you finally gave up andit sounds like you want to work with them or is it something you are just think there is double pane windows. We can adjust the base or position it and work with you but im just saying is this something you stilllet me tell you, there is a long history there. I understand. I know these owners with their other businesses and they are very responsible and honest people so think they are here to reach out and work with you and just want to know if the double paneope toon the measurements and can do the best they can to mitigate this problem so you wont be disturbed. I know it is a couple of your pressure sundays but we can always shorten the time, we can do a lot of things but want to see where you are at being in that community for 16 years. Work wg with a new owner that has been there 5 years so just want to hear from that. Um, ill respond three ways. I am totally open to the inspector coming to my apartment and measuring when an event is going on because i think that is critical. One thing i must say during my 16 years of living there, this is the first time anybody has reached out to me to say i want to know what is going on in your apartment and never happened before so that is part of my mentality around this. It has [inaudible] implacable like nothing, nothing nothing. We have the double pane windows already. The main thing is for somebody to feel the base and then to address it from there i think. When my windows are closed i can still hear the mid and high range and becomes a blnded noise for the dj that is always like barking and i do think like the Federal Building i think has something to do with because it is just giant reflective wall. It does bounce back right at you. I moved two years ago from the third floor to 6th floor and between me and the phoenix like part of my kitchen is here, my living space is here, between this part of my apartment and the phoenix is the entire Apartment Building of 665 eddy street, so i have no idea what they experience, but i thought that moving up and having that shield would make a difference but it hasnt. The high midrange is different. The base stuns me. I just learned today sound does want dissipate until you hit 8 stories or 80 feet above. That is interesting. Im in there. You are in that zone. Most of San Francisco is in that zone. We understand. I think other questions for nope . Why dont and have a seat again. Thauchck. Thank you. Like i said this permit at hand which i believe is this sunday, so i think they are probably people expecting this event to happen but there is a longer term issue to too so im inclined to go ahead with the permit this sunday but provide clear guidelines for our staff about how to address this. It sound like there will be up to 15 or 16 permits a year that the phoenix will be applying for, so how many more permits are they asking for after this one . Do we have any in the queue . There is none in the queue that i know of but asking the same question i got the answer of 7 i think and they can confirm possibly additional one in december so maybe 8. Isabel can you verify that . I wrote that down but may be wrong. Hi, so for the rest of the summer we have this particular month, july is the month where we have two back to back event u one sunday and 31 is one. We did pass that information to the groups. Then we have two scheduled for august, two scheduled for september, one in october. I did look at the calendar this morning and saw there is a wedding in october, i dont go if that has outdoor sound. It isnt on my radar and have a big corporate event in december that is a hotel buy out that will likely have sound component because it is a big event. That is 7 . 7 left. This is 8 total . Yes. All these events have some kind of dancing component to it . Uhhuh. Yes. Not just fashion show and we are done. No, there is fashion show and art and dancing and grill. Have you made physical improvements to the hotel itself . I think there are sound walls that people build and otheri dont know how you contain the speakers not just the direction they are pointed but any attempts to improve the actual physical structure to try to contain sound . Well, not as far as im not sure how we can do that because we are in the courtyard with hotel on one side and the restaurant on the other. I dont know how we can put any sort of sound barriers there. We certainly put a lot of improvements into the interiors of both but if you have suggestions for Something Like that would love to hear it. Okay, that isgot the answer i needed. We can try to get levels of dba, b and c and try to figure out then what are other technologies and what not we can use to help mitigate that. I would advise conditioning that before this next event because it would probably have to take place during this event rather than before since there is no event before that. We own emporium and have two locations in chicago and as the announcement said before we started, it is a combination of classic arcade, live event venue, tavern, among other things. There it is. So, a little history, we opened first location in 2012, emporium wicker park. We the pictures are a little small. If you would like to see them later we can email the packet. We opened the second location in 2014 in logan neighborhood. They have a similar neighborhood in the neighborhood we are proposing to move in San Francisco. We focus on games such as classic arcade like pack man, donkey cong , pool tables, fooz ball, air hockey communal games. It is a social environment. You can see we have a large screen. One location we do Film Screenings to presentations to even