There are no public speakers here signed up for this resolution. Do want to hear from our superintendent. Thank you president walton and commissioners i wanted to comment about the resolution and the guidance prosided to staff and families we agree with many of the value articulated in the resolution. Highlighted in the title are the principles of defending labor rights immigrant and civil rights certainly stand with the authors on all of those values i want to say for clarification we have communicated as we have done in previous unexcused absences in terms of guidance to staff we with respect the rights of staff to take personal time off to participate in this action at the same time we also are concerned about adequate and safe coverage of our classroom andish youd guidance to our school sites with both of those interests in mind. We do have some reports several of our sites are expecting high absences that does give us some concern. We want and will take every step to provide adequate coverage deploying our staff as needed. Depending on the extent of the planned absences we are somewhat concerned about our ability to do that and we ask all of our staff to register their intentions, to be absent and request substitutes i just want to remind our community about those fundamental interests of protecting or school and student safety in voicing the personal beliefs that people have. Thank you. Thank you. Superintendent lee. Any comments from colleagues . Commissioner haney. I want to thank commissioners walton and sanchez for bringing this forward. I respect superintendent lees points on the impact in some of our schools sol of the schools have done with Large National demonstrations is organize teaching and ways to engage students ways around participating in different ways and learning and supporting the general cause. At least learning about it. Notten couraging Political Action in any type of way that is inappropriate. But using it as a teaching moment and having ways that our School Communities to engage we should encourage that and with their rights however they can with your guidance but think about ways our teacher and students and community can participate if they so choose where appropriate. I want to encourage that as well. Vice president mendozamcdonnell. I wanted to thank you my colleagues for bringing this resolution of support. Its very troubling time and we need to do all we can to protect our students, our families and so many of those who make up our beautiful city. I respectfully to have all of our names put on this resolution its an important resolution that speaks to our School District wholeheartedly and would make sense for us to be able to all demonstrate our support. Add the commissioners the immigrant and labor families and everybody under attack in this administration and put our best foot forward to show solidarity in this fight against solidarity with that said, in comments from colleagues or superintendent roll call. All right. Good afternoon, everybody welcome to the board of supervisors language for that monday, april 17, 2017, my name is mark farrell ill be chairing and joined by supervisor peskin Community Member supervisor tang and with us is supervisor Hillary Ronen thank ms. Alicia and others from sfgovtv for covering this mooring and madam clerk, any announcements . Electronic devices. Completed speaker cards and documents to be included should be submitted to the clerk. Items acted upon today will appear on the april 25th board of supervisors agenda unless otherwise stated. Okay. Thank you very much madam clerk temperature item no. 1 Green Building and environment codes requirements for installation of electric vehicle electrical vehicle chargers undergoing major alterations and making appropriate findings. Thank you this was sponsored by supervisor katie tang so im going to turn it over to you. Very much were here to make a simple amendment to the ev readiness we heard at land use and hearing concerns from various associations the indictment has met with organization as much as as Sf Apartment Association and well have a proposed change on page 7 starting listen 6 through 8 essentially we are exempting projects that are undertaken specifically to meet the you may have a seat. Schematic retrofit program from the ev readiness ordinance as you recall from last week the be argument made was that the city has a mandatory program and another ev ordinance on top that so there is a desire to exempt the you may have a seat. Schematic retrofit buildings from the ev readiness ordinance so i dont know if you have any questions sf environment staff are here otherwise ill make a motion avenue public commissioners comments, and questions. On number one. To supervisor tang i appreciate the fact the department of the environment undertook those meetings and appreciate this amendment i spoke a little bit based on correspondence that we received there was another point raised with regard to also exempting accessary dwelling units in the same regard not that i think will be many in the 25 thousand square feet buildings but i was wondering if there are any conversations with the department of the environment or i know those issues were raised and correspondence we received. Sure maybe ill have dbe month from the department of the environment who is part of the conversation. Good afternoon, supervisors for the record geremo department of the environment as supervisor tang mentioned at the last