Good evening, commissioners im going try to be brief i wanted to update you on the resolution that i brought this up that he last meeting regarding supervisor wieners resolution on the creation of an lgbtq Late Night Task force after the first hearing at the Land Use Committee the resolution went to the full board at which time supervisor campos returned it to committee that was reheard but very briefly this yesterday at land use and again is being moderator to the full board with recommendations i think that supervisor campos addition was just to wanting to insure is it fair to say inclusive as possible and this task force late night and heritage was not just south of market but also you know encompassed areas in the mission and obviously his district and anywhere else lgbt cultural existed well about get that clock ticking it gave us a passage at the full board about 6 months to return at least some form of the strategy to the board we pursue that and again any, any assistance in terms of who should be a part of this working group well happily take suggestions well do that in the next few weeks. Up an opportunity for an event producer to comment on changes and regulations you know so they can plan carol for a difference in revenue ill send all you guys a recap of the notes and materials from that and make sure that everything is complete you can take a deeper look and this dovetails into a development that relates to the collection and evaluation that is, we are going to be doing think evaluation report which i mentioned but we actually working with the citys civic Bridge Program and mckinsey and company signed on to volunteer pro bono with the evaluation were calling this improving and sustaining Outdoor Events in San Francisco ill be the project coordinator working closely to make sure we stay on the objectives make sure theyre met and basically, what wear covering look at the birds eye and grand letter view the Customer Service center and funding streams and how does San Francisco measure up to other cities in terms of best practices and analyzing things that factors that impact the success and failures of event not just from the point of view of the producer but from the regularity so i think the takeaway to this news is that you know myself and director kane and all of you once we get in a data that will be where sort of the work of the commission really starts where we can make those recommendations for policy change im not expecting the mckinsey people to be experts in making recommends but i think theyll be able to crunch hard data and theyll help us to really elevate this evaluation we have to move quickly were due to center the report in january and so right now, im finalizing and getting all the data so all the forms and the links to code and then two members from the mckenzie were at the workshop theyve dived in so ill update you guys as long as i have more information. Great so i know there is a survey that is out or going out. Yeah. What i know you named a couple of data sources what data are they looking at outside of the survey. So they are im helping them get a sense of belonging every Single Agency they interact with to do an event for example, if you have liquor and food and 25 hundred people and a street closure and public free admission you know you have to deal with 10 agencies at the very least and so theres nuances that are not apparent in the process youll not see if you look at the permits online. I guess what im asking are they interviewing people or looking at forms. So we havent figured out but were ill be the primary contact im interviewing all the people im sure that was not clear one by one and taking good notes so the point is not to have too many cooks i can share this information with them. Inspection pauley good evening, commissioners several items to go over with i did an inspection at the mays on polk street they received a bunch of complaint over foot traffic and noise i did a walk through of the venue and talked with the owner we talked several times through phone communication and explained the concerns of the neighbors that are complaining im preserved the issue but nevertheless, explained as well as there is security so the issue was about loitering we talked about this last hearing objective on that block there is a bunch of venues operating at the Maximum Capacity it is hard to point the finger at mays but nevertheless, he talked with management theyre on board to alleviate the issue i performed a sound teste Great Northern and in support of poe they dont have neighbors so they peaked at one 12 during the sound test and it was not particularly loud outside but will change with the freeway traffic ill be fine with that kind of sounds like alignment if there are changes in the neighborhood there maybe changes coming but well communicate about that if there is something that needs to change but that sounds like test went fine a new complaint im not sure there was a letter written in regards to issues that are added club malibu we originally got a complaint about a month and a half ago about ventilation holes they cut i dont persevere to be an issue but the Building Code may i dont know about cutting holes into the walls but nevertheless, the neighbors are serious about whatever issues they preserve so what well be doing performing residential sound inspection to figure out the impact that the noise impact is compliant or not and also ill be i talked to the operator about the issues before but we didnt get deep but nevertheless, i think there are things they can do immediately to take care of the sounds like situation if there is a sound wlaek like look at it scientifically youll update you on that that and expect more information to