Well start with the news. Coronavirus case numbers are exploding across the country. Yesterday, the u. S. Set another singleday record. According to an nbc news tally, nearly 186,000 new covid19 cases were confirmed. That surpasses the previous singleday record from last friday. Since the beginning of the pandemic, more than 11. 8 Million People have tested positive for the virus and nearly 254,000 people have died. Amid this recordshattering resurgence, several state leaders across the country are ramping up restrictions while trying to avoid fullblown shutdowns. Meanwhile, Health Experts fear that the infection rate is only going to get worse as we head into the holiday season. Wear a mask. Testing sites across the country are reporting long lines that can stretch for hours. The front page of this mornings the New York Times features this photo of cars wrapped around l. A. s dodger stadium. Thats a drivethru testing site there. This was the line outside of a testing site in philadelphia yesterday. Pennsylvania officials reported more than 7,000 new covid cases on thursday. Thats a new daily record for the state. And heres footage outside of a testing site in madison, wisconsin, on tuesday. Wow you can see hundreds of cars are lined up there. And right now, laboratories are warning that shortages of key supplies are likely to create more delays in getting test results out, especially as these case numbers surge. According to the associated press, Trump Administration officials estimate that the u. S. Has enough tests this month to screen between 4 and 5 Million People per day, but that doesnt fully reflect realworld conditions. The tests that are used at most testing sites rely on specialized chemicals and equipment that have been subject to chronic shortages for months. Please be careful out there. Now, though, we have to touch on this morning that thoroughly bizarre News Conference from the president s personal attorney, Rudy Giuliani, yesterday. He and his team threw out one baseless accusation after another about alleged voter fraud with no proof. It was a rambling mash of misleading statements peppered with qanonlike conspiracy theories and buzz words, like the clinton foundation, george soros and antifa. Heres a portion of the roughly 90minute newser. Did you all watch my cousin vinny . You know the movie . He says to her, how many fingers do how many fingers do i got up . You know, if you lived in philadelphia, unless you do not thats an stahlan expression for stupid unless you were stupid, you knew a lot of people were coming over from camden to vote. They do every year. Happens all the time in philly. Its about as frequent as being beaten up as a Philadelphia Eagle football game. Happens all the time. I know crimes, i can smell them. You dont have to smell this one. If i were governor of that state, id fire everybody that was involved in this election because im sending my votes of people in michigan over to germany . Maam, maam, maam, maam, maam peaceful transfer okay, let me answer the question. Let me answer the question. The fact is, we have very, very few lawsuits. The lawsuits youre talking about have been brought by private individuals and groups. Most of them were dismissed for lack of standing, probably correctly. Oh, boy. This is the other thing people couldnt help but notice there was the black streak of sweat that ran down the side of his face coming from his hair. Yikes. One biden spokesman called the entire ordeal, quote, yet another Rudy Giuliani spectacle, exposing the absurdity of Donald Trumps thoroughly discredited claims of voter fraud. If youre really serious about it, is this the way you do it . Prominent republicans are, finally . Sounding the alarm on the Trump Campaigns efforts to challenge the election. On twitter, mitt romney said, having failed to make even a plausible case of widespread fraud or conspiracy before any court of law, the president has now resorted to overt pressure on state and local officials to subvert the will of the people and overturn the election. It is difficult to imagine a worse, more undemocratic action by a sitting american president. And in a statement to nbc news, nebraska senator ben sasse said in part, what matters most at this stage is not the latest press conference or tweet but what the president s lawyers are actually saying in court. And based on what ive read in their filings, when Trump Campaign lawyers have stood before courts under oath, they have repeatedly refused to actually allege grand fraud because there are legal consequences for lying to judges. The News Conference yesterday was an utter spectacle that fit right with everything weve ever seen from the Trump Administration over the course of the last four years, but the problem remains that there still are so many republicans who are entertaining this, saying this will go forward, staying silent in the face of whats going on. Youre starting to have a few come out and say, hey, this is a problem, people are believing whats being said at these kinds of events, and the conversation, in some ways, is turning towards, what does this mean for a future Biden Administration . Does this undermine his ability to govern with the consent of the American Public because so many of them are going to be believing that this is actually what happened . How are they grappling with the ramifications of that . And is pressure building on republicans that youre talking to in terms of how theyre going to handle this . Yeah, i think what youve said is exactly right. We are finally starting to see a groundswell from republicans who are having this realization watching Rudy Giuliani with his hair dye sweating down his face on television and regretting giving so much providing so much fuel to this fire. You had, you know, chris krebs, the fired cisa director, tweet yesterday that that was the most dangerous press conference, hour and 45 minutes of television in american history. And i think that youre starting to see republicans privately and more and more publicly come to that conclusion as well, as theyve seen this white house shift to trying to reverse ballots through recounts to now just trying to outright weaken Democratic Institutions and really test american democracy. But look, you still have people like mark meadows and some of the other president s closest