meeting we heard broadbased support for the ordinance but the department and the department of housing raised concerns we may be seated with them a good meeting walk through the ordinance in great detail about the drafts and the many types of buildings undergoing market octavia retrofit and some of the adus questions i think we came to a good agreement on the amendments that is before you today where arent to the schematic retrofit program looked at the projects that are call the roll. At the dbi and looked at it the definitions and the projects to see if theyll trigger the retrofits and require this out of abundance of caution we decided to go with the amendments before you where were is the accessary dwelling units again, we building that the ordinance has strong provisions in place to address many of those types of projects again, the 25 thousand square feet definition of a planned area really is extremely large as well as to have to pull you know of significant electrical Plumbing Mechanical structure we feel those provisions are Strong Enough in the existing ordinance to deal with the adus and if it does become an issue to identify the projects that trigger well send it back to the board and address those concerns thank you. So chair peskin and supervisor tang i mean based on what mr. Recordings said and as far as as we dont want to discourage them ill offer a amendment number 5 to insert after accepting Public Comment where a project is under construction of the c of planning code. Supervisor tang thank you. I do appreciate that thought but i have to stand by what mr. Rodriguez said when it comes to major renovations i forgot what page but clarified the dbi 3 out on im sorry on page 43, 3 out of 4 structural and mechanical, electrical and or Plumbing Systems so again page 4 on the bottom as mr. Rodriguez mentioned those are significant amounts where in most cases probably you wouldnt trigger an adu alteration and okay. Colleagues any further discussion okay open up for Public Comment anyone from the public wish to comment on item number one, please come forward and line up against the far wall two minutes. Good afternoon, supervisors San Francisco Apartment Association thank you very much to all of you and thanks to the department of the environment for working on this legislation with us our initial requests was to exempt seismic a exempt adus from this program we believe that getting more adus on the market is a really important policy goal of this board of supervisors and we want to make that as easy as possible so if we could exempt those that would be our preference but dont want to say that is department of the environment has not reached out to us and done their best we kind of reached this policy impasse so whatever you decide today, our policy goal to get as much schematic work done and as many adus on the market as possible thank you. Thank you. Next speaker, please. Good afternoon, supervisors corey smith on behalf of the housing coalition. Actually agree with the previous speakers comments between one familyfriendly equipment and at the same time want housing with the adu protective forward with our support. Thank you. Next speaker, please. Good afternoon, supervisors laura on behalf of spur and to support the proposed legislation for the environment code for the vehicle charges and undergoing major alteration im not prepared to comment on the proposed thing but spur has thought we, of course, need to solve the housing but little climatic change and in the 2016 policy in the bay area we find that personal cars are the largest Green House Gas emissions in the bay area and hope by 0100 percent of cars needs to be zero Mission Vehicles and meet the goals by 2050 we need to add more charging capacity that legislation is directly in line with the spur represents that requires all residential and commercial dont know how many in the future but ev ready and at the capacity and as sf shows reducing the costs of retrofits i would prefer an earlier version of this provision like oakland 10 percent be added we offer our support including with the seismic with one request for we and others building the electrical cars should grow as cars in the future we acknowledge that is other technologies may and eclipse the electrification and the ownership could decline as shared vehicles and wireless would be available suggest a review in 4 or 5 years to see how the implementation is going and the scaling up of electrification is relevant to the adu. Thank you. Next speaker, please. Hi, my name is spencer represent the charge point and thank you for the opportunity in support of this legislation i want to expand our network the latter in the country the ev chasing stations in San Francisco county. The north bay have over one and thirty are corporate customers n judah the city of San Francisco im working with Property Managers and tenant that point the benefit of those charges and have high tech employers and nonprofit schools hospitals and misrepresent housing across the Diverse Group of stakeholder where retrofits how to keep down the costs and this proposed legislation is an important step and charge that it in is in support that have this wellthoughtout legislation whether we need to plan ahead should be up one in 5 vehicles are sold in the bay area u. S. Ev sales has grown every year and looking at 35 percent more than last year for easy so how to best support those electrical vehicles to do that is cost elective