independent game event and that type of thing. More pictures of different games. We have a progressive Beverage Program and work with local and regional brewerys and distilleries and try to get those organizations involved with our events and they are already very involved in the communities so usually a good partnership. Live event venue. We offer live music to Charity Fundraisers and everything between. Work with local artist and commissioned murals on all our walls. That is something we hope to do here. It is all very Community Driven and you know, it is usually a good thing. We work with groups. Our food program usually consists of more of a food partnership. In the upper right we have a food truck permit in one location where we bring local restaurant that do a pop up thing every weekend. We also have a byof policy the local restaurants love because we are not in competition with them. Good reviews on line. Emporium San Francisco started when jack [inaudible] covered by the subtitles, life long friend of my from chicago and lived in San Francisco for 10 years with wife brook and came to chicago and saw our business and thought it would be great in San Francisco. We found the hearting theater and fell in love with the space and neighborhood and did research and learned the neighbor had sort of [inaudible] there had bine a lot of back and forth about the future of the space over the last several years. It was saved from demolition several times due to preservation Type Movement so the first thing we did is met with the neighborhood groups last may went to the square groop and september in north of Panhandle Group and try to maintain contact and received feed pm back how to taylor our concept well for thir community. We have been continuely wanting to work with these groups and make sure what we do is what we want to do but also what they want us to do. We have been in contact with supervisor breeds office and everyone is very supportive. We signed our lease in november and had the cup hearing in november. The plans for the space are restore to the preserve as much hof of the architectural detail as possible which is all most all of it and restore to former glory. So, our plans for the space obviously we understand that there isnt much left. The plans for the space we take our operations seriously. All the servers and staff are certificated and understand there is similar certifications for alcohol servers and manager servers here in california and San Francisco and we are very strict about enforcing those. The security plans as well, you know goodwe have full surveillance cameras throughout our properties. Good exterior lighting. Lead training of the security personnel on site and you know, we want to make sure that all Good Neighbor policies we take that very seriously and it we havent had issues in our current communities. This is sort of a hard to read but the floor plan the space. A lot of games. You can kind of see we have games throughout and the stage and restore the original stage and bar and we have agood bal cuany space for private events. It is a great community, the divisadero corridor changed but great community. We see ourselves as a destination spot which should bring a lot of new people to the neighborhood that can patronize the businesses and hope to be a Good Neighbor in that regard as well. That is pretty much it. Im sure there are questions and sure the noise issue will come up. We have not done sound proofing as of yet. The building was designed to be a entertainment space so has thick concrete wall squz acousticly designed as all buildings were back in the days before high tech sound systems where the sound had to do well within the space so we are hoping we can utilize the natural original build of the space and not have to use excessive amplification but because we are still in the construction phase we will work closely with sound contractors to make sure as we go we design the system to hopefully meet and be good for the community and neighbors. Thank you. Thank you. This is a really exciting. I think we have seen it for a long time i wonder what will go in so glad you have come from out of state. One question about there floor plan, is it flexible or im just trying to imagine when you have live acts are you setting it up a different way or will the pool tables be there . The pool table thrz there is a pool table dolly which is a exciting thing to move a pool table with one hand but try to keep the spacing flexible. The way it is set up now the floor has a slope to it and when we went to planning they were very concerned we maintain the original so we will build 3 platforms on the main auditorium space and bal cuny so we have flat spaces to put the games on. So, this space of the games are movable but think we are building in a waythe idea it isnt just like a normal concert venue where you stand at a band, you play pool or play games while you watch a bands so you get a little of everything. It is fully interactive experience. It isnt you are standing with the person you came with and interact with the person. There isnt nightly live events. It will probably be i would say one to 3 our 4 days a week we have an event and that will ebb and flow defendant depend on th e bookings we get. We like to the capability to bring in different types of entertainment and you know local entertainers judging by your history in other cities what type of acts do you bring in . What motivated me is thinking about are you creating another independent like right next door or are we really adding a different type of venue there . Are you talking about you