come forward you and know in the letter they talked about people urinating and playing the radios and no security when the club closes i know youll inspection the actual but did you talk about the security. Not particularly about that i go by every weekend and dont see that at all ive never seen that but they live there. A friendly reminder didnt hurt. President tan lieutenant San Francisco Police Department i think everything is aware we had a homicide on one the licensed businesses i cannot go into a lot of details the fact we had an incident 3 or so months ago it ruled in the loss of a life and just up until 5 oclock director kane and others metabolic owners of club as well as their Security Team and we were discussing the most recently incident and what i can tell you tonight is that ill speak for the Police Department my takeaway i was not satisfied with their responses and i think that well be coming back to the commission in the near future with some specific actions and were going to be working on that now were working i have staff working on stuff well be working on it through the week and i think well see where it takes us but the sense that i got from the meeting and from captain fong got they didnt want to take a lot of responsibility i think when we experience that with an egregious incident they might be lorgz perspective on their responsibility this license is a privilege they procreate a licensed business and have certainly responsibilities as such so we hope to move thoroughly but as swiveling as possible are they open. Yes. I know the last time they voluntarily closed for like a month. Yeah. Well, i know they reopened but after the incident. The first incident they served an 18 day volunteer will i closure to do rebranding and in fact, they did that and meet many of the goals and objectives so all that was positive but unfortunately, this in the short lapse of time this is the ultimate crime we get to get on top of and ahead of that i would have liked the meeting to have gone differently but that was their choice so thankful been we kind of told them our feelings how the meeting of time and at the conclusion theyre aware so specifically president tan theyre operating where this goes to the immediate future well see. I have a question for you in the last year other than those two homicides has there been any other places of entertainment to your knowledge. I have to say 0 no. In my opinion this commission and the Treatment Community worked hard not to be the source of violation our submits were born and the staff has to make that happen. I know youre waiting to say the Police Department has done. And the Police Department has done to have two homicides in 3 months at the same venue is incredibly troubling. Seriously speaking absolutely. And so, yeah okay. Id like to bring up one other point. I dont want it to be a reflection on the entire Entertainment Community we work hard as a community to make sure that kind of stuff doesnt happen. We did have an uptick in homicides this past weekends i want to point out monopoly of those occurs in absence absent or entertainment licensed venues those are unrelated and not part of your purview. Id like to echo when commissioner joseph said in light of what goes on in communities when people brush a wide stroke over an organization as much as the Entertainment Commission this is only you know one not two but one place and the rest of the city the Entertainment Venues have been Public Comment is closed. When you say your disappointed was it their actions before this happened or the actions afterwards or like are they not helping with the investigation or they not willing to forward and make changes you guys are suggesting. They have the unique experience of having experience at this the first incident and the first incident didnt communitybased that well but this was theyre first time going through the process we went to Great Lengths explaining this is not a point the finger but understand what happened and need to fix it and booster the areas, etc. So i think what i want to leave you with our anticipation today was they were going to across town come in and recognize they have a role in the incident it is unfortunate and what more can he do collaboratively thats not the takeaway i got a lot of defensiveness and some in this investigation it is extremely preliminary our goal quite frankly is were going to bifurcate the Homicide Investigation from the receive vacation or abc revocation were not going to table this while we solve a homicide ill not be talking about the homicide itself thats a fact thats the part that i plan to bring forwards i want to bring forward the relationship this specific privileged licensed business has to homicide that maybe the grounds for disciplinary action up to including ref indication. Any night i think we have been in club delux its a wonderful place but having the neighbors complaining is how clubs gets shut down and you really cant leave the window open you need to find a different ventilation solution for your musicians and audience that didnt involve having a neighbor having to come over and close the window herself i appreciate the neighborhood runs itself but, yeah if you can figure out a different solution whether fans or you know talk to some of the other club owns so we dont have to come back all over the place in some period of time with complaint from the neighbors. As an operator it is annoying you, you have a phone number and you want to run our business you dont get interrupted you have to turn down your sound because the next door neighborhood can hear you so making the changes consider had the inspection goes out and go a sound check hell tell you and you can go from there. Take the