As enthusiastically as i can, but i think hes a terrible human being, but the choices on the other side are just as bad. And then flamsing michael fly flynn. Plus trumps po lawyer insisting that had directed him to make hush money payments. Are you still cooperating. The officer of Inspector General federal investigations how he has used his traveling with family members. Lots of the ethical questions that have come up where hes denied in any wrongdoing. Those who have liked what he has done in office, thats been about the fact hes been trying to protect federal lands, trying to expand exploration for oil and natural gas on federal lands. That kind of thing, but in terms of the help wanted sign, add another one to the north lawn, because now the president has to fill that vacancy. He says through his twitter, he will do so in the next week. We dont know who is on the short list, but thats a position that we are not surprised to see theres a vacancy. It was the kind of thing predicted, and certainly theres a lot of reasons why. Then we shift over to the chief of staff position. Weve been talking about john kelly exiting. It is official. By the end of the year, the retired general will leave his post here. What makes this interesting is mick mulvaney, who has been serving the president as director of the office of management and budget isnt giving up that title. Hes Senate Confirmed for that position and has requested being the acting chief of staff. That really does give it a temporary spin. Of course, there are real questions about what does that mean for his role . One of the most powerful roles in washington is typically the chief of staff, but in a trump world, we have seen how the president has often called his own playing, done his things his own way. So now this would be a real shift inside this white house. Part of what will be different is mulvaney brings some political experience. Hes a retired member of congress from south carolina, serves theyre or four terms there. So he has a bit of a sense of the politics of things, as well as know the budget size. That becomes more critical as we have this looming shutdown. A lot of asterisk around it. Why acting . Why not a further commitment and of course now an openings at interior. Kelly, you set us up nicely for conversations this hour. Thank you for that. The inaugural committee is under legal scrutiny, and now its being reported that the Trump Organization may have overcharged its own Event Committee for ape event space, and ivanka trump was at the center of those negotiations. Nbc news has not independently verified this report, but the coauthor is joining me now. Justin elliott, republican with propublica. What exactly was ivankas role in this. They raised a recordbreaking 105 million and basically theres been questions about how it was spent. Weve reported that a significant amount went to the Trump Organization, and weve have emails where a top planner says to the trump hotel, the price quote you are giving us for event space is outrageous. 175,000 a day for four days. This planner is expressing concerns about what was going to happen when it ultimately became public, and ivankas on the email, so she apparently was playing some role in these negotiations between again trumps own inaugural committee and his business. We should say ivanka trumps ethics lawyer says ms. Trump passed the inquiry on to a official and said only any resulting discussions should be at a fair market rate. Ms. Trump was not involved in any additional discussions. Thats the statement there. Does that align with the evidence that you found in your reporting . Well, theres still questions about it. Were not sure what rate was ultimately charged. We know the organization got money, but the exact numbers are not clear. The statement from ivankas spokesman that you just read, i went back and forth with him, i said, please show me the emails from ivanka says charge them a fair market rate. They declined to do that. Other than that statement theres no documentary evidence that thats what happened or didnt happen. I think thats important to note. The other thing is that it turns out the tax law actually prohibits a transaction like this in which trumps business overcharges his gnaw rad committee. There could actually be potential legal issues here, and several Media Outlets reported last week that the inaugural committee is the subject of a criminal investigation. We dont know about what, but theres still sort of looming Unanswered Questions about how they managed to spend 105 million, which shattered all previous records for spending on inaugur inaugural. Im going to have my director put up on a full screen what was mentioned to you. But the organizer for the inauguration replied that the rate should have been about half that amount. So have you looked into what the legal consequences of this could be . Yeah. So it turns out because donald trump was obviously an influential person in the gnaw rad committee, that the tax law says you cant then have your private business overcharge that nonprofit that youre involved in. So if in fact the trump hotel overcharged the gnaw trumps own inaugural committee, you know, i talked to the guy that used to run that part of the u. S. He sid