said it is one to 4 nights a week, but are we thinking acts that are touring throughout the country or local . It is range of stuff. It isnt another independent and wont be rock bands 6 nights a week. My guess is we will have rock bands 3 nights a month, 4 nights a month but one night it is a rock band and another a game tournament and one night a movie thing, probably djs on the weekend, but that isnt like dance clug djs it is more ambient music. It is more we have the classic gamesland to a little bit of 80s 90s thing so that is sometimes mixed it but popular music and rock music and mix of stuff but it is not hard core Dance Club Music and it wont be a nightly rap venue either. We do do rock bands but because we have this entertainment component we are at libty to not drive our business just through live music, which a lot of live venues if there isnt a live bandwe have a draw and can be more choosy with our programs. I is a few more questions but will open up to other commissioners. It sounds like you control all activities. You hire a dj and your security. We do a mix of things, we work with promoters and oretd groups that want to put on events at our space. Other grumes are bringing in our booking our space and do rentals on occasion if that works and have a big group with a big space. Do you provide your own sound system that is adjusted to your space . Yes that would have to use your system. What we do is have a base house system anyone can use if groups want to come in and supplement that they can. I think once the inspector sets the level if you go over it you will have neighborhood issues im sure. Absolutely. We want to be mindful of that and hopefully well be able to do significant testing before we start that can set our ceiling. At our Current Space we have a pretty good sym there so dont want others coming in and using their systems. It isnt an auditorium or arena where people need 250 bring in a system it is dependent on the band. Sometimes they want certain equipment and if they dont do it you dont get the band and sometimes people overlook that part of it. I guess what ill say is well work within the ordinances and whatever the regulations are. Other questions, commissioners . When are you scheduled to launch . There is always delays but right now we were hoping for midto late fall. Now we are probably looking at early 2017, february is what we are targeting now. Can you tell us about your Community Outreach . It sound like you started with people that were trying to preserve the build{have letters of support but have you come across any opposition . Not really. We have been to the the alamo square Neighborhood Association, north of Panhandle Neighborhood Association a couple times. We have been in contact, there is Divisadero Merchant Association which seems on a temporary hiatus, but there is a big email list so have been reaching out from there and letters of support from a few people in that group and try to stay in touch as much as possible. People have been pretty supportive and encouraging for the most part. There is some discussion people were hoping we could possibly do in under 21 certain hours which we are trying to figure if the is a way to do that. That is really the only push back is 21 plus venue may not be what Everyone Wants. Obviously you will never bow able to do what Everyone Wants but we are open to Something Like that. The only issue with that to do the type ofwe need to be a restaurant or bar and if we are a rest raupt we need to make modifications to allow a kitchen and also we lose that sim beoses. We cant allow under 21 people unless we are a restaurant and if we are a restaurant we have to really boo a restaurant. We are open to further exploring there are a couple large residential developments coming up behind you and next door and down the block and we are doing our best to insure those properties and future residents dont complain about the crowds you will bring. Having not been open and opating we dont know the impact so put something on your radar to not just reach out to folks there now but notify and be friendly to the residents that will be coming in. When supervisor breed first ran for supervisor back in 2012, this is one thing that important to her is achieve the activation and preservation of the hardings theater. For those that are not familiar with the buildings t is a beautiful buildings, previously a theater and church and sat and riddleed with graffiti for over a decade. It is a source of [inaudible] disagreements and it was important to her tomake sure it was activated in a way that brought the Community Together and preserved that beautiful building and think we achieved that and thatd is in no small part thank thooz the alamo square Neighborhood Association represented here this evening and north of pan pm handle. I want to thank all those people. If we also didnt take credit i want to point out thisalcy probably wouldnt be possible without our office and your commission and staff center done over the last couple years. In twnt 14 working with director jauslen and former staff who is here, we passed legislation reforming the 30 year old ban on arcades in San Francisco and your commission and staff was a ininstrumental part of making that happen. As a result [inaudible] in the upper haight has been able to keep the pen ball machines and leagues and brew cade my personal favorite bar in the upper market has been able to open and be successful. They have wine slurpys that are delicious. I degress. In twnt 14 2015 we passed legislation to protect night life zenues like the independent. That was the first in