opportunity to speak to you id like to take a few moments ago about the background of the vision and turn briefly to programming infrastructure and the outreach that we conducted many decades beginning in the 19 hundreds you mean the history of the tenderloin the heart and soul of the city drawing people from all walks of life to the jazz the tenderloin was home to one of the most famous jazz bands the black hawk about a block and a half from the black cat that club hosted some of the jazz names in the world billy holiday and every musician at the time and miles davis recorded one of the biggest al bad news bad news it was eddy and mason a vibrant atmosphere all people from all walks of life enjoyed diner and jazz by the 19 san jose the scene the tenderloin was the jude heart of the city was not the hot spot for arts and entertainment the scene move on to north beach at a time and forward to may 2016 i toured eddy that was kaufshtd into two restaurants vacated one a delipidated Chinese Restaurant with 7 foot ceiling and the former a vietnamese restaurant gambling house it ceased to exist with 7 foot ceilings the 3w5e789 space assessable by a staircase was kaufrd into tiny rooms that space should not have been used except for storage when i first sobered the space i heard and felt the energy of a jazz and super club and with jazz flowing into the room standing in the space that first day that name black cat came upon me i didnt roles until a couple of weeks later Historic Events existed in San Francisco by that name it was a vision to bring the super club to the city we spent two years getting the place and designing and building a space that would pay homage to the glory days of the community and it helped to restore that that was the vision of black cat that was 7 foot ceilings now welcomes more tables for dining a center bar the downstairs space as a variety of seating options including the bar and people socialize in the downstairs space at the stamp a grand poa a acoustical curtains and lighting i want to talk about the full service at the super from 5 30 to 2 00 a. M. And serve the food menu and opened the doorways on july 28th if we go back to april of this past year we asked our attorney to initiative the process for how to get a license we paid the fee to our attorney our attorney compact the Entertainment Commission and mistakenly advised us that the application could not be processed until we received our Liquor License and operating permit our attorney based on the mistaken understanding put the circulati application on hold our attorney then resumed the application process to become fully compliant in terms of our programming we will feature live jazz 7 days a week in october Live Performance are limited not basement area of the venue we feel our program is unique we bring some of the took up local musicians together and create ongoing resident sisters and performance that didnt exist in the city and opened all nights to young jazz musicians giving them the rare opportunity to sit in with older jazz musicians and top talent this create a organic atmosphere i think this atmosphere is a true home for not only jazz musicians but brings together a great audience and others that are hearing jazz for the first time people in their 20s and 30s oh, my god this is amazing our guests represent a difference demographic residents from the tenderloin and every other neighborhood theyre young and old from every ethnicity thats the situation that is seldom seen in the city we took care duo to have a high quality listening environment that allows warm acoustics and protects our neighbors we did 3 things we hired a retired engineer who designed and built our acoustical environment in the sound system and number 2 the performances are limited to the lower level only we install four layers of acoustical materials on both it florals the fiber glass and a double layer of sheetrock a layer of quiet rock and acoustical material so youll four layers exist on all 4 floors and our speakers were insulated to float them to minimize in any noise we invested a sum in the acoustical materials to protect our neighbors and create a comfortable listening environment since the opening two complaint early had in the process those isolated incidents were in transitional incidents those issues have been worked out and no additional complaint i want to just to be clear a high priority for us to be a Good Neighbor weve done it in many, many ways sound is important and dont anticipate noise issues i can assure you well quickly address those that are brought up u out in terms of operations we have an experienced team of seasoned professionals to manage our business a residence engineer not the folks that control the himself the Live Performance are in the basements their barley accountable and not you cant hear them on the center when the guests come and go and stand outside and those cant be heard our general manager collin managed one of the most the largest restaurant Entertainment Venues in the Mission Successfully for more than 3 years thats in the mission colleen organs our security staff those are 5 that gh are why a i couldnt a finally weve met our neighbors and talking about a programming hours of operation security and be neighborhood integration we have first of all, obtained more than 50 signatures from the neighbors in support of our license and over the month we talked with neighbors and gotten verbal support for what were doing and the improvements of the quality of life in the streets in the neighborhood at nuts and bolts night and being a Good Neighbor is a key component and worth mentioning staff and chef were hired from the neighborhood and working closely with the neighbors and they support