that would bea a violation of the law. The irs could impose all kinds of fines on both the Trump Organization and the inaugural committee. We dont tutly now how much of Trump Organization charged. We know that they were paid money. We dont know the specifics. They wouldnt tell us the specifics, and the inaugural committee, even though its now almost two years later, has never actually detailed where this 100plus Million Dollars went. One of the key questions, especially now we now theres a federal investigation. Extraordinary digging. Good reporting, thank you for being here. What does this all mean for the president . Theres no question that the legal danger around this president has increased exponentially as of late. As youre putting on the screen its the trump business, the foundation, the inaugural committee, the transition, so on, all receiving some degree the scrutiny from federal officials and from federal law enforcement. This coming days after Michael Cohen being sentenced to prison. Of course, the ump himself denies that. So it adds to the siege mentality here in the building behind me. You have all these investigations going on. You have the staff shakeup that was detailed including in the last 24r hours, both mulvaney switches jobs and zinke heading out. And we have signs of perhaps a economic slowdown, which is perilous for this president s reelection chances. As of january, the democrats will take control of the house and will wield the power of subpoena and plenty of talk like impeachment. This white house is now girding up for what they expect to be a long, protracted and potentially very perilous fight in the months ago. Do you think the fact weve been keeping our eye on six bouncing balls, if you will, that that hasthe president in some ways. Its not like all the focus was on, say, Hillary Clintons emails. Its hard to follow all of these Different Things in terms of the public scrutiny. No question that the media has had sometimes trouble keeping track of everything. Certainly if we do, imagine how it looks to the general public. Theres so much going on, a fire hose of news, and the president himself feeds to that, with his constant tweets, with a barrage of, you know, medicals information. Halftruthing, that he and his advisers add to the conversation. His deals with the hill and democrats. Rudy giuliani has to do me, thats sort of part of the plan. He was talking specifically about dealing with the russia investigation. The idea of throwing out theories, day after day putting out their own narrative to get that story across, and practicesh but at the very least it adds to the fog of war that surrounds this probe whats true hand whats not. So, you have the incoming House Committee chair, and he she is pan plans to the possible illicit part of the conversation i was having just prior to this. How do you think theyre going to take up this revelation . First of all, i do want to say could youos to the reporters who are following the money here, but this amount of investigation goodsst goings on outside the new york investigation, outside of the inaugural committees investigations, and outside the russia investigations. It is pushing they closer to impeachment, closer than they would like to be. As you see dems say theyre going to prepare to go after the president s tax returns, and just various ethical issues that the president has failed to respond to over the past two years, the onslaught of investigations are going to continue. I do want to say while there is a barrage of, you know, constant negati negative stories they are all interrelated. It results in, you know, an unprecedented amount of cab knelt secretaries resign under a clout of ethical investigations i do think theyre struggling, regarding a disregard for these conflicts of interesting that have been quite obvious. To your point, the common denominator is donald trump. I want to switch gears and go with you, abby, with the president announcing another shakeup to the cabinet. Ryan zinke is heading out as interior secretary. Anything to the timing . We not that President Trump wanted him to stay on despite the ethical questions that hes facing, the legal costs, the investigation, very similar to what happened with scott pruitt, the president was a big fan of ryan zinke. He thought what he was doing was supportive of his agenda President Trump was surprised by this move. He doesnt necessarily want zinke to resign. He didnt necessarily see him as one of the people who would be part of that cabinet shakeup, but it does seem initiated by the interior secretary, that he felt it was time to go. Hes feeling the pressure of these investigations, one of which was recently referred to the justice department. It looks like hes stepping aside waiting for someone to be ushered into the rule thats less of a liability. Is there any chance that david benthart staying on permanently . Previously trump certainly has elevated deputies to the acting secretary role. He did that at the justice department, at omb now, at the Veterans Affairs agency. So its almost like they have a trial try out. He could do that. He was did that with matt whitaker. So he very well might elevate him to that position, give him sort of this test run, see how he