the country and our office and your commission and community did that together. The success we are seeing has a lot of parents. The community is huge part of making this happen. The folks from chicago are great partners and really receptive and responsive to the community and work we have done inside the building legislate ivly helped lay the ground work. Maybe chicago is showning us on knowing how. I think by supporting them, we will fix the building up, bring energy to it and vibeeracy to the area. It is just what we need. They will be continuing entertainment. They host small local bands, they will have karaoke, occasional djs and more. For background on june 23 the riptide appeared before the manning commission and motion 19677 which well see in the file which adopted. In the motion it is poncht pornts to note the Planning Commission limited hours of operation to end at 1230 30 a. M. Sunday through wednesday and 2 a. M. Thursdays through saturday. The Planning Commission is directing the Entertainment Commission to consider this evening requiring sound atinuation measures as second internal door, additional sound curtain, sound scramblers and sound atinuation as deemed necessary. The owners can speak to this as they have already begun these measures i believe. Please note the riptide received substantial Community Support. I included a sampling of dozens support letters and many sig xhrs of support of the business from immediate neighbors and supporters of the business itself including a letter from supervisor katy tangs auchs. You will see 6 letters from neighbors and supporting documents in protest of this permit this evening. Taraval station approves the application with recommendation that the Entertainment Commission consider further limited sunday through wednesday to end at 11 p. M. Opposed to 12 30 a. M. Stop the Planning Commission recommendation. They recommended there is no bingo allowed but ininstructed the owners bingo isnt in the purview of the permit and ininstructed how to ply for the permits through pd. David quinnby, this is lesley mobley, we have been Business Partners just over 20 years, 12 years at the riptide and here to ask for your support of the recent Planning Department decision to grant the riptide an Entertainment Permit. We opened in 2003 and at that point we immediately resumed entertainment as had every incarnation before us since the late 1940s. So, we resumed the music 2003 and mainly also like movies, open mic, blue grass, about a 750 square foot space. Use today be a bate shop so it is a small space. Maggie mentioned the fire, we had a fire august 18, 2017 2015 and just about to reopen. Two great things that came from the fire, one was Community Support. Incredible outreach we have been able to speak with everyone and 99 percent positive. 20 venues put on benefit concerts for us which blew our mind and it changed our lives to see that kind of support. 20 different shows and different venues. Great american [inaudible] all the different places. We never as far as supervisorss we have been there 12 years with fiona [inaudible] carmen chiu and katy tang and there is never a complaint to their office or entertainment as far as im aware. Taraval station says we average 4 noise complaint per year which they say is extremely low. We are not changing our programming at all. The other thing that came from the fire is we were ableit was a bait shop with quarter inch pine walls and now we have photographs but rebuilt this the Fire Department came just in time and were able to save the studs and stringers, and we were able to unsilation and sheetrock two layers. As far at the security plan we covered all that. We will have dedicated staff [inaudible] sidewalks and supervisor tang and ashly summers and carmen chi u did a huge street improvements and now the whole place is lit up. We have flood lights as well and sign that illuminates and installing security cameras as soon as the mural is done being fixed or painted. Lastly i want to say it is a Incredible Community support. The sound system is being donated. The Piano Companies asked us to come to the show room and pick a piano which we find incredible and sf opera a couple people from there are doinating their time to give rose bud curtains like the thickest curtains possible. They are donating those and sewing them for all the doors and windows and behind the bands. We have about a thousand letters of support and 4 or 5 with concerns which we addressed. Any other questions great. Im excited, congratulations taking a tragedy and turning into something new. We often talk about entertainment and night life in certain parts the sate so it is nice to see someone from the outer sun set come in and say we need a place to congregate and build community. Commissioners, not sure if you have questions, i dont have a whole lot. Can you explain howi am reading some of the complaint or protests and can you tell me about how you handle your sound . What would you do at the end of the night when if it time for everyone to go home we get people out otabout 145 and have dedicated staff making sure people move along and go hopefully to bikes or walk home. Most of the people live around there. Most support letters came from 300 foot radius, so we had over 200 from the 300 foot radius. To answer your question, we will have dedicated staff make sure people move on their way. And also we changed our bottle recycling. Used to be around 1230 30 pm and made it noon now. There is a couple across the street who repsychosqul said they will come at noon the following day so thought that would be helpful. And it is