this legislation is welldesigned in support of that. Thank you. Next speaker, please. Good afternoon members of the board thank you for thank you for your time im bill on behalf of tesla to over our support of proposed ordinance for make ready charging infrastructure in order to meet the state goals over the coming years that is necessary to increase access to ev charges infrastructure both with that lafrp and more affordable long term vehicles with the model 3 well have more ev drivers detrimentally in dense urban arrests with charging infrastructure may be difficult for high cost and may put an ev out of someones reach this is a low cost solution given the analysis by pg e that demonstrate up front costs versus retrofit with the ev infrastructure thank you very much thank you. Next speaker, please. Hello chair peskin and supervisors my name is jeff the cocorridor local 350 climate nonprofit want to support in legislation and thank you to the department for working on that we do a lot of work in the bay area quality and tomorrow theyll be approving their clean air plan for 2050 to be follows free and this is a crystal piece of that and ultimately you know we civilization will end if we dont substantially river our climate issue it is penny wise and pound foolish to be quickly over one we know well need 100 percent electrification and support the comments there is a place for Technology Review at a time to make sure were not spending money on most that ineffective we are keeping up with the new itself trend but ultimately make sure that every parking space in the city eventually can priority 40 provide for nonprofit transportation that needs to startle now, when industry will be more expensive want to flag that i mentioned the bay area of Quality Management theyll be looking at providing funding best practices, etc. On ev charging and could spread legislation like this around the region lastly sfaep sonoma has instituted a program for the adoption if cleanpowersf didnt meet those charges. Thank you. Next speaker, please. Hello supervisors my name is stacey im the ceo of the power we are a charging Service Providers to permeate dwellers i think the points that were made by the prior commenters are on point ill highlight as well that there is a social balance social justice for charging for apartment dwellers currently according to the cc m it that administrators the Ev Rebate Program 95 percent of all vehicles that are influencing in have been sold to singlefamily homeowners yet San Francisco has 2 3rds of the population that rents ios renters would like to have charges and electrical vehicles have been denied federal rebates and state rebates and to the salesforce that electrical vehicles what provide to the ownership and as a result that is impoverishing the community by denying the access of those savings so keep in mind as much as possible providing assess for renters a significant benefit on multiple levels thank you. Thank you. Next speaker, please. Anyone else wish to speak on number one, feel free to line up on the screen side of the room. Im here representing ever charge were also in support of this legislation i would like to point out that current a 10 to one ev charges to electrical vehicles stations in the city this needs to change for the electrical vehicles to ton to grow and 90 percent of ev drivers peace officer to charge at work or home or both are available this legislation absolutely meets that goal and i very much hope you put it forward thank you. Thank you. Next speaker, please. Hi laura clark action i wanted that remind everyone this is maybe okay legislation but the most powerful thing to do to make sure that we are buildings Green Community to build dense urban refill that is building more housing this may increase the costs of building housing thank you. Thank you anyone from the public wish to comment in Public Comment okay seeing none, Public Comment is closed. For number one supervisor tang. Thank you very much thank you for your comments i will work with it sf environment in terms of reevaluating whatever technology is on the market absolutely that is crucial and so you have my commitment to continue to do and sf environment and i will say, i would proposes the amendment to exempt the Seismic Retrofit Program in selfill not include adus we already have quite a high threshold that triggers a major alteration and on top that we want to currently many people to be able to drive ev as possible and capturing the window of time less expensive to be able to install the infrastructure rather than going back to Old Buildings to install the charges i would like to make a motion to adopt the motion on page 7 lines 7 and 8. Supervisor tang made a motion and supervisor peskin on that motion without objection. So were clear first of all, thank you to the department of the environment and supervisor tang and the mayor for putting this forward it is very good legislation i think that the amendment that we are i think all in agreement is about balancing competing needs to very important Public Policy about seismic safeties and climatic change i think that number 5 fails in the same vein not used much but take advantage in new construction in most case but to the extended we have a priority of building adus id like to have a vote on that one sentence amended i offered number 5 under the number 4, ill prepared to take without objection. First of all, supervisor tang emotion and supervisor peskin seconded