Now an aid e has tell abc news that those talks have broken down. They could reach an agreement tomorrow, thats considered the last day to have lawmakers to consider and vote on legislation to fund the government by midnight this friday. However, hope for a breakthrough have now diminished. The white house chief of staff and mulvaney says the president is ready to act on his own if he does not get a deal he likes. We cant rule on a shutdown. Whether or not he gets 2. 5 or 5. 7 million, hes going to do whatever he legally can to secure that border. Is declaring a National Emergency still on the table or is he persuaded by republicans lets not go there. It is not a precedent. This is the law. One of the top negotiators believe there is still a 50 50 chance a deal could be reached. I dont think we would ever give up with the president will have some options, perhaps will have some options but short of a deal, theyre not good options. The next 24 hours a crucial, we can close some deals but they got to be good to secure our borders. The biggest Sticking Point appears to be money for a border wall verses the number of beds the government will fund to detain undocumented immigrants. I promise you this, donald trump, is not going to sign any bill that reduces the number of bed Spaces Available to hold violent offenders who come across our border. He cant do that and he wont do that. You can take that. The democratics goal is to reduce the numbers best place provided for criminals. The Budget Committee offered this assessment at the state of the union and what could be done next. I think the goals have shifted a lot on both sides. This is really not over substance and what neileds to happen is secretary neil needs to come to the hill and lay out her plan so we can figure out and try to agree on an agreement on what the provision should be and well fund them. Nbcs correspondent, kelly odone odonell, what are you hearing about this. Reporter the expectation had been the team of negotiators of both parties and house and senate could conceivably reach a deal today. They sign that report, it becomes legislation and the steps for the house and senate to vote and ultimately the president to sign it would happen by friday to avert a shutdown. Thats why today is so critical in order to have enough time to have the necessary steps. Both parties and as you show in that very good round up of the critical sound today from news makers, theyre saying they really hit a snag, the issue are over the amount of money or the definition for border or barrier security and the number of detention beds. The president has weighed in on twitter and complaining that he says democrats were involved in this process are given permission to make a deal. He does site the beds and the numbers there making the point of violent offenders and the number of detention beds are a great concern for democrats because they have been utilized for the migrant families who are not violent offenders other than they are undocumented and being housed for a long period of time. For democrats the idea of reducing the number of beds available for detainment would have an effect of the policy, not wanting to have families separated and being housed by the u. S. Government. These are substantial issues, the dollars and the policy. If they are not coming together today, thats a worrisome sign. The acting chief of staff for the president and hes the budget director as well, Mick Mulvaney was on television this morning. Here is how he frames the situation right now. The president is going to build the wall, you saw what the Vice President said there, thats our attitude at this point. Well take as much money as you can give us. Well find the money some where else legally in order to secure that southern barrier. This is going to get built with or without congress. Reporter the context for that is the president asking for more than 5 billion for the wall. If they could reach an agreement for less money being devoted to the wall right now, there are other means where they can take appropriated money and directed towards the use without a National Emergency, just sort of working the system to look for that and openness to that idea from the administration would be the president moving some what. The president is not backing off wanting a wall or a barrier and now this new issue of the number of detention beds being made available and how many would be funded, that carries big ramifications so thats a serious concern as they are running up against the deadline. Alex . Kelly odonell, thank you for laying it out for us. Lets bring in katy hill, democrat from california, also, science and Space Technology committee. Welcome back to the broadcast, i am glad to see you again. Tell me what you are hearing from your colleagues of the negotiations today. Right now this is a stall. We have put on the table there is going to be some funding for barriers and this is what i have been talking about for a long time. The hang up is around detention beds. What the president and the republicans are asking for is not more beds for violent criminals, theyre asking for more beds for violent criminals. They made crossing border a crime. These are people against seeking asylum and coming from desperate situations and now have became criminals and we are detaining them. But, this is something that is basic humanitarian thing, it is a value issue. Is there any way to distinguish between those beds, i mean to accuse democrats of wanting to reduce the number of beds for violent criminals is an absurd concept. As you explain for the familys crossings, you dont want to allow the ability for i. C. E. To detain them in such a manner. Right. Can that be spelled out in details . Yes, i am sure it can. I am getting on a plane right after this about what it looks like. This news came from republicans who decided that their narrative is going to be we are trying to reduce beds for violent criminals and it is not true. We need to get ahead of this to talk about what the plan is and what we are asking for and how it compares to prooeevious poli. You heard Lindsey Graham says this could end up to be another cr. I think that there is a possibility of that. I think we are all very, very committed to not having another Government Shutdown. I certainly hope that we dont go into another cr. The longer we push this off, the more indepth well look at governing. The longer it takes for us to get to the real work that matters to so many americans. Hearings have been postponed because we have to focus on this. Committee work has been postponed. It is a tactic on the part of the president because he does not want these investigations to happen. I think we have to get this matter resolved. We cant get it resolved for another two weeks or months. We node to get it done for the balance of the fiscal year and we can come back in september and figure out whats next which is also annoying. Just for clarification, you said we all dont want the prospect of another shutdown, were you talking about democrats or everybody on capitol hill, both parties . I actually think both parties. Republicans know it was damaging to them, too. Many of them really did feel the pain of the people in their district but they. Reporter silenwere silence. I do they they do not want this to happen again. God, impassion nate abo am pass making sure it does not happen. We are seeing attempt for punishing california federal workers of unemployment. They did that. Now, the department of labor has issued guidance saying theyre not going to pay california or other states who did that back. I have introduced legislation that would fix that problem. But, it is just one attempt after another to undermine california and our federal workers and i think we really have to focus on the bigger