allies who are happy to throw Rudy Giuliani out there, do the president s dirty work on television, and not have to implicate themselves. But the reality is, is what this president is doing, now shifting from trying to fight this baseless fight in court to pressuring state legislators and electors, having actually the electors from michigan come to the white house and pressuring them not to certify the votes. Now i think people are starting to realize, okay, were bordering on the line of dangerous right now. Well, and as this is all unfolding, i mean, we have barely seen President Trump since he lost the election. I mean, hes leaving it to these people, and hes been tweeting, but we have not seen him, even though we know that he typically revels in the public appearances that he makes and the backandforth that he has with the reporters that cover him every day. What are the implications of that . I mean, its especially as this pandemic is raging across the country, its almost as though hes not bothering to govern at all. Yeah, and this is a president that has never been particularly interested in governing. Hes always been more focused on doing things to bolster his own power, his personal status and influence. And now its clear that hes happy to have his, you know, henchmen out there, like giuliani, trying to provide him talking points that he can use the next four years while Vice President elect, then to be President Biden is in office, to set him up for a potential 2024 run, or just create a sphere of influence where he actually is still the most powerful person in the party. But doing this at this very time is just even more problematic than it would normally be. There are 4. 4 million Americans Still receiving pandemic emergency unemployment compensation, and just last week, 1. 1 million more americans applied for new unemployment claims. This country is not only headed into another terrible wave of the pandemic, but people are really struggling economically. And what the president is doing right now, refusing to govern and hardly emerging from the white house, it could have longlasting, detrimental consequences for the American Public. For the first time in four months, the white houses Coronavirus Task force actually held a briefing. With cases and hospitalizations rising across the country, President Trump directed us to host this briefing. And this is really a call to action for every american to increase their vigilance. Were not talking about shutting down the country. Were not talking about locking down. Were talking about intensifying the simple Public Health measures. If we do that, well be able to hold things off until the vaccine comes. So, since the last time we had one of these briefings, more than 119,000 americans have died from the virus. And overall, weve lost more than 250,000 of our fellow americans. Despite the surge in cases highlighted in this graphic by dr. Birx, the overall message, especially from those most loyal to the president was one of hope, thanks to the vaccine, but reporters were not allowed to ask any questions about the details of the vaccine or any questions at all. We will get through this together. Mr. Vice president thank you all mr. Vice president are you really not going to take questions . Not taking questions all of you need to answer this why is the federal government what is going on . Why are you not working with the transition . Youre all undermining the democratic election dont forget, we also have not heard from the president of the United States on his election loss. Meanwhile, all senators received a Coronavirus Briefing on thursday, and the senators were able to ask questions of top Public Health officials. In a Conference Call led by operation warp speed officials, the focus was on the vaccine and how to distribute it. We know that 20 million americans are expected to get the vaccine by the end of the year and that each state is going to receive doses according to their population, and then states will decide who they give the vaccine to first. We also learned some states are doing better than others, as far as executing and outlining a plan, while several states have yet to even submit the plans about how theyre going to distribute the vaccine. And in terms of longterm planning, the head of warp speed also revealed that, so far, theres been no coordination whatsoever with the biden transition team. And right now theres no plan to do that either. Meanwhile, President Trump has invited Michigan Republican lawmakers to meet with him at the white house today, a republican source tells nbc news. The invitation, an effort to overturn the Election Results, comes as trumps legal team withdrew from its federal lawsuit in the state. According to politico, the Trump Campaign falsely claimed that local Election Officials had declined to certify the detroit areas vote tabulation, even though they voted unanimously to do so on tuesday night. The group of Michigan Republicans will consist of roughly a dozen people, although its unclear exactly which members are actually going to be attending. Even though joe biden is leading trump by almost 160,000 votes in the state, Republican Leaders in the state legislature there have faced pressure to name electors for the president. Thats a procedural maneuver thats trying to mess with the official Electoral College process that were going to see here in a couple of weeks. Georgias manual recount of the president ial Election Results has, no surprise, confirmed joe bidens victory. After handtallying nearly 5 million ballots, the audit left biden with a lead of more than 12,000 over President Trump. Georgias secretary of state has been adamant that no instances of widespread voter fraud were found during the recount process. In a statement, Trumps Campaign claimed that the audit went as it expected because it, quote, recounted all of the illegal ballots that had been included in the total. The state is expected to certify the results of the election today. And of course, we are now approaching two weeks since joe biden gave his victory speech after winning the presidency. He is all but guaranteed to capture 306 electoral votes, and no amount of lawsuits seems to be changing that. But the president elect still has no access to the current government, and our Kristen Welker now questioning