by without objection and supervisor peskin you want to make a motion. Yeah. I made the motion i dont think in committee we need to second but vote on that. Okay roll call vote on supervisor peskin motion. On the amendment by supervisor peskin supervisor tang no supervisor peskin supervisor farrell nope. There are 2 one i and one no im sure that is part of discussion in a few minutes and i want to thank commissioner tang and the dipt for working on this issue it is awesome legislation about a year since electrical vehicles and an awesome experience but feel it is for the right reasons so the more we deal with legislation i want to thank and supervisor tang for this issue so with that, the underlying item a roll call vote. Supervisor peskin a roll call vote. Okay motion by supervisor tang. Through the chair with a positive recommendation as amended and a committee report. Without objection. All right. Item no. 2 urging the evaluation and allocation of properties for urban agriculture. The properties fushlg. It was sponsored by supervisor ronen and supervisor tang so supervisor ronen. Thank you colleagues today im proud to assume the officeship of a resolution together with supervisor tang on urban Agriculture Supervisor avalos the former district 11 supervisor introduced this on the feed of the closure of the city garden in district 11 last december that was a beloved neighborhood gardener for urban agriculture this resolution reaffirms San Franciscos commitment to allocate properties for urban agriculture so that hopefully in the misfortune we can recreate the magic of little city garden without shutting down in 2009 San Francisco made a commitment to prioritize un and local Food Productions from mayor gavin newsom the healthy and Sustainable Food for San Francisco in 2011, the city demonstrated further commitment by administrative review the planning code to allow United States umg in all zones throughout the city as recently as 2014 our city created the first urban agriculture incentive zone by implementing the Assembly Bill that loud the city to evaluate sites including surplus city sites thats been 3 years and not yet secured the land for the if you will indulge me projects that what provide Educational Opportunity for children and families and adults and the chance to grow fruits and vegetables here within the city i understand that there are questions about competing priorities for land use given our huge affordability and hicks housing crisis in the city certainly building housing is a top priority housing is a top priority we have to balance our Housing Development in this city where some agricultural space for heath fresh foods for the residents and connection and for the unification in neighborhoods that resolution calls the assessment of a limited number of suitable sites for the Development Challenges have been rendered vacate and underused foresight from flooding and limited egress that have a history of aulgz usage and sites identified by the Community Groups to be desirable for architectural i made in the portal neighborhood which is known and has been declared the Garden District of San Francisco ways in the past century that was a place for new immigrants to establish themselves by growing flowers and other things geographically and hiv that has perfect weather for the city for the implementations of a urban agriculture project as a contribute to the neighborhood groups i hope this resolution is a step to accomplishing that goal and the urban agriculture projects are valuable assets they help to galvanize the neighborhood and provide hands on education about produce and preservation and understanding the larger agricultural system long use tenure has proven an important thing as addressed by the Assembly Bill in 2014 if we want want this to be a permanent fixer for San Francisco Educational Opportunities we need to forge a pathway for urban agriculture projects to assess outside of temporary land use spaces before i open up to commissioner tang and my colleagues in Public Comment i wanted to give a huge thanks from supervisor avalos for beginning this to kate from the little city gardens youll hear from shortly and angelian from the urban Agriculture Alliance and others that or the cofounder the project and eli from spur and karen from the sf cause for working with former Supervisor John Avalos and my office to form a resolution i hope that gives us more momentum to we can secure the goals of gaining space where we can have permanent urban agriculture in San Francisco thank you very much. Supervisor tang did you have any comments if none have comments open up for Public Comment and im oh, im sorry. calling names from rec and park and has a brief presentation thank you so much for being here. Thank you, supervisors im the brand new urban and Community Gardens Program Manager for the rec and park i recently moved to rec and park from the department of the environment where i worked for 10 years on a variety of things with the urban agriculture and worked on those policies that you mentioned in our introductions im delighted to be part of rec and park and providing more direct service and happy to talk about the urban agriculture and Community Gardens so overall i wanted to give some overall of what rec and park does to support the Community Service in our San Francisco and take questions. So we have two major goals for spotting Community Gardens one is to provide a direct support for garden and provide