narrative of getting it done and doing the right thing and making progress to the american people. What are your expectations for the president when he heads to el paso tomorrow. I am sure hes going to make another case that this is the crisis. I know a lot of people who live in el paso. Their overwhelming narrative that this is not the problem hes making it out to be. There are reduced criminal rates in border towns and border cities than there are across the rest of the country. This whole false narrative is unbelievable. How many times can you Say Something thats untrue and turn it into this false reality for people. We just have to keep counting that narrative and move on. There is a long list of actions under investigation right now. One of the things your over Sight Committee is looking at is White House Security clearances. Listen to ivanka trump talking to abc news about this. Here it is. The president had no involvement pretending to my clearance or my husbands clearance. What were the problems earlier on . There were not any, other than a backlog close to a million. Does your company want to hear from ivanka or the individual who approved both her and Jared Kushners clearances. Those who approved the process. What i want to see is how theyre able to by pass all of those millions of people that were on the backlog. It is true there is a backlog and this afenfects my district ska significantly. We are heavy involved in the aerospace industry. It can stop people from being able to get those important jobs because of how long it takes. I am interested in this for two reasons. Why is this so difficult for us and what resources do we need to put in place for regular people, what i also think is critically important is why are we holding the most important people who are working in our government to by pass all of those standards and what risk does that put us in . Congresswoman, katie hill, from california. Safe travels back to d. C. And get to work. Joining me right now, Jonathan Lemire and msnbc political analyst, charlie sadvige. Hey guys, good to see the three of you. Put all this into perspective and why is this a point of contenti contention. It sounds like what democrats are trying to do is bring a new issue to the table to cap the number of beds that i. C. E. Can use to detain undocumented immigrants as a way to curve the aggression of i. C. E. Which is a big issue on the left with the abolished i. C. E. Rallying a cry. Republicans are saying lets have an exemption for violent criminals. Everyone whos a violent criminal would not count towards the cap or it would be meaningless. It is interesting that this is coming in at the 11th hour, looks like democrats are willing to budge a little bit allowing trump to build some barrier. It is causing republicans to sputter. One more sign that this thing is not close to being resolved. I think this is dpoigoing to en with trump declaring a National Emergency and the whole thing gets tied up in court rather than any deal. It is going to be hard for him to back down without totally losing his base and thats where we are. Charlie, you dont think if he gets 2 million, that was more than what he originally proposed, hey, this is a start. What would anne coulter say and hes looking at his reelection without his base and which was all about immigration, thats the core of his base and the mexicans are rapists and so forth. Right. You are thinking of National Emergency declaration here. Jonathan, when we listen to mulvaney this morning, he let open a possibility of a shutdown. He says this wall is going to be built one way or another. Do you think there is a new sense of conference and new sense of that in the white house . There is several different options here. There is no question of optimism last week that a deal was closed and the talk of no question hit a snag that there is over detention bed as you said but also the exact amount for the Border Security and the wall. Mulvaney today could left the door open for a couple of different things. Yes, he was very clear, the president will be justified in doing so and had legal authorities doing so. We know there is a lot of resistance in doing this. People in his own white house have cooled on the idea and a number of high profile republicans and including Mitch Mcconnell have counted on the president not to do this, also, that it could set a template for a future democratic president to use it to advance some sort of liberal cost. Their third option beyond the shutdown which is on the table that the white house really wants to avoid considering the beating that the president took over the polls, that last option you take the money that Congress Gives you whether 1. 6 or 2 billion and you find the remainr remainder some where else. That may face legal challenges but that would allow the white house declaring some sort of victory and importantly allowing the president to say as the legal battle goes on, hes still fighting for the wall. The fight is even more important than the wall. Are you giving credit to Lindsey Graham saying another cr . Hes one of the president s closest allies on the hill. There is other times where he floated ideas within days or week that the president sort of grab and oh, well do this. It is possible. It is possible it got kicked down the road a little bit. Both parties want to avoid that. They dont want to love this drama. They want to go to other things and the House Democrats want to move onto other business including the investigation. I think that cant be ruled out. Both sides would probably view that as a better alternative than another shutdown. Lets take a listen to Something Else that mi Mick Mulvaney said this morning. Here it is. I just dont know where the democrats are. Thats a reflection of where their party is. I dont think they know where they stand on this issue. Thats one of the reasons we are having a difficulty coming to a deal. Is that a fair c categorization . Do democrats know where they stand . I think nancy pelosi have been clear on day one. Zero money for the wall. They have open to border fencing or barrier money. Thats something democrats have come around to and they got to close to an actual number. Thats where they were at on friday. They were hammering the final number for that. The question was whether trump would be willing to accept that. We dont know where trump is. Hes the most unpredictable component of this negotiation. Hes the wild card. It is whhard to say if hell si. I agree with charlie, i think this is headed towards a National Emergency and thats the way hes going to try to get his wall money. Will he sign a short term cr or continuing the resolution, i talked to mark meadows on friday, he was one of these guys who helped orchestrate the first shutdown. He says he would support a yearlong cr and the president to do so as well. We dont know. Hearing mulvaney this morning on meet the press saying another Government Shutdown is not off the table is rattling a lot of people on capitol hill right now. On the flip side, there are lawmakers involved in negotiations who expressed skepticism but they do remain hopeful. Take a look at john tester. The bottom line is we got people who are not bomb throwers, people who know how to get together to work a deal. With this group of people and the folks in the house, i think well end up with something. The deal with detention beds or barrier or technology and the challenges that we have on the southern border in a common sense way. I am hopeful, not positive that we can come to an agreement. Is there an appetite anywhere for another shutdown . There is absolutely not. What senator tester is saying hes not talking to the right people. Nonbomb thrower republicans on the hill are not the problem here, the problem is what the president