him about whether hes going to do something about that. Reporter how do you justify not taking legal action to get the briefings that you say are critical, that you say you need . It would take a lot of time. It would take time. Its not going to speed it up. So you havent ruled it out . You havent ruled out legal action against the Trump Administration, against the gsa . We havent ruled it out. Lets talk about what the president elect had to say to kristen there. And i know youve done some more reporting and digging around on this. I understand theres some reluctance to take this kind of a step. Why is that . And what is their thinking right now about how to proceed . Reporter yeah, its interesting, kasie. At the beginning of last week, it was the first time we heard the transition float this idea of potential legal action, if this gsa issue continued. And the next day, in fact, the president elect himself really seemed to rule that out, thinking it was going to be unnecessary. And its also interesting, you know, the transition had very detailed plans of actions that were written before the election about how they were going to spend every day of this transition, including, by the way, a contiguongency plan for they would proceed if we are in the situation were in now, where there was a refusal to concede or acknowledge the results on the part of the incumbent president. I think all of those plans were fine and good, but there was an inflection point, i think, over the last day or so, kasie, where this prospect of trying to interfere with the Electoral College, of continuing to try to muddy the results in these states and push through challenges that were less about actual voter fraud and more just trying to disrupt the process, i think led the team to really try to ratchet up the pressure that much more. And you heard biden, himself, yesterday talking about how irresponsible this was, instead of just calling it embarrassing as he had before. Reservations about the legal strategy are still real and you heard biden articulate part of it, that it would just take time that they dont really believe is going to pay off. The other part of this, kasie, is there is no precedent, right . Lawyers want to act when they feel precedent is on their side. Well, theyve never had to go to court to force this question of ascertaining a president elect. And so, i think they dont want to go through this process, if, especially with republican, conservativeleaning courts now in place, where it might actually backfire on them. So, i think the best theyre hoping for is that the Pressure Campaign is continue. You saw this also on capitol hill last night, strongly worded letters only go so far. But most of the Democratic Caucus signing on to a letter, really insisting on a briefing from the gsa by the end of the month, i was told that was one of the tools in the toolbox that they were keeping in reserve. Well, they unleashed it last night as well. So, more pressure to come here. Interesting. So, mike, speaking of the hill, biden is going to meet today with pelosi and schumer, the two democratic capitol hill leaders. What do you know about what the focus is going to be on this . I mean, obviously, were looking aat funding the government, a possible Coronavirus Relief bill. But the pandemic, its so strange that this is going to be the first time they meet in person. Reporter well, kasie, its joe bidens 78th birthday, and who would you rather spend it with than nancy pelosi and Chuck Schumer . So, i think thats the starting point. But really, the prospect of both a relief bill in the lame duck and then how it would be met with by a new president joe biden, i think trying to balance how those two separate legislation would go is important, especially in light of the conversation biden had with the governors yesterday. He said he wants to have a bill on his desk on day one that includes significant aid to the states. As you would know better than me, its unlikely that were really rushing towards a con dilution, something some the lame duck, although there were glimmers of that from Chuck Schumer, talking about hearing things from mcconnells office that hadnt been but i think they want to have a sort of track system here based on what might happen now and then how it will affect the legislation they try to move down the road. Very tricky. And of course, weve got an incredibly unpredictable person still in the white house. And while Congress Seems on track to do Something Big in terms of funding the government and maybe some of these other programs, i think everyones a little nervous that President Trump might decide to blow it all up. While both candidates health faced scrutiny during the election, biden has been adamant about showing hes got the vigor to be commander in chief, and hes promised to be transparent about his health. Joining us now, associate editor of commentary magazine and msnbc contributor noah roffman. Good to see you yesterday on morning joe and glad to continue our conversation here this morning. But i want to focus on the giuliani News Conference and some of what we saw from his lawyers there, because i just i dont understand how if you are a republican who is elected, which means that you rely on the faith that people have in elections being free and fair in this country, how you can let this go on this way without saying something to the people that, in theory, youve been elected to lead. So, Donald Trumps presidency and his ascension in the conservative Movement Began with a hostile takeover. It looks set to end in a hostage crisis, and thats what republicans are. They are hostage to this president and his movement, which hes very reluctant to let go of. They do not want to be seen to be pushing him out. They dont want to be seen to be the executors of his defeat. They are hoping at some point, he acquiesces to the forces of history here. And if not, hell maintain his position that i was robbed, the election was rigged or what have you, but he will go quietly nonetheless. That looks increasingly less likely as the days go by. Notably, Sidney Powells assertion yesterday, which made, i think, a lot of republicans look up from their phones if they were watching this thing, in which she said, look, the level of corruption were looking at, were talking about democrats and republicans