leadership within our Community Garden network anhiand have a lead role of our sister agencies on the ushlg policies for the first point rec and park oversee and provide support of 39 Community Gardens with the Community Gardeners have over one thousand plots available for purchase in San Francisco and have alamany farm the largest and longest urban farm in San Francisco that farm has has approximately 7 thousand hours of volunteer hours dedicated were proud of that site we also acknowledge there is a high unmet need for Community Garden space in general in San Francisco we have more than 35 hundred people sign up to an a wait list to get a Community Garden that demonstrates we have 11 hundred plots and 35 hundred people waiting for the second role rec and park supports an un citywide were reessentially the Ad Working Group and working to reestablish the open garden days we give away resources to Community Gardens and their gardens whenever their gardening and were also looking to identify stakeholders additional stormwater that will fascinate the workshops that will balance the budget all our City Resident im available to answer any questions if you have any. Great. I think im going to open up for Public Comment if in my colleagues dont have any questions okay. Thank you very much. With that, i will actually open up for Public Comment. All right. Anyone from the public wish to comment on item number 2, feel free to line up on the screen side of the room. Everyone will have two minutes. My name is karen im here on behalf of bee cause in support of resolution our organization was founded in 2010 and sponsored by the Parks Alliance and 3 olympics to educate resident no need to be afraid of bees native or honey bees and what kind of bees in San Francisco and what we can do to help them and why are honey bees and native bees are important in their environment their pollination helps the argue more successful and maintain the bio diversity from 2010 to 12 we were on the farm on the part that is developed for housing in 2012, we have a charitable use of half an acre on san bruno on the edge of the Visitacion Valley neighborhood sins then turned the neighborhood eyesore into eye candy were the bee farm and conducted 3 projects first, we won a two year bee keeping Apprenticeship Program and began the fifth program and for demonstration we grow bee pollination and other plants managed by volunteers this we conduct bee surveys 2017 will be the third year nothing like the bee farm no where in the United States there simply isnt and unique were entirely selfsupporting the honey produced and managed by the bee keeping Apprenticeship Program the new owner will develop housing that is great but we also want to continue and we are looking for a site thank you. Thank you very much. Next speaker, please. Supervisors thank you very much for having this hearing on this important topic im the president of urban resources the home of just one tree projects and other green promotions we have been advocating for greater urban Health Alliance for thirty years our city does a great job in setting the goals for religiously the Carbon Footprint but the food areas is hit hard i think that most of us know the majority of our food comes if 2000 will miles away at every mail 5 ingredients from another country we must focus on Food Production in the city i think many people thought we couldnt do it here not having the land we have some land and other production sites that are important we can go vertical that is the nature of our demonstration project our goal is to show that any city even the densest city in america like San Francisco, california selfalign we pick lemon trees only 11 thousand to be sufficient this is what weve been trying to do this legislation is important because public land is where a lot of the Food Production can take place many of the agencies that have land does not think about it in terms of Food Production id like to suggest this legislation add to the list maybe include owl city agencies our biggest lemon orchid site theyll not normally be thinking about Food Production but have a good leader ill expand all the legislation to include all city agencies reporting about what land they have thank you. Thank you. Next speaker, please. Good afternoon, supervisors todd to support this we think that the community farms and the commercial automatic is important part of livable city if you look at studies from philadelphia having the access to Community Gardens and farms and people growing food for improvement of innovation is helping the pocketbooks and helping to save money and build communities and a huge number of gardens reports that are connections with neighborhood improve Mental Health physical health there are a myriad of benefits and competition for land this is important as we move forward we hope you will think about equality we had a map if you look at the general plan with the playgrounds and the radius around playground you realize this is a desert their low income Communities Community with recipients that dont have garden in their communities so the key piece to find the land as your assessing think about mapping and another standard for accesstolysis another stunt here we find food on rooftops we have an issuance a lot of that is habitat like the community of science but it can be urban architectural look at the 25 percent of the citys in the public rightofway about 13 blocks unaccessible and not maintained