will sign and his behavior makes it difficult to know what is achievable deal. You are echoing the sentiment of melanie there. Last question to you, jonathan. Speaker pelosi urging the white house to stay out of negotiations, has he been able to do that . Well, he largely stayed out of negotiations in the room. Mulvaney convene lawmakers at camp david on friday and thats where things start to hit a snag. The president is not restraining himself on twitter. We have seen him time and time again, weighing in on the deal. To this point, it is fair to say hes less involved than the last time when of course he famously in the oval office would own the shutdown if that were to happen. He was forced to own it. 35 days and we saw and developing some cracks in his own party. He kept a little more distance from negotiations but the same thing, the wall is still his surka Signature Campaign process. No, mexico is not going to pay for it. If he takes no wall money or little wall money, he has to be able to sell that to his conservative base and it was them, it was the anne coulter who last time more or less scuttled the deal. The president was willing to take a agreement and after they bought, thats what he pulled out in the Government Shutdown. Last toward to you melanie, do you want to give me a prediction . If we dont get a deal by tomorrow from naegotiators, it s not going to happen. There will be a cr put through and trump will declare that National Emergency. Jonathan, charlie, and melanie, very good to talk to you. Another candidate is joining the field of democrats who want to be your president. Is it better to jump on the deal now or later . Now or later does your customers connecting to the wifi ever slow down your business . Yes, it does slow things down. Aggravating. Its a nightmare. So our gigspeed network is fast. And we go beyond fast by making it easy to create separate networks for your business and your customers and even control how much bandwidth each of those gets. So your business wont miss a beat. This is a big game changer. This is the new wave, and whoever doesnt get on, i think they would be left behind. Just one more way we go beyond at t. Right now get fast, reliable internet and add wifi pro for a low price. Comcast business. Beyond fast. The president weighing in this morning on the chaos of virginia, africanamericans are ang gi angry of the double standard on full display in virginia. This comes from the polls showing 58 believes northam should stay in office opposed to 47 in the overall. Given the breath of this story. What are we hearing or if anything from ralph northam, mike . We are hearing from ralph r northam and we are not hearing from the Lieutenant Governor whos under the gun right now and that would be Justin Fairfax, Late Development last night, the Lieutenant Governor putting out a second statement and clearly and quite forcefully denying the allegation including a new allegation on friday night he raped an individual in the year 2000 when they were both duke students at the university. Our camera outside at fairfax county. Justin fairfax walked out of his home. He did not have any comment for anyone. He did put out a Statement Last night saying i did not assault watson or tyson or anyone else. Interactions that hay had, not denying there are interactions but he said they were consensual and he heard from them and had conversations and talked with them in the years following these allegations, he says they never brought it up. Thats something both of these women through their lawyers are disputing. Governor ralph northam, we thought he would be gone and fairfax would be the governor of virginia after that controversy exploded two fridays ago. Hes giving an interview from the Washington Post. Theyre testifying to the character of ralph northam. Shes giving an interview to cbs and he was asked about Justin Fairfax and whether or not he should resign. These accusations are serious and they need to be taken seriously. If these accusations are determined to be true, i dont think hes going to have any options but to resign. Do you think he should resign . Thats a decision he needs to make. What do you think . I want the truth to come out. Reporter and alex, back to the two women who are accusing Lieutenant Governor, watson and dr. Tyson, they have put out a statement to the latest statement to governor fairfax, did you remember friday night, the house delegate is going to introduce impeachment against fairfax when they return tomorrow at noontime. Both women now say they would happy to come to richmond and testify against fairfax if they are going to happen at all. This is far from over. No doubt well see you there from richmond again. This is absolutely not a crime to ask somebody to simply tell the truth. Tell the truth that this was not politically motivated. If you dont want to say what you want us to say, we are going to publish these photos. It is part of a negotiation. Not in an attempt to blackmail for commit any crime at all. Politics did not have anything to do with this story. It was a typical enquirers story. Jeff bezos was not quote, good faith negotiations. This comes as prosecutors looking on whether investigators violated the code. Joining me now dylan byers, welcome to you. As we look at what the attorney had to say there. Is this typical enquirer story . Well, yes and no. It is typical how sorted it is. It is typical in terms of the highly sexualized and scandalous nature of it. The wealthest in the world, jeff bezos, i think on of of that alex, by the time this story comes out, david pecker already entered into a federal agreement which he admitted to some of the shadier aspects of the National Enquirer journalism including the catch and kill story. Why even after admitting to that, why are you continuing to engage going after jeff bezos and more importantly sending letters to him that may or not be but having the appearance to be extortion and blackmail. You are right, legally there is questions of how that fits in the federal profile there. Let me ask you about this. Bases appear to highlight in my connection with the president of saudi arabia. Lawyers responding to that. Take a listen to what he said. All ami wanted was the truth. Any investigators investigating this knew who with sources was. It was not the white house or saudi arabia. Dylan, can you put all these claims together for us of what you make with jeff bezos connection, is it plausible . Everything right now is plausible. It is plausible that there is a political motivation. You look at the relationship that david pecker has had with President Trump going back decades. You look at the relationship that david pecker had built with saudi arabia. The insinuation that jeff bezos floated out there, but not coming down hard on an actual legal charge or even real accusations just floating out there. Yes, it is plausible. Is it possible that abramnowits saying it is true or perhaps Lauren Sanchezs brother and has ties to ami or Lauren Sanchez herself. It is all plausible. Jeff bezos when he released that, it effectively floated all these threads for the media and for federal prosecutors to look at and chase down but at the moment we are sort of in the dark right now of what checks out and what does not. I want to make sure Lauren Sanchezs brother denied hes the source of one big circulation out there. Thats right. Could this turn out to be a bigger conspiracy ultimately, i know you are saying anything is plausible at this point but with regards to politics and the fact that ami and david pecker supported the president , and we know how the president certainly feels of jeff bezos which is not highly. I mean is it a chance that this who el thi whole thing mushrooms . Yes, absolutely. We should not suggest anything is outside of