here quote, who may have, rather, quote, paid to have the system rigged to work for them. Thats a threat. That is an assumption here that theyre going to move forward and say, listen, our election wasnt, you know, above board, maybe yours werent either. And a lot of republicans did very well in the 2020 election, so to call into question the legitimacy of their claims to office should have the little hairs on the back of every republicans neck sticking up. Well, and theyre talking about now trying to mess around with the Electoral College, which, of course, is a system. And you and i were talking about this, and i want to make sure were not too far in the weeds for everyone whos up super early today. But republicans have always looked at those kinds of systems, like the Electoral College, like the senate, and have said, you know, these are our protections against direct democracy against the rule by the mob. Its almost like trumps team is creating a mob to try to overtake some of these institutions that we have, and republicans are just standing by and allowing it to happen. Well, i dont think so. I would say that they have more faith in institutions than their critics do. If youre concerned, as i am, about the demagogic impulses that were seeing from donald trump, these institutions that have impulses we are seeing from donald trump, these institutions that have fallen out of favor particularly among the republicans are your last line of defense. Like the Electoral College, like the senate, like the courts. These are things that are going to tamp down the impulses and mute and dilute the power of an angry mob. For example, you know, Rudy Giuliani presented a lot of facial evidence yesterday, which is witness testimony and its evidence in and of itself, but you didnt hear the michigan judge who threw out the cases and he said there was a bunch of fraud in pennsylvania. He said this is not a fraud case, theyre not arguing fraud before the judge because to argue fraud would need an evidentiary standard they cannot meet. Because its not actually hell not to lie in the court system which means that Rudy Giuliani is lying to americans when he stands before the cameras, but not when he of course would be held accountable for it. What is your 1 big thing this morning . Were looking at the blunt lessons from 2020 as we sort of sort through the wreckage, sort through the results and obviously theres a lot. Especially for us reporters, us in the media, theres a big chunk of the country we dont understand. We knew that in 2016. I think it might be even worse now. Almost no reporter, no editor sort of saw this coming, saw that donald trump might have more appeal with hispanics than we thought, that his turnout would be even higher than we thought. I think thats one of the big lessons. The other one and it goes to a lot of stuff you have been talking about on the show today. Were losing the war on truth. Like we are real in we dont figure out a solution quick, we might be screwed as a country. You look at like twitter, twitter is like a mass distortion field for liberals and journalists who highfive each other. Facebook is a mass distortion field for conservatives. If you look at the official pages that get the most traction on a daily basis, so much of its conspiratorial, so much is propaganda and so much is where most voters are getting their news. We dont pay that much attention to youtube, but youtube has a lot of false information. One week around the election, 138 million views on videos claiming election fraud. These are sirens going off in society. And if we dont figure out somehow, some way, to reclaim the truth, this actually could get worse. I dont mean to be a total downer but look at whats happening in realtime. Conservatives are you are kind of being a downer, but its a great point so continue. Conservatives are saying that fox isnt trump enough. Theyre going to newsmax or oan or going to parler, which is a new version of social media for the right. So its not like people are saying, you know what, let a all come together. No its going this way and that worries me. Yeah. I mean, i would even add pinterest and instagram where there are so many people just if you flip through stories its remarkable. What do you think the responsibility of the social Media Companies is to do about this because we have obviously seen them essentially not do very much. I mean, they have tried in some ways to put those warnings on the president s tweets. Facebook has been taking more action against, for example, antivaxxers on their platform, but doesnt seem Like Congress can address this. Whats the answer, do you think . Its crazy, right . Like 15 years into some of the technologies and we put no rules to the road for anybody. And people are behaving so irresponsibly on these platforms. Conventional media, we have to do something. Again, i dont mean to sound like a downer, but when you have more than 50 of the republicans telling pollsters if you believe polls anymore they dont believe in the integrity of the elections, you cant have a functioning democracy if people dont believe anything. Yes, its more of a problem on the right, but its spreading problem. So social Media Companies have the same responsibility that we do which is if we dont move quickly, you could end up with we talk about decoupling, this idea globally decoupling from china, where you have two internets, two worlds, you might end up with that in the United States. Where you and i are talking to each other and you have the whole other conversation for 50 of america, happening in a bubble, in a parallel universe. You have to get back to the belief that some things are true, even if theyre inconevent. If you dont do it, i dont like the outcome. Jim vandehei, thank you for that cheerful end of our show today. What we just were talking about is exactly what the biden team is starting to worry about, what democrats are starting to worry about and what some republicans are starting to worry about, that a Biden Administration is going to be hamstrung because half of the country simply doesnt believe in what they are doing, that the truth is going to remain disputed and that is ultimately the consequence of what we are seeing this president do and republicans enable here in this period after the election, but before the nation.