that is a huge land use you can find the skweeflz i skwieflz and green space by taking 10 percent of public rightofway so a lot of opportunities and hopefully that is the beginning the conversation thank you. Thank you. Next speaker, please. Good morning supervisors im kate less than and the cofounder of the farms until our closing 2, 3, 4 december we were the only farm grew food and flowers and offered tech programs we worked onsite close to seven years and when we were there the gate was open for food im here to spotlight this it is conducting liz cotter was a narrow property that flooded only assessable on one side and owners failed to get permits for the Housing Development before he we exited the site the properties is notable here particularly challenging site for decades and particularly well suited for neighborhoods funds and unfortunately despite our efforts for pretty much weve been in conversation with folks and it went on the market in 2014 and purposed quickly that past fall despite hundreds of members the Planning Commission felt their hands were tied and approved the plans for the development the loss of this site where the policy came to fruition so today as the land farmer with incredible experience he look to the resolution to help us figure out how to move forward and i think there is a lot of Untapped Potential and the availability of farm is dwindling we need the citys support we hope weve got our vote in favor. Next speaker good afternoon. My name is marion a cocoordinator as the Alliance Works to help to pass a. D. 551 and San Francisco was the first to implement urban zones we believe that this resolution will be a way for the city to show the continued resolve for supporting european e that ushlg the first coordinator for rec and park showed Public Interest in urban agriculture people want to get involved and know the benefits and as you may know we have high Property Values and not enough housing so the city is responsible to try to prioritize in the places where it is it can happen we believe this resolution can help to show that resident and other cities that the government of San Francisco is dedicated to making sure we dont lose those more spaces that are possible for urban agriculture obviously not as high of a monetary value but other value so, please vote yes on this resolution thank you. Good afternoon. My name is patricia a unite whaler in the bayview and a farm in alamed it provides employment for homeless and im here to support the resolution that we believe will be a step in the right direction there are a few institutions that has the impacts on a community and makes that for myself ill not be here without little city garden and has been in the city on a regular basis the trainees at the farm talks about hallway u how this helps their families wellness and this work has become valuable spaces that art and health and food ecology and cultural and blight and sustainability politics and so many issues come together and unique in some ways those desire direct attention and engagement should not be close to the margin in the city to keep it assessable and connected to the community their part of the farmable lands will be missed once it is turned into condo how can those recovered the city is hard fought made hard steps towards this in the past and this resolution is another incredibly value step in the right direction and continuing to cultivate a city for progress thank you. Thank you. Next speaker, please. Good afternoon, supervisors my name is eli on behalf of spur im here to support the resolution thank you, supervisor ronen and supervisor tang for bringing it forward first, the support of this for a variety of reasons one of the biggest is education connecting people in the city to a sense of what fresh food is and 2012 report called the public harvest we recommended the city continue to identify the public land and sites for acquisition we can expand urban agriculture i want to note on the 2009 executive director inventory that look at this and may i less than pulled this together but the puc is developed this an education there is a good chance well find additional spots i understand the concern of competition with housing working with spur we understand this and want to see more housing and 3 things we want a mix of open space not all sites are suitable for housing and not for if you will indulge me but this should say a be a case by case and more importantly that doesnt dictate where this will happen it only calls for the city to examine this and identify the sites at that point the evaluation we can do the balancing for other uses i hope youll supported this and thank you for your time. Thank you. Next speaker, please. Good afternoon, supervisors i volunteered at the this city garners for a year and a half for the support of farms a unique place especially in a city environment of most i got involved the more i learned about urban agriculture and place like austin and brooklyn and others this is why i found shopping with the San Francisco a place usually at the forefront of proving changes cant protect its own viable farms there was a ton of support to keep this operational neighbors came out and you cant august that with the real estate value and pollution and noise reductions i myself was inspired to start my openly own Small Business i sold ice cream in my own backyard in order to grow the business i need a plot in the future with the Farm Movement now growing being