your own policy but what do you dothere are smokers outside and will smoke outside so in front of your space do you have designated staff for that to sweep up our we have something pretty much where there is a movie each night of the week, so more laid back nights where it is trivia there is a dedicated member of the staff. Anything that the band withwe had bands from all over the world. We are mainly local and regional acts but also over the world ovthe last 12 years. On those nights we heeur Guard Security people, so just one because our facade is only about 23 feet wide so if they stay in the center they have two [inaudible] you can stand in the middle of the two doors and monitor everything and make sure people keep voices down and that type of thing. And when they finish smoking get back in or move on. Alright. Commissioner thomas. So, the Police Department has recommended no amplifyed sound past 11 p. M. Sunday through wednesday which is shorter timeframe, is that acceptable condition for you . Another thing to continue to do what we are doing, the long history of entertainment i think what the Planning Commission set forth was fair. With 12 30. 12 30, sunday, monday, tuesday, wednesday to 2 oclock thursday, friday saturday. What the Police Department recommended is sunday through wednesday 11 p. M. And sticking with 2 a. M. Thursday through saturday. It sounds like he said that he would like it to not be what the police 12 30 to 11 . Yes. To 12. 12 30. Got it. Um, commissioners other questions . Commissioner frost and then commissioner [inaudible] it does say security cameras here. How long do you think you will keep copies of we thought 30 days. 30 to 60 days s. We dont want to run over tapes. Probably dvr. We want to keep in caseit was a very high crime area and luckily that turned around. All the businesses used to be shuttered and we were the only light on the block and there are 11 businesses opening around us so that is a beautiful thing that is happening. So, the crime will go down once everybody opens but think we would keep the recordings at least 2 months, 60 days. Thank you. Commissioner prer ez. Thank you for coming in. I just want to say i was touched on your story about the industry folks helping with your fundsraiser after the fire. Very impressive and very cool. I also appreciate you have a lot of letters of support and signatures from the neighbors. There are two letters of complaint or protest, i wonder if you had a chance to reach out to those two particular people . We had 3 Community Meet lgz at the synagogue just about 4 doors up. 46th and taraval. We had 3 Community Outreach meetings and spoken with all theboth of those people you were able to solve the problem that they have our issues they have . It is mainly the main complaint is general bar noise, it isnt the entertainment or the band or all that which will be very taken care of. We have the 5 8 sheet rock so it will be contained in the lock box. Can you pass the photos up . You can put them in the screen if you want. We were able to put installation, r 30, the most resilient and best installation and then a 5 8 sheet rock, a layer of green glue, 5 8s again on all walls and ceiling in the front and the wood panelling that was there which was the only sound reinforcement we are going back to curtains and sound baffle and what was the other stuff . The echo eliminator, sound panels and had those around the band before and behind the curtains. It was very [inaudible] it will be much more now. It appears a lot is around crowd control and whether smokers or people leaving as they exist the bar making sure not to scream and respect the neighbors. Exactly. Part of our Good Neighbor policy is have signs outside saying keep it quitet. We have always had those and will have them a little bigger this time so people can see them. Great. Other questions . Just make sure that the people that are concerned about the noise that they have a phone number that they can call that will be answered. Absolutely. We have a land line at the bar any time they can call and talk to us, but they can also contact us on a separate cell phone like during the day or whatever and leave a message and well get back to them so we will always be in contact. We see them every day. We are there working every day. We have been talking to them since 2001 so a lot of good contact. Thank you. Thank you. When did you say you are planning to open, august . About 10 days. We are letting the varnish dry on the bar, so we will open without the piano and sound system because people are wanting to [inaudible] it is a Community Hub Gathering Place so we will start events as soon as we get the sound equipment. Great. Why dont you have a seat. I think we are good with you. Any police that would like to comment on this . Im the officer with taraval station. The original when we originallythis started with them not having a Entertainment Permit from day one which they explained to me that they thought they were grandfathered in so that is mute point because the fire changed everything on that. The first meeting we had was set up by the opposition that wanted to talk and invited mr. Quinby to the synagogue and i went to the meeting. There was a lot of support for the bars and concerns within the neighborhood about noise, about the sound and so on and so forth. So, we came to a conclusion that sunday through monday we have some kind of a work a deal out where the music doesnt go too late. On june 15, i sent the Entertainment Commission my recommendation and that recommendation was actually no amplifyed sound after 10 oclock. That would be