our project our second outreach is the presentation to randy shaw randy is the director the tenderloin housing a nonprofit focused on Community Housing support in the tenderloin right off the bat is a well connected he reached out to a Network Based on his views in the conversation with those he submitted his letter of support letter of support for our treatment license and finally reached out to the Mary Elizabeth thinking it is located in the building the hotel where the black cat is located they expressed theyre positive energy were bringing to long dark corn of las vegas worth and eddy and provided direct contact for any complaints to be dealt with prompting we have a telephone that is answered every night and any issues brought to our attention will be dealt with prompting i believe the type of entertainment we offer is important it fosters the diversity of attempt that made our city the unique place and ask for your support tonight. They are 12 inch speakers about this size and mounted so upstairs. How many. On the street level we have 6 speakers on, on the basement level thats for house music means our play list on the basement level 40 speakers and two stage speakers the 2 stage speakers are 24 inch speakers. Are they on stands. Theyre mounted to the sides of the stage. Are they for the musicians or the audience. They are for the audience. We have monitor as well on the floor for musicians. You have monitored can you tell me once again how big our room is downstairs. 24 hundred square feet and upstairs 2000 square feet. So you have 4 speakers downstairs and two on stands mound to the walls and monitor speakers wedges on the stage . Correct thats correct. Okay. And you dont know what is in the speakers. What size. I did not know. All right. And do you have a sound board. We have a sound engineer that can figure the sound board. About you came here and operated all of this work was done. No, we created this environment. All of that work was done before you came here but you were operating and complaint. It sounds like no complaint based on what you said so did you find out what we were complaining about. What was haven in the building was a base visitation in the time we were experiencing with moving base guitars that since been disconnected we are transitioning our controls from a stationary console to a remote so the trans inference our sounds like engineering was trying to bring it into fine tuning. Do you have the base speaker. The base is no longer connected to the system. Did you remove that completely. It is removed completely yes. Is okay so the base was interfering into pipes out the door. I find it hard to believe you had any complaints whatsoever i mean tech is one of the finest soundproofing you used quiet rock and preinsulated with fiber glass we use in our homes and you have isolation mounts on your speakers it is hard to that believe that happened. We agree. But it did happen. We firmly believe that was related to the base i talked with the person that filled the complaint they felt vibrations on the floor so we were confident that was what it was and this is this venue as has not been used at night so having any change they were 415 sensitive we spoken as to the residence and no issues i think that was that transitional time for us how what youre base speaker a sub called a sub because all of your speakers have base. In order for them to work right was this one speaker a sub an extra base what happened is when a base player it can go to the microphone not picking up the same base sound use their deattached base speaker is more localized our sounds like engineer tried to get the base hooked. Thats the amp so youre talking about the musicians a. M. For the base guitar. When a no our sound engineer was giving the base player the option of tax on outlet and plugging into our system so in terms of of our house system was at the amplification for the baits that was directly exactly. Plugged the bases into da bases at the time but not happening. There was a wonderful jazz club in north beach called the black cat as well. Commissioner lee. I know they want all the musicians to go through the board to control the base in this case the base was pleasing and the board it was great you isolated and not go through the board but control your musician because depending on the band they love to crankup the base you have no control. So the deal you probably got the double wham i didnt not putting it in the board your sound like engineer can control the base. What we do now the base is actually, we use a microphone rather than a direct. Thats what we do. I hope you get. Taylor im a ive been living in california since i was im a well traveled musician that has come across the black cat through a friend who come into town to play at the black cat for like their second week of opening we he advised me that was Something Like we grew up about 20 years ago as was mentioned in north beach there was a a lot of great music especially jazz pearls and around the corner another place it had a name of a cat but i dont think it might have been the fat cat but as a jazz musician there are few places to play nowadays especially e line which he sees oakland is able to caterer to local musician one day a week and thats very limit for the amount of musicians out here so to find a place to allow to have expression as a musician and still allow for jazz to actually happen a lot of places ive approached understand that they can only draw a crowd with you know base heavy amplified, you know, hip hop or whatnot even if it is rock so have places like the prior venue that i played in the club delux but understand that there are many people who have come in who have never heard this music before.