the normal i imagine im not the only one please port this this is beneficial to our neighborhoods and environment thank you. Thank you. Next speaker. Hi good afternoon. My name is Richard Chung a volunteer at the little city garden for the past 5 years im grateful to have state your full name for the record on them and in support nephew resolution he went to school at marshall and in the district i see this concrete concrete concrete and im grateful to have moved off and nurturing that aspect thank you. Thank you. Next speaker, please. Good morning supervisors thank you, supervisor ronen for introducing this legislation my name is lou which i im here on behalf of the greenhouse were with the portal district and our current Central Project is 777 an entire block were working as a urban farm for the benefit of Portal Community in San Francisco largely first, i want to echo everyones sentiments about the robust benefits of urban agriculture the city environment and the health and wellness and how critical for the residents of San Francisco this legislation address an obstacle when we interviewed people how difficult to secure the access to and continue using land for automatic in American City and counties cities it is true in San Francisco where undeveloped planned lapd is harder and harder to find given San Franciscos longstanding commitment to sustainability and resilience and its recent investment in urban agriculture the city want wait to preserve the parcels for farming as a pro tem site that makes auto the contrary and so forth in the resolution 770 will serve there the robust and john Training Program and part of next chapter of urban agriculture speaking on behalf of the Portal Community we give me our support and develop the urban agriculture in the city over one hundred Community Members gathered to celebrate the neighborhood recognized as the district and lord to an agricultural as the portal addition once again the Portal Community urges the committee and the committee of the whole to pass this legislation thank you. Thank you. Next speaker. Hi, im keri a san franciscan and live in the Mission Neighborhood i actually little city garden is around the corner from my house this resolution could be one of those things with the last commercial farm in we lost that battle and really want to be part of a city that has this resolution can be one of the things that could have saved that farm maybe you can safe other farms and have spaces for them so, please consider it thank you. Thank you. Next speaker. Hi laura clark action i wanted to remind everyone were less dense than we have a lot of space we can building more housing especially on the west side to actually take a real bite out of our you know climate goal but additionally im concerned that kind of resolution can be used to fight against shadows maybe cast on a Community Garden which building 2013 housing it is most useful thing to do with the dismays this can be used to fight housing obviously thats the only thing i care about. Thank you. Is there any additional Public Comment on item number 2 . Seeing none, Public Comment is closed. Supervisor ronen i have one question sure. First of all, thank you for bringing up this forward i grew up where my mom was a member of the action on federal land it is different but awesome growing up in San Francisco and a lot of the comments having diversities of spaces and not just a concrete jungle i agree that only question i go supervisor ronen through the City Attorney how will this effect our surface land and heirs ordinance and how will we justify kind of or reconcile the two, if you will. Sure i mean would you like me to answer i think we Just Creative a catalog of possible things to look at it and to consider when looking at pieces of land whether surface or properties perhaps the city can acquire to create urban agriculture not a you know prison thing weo show evaluate the for land use one piece of pulse is that appropriate for the Housing Development near and dear to my Heart Properties ordinance but not all of those pieces of properties some are too small and some inappropriate when that is the case another aspect to look at when deciding whether or not the particular piece of land will be appropriate for urban agriculture. Well done okay you thank you very much. Sorry supervisor ronen. I want to really thank everyone for coming out today and say that we learned unfortunately, the heartbreaking loss of little city garden and fight to preserve it and during that fight learning about how much that garden brought to the neighborhood and brought to San Francisco as a whole was you know a very sad way as a city to be educated by the benefits ever urban agriculture and sad to say were not able to safe that farm but hold that loss in the memory we no longer have in that farm together with the resolution to continue the many years of the citys focus on urban agriculture well renew the sense of urgency around the need to create a new space and i really want to echo some of the Public Comment around equality and especially in areas of city that are predesert that we particularly looking at those areas for potentially to acquire the surplus this is a resolution recommitting ourselves to this project but committed to continuing to work on this issue and partner with rec and park, cca our Real Estate Division and any city agency that shares the goals to realize a permanent space to have additional ushlg space and hopefully