sunday through wednesday. I received a call that afternoon from mr. Quinby on the cell phone and said 10 oclock is hard for us, can you just to 11 oclock and i can said absolutely, that sounds fair to me. I dont think the neighbors will mind and agreed on the 11 oclock. I said, i think that is fair. That is what we recommended and then i resent my recommendation last week stating the 11 oclock. That is something i had to put in to know this was not going to happen because they didnt have a license for bingo and that was something they have to work on down the road and the security cameras we ask pretty much everybody for those now. That 11 oclock was basically kind of a compromise for the neighbors and the bar and we kind of thought and i thought that was a fair deal and mr. Quinby at the time when we talked about it said he thought it was fair. Whether things are changing or whether the Planning Commission said that is up to you. Whatever. Other than that, i will say when the Planning Commission asked for our recommendation i told them we dont give recommendations because that isnt something we get involved in but asks for statistics in the last 2 years for calls for service and they had been closed for half a year but in the last year and a half they had 14 noise complaints to the riptide bar and then it was a couplethere was one a robbery but that was something outside the bar so we cant say that happened and it was a patron the bar. There were a couple calls for crazy people but that is in this city that is the norm. There is one thing i do have to say though, i understand mr. Quinbys part about doing business, but this is not broadway. This is a 3600 block of taraval street. By 10 oclock at night on a monday, tuesday, wednesday or thursday, it is quiet. I have talked to taraval station in the past back in march of 2015 regarding the riptide and whether they did have a permit for entertainment and other issues that we were having with them regarding sound and noise and patron issues and i was told they would check into it but were good guys and the police work it out with them which i have done over 8 years. Not only have they ignoreed the rules but outright disrespeptful to the residents of the neighborhood. Any time any spoke to david quinby he would change the subject or give the run aroun. He acts if he is above the law and can kooas he pleases. He gave the neighbors a one day [inaudible] post thd wrong day on the flier he distributed. I feel when they went to ocean beach i feel it is better and safer to geto the riptide and think it is a nice [inaudible] nice people and not really like wild party people, they are kind of responsible and she has grown up in San Francisco and think it is a great place. I was the one who cut them off exactly at midnight, and 10 30 with [inaudible] i sweep up the cigarette butts. I want to touch base about monday and tuesday where we have monday open mic and tuesday karaoke. Karaoke doesnt get started until 10 30. Cutting off amplifyed sounds at 11 oclock would be detrimental to tuesday night business as well as monday night, same thing with open micism we have sign ups about 8 30. About 20 people sign up in a minute. We have singer song writer until midnight. I hope we can get to 12 30 for those. That will be huge. Thank you. Any other Public Comment on riptide application . We could do sort of like a sortwe could do a condition that could be temporary where for 6 month period of time we do until 11 and thensuming all goes well our staff we can entitle the staff to list that and let it be 12 30. That is one option. So, the Planning Departments recommendation is unusual. Want to tell the neighbors that the extensive remodeling on the inside for sound probably will keep everything in. I know your concerns are probably outside. We have to give it a shot and i think with the Good Neighbor policy i like to add we put a condition on here that thethey sweep the front and keeping their area clean and also their security to get everybody for loitering around when it is time to go home as a extracondition. Good neighbor policy, number 3 says employees shall walk 100 foot radius from the premises sometime between 30 minutes after closing and 8 a. M. The following morning and pick up and dispose and discharge beverage containers and other trash left my entertainment patrons. That is part of the current Good Neighbor policy, you can add to that if you like. It sounds like there is also concern about noise around the premises. There are items that address that including having a phone number that is active that can be called should a neighbor complain and want that noise to be lowered, so i agree that area is really quiet and know having any type of [inaudible] people noise will probably wake up people. But the bar has been there a long time and understand there has been issues but under a permit there is control and recourse to the owner. What im thinkingwe can always limit the hours now and if they want to come back and extend it again. They can reapply for that if we want to set up a certain time. I think to save everyone time i prefer if we were to limit the hours at this point in time to give a timeframe around that and allow our staff to determine at that point whether they can be lifted to remove that particular condition. Again, commissioners, it is our choice, so i think it sounds like the most contichant thing is the hours at this point. It sounds like you are looking for motion to approve with the condition from the Planning Commission and condition from the Police Department that sundaywednesday no amplifyed sound past 11 