the realm of possibility in the year 2019. This story keeps on getting crazier. What i will say is we are all focused so much now, at least pop culture right now and so much focus on what ami has on bezos and what are in those pictures and text messages. The real story given how high this has gotten and quote on quote blackmail and extortion, what does bezos investigators have on American Media or on trump if you be i the conspiracy theater. There is full potential that this can dub tailed right into other investigation going on with President Trump. This is not so much a story of the richest man in the world or a media story, it could be heavily charged political story that ties into some of the investigations that we have been covering the past two years. Everything is on the table right now. The question is investigators are looking into it, at what point do they nail down into the specifics. I am not in a position to say the president will absolutely sign or will not sign. There will be some things simply we could not agree to. The Government Shutdown is technically still on the table. Mick mulvaney admits new alarm around boarder negotiations. Another burden shutdown. Lets bring in Elena Beverly and our republican strategist, susan persio. Welcome both of you. This is is this a hiccup or is it some kind of a major warning line . We dont know. One thing we do know that it was left to the folks at the table right now, they would come to an agreement. Thats pretty much said on both sides of the isle. We just dont know where the president stands and maybe he was willing to accept it until 15 minutes ago when he saw something on fox that he did not like. There is no way of knowing. Thats the uncertainty behind all of this. Your point is this. Those negotiating will put this together but elena, there is a senior democratic aide who told nbc news, those that are not necessarily due in negotiations, reporti putting this limit on the number of i. C. E. Beds. If the detention beds are Sticking Point in these talks, is that one thats worth risking in the shutdown . Well, i think the democrats are not just focused on i. C. E. Detention beds, i think the major Sticking Points whether or not there will be wall at the border, whether it is 65 miles or something more to what trump has offered as his negotiation point which is 5. 7 billion worth of a wall. I think that ultimately it is not the i. C. E. Beds tha, theyr trying to make sure it is not undo attention at the border. Thats what the democrats are stanni standing for. Theyre saying there will not be funding for a wall, that goes to the level of 5. 7 billion. Lets go further with this dollar figure. Suzanne, look at the Washington Post that lawmakers are trying to land some where between 1. 3 billion or 2 billion. Thats short of what the president is demanding. Lt lets say they make a 2 billion arrangement deal here, do you think the president will reject that or a way he can sell it as a win. He can do that by saying we have barrier protection in the ground of 2 billion and we have smart wall being built and Technology Wise for another 5 billion. Hell say thats more than he asked for. Hell just spin whatever he wants and thats where some of the new negotiations that were all in the wording of all this. We are not talking in the scheme of things, that much money they could not negotiate over. It is all about the wording. Hes also heading to the border for a Campaign Rally first of his 2020 campaign in el paso. What do you this i tnk the risk doing this right now for these funding talkingsstalks . This is what the president does. And under any circumstances, we say there is no way that anyone to do this. I am just at this point i cant tell you why he thinks the way he does and why he should do it. I cant tell you if it is going to backfire with his base. Probably not. Elena, speaking of tomorrow in el paso, we have beto orourke whos staging a counter rally, hes planning to make a 2020 decision by the end of this month. Do you this i this event is a sign that hes testing the water to see what kind of crowd and the reaction . Well, he knows he gets organ gigantic crowds. This is a platform that he may consider making his announcement, the march for truth. Hes pacing himself as the foil as the counter to donald trump and his racist rhetoric about migrant families as criminals at the border. I think this is going to be fabulous platform for beto orourke and hes positioning well in 2020. Always positioning yourself very well, susan and elena, thank you ladies very much. How is el paso bracing for tomorrows call for and against the wall . Wall burke parking splat. And we covered it. Talk to farmers. We know a thing or two because weve seen a thing or two. We are farmers. Bumpadum, bumbumbumbum we all make excuses for the things we dont want to do. But when it comes to colon cancer screening. Im not doin that. I eat plenty of kale. Ahem, as i was saying. With cologuard, you dont need an excuse. All that prep . No thanks. That drink tastes horrible but. Theres no prep with cologuard. I cant take the time off work. Who has two days . And i feel fine no symptoms everybody, listen all you need is a trip to the bathroom. If youre 50 or older and at average risk, cologuard is the noninvasive option that finds 92 of colon cancers. You just get the kit in the mail, go to the bathroom, collect your sample, then ship it to the lab this is your year own it cologuard is not right for everyone. It is not for high risk individuals, including those with a history of colon cancer or precancer, ibd, certain Hereditary Cancer syndromes, or a Family History of colon cancer. Ask your doctor if cologuard is right for you. Covered by medicare and most major insurers. Well, for those of you keeping track at home, there are only 632 days until the next president ial election and the president is hitting the campaign trail tomorrow, first time in the 2020 election cycle heading to the border city of el paso, texas. He focused a large part of his state of the Union Address on Border Security but will face opposition from an antiwall march called the march for truth. Potential president ial candidate beto orourke is set to appear. Joining me, jose rodriguez. Thank you, sir, for joining me. Start first with the president s trip to el paso. You represent el paso in the texas state senate. What your reaction to the president choosing el paso to hold a rally to champion for a border wall . Well, i think, alex, its outrageous, adding insult to injury after having made his statements in the state of the union, lying about el pasos safety. By now the countrys finding out that el paso is one of the safest and has been one of the safest cities in the country, and this is not something that developed overnight. Its been the case over the past 30 years. I have firsthand knowledge, because i was the county prosecutor sdduring the time th wall was built and i assure you the wall did not have a big, contributing influence in the low crime rates in el paso. It was, in fact, Community Policing, Community Policing that involved citizens including undocumented immigrants who were invited to cooperate with police and reporting crime and supporting Community Policing efforts. So theres been a lot of things weve done here that make us one of the safest cities in the country for its size. You would say a lot is attributable to local Law Enforcement . Yes. Community policing. When it was implemented back in the 90s. Measures that many of us implemented, like myself as county prosecutor. Having zero tolerance or juveniles trafficking and drugs. Getting civil gang injunctions against transnational gangs. Like those that got established in teen courts and a lot of commune education. We have not only great, excellent enforcement in the Sheriffs