another commercial farm here in our city so with that, colleagues, i will ask for your support colleagues any commissioners comments, and questions. Okay motion by supervisor ronen. All right. I dont think i can. Ill make a motion. Thank you very much sorry. Make that motion to. Send it to the full board with a positive recommendation. Motion by supervisor tang colleagues, can we take that without objection . Objection so moved. Number 3. Item no. 2 planning code construction of accessory dwelling units. Into conformity with the state law mandate and michael appropriate findings. Okay. This item was supported by supervisor peskin so im going to turn it over to to him. Must chair peskin and supervisor tang as you may know over the last decade and maybe dozen years thinking around secondary units we call them accessary dwellings has evolved i think in 2002 actually introduced an ordinance to try to look at the development of more and more o more of the inlaw units but in those days, the third rail the politics in San Francisco and i was i think i fella vote shy fast forward a decade my successor david chiu passed a similar ordinance and after that ms. Turner or Supervisor Scott Wiener did a Pilot Program and my predecessor pioneered a similar albeit it adu legislation for district 3 and in as far as great minds think liquor the chair and i had similar legislation that came down to a coin toss with the b anthony dollars to interesting enough and our two pieces of legislation laterally end up condo to one another and the subject of ongoing conversations and amendment that will be discussing in the week ahead the state Legislature Passed a law that become effective on january 1st, i was informed by the deputy City Attorney that typically our law was out of compliance so what is before us today is what the City Attorney recommends to bring this back into compliance that was heard by the Planning Commission on february 23rd and again briefly on a thorough procedural matters last thursday and some of the most important suggestions that planning made i have gotten the zoo to incorporate and they are ready to speak to and i will hand to you colleagues there is one and here is another actually. That one is for the City Attorney theyre the same. And so we have representative from the Planning Department here today what i indicated to the Planning Commission ill do duplicate the file today and would like to in the interest of time send the first part with a few amendments and well hear from the City Attorney about a couple of the missing details actually typos that we will need to amend in the whole and the duplicate file will be continued to presumably the land use and Transportation Committee after may figure that out is may 8 i believe if im doing the math right and entertain the trailing amendments on that day and with that, im happy to hear from the Planning Department staff and colleagues and members of the public sorry just to be clear i think that is sounds like are you going to speak to those or the Planning Department. The major amendment is the amendment that was appointed by Planning Department staff and that is to have this legislation include singlefamily homes in misrepresent family Zoning Districts that was necessary and was an oust to conform with state law and that the minor technical amendments john gibner, deputy City Attorney. And speak to actually maybe in our version of with my mark ups there is a sub one that actually is supposed to be sub 3 on one moment if i gave you the one i marked up mr. Gibner you want to speak to those. Hold on no, no we should step back and as opposed to flipping throw things and going through different amendments talk about one by one what is contained in here. Planning or to supervisor peskin. Good afternoon Planning Department staff i would like to first thank you supervisor peskin and appreciate his efforts for keeping the adu program in compliance to state law and in a timely manner the state law finds that the programs are not in compliance with the state law theyll be demonstrated null and avoid this item was before the Planning Commission on february 23rd and strongly supported the ordinance that the following modifications the first is about adus and rh1 district the proposed ordinance maintains the language in the code that makes the general reference to the stating for adus in rh1 d districts at the same time the ordinance creates the detailed new set of standards for the adus and singlefamily homes in rh1 and rh1 h from the planning code is required the commission represents accepting the rh3 for the same set of standards without the recommendation the department will need to issue a Zoning Administrator bulletin to implement the state law for rh1 b district to develop this the department will duplicate the work of the ordinance interpreting the state law the state law that informed the new controls in this ordinance the second recommendation is about the types of spaces eligible for conversion of adus the proposed ordinance that allows 0 the space from an existing unit but not from the garage the staff the Planning Commission recommends including the garages as an eligible space to be converted to adus that is consistent with the citys policy with adu in the past couple of years that allowed for the garages converted to adus the 3rd. Maam, sorry to interrupt just to be clear what lines are we are talking about here. The line in the ordinance. Uhhuh. The second part