p. M. Thursdaysaturday amplifyed sound till 2 a. M. I have gotten permits where there were things they didnt permit so wanted to do it the right the way. I brought in friends who are musicians to look at the space to see what we are doing to make sure they feel comfortable. I have seen them at other venues they do acoustics works well with what they are doing and the sound doesnt bleed where they play. I experienced that myself. Along those lines wine bars cater to a lot of women that talk and get wide and have sound proofing in the ceil and something we are ready for. [laughter]. Thanks. We spent money on a ceiling to help absorb sound. One of the benefits is it will keep the sound from traveling. Our building is a 4 storey building and one condo above us and received support from the entire building. I understand the Police Department recommended that but the building is really excited about what we are doing. We predict quite a bit of support from this at this point. Also we are not seeing the [inaudible] which is nice. We did practice [inaudible] and walked around to see whut what it was like i are you planning to have jazz every night . Not every night. They did two or three nights a week and we are looking at keep talking. No problem. For example in the Mission People that make over 150,000 a year that population has grown 65 percent since 2000 put city wide 10 percent and have seen a big lauz of latino businesses especially ones that are family serving and community serving. I remember going to the old days and know this is not the environment they are trying to build. This is like a family environment fl a alternative venue to have. Gold star, the south of market club owners do a mujtly meet wg the Police Captain which started by captain charley [inaudible] and so every month we get together with ray bob bitt and sf clubs and meet there when the captain is available when we met with the new captain, caipten dairl [inaudible] and discussed the mission at first was to find out what pride events were going on at the clubs and talked about clubs like dna, mezzanine, the grand and the larger clubs and we meet all the time so we are like jauslen is there and sometimes sean is there and have pizza, so anyway, the topic was in the concerns was the Mass Shootings and things and think in the meeting jauslen says the south of market clubs we have done pretty strong prevention as much as we can as far as pat downs and wanding and things like that which other maybe neighborhoods dont do because of whatever. But the topic was interesting that somebody mentioned with all the active shoorter situations if it is thought to have on security at clubs and im personally totally dont like that. I dont like Armed Security and what the captain mentioned was misidentification of a Security Guard maybe being shot by mistake or [inaudible] it was discussed and think mentioned and asked for by a lot of club owners is some best practices about active shooter scenario. An example if a shooter want said to do something they will do it no matter the security is trained and these guys are trained but human error will be there and distractions and whatever hap nls. A lot were interested protecting the patrons inside the club. We try to screen outside and once they are inside they are still our responsibility, but how to doyou handle it. There were comments like as you see these are 8 mentioned, but we hope the next meeting that we will have more or some maybe a draft either from this commission or alu or cmac to see where we can come up with best practices and as a example they mentioned like venue sweeps before we open the door. Things can get planted ahead of time. Some clubs are doing venue sweeps and checking the bathroom before they open the doors which is interesting idea. Obviously searching bags, purses, talking about more use of security wand, checking for metal. I personally like pat downs the best and have to have a female guard to do the pat downs for the women. They are saying call for service if there is any emergency to call 911 and identify or get license plates or descriptions of people and make sure all your security are well marked because it is dark. This is a good number 7 and is assign somebody at the beginning of a shift is to assign somebody who bows where to turn on the lights. In a active shooter situation you want to turn on the lights so you know what is going on so i think a lot of times and i have seen other clubs is there a one guy that just started and dozen know where to turn on the lights so that is a basic thing. And having evacuation planism unfortunately we have protecting our clubs and protecting the inside and minors and keeping out drugs and what not but we have to worry about terrorist acts and i encourage club owners listening come to this meeting and share their experience or learn from what we talked about at this meeting because it has beeni wish other districts could have meetings like this because we are not competitors with situations like this. We are all in the industry. There is more to come so i pass this to you and the rest the commission of what was discussed and hopefully more will come out of it. Thank you. The main thing is they love their businesses and the people that come to their clubs they lover so when anybody is injure td is heart breaking. Even in france when the truck drove through the crowd. Clubs are not the only place, it is anything public, but at least at the club level the south of market owners and some in the tl that showed up at the meeting they are very concerned about the actf shooter situation and want to be trained for it.