Department and city police, also a lot of federal presence. The Drug Enforcement administration, customs, border patrol. Largest geographical in the country. Fort bliss. That as well as the culture. Were the largest binatural, bicultural biliterate community in the world and have a symbiotic relationship with those across the rio grande that promoted trade over 400 years. I want to put up the response or talking about the wall and its efficacy from the republican mayor of el paso and let viewers read that. Much of it is actually running in syncing with what you are saying. This is the republican mayor. Discontent to what the president is saying within his own party. I want to ask what may show discontent tomorrow. Beto orourke, speaking at the march for truth, the counterprogram to the president s rally, the 2020 rally there. What kind of message do you hope to hear from beto and is there a chance he could outdraw the president in terms of crowd size . Well, as we know, beto has a tendency to draw people of all stripes, and he very likely will draw more people than the president himself. Hess message is likely to be what he has been saying all along, including myself, our congresswoman, and others, and that is that we need to see the border in this country as an opportunity, as an asset. Its not a dangerous place. Its not a war zone, as some declared. It is a community that has this longstanding relationship with mexico, and it includes not trade and commerce but familial ties, culture, history. This place was one when passing through in 1598, long before the pilgrims landed in plymouth rock. We have a culture where people help each out out. This is almost a quarter of a million population in el paso county, but anybody who comes here will tell you and lives here that it is a small town environment to it because people care about each other, and thats why weve been successful in Community Policing efforts. Glad for you giving a bit of the pulltural history. It is quite impressive in el paso, texas. Democratic state senator from texas, jose rodriguez, thank you for your time. Thank you for having me. The chaos in virginia take as new turn. New reaction and a new poll sheds light on what could happen next. A new hat in the ring. Amy klobuchar set to make a majory nou announcement soon. And a very good day. Welcome to weekends with alex witt. Developing this hour. New indications the government could be heading to another shut down in less than five days. Agroup of lawmakers from both parties have been trying to agree on a Border Security deal, but now Top Democrats and republicans say those talks have broken down. Less than 48 hours ago, negotiators were optimistic they could reach an agreement by tomorrow. Hopes are dwindling. White house acting chief of staff and budget chief Mick Mulvaney says the president is ready to act unilaterally if he doesnt get a deal he likes. We cannot definitively rule out a Government Shutdown end of this weernlgts whether or not he gets 1. 6 billion or 2. 5 billion or 5. 7 billion hes going to do whatever he legally can to support that border. Is declaring National Emergency still on the table or persuaded by fellow republicans, lets not go that route. Its absolutely on the table. Not a precedent. This is the law. And a republican lawmakers close to donald trump says it is likely the president will declare a National Emergency to bypass congress and therefore build a border wall. I do expect the president to take some kind of executive action, a National Emergency is certainly part of that. There are a few other things in his toolbox he could use, but i do expect him to do that, if we dont reach a compromise. s listen, we have about 24 hours to do that. The dollar figure democrats are proposing, around 2 billion, much less than the 5. 7 billion the president requested. Another major Sticking Point, democrats want to fund fewer beds to detain undocumented immigrants. The president fears that will promote illegal immigration i promise you this. Donald trump is not signing a deal reducing the number of bed faces available to hold violent offenders who come across our border. He cant and wont do that and take that to the bank. A continuing resolution is probably where well go. And this assessment of what could be done next. I think the goal posts shifted a lot on both sides. This has become pretty much an ego negotiation. This really isnt over substance. What needs to happen is secretary nielsen needs to come to the hill and lay out her plans and be questioned on them so we can figure out and try to come to an agreement on what the necessary security provisions should be. And then well fund them. Nbc White House CorrespondentKelly Odonnell has more details on this. Got to tell you, kelly when that first shutdown ended 35 days in, seemed unthinkable we could be on the brink now of another shutdown at this point. Reporter and broadly there are people in both parties and around the country who are saying, no, no, no shutdown and were in a new twist and turn in this, where certainly the administrations not taking it off the table. Yet at the same time say they dont want to get there, but were at a critical point, because of the deadline before the deadline. You really need have a deal put together today, tomorrow, in order to have enough legislative time to draft that into a bill fop let the house and senate pass it. To have the president sign it. Were up against the deadline. Are there other options . Like a continuing resolution to kick this forward and give them more breathing space . Sure. Could happen. That may be the way to avoid a shutdown. The larger issue of trying to get to an agreement could last in a more durable way which is what these negotiators have been working on, really hit a snag today, because of the issue of how much border money and it was clear the president wouldnt get his full ask, but where in the sort of range would democrats go and would they put restrictions on how that money could be used . A fence, a barrier, that kind of thing. Now the issue of the number of funded beds for detention, which has different views depend where youre coming from. The president tweeting about violent offenders limited and his concern in the National Security argument. Democrats talking reducing the number of people held by the government, who are migrants trying to seek either asylum or just more of a social humanitarian perspective of wanting fewer in government detegs. Today Mick Mulvaney voiced how the president feels about a wall and the options he might still have. Heres mulvaney. The president is going to build the wall. You saw what the Vice President said there. Thats our attitude at this point which is well take as much money as you give us, and then go off and find the money someplace else legally to secure that southern barrier, but this is going to get built with or without congress. Okay. And weve seen in recent days both the president and Speaker Pelosi backed off. They were allowing the committee to do the work here, but today the president weighing back in on twitter saying he is concerned the democrats might not be giving their negotiators per in addition to come to a deal, and again citing this concern about detention beds which he frames as being for violent offenders. Certainly much broader than that is what it is. The president weighing back in and of course is headed to el paso tomorrow. A Campaign Event. Not an official government white house event. He will be probably, we can presume in full border wall mode, and it comes at a time when negotiations appear perilous. Typically just looking back, there is always a burst of anxiety before a deal ever happens. Maybe thats the window were in. Or perhaps it is more gloomy, as a predictor of what could be ahead of us. Alex . Kelly, thank you for wrapping that for us. Joining me now, representative lloyd doggett, a democrat from texas. Chair of the ways and means health subcommittee. Welcome to you. How do you see this playing out . What are the bick issues . What do you think can happen here . Well, thanks, alex. Great to you with you again. I think probably the least, worst alternative would be for President Trump to go ahead and declare his fake emergency. This latest outburst about detention beds is just part of his continued bigotry and demonization of those who are trying to escape such horrible conditions in central america. The detention bed issue has been on the democratic agenda since last month, and it is about whether or not were going to have more families held in prison. Their children in prison with them now instead of torn apart which is still a bad situation. So it is not only the waste of a wall that experts say is not needed, but its the waste of money at hundreds of dollars per day, to confine immigrant families in detention. It has nothing do with violent criminals. Theres not a democrat in congress who doesnt believe in detaining and prosecuting every violent criminal. Its hard to find one among the thousands of people that are seeking asylum here, but certainly there are some and they should be prosecuted to the fullest extent of the law. When the president has no case, he has a phony claim of crisis, he always turns to his prejudice and his demonization of foreigners. So your thinking that he will declare a National Emergency, you said thats the least, worst of the options there. Does that mean you do not believe theyll be able to come to a deal, to an agreement . Well, you know, he condemned this effort including the republicans who were participating as a waste of time from the beginning and repeated it. I hope they can come up with something. I saw the suffering of so many families from the last shutdown. You know, i think this is so outlandish. A president who shuts down hits own government, twists and turns, if it had been a movie script no one would have bought it, its so outrageous what about a continuing resolution suggested by Lindsey Graham . So often that happens. Push it down another few days or weeks. Not a good solution, certainly better than Government Shutdown. If the president declare as National Emergency, does he get started on building that border wall . How long would that take . I think theyll be action in court immediately. But at least instead of just blaming immigrants he can blame the courts and blame democrats. Hes in the blame game. I dont think he really would want to resolve this anyway. What he wants is a continual fight where the sole issue is, his efforts to protect us from a crisis and an invasion that doesnt exist. Not terrorists, not criminals invading our country but families trying to escape criminals and terrorists. What you would do for your family if you thought your children were about to be attacked or forced into gangs. Hmm. As youre well aware, the president will hold a rally in el paso tomorrow. Data from the fbi shows that the president was wrong when he claimed during the state of the Union AddressViolent Crime in el paso was extremely high until a border fence was built. Can you share the reality on the ground there in texas and what the effect of the president s misinformation had on your district . Which i know, sir, includes parts of san antonio and austin. Has it done anything to hurt the businesses in the district . Kind of a fearmongering, people thinking i dont know if i should go there . Of course, he had an amazing wall in san antonio he said make san antonio safer and we havent been able to find that wall since he announced that. El paso is very close to our family. My wifes hometown is el pasos many of our friends and family are there. Dynamic new congresswoman Veronica Escobar and senator rodriguez from whom you just heard, el paso is a safe city. A community very tied to juarez. I think the big problem the president will have there tomorrow is that even the difference that he had about his inaugural crowd and whether it was the greatest ever, the people of el paso of all political stripes will turn out for the truth rally, not for donald trump. And it will be obvious that they dont like to see their community talked down when theyve done so much to make it as safe and as vibrant a place to live. It has negative impact when you begin to interfere with employees legally moving back and forth across the border. And when we rely on commerce back and forth across that border. What trump has done is harmful to texas. Its unfortunate that more Texas Republicans arent speaking out against it. May i ask you how democrats move through the president s false narrative when he says democrats are not for Border Security . Well, he wants to continue making that claim. I think that we voted for more and more dollars for the border. Were spending more money on law, federal Law Enforcement at the border than we do on the rest of federal Law Enforcement. We have supported a number of measures, and da gaited a plan, i believe he goes there because he has nothing else to offer. We thank you very much for your time, sir, and well have you back to talk about your solutions to the Prescription Drug price issues we have here in this country another time. Meantime, thank you very much. Look forward to it. Thank you. Joining me, author of power up newsletter of the Washington Post and from Time Magazine as well. Can you explain why detention beds are such an important issue for democrats and how republicans view it . Yeah. Thats exactly right. This has become the Sticking Point potentially leading us into the next Government Shutdown. Republicans are positioning democrats limits on immigration beds as potentially a loophole for more violent criminals to come into the country, and republicans are, you know, saying that if we limit detention beds, this is going to be problematic. I also think this is something that republicans have seized on in order to create blame towards republicans, because, know, the president himself has downplayed the effectiveness of this committee trying to figure out a way forward on immigration in order to keep the government open since they started negotiations. January 9th, tweeting, this is a total waste of time. Seems that this white house has had their mind set on an Emergency Declaration since the start. Since the last time they reopened the government here, and theyve had their eyes on 5. 7 billion as well. I think theyre realizing thats not necessarily a figure theyre going to be able to reach, and immigration beds is a pretty easy target here. Whats interesting, the optimism around all this. It was pretty much there until this morning thinking that a deal was close, but if you heard lloyd dockett there, he said the issue of immigration and beds along the border i. C. E. Would have action to was in there a good month, theyve dealt with this. Why coming up at the 11th hour . The definition of insanity is doing the same thing over and over again and expecting different results. Right . So these issues have existed from the beginning for both democrats and republicans. Democrats have been against giving more money to the border wall. Against the funding more beds for Asylum Seekers and immigrants. Always characterized the beds as beds essentially for families, for children that are being separated from their parents, and the Trump Administration has always asked for more money for the wall, for more money for beds and characterized those beds as beds for criminals and violent offenders. Its always, this has been the same thing that shut the government down for 35 days, same issues that existed from the beginning. The idea somehow these negotiators were going to bridge