performs, and then decide from there whether or not to nominate him. So moving on to mick mulvaney. Hes an acting chief of staff. Is this potentially a tryout, or is this definitively acting . Considering the rate of turnover. This is reportedly agreed upon. That said, the white house also pushed back, said the president didnt have to talk mulvaney into it, that acting was some he insisted on. But theres no set end date here. We know both sooner rather than later ran afoul, and by the end here with kelly, who had some success early on, sort of streamlined the policy process, and better managing the president , at least his daytoday schedule, if not perhaps his twitter feed. Trump grew weary of those restrictions and wanted him out. Mulvaney wasnt always the most popular there. They also feel like trump was pleased with how hes run other federal ades, and nods this without needs to be ready. Nothing at the Trump Organization was ever done unless it was run through mr. Trump. He directed me. He was trying to hide what. Yes, he was very concerned how it would affect his election. To help the campaign . To help him and the campaign. How much political damage may this do . We heard orrin hatch walk back his statement, saying he regrets what he said about President Trump. He had told reporters earlier this week that he didnt necessarily care what was happening with mike at cohen, and hes now walked that back. Hes one of the several reps who in the past week have said nobody, including the president is above the law. I think the the president sitting back watches that interview, presumably, has to be increasingly worried about the direction of this. This is a man who wasnt just hi attorney for a month. He was the president s fixer for a number of years. I imagine hes increasingly worried. This probably will only guess worse from here. I want to thank ought three of you. You guys, thank you so much. We have a court saying that the president directed the commission of two felonies. Thats significant. Weve got at least six investigations swirling in the president s orbit right now. We have the mueller investigation, the payments to women, the spending business hi inaugural committee, foundations, businesses, and jerry nadler, who is weighing the idea of impeachment. Do you think that would be item number seven . Look, i think we have toes focused on two things. At the same time we also have to be responsible to hold this Administration Accountable, and i think the American People elect us to do both things deliver on the promises we made, but also hold this Administration Accountable and get to the bottom of all these investigations. In the first instance, we need to protect Robert Mueller we need to protect the special counsel so he can finish his report, present it to the congress and we can take whatever action that report requires. Listen, theres no doubt that you have a ton on your plate to deliver on the promises to look at the investigation and the like, but therest is there an investigation in your mind that has priority . Its hard to say. That involves an attack on our democracy and whether or not there was conspiracy between members of the Trump Campaign and foreign adversaries to attack our democracy at the same time theres substantial evidence that the president violated Campaign Finance laws and directed mr. Cohen to hide things that may have had an effect on the outcome of this campaign. Thats serious. Then the report about the conflicts of interest, the payments that the gnaw rad committee maid may also raise some ethical questions. It seems to be focused on one thing, the president getting to office and this enormous greed of the Trump Organization to leverage those positions to access more wealth. Theyre all very serious, and i think the Judiciary Committee will take the oversight responsibilities very seriously. Can i ask you, what you said you wanted to learn this week, which was more about the admitted russian operative maria butina that has widely reported. What do you expect to find there . Look, we have seen the contributing influence, but we have all taken the position that we need to be and we need to understand what was the relationship between the nra and these russian operatives . Did it in fact what were the purposes of building these relationships . I think theres a lot of questions there. Look, the American People should decide who gets to be our president. They have no business interfering in any way. If anyone helped facilitate their interference, we need to know about it. I know youre going to bring us the questions and answers in the future as well. You pointed out ivanka trump, the pun who handled this deal has preparty answers, what does that tell you . She previously ran into some issues, so no surprise shes lawyered up, but i was surprised she a spokesman at the ready, immediately prepared to combat these allegations when they were made. That tells us theres some sensitivity there that they were expecting they sorts of allegations to arise at some point. I find that to be interesting, alex. Yeah. So a question for you, matthew is this, the emails will implicate the president s eldest daughter, but is there a law that gets violated by doing that . Potentially yes, alex. I think