these issues and come to agreement. Yes, some severance optimism they might somehow do that but with the white house in the background constantly throwing shade on them, theyre never going get there. Always hard to understand how theyre going to get there and convince the president to sign whatever agreement theyre going to come up with. To your point of lawmakers remaining hopeful. Take ap listen to democratic senator jon tester, among those negotiating this deal now. Listen to what he had to say about it. The bottom line is, its that weve got people who arent bomb throwers. People who knee how to Work Together and get deal. Im not positive well end up way deal, but with this group of people and the folks from the house, i think were going to end up with something that deals with detention beds, with barriers, with technology, with the challenges we have on the southern border in a common sense way. Im very hopeful. Not positive, but very hopeful we can come to agreement. To quote the senator, looking for a bottom line, is this about the lawmakers that are negotiating the deal, or is this about the president . I think this, that perfectly encapsulates the biggest problem here. Hes exactly right. These are a bunch of rational, levelheaded people, people used to cutting deals during times of distress and anxiety prior to a government sdhount but end of the day this is really about the president , and mick mulvane sy a perfect example. I keep looking back to when the president lashed out at mulvaney for causing all of these issues here, because he didnt originally appropriate the 5. 7 billion towards a wall when he was omb director. Now you see mulvaney carrying his water and going on television saying the president is going to get this money either way. Those are the expectations, and so i think this idea of trying to foster compromise is sort of a ruse to begin with. You have the president going to el paso tomorrow to just create another fight. Its one of the safest cities in the country. Theres not a lot of support for the president there to begin with and now you have congressman beto orourke positioning himself at the exact foil the president wanted to begin with. Posting a duelling rally thats you know, propelling everything that the president is against. This is the fight the president wanted. You know, i spoke to sources last week who said the Emergency Declaration is already drafted and theyre prepared to take that measure. Yeah. Quick. I was going to ask the question, what needs to happen in the next five days . But its actually really the next 24 hours considering this has to be in front of congress to get written up, approved, voted on. The next 24 hours, whats most critical . Come to agreement and draft the legislation. Pass it through the house and senate to reconcile it and get it signed into law and get the president to sign it. Look, you have to so many procedures here. You have to make sure to get it done, and i just dont know theyre going to come to an agreement. The details are so important. Drafting these things are hundreds of pages long, oftentimes. Especially dealing with budgets. Every tiny detail can mean millions and millions of dollars, and this is the kind of thing where if you make a mistake youll come back next year, next month and have to correct it. So these are the things where these agreements, like, when trying to come to these headtoheads, the devils always in the details and theyre so far away right now. Its hard to see how they get there. I think well have to do a continuing resolution. With this clock ticking as well. Ladies, stay where you switching topics other side of a break. Talk about whats happening on the hieelals of this announcement. The senator having trouble finding campaign state of due to mistreatment of aides . Known to be intense, but is this getting more attention for any particular reason, because shes a woman or her profile is higher . Any political fallout here . Reporter yeah. Those stories are percolating in the leadup to this should be announcement for president. Her campaign in a statement said to me basically that she loves her staff. And on background conversations shes blunt and tough but push back too hard of a boss. Weve seen that reporting come out speaking anonymously with outlets like the huffington post. Not what you to see kicking off your campaign. The way others entered the race, theyve had to apologize for something at the outset of their time on the National Stage for 2020. It wouldnt necessarily mean that Amy Klobuchar is at a huge disadvantage but its something she has to contend with. Got to say ive got an manned written note, thank you note before. Clearly has the ability to be very gracious indeed. Also known for her midwest roots. Moderate viewpoints on health care and immigration. Does that help . Reporter you can see, people are filling in behind me. The signs ive seen, that shes bipartisan. A leader. Wants unity. Excerpts from her speech earlier this morning, thats definitely a message shes going to press. I think the idea of minnesota nice is something she might be trying to take to iowa, to new hampshire. She is someone who will challenge trump, the Trump Administration and the president , but also shes someone who wants to work bipartisanly. Behind, when she is behind me on the stage will talk about the way she got things done in washington. So i think its going to be interesting when you look how candidates run. Elizabeth warren is out there in iowa today saying she doesnt even know if President Trump will be running in 2020, because she doesnt even know if hes going to be able to. Whereas i dont think youll flare from Amy Klobuchar. At least not today. Interesting ways for the candidates to take on trump without making him the focal point of their messaging. Okay. You are a trooper. Both in what youre telling us with content and staying out in the cold for us. Warm up, my friend. Back with me, author of power up newsletter at the Washington Post and a contributor for Time Magazine pap question for each of you ladies. You have Amy Klobuchar making this announcement. Elizabeth warren announcing yesterday. What is this all about . Fundraising . Partly fundraising and about defining yourself, being able to be the foil for donald trump right out of the gate. Being able to pair with him on twitter much like beto on the border tomorrow will be. The one to sort of rise to the person that is the main sort of character. I just want to add a little about Amy Klobuchar. I wrote a book about broad influence, about women in the workforce, particularly i did write about her as one of the women in the senate. Ive interviewed her multiple time and known her many, many years. I think its a sexist knock to talk about what kind of manager she is. Look at donald trump. He is probably one of the most difficult politicians to work for. Enormous staff overturns in the white house. Nobody want to work for him and its not a disqualifier for him being a leader and commander in chief and wasnt for him going into the election. The fact theyre talking about this is really unfair. Glad you made that point. Any idea who is the strongest contender of hose that announced . A lot of rumors who may still come down the pike. So far . A really difficult question to answer at the moment. As ally said right now the countries are apologizing for a bunch of pass misdeeds. Those who sort of already have gotten that out of the way, Kamala Harris full fledge forward on her plass form, defining herself and the issues she stands for and you have cory booker as well not necessarily apologizing for past actions but i think all of these candidates right now are really trying to differentiate themselves from one another. Which either means just incrementally different on certain issues