there are two questions that surround this particular new aspect to the investigation which is coming out of new york. One is, were there promises made to people in order to get them to contribute money . And then thats just oldfashioned corruption, but secondly, what happened to the money . What you see is that the Trump Administration or coming in the inauguration raised roughly twice as much money as any previous inauguration. So if you had, lets say theoretically the president s daughter funneling that money into an entity that would benefit either the president or the president s family, that would absolutely violate a number of laws. Natasha, i want to get to you here. Youve been leading the charge on the reporting with George Papadopoulos, and you say there are sources which report the fbi is interviews the anonymous author of a letter claiming that George Papadopoulos attempted to work with russia after the election. You obtained that letter, according to your reporting, back in november. What is in this letter . This was written by a former confidant of George Papadopoulos, who has come forward to the House Intelligence Committee and to the fbi to say she has information about his alleged interactions after the election that may have had ties to russian officials and he was trying to do some big business deal that would, quote unquote, set himself up for life. As we reported, they want to interview the author of this letter. They want to understand whether or not George Papadopouloss ties to russia are deeper than previously understood. Of course hes a central figure in the russian investigation. I think hes been trying to put out this narrative that he really was kind of a player who had more to do with maybe oil and gas and energy, and he did not play that big of a role in the campaign. But he was the one who essential sparked the entire russia investigation, according to reporting we have seen. His conversations about learns of the Clinton Emails that the russians apparently had in april of 2016 are what prompted the entire fbi probe to begin with. Its really important to understand whether George Papadopoulos, a, told the campaign anything about the conversations, and b, whether he was kept in trumps orbit because of rather than despite those russia connections. And part of it is he was doing a business deal both for himself and for mr. Trump, and this confidant has said, im willing to take a polygraph. Did this plea put more issues on the president . It could. We dont know how much its connected to Robert Muellers probe. We do think that Robert Mueller will want to interview her, because she was interacting with various members of the Trump Campaign throughout the 2016 election. She actually interacted directly with trump himself at one event in las vegas in 2015, when she asked him what is your opinion on russian sanctions . I think a question is was that staged in any way . Was that prepared so that he could use that opportunity to disclose to the world that he actually felt that sanctions on russia were not appropriate and to what extent, if any, her operation on the ground was connected to the broader russian interference of the campaign. Joyce, theres a new that to guarantee that his report goes public, Robert Mueller should try to indict the president , because the attorney general would then have to Tell Congress why he rejeblgted, if he does, to prosecute the president. What is your take on this . This one is a bit inside of baseball, for it to make sense, we need to remember that the special counsel regulations that mule he r has a quirky and recommended a course of action that doj rejected. If that happens, it triggers a part of the provision that then forces a report to be sent to capitol hill to the leadership of both parties, in other words make that rejected proposal public. So heres how the table is set for bob mueller. Mueller doesnt have to want to indict the president per se, but by making the request, which seems likely to be rejected, he would then trigger this reporting mechanism and ensure that the information he has put together, or at least significant portions of it are sent up to the hill, are accessible to both republicans and democrats, and can be put to use by the hill for whatever purpose it sees fit. So although this might not lead to an indictment of a sitting president , per se, it is a failsafe mechanism thats embedded in the special counsel regs. Michael, what are yew thoughts . Robert mueller, for his part, is not there to make a recommendation. Hes just presenting the facts as he has found in the investigation, correct . Yeah, mueller, you have to understand hes a marine. He was given an assignment. He follows orders. I know him pretty well. I do not see him going outside the bounds in order to bring an indictment. Whether you can indict a sitting president is an open issue and really a political issue, but mueller will be straight down the middle on this. What i could see is him bringing some kind of an indictment, maybe not taking it to the grand jury, but basically drafting an indictment so that you would see what it would look like, what the charges would be, and then showing what evidence would support that indictment if it were to be brought.