but time will really tell who has the greatest leg up. We are things are still really early and theres still a number of candidates to jump in. We have time. Joe biden hasnt announced, beto orourke hasnt announced. Well see thank you, ladies. Nbcs from richmond with the latest. Rich, the question about impeachment proceedings. Will either of these two elected officials face them in this week ahead . Reporter you know, thats a great question, alex. We really are in uncharted territory as far as the state house and the Virginia Legislature are concerned. Ralph northam, it hasnt really been raced. The Lieutenant Governor, Justin Fairfax in the wake of these two sex swal assault allegatiual as coming friday night. A democrat nimed patrick hoch from Northern Virginia said come tomorrow at 12 00 when the house is in session hes going to introduce these articles of impeachment against the l. A. Times Justin Fairfax. The question, will it be taken up . Near as we can tell, this would work similar to the way it does in the u. S. House and the u. S. Senate back up in washington. In other words, the house of delegates by a simple majority could impeach an individual but then it would be up to the state senate by twothirds majority toy convict. Obviously, we went over that territory way back in 1998 and 1999 with president clinton, with the senate acquitting. Unclear whether or not they would even move forward with that. Now, the state constitution says someone could be impeached by offending against the commonwealth by malseasons in office. Another gray area. These allegations happened well before fairfax was in office. Neglect of duty and high crimes and misdemeanors, other reasons for impeachment. In a little over half an hour a major announcement from senator Amy Klobuchar, expected to kick off her 2020 president ial bid in bitterly cold minneapolis, by the way. About 13 degrees outside now. The already crowded field is not holding her back. The event taking place less than 24 hours after senator Elizabeth Warren made her bid official. Joining me now, democratic strategist don calaway, and director of Strategic Committee for hillary clinton, and good to see you all. I want to ask you each what youre looking for as the democrats on the panel with klobuchar announcement. Don, you first. I think that Thedemocrats Party right now has the blessing of embarrassment of riches. Im happy that senator klobuchar hopping in thing. She knows her stuff. Shes been a tough senator and really smart and runs a great office. Im so happy to see even more democrats hop in this thing. Again, we have a plethora of really good choices, and each one brings a different issue and a different skillset they will make central to the democratic platform. So im just really excited shes here. Im happy for all of them here. Shes probably not going to be my choice, but im happy that another strong senator, strong candidate joins the democratic fray. Im going to add as you comment on this a strong woman. I was just going to say, alex, you took the words out of my mouth, another strong woman entering the democratic primary field. The more important it is as a candidate to really distinguish yourself, to hone in on a message that allows you to stand out from the rest of the pact. So ill be really interested to see what senator klobuchar delivers today on that front. You have 40 minutes or so to wait until all that gets under way. Let me switch gears and begin with you, amy, the big Campaign Event set tomorrow the president holding the rally in el paso. Doesnt he risk, though, disrupting all these funding negotiations that are in a very critical state right now . The timing of this rally could be detrimental . Do you think its about reiterating his position to the base . I think its a combination of both. I was here in an interview this morning where they were digs cussing the current stat of where they want to get rid of the amount of beds for i. C. E. , and then they were also willing to still give him a little bit of money, not necessarily for a new barrier but to fix the current barriers. I dont know how well thats going to go over. So i think that the timing is obviously its on purpose. Probably to send a very strong message to those folks who met over the weekend together with Mick Mulvaney. I dont think anyone is ready for another Government Shutdown. Yeah. I think pretty much people can universally agree on that, thats for sure. Don, we have another high profile person, well put it this way, not officially a candidate but former congressman, beto orourke joining this duelling rally. A march there in el paso. Is there more to this than meets the eye . Do you think it might be a steppingstone towards his own 2020 announcement . You know, i like what beto is doing in terms of taking his time because i like the idea that one need not be first in order to compete in this president ial field because the reality is this is absolutely a marathon. Im, however, not convinced that beto is running for president. Beto knows that john cornyn is also up in 2020 and john cornyn is at a low point historically in terms of rating wise and texas approval ratings. And beto is fresh off of a race. He could take this same data, he could run the same race he did against ted cruz over again and could end up in the United States senate. Beto is talented. Beto can raise money but he sees that this democratic field is packed. I dont really know that he wants to jump in that fray right now. Interesting point about possibly going after the senate seat. Very well could be. The announcement Elizabeth Warren made yesterday and shared her vision for a progressive platform and did not shy away from taking shots at the president. Lets take a listen to part of what she said. We need to change the rules to clean up washington, end the corruption. Now we all know the Trump Administration is the most corrupt in living memory. Did she give democrats what theyre looking for with that kickoff . She absolutely did. Alex, i thought her speech yesterday was outstanding. Again, going back to the point that i just previously made, its really important with so many candidates in the field and that number, of course, is growing, to figure out how to distinguish yourself from the pack. The first word i think of with Elizabeth Warren is fighter. The first phrase is somebody who is working to essentially fix the rigged system that favors the wealthy against the middle class and essentially against any other demographic. So Elizabeth Warren is finding her path. Again, the most important thing that i think shes got to keep doing is getting away from having to defend her native American Heritage situation and moving on the issues. I think shes done a very good job on that front. Something she has apologized certainly several times now. Amy to that native american issues, certainly doesnt help that the president is pounding away referring to her as poke hahn us the, any chance the president is doing that because he might be threatened by her and her message. Maybe to a small degree, but its a twoway street. We know that this president is no shrinking violet. Really . Does he need to pound her into the ground . Probably not so. Its going to be interesting, i think, once that Amy Klobuchar is in the race really where the focus ends up going. If she can get through primary, then i think she would be probably one of the more strong contenders against President Trump. But then you have people like senator warren who obviously are more progressive darlings. Im sorry . No. I just said yep. I was listening to you, a progressive darling. Yes, more of a progressive darling who will probably do much better in a primary. Guys, listen, ladies and gent, always good to see the three of you. Hope to see you next sunday. Thank you so much.
