Well start with the news. Senate republicans are full steam ahead after locking up the votes needed to move forward on the president s soon to be named Supreme Court nominee. The path was cleared after senator mitt romney of utah announced that he agreed with Senate Majority leader Mitch Mcconnell that its okay to fill a Supreme Court vacancy in the final year of a president ial term. If the same Party Controls the white house and the senate. Republicans are moving fast. Two sources tell the Washington Post that Senate Judiciary Committee Chairman Lindsey Graham is looking at scheduling a confirmation hearing for the week of october 12th. A Committee Vote near the end of the following week, for a vote on the floor before halloween. Meanwhile, i asked Senate Majority leader Mitch Mcconnell about the time line for the vote. Watch. Could it be the reality that we could face a contested election coming up, that it could end up in the courts, that the Supreme Court could be making decisions about the result of the election factor into your thinking about the time line . All kinds of things could happen. For example, my colleague senator barrasso and i think senator blunt as well mentioned that theres all kinds of threats out there, way predating this Supreme Court vacancy. They would get rid of the filibuster. Theyre going to make d. C. A state. Puerto rico a state, pack the Supreme Court. All of these threats have been out there for months. What we do know is what the job is right now. The job right now is for this well qualified nominee, which i expect well see on saturday, to be processed in committee and brought to the floor and voted on. And thats what we anticipate will happen. Holding his cards close to the vest, but also getting the Republican Campaign message in there right at the top. Meanwhile as u. S. Coronavirus deaths surge past 200,000 new cases, and positivity rates continue to rise at worrisome rates. According to the Washington Posts analysis of Public Health data 27 states and puerto rico have shown an increase in the sevenday average in new confirmed cases since the final week of august. Minnesota, montana, oklahoma, puerto rico, wisconsin, wyoming and utah set record highs monday for sevenday averages. Meanwhile, President Trump continues to defend his administrations response. There doesnt appear to be a plan from the Trump Campaign beyond what we just heard which is, well, it could have been worse. The reality is we spend some time speaking with families and individuals affected by covid. The main response we have right now it could have been better. Theres a lot of comparison happening between what has happened in the u. S. To other countries. Specifically, i was just reading a covid victim talking about how much better japan did because of how their leadership responded very early. So, in these final weeks before the campaign, those who are still hoping for the president to release some type of statement or response how they would more aggressively effect a response, i should say, to covid are quite disappointed. So, yeugene, how does the Supreme Court it seems to me this is one of the big reasons why they want to be talking about this and keep this process front and center in the campaign, because a focus on that talks to their base of republicans. And i know you wrote about this specifically. And tried to motivate them to get out to the polls. And perhaps, pull peoples attention away from the handling of the coronavirus . Absolutely. One of the things that the president has done more effectively than anything else is position himself as a chief culture warrior. And his base, even those voters outside of his base, care quite a bit about social issues related to gender or sexuality or life know that it something that the president will pay significant attention to, even when other areas like the economy or a pandemic are begging for more attention from the president. And he knows he can be effective in connecting to these voters who he really will need to turn out in arguably record numbers in some of these swing states for him to maintain his position in the oval office. And so that strategy is the one theyre going to prioritize over what may in fact need more attention which is the pandemic. That Public Health experts believe will get worse this winter. All right. Bloomberg released a statement that said in part, quote, working together with the Florida Rights Restoration Coalition were determined to end disenfranchisement and discrimination thats always driven it. President trump says hes going to announce a pick to replace Ruth Bader Ginsburg this saturday at 5 00 p. M. The president is heading to florida this friday, but he is not expected to meet with judge Barbara Lagoa while hes there. Chief of staff mark meadows said any meeting regarding a Supreme Court pick will take place in washington. On monday, President Trump met with judge amy coney barrett. Sourcing tell nbc news that the meeting lasted about 30 minutes and it went well. As for the timing of the vote, two senior officials voiced a positive, with one stating a strong possibility. And democratic nominee joe biden refuses to say whether or not he supports the growing call to add more members to the Supreme Court. If trump as you Supreme Court vote goes through, miraculously moves through. And you win the election, lets say the democratic take over the senate and the house. Would you consider adding more to the bench . Its a legitimate question. Let me tell you why im not going to answer this question. Because of the focus thats what he wants. He never wants to talk about the issue at hand. He always tries to answer the subject. Bidens nonanswer helps to keep the options over should democrating win this control in november. I know this is an issue so is the puppy, so anybody that hears the yapping in the background, i apologize. We are a dog friendly show here on way too early. Do not worry about it. We will figure it out. But lets talk about this idea of courtpacking. Because some democrats are raising that as a possibility. And republicans seem thrilled with that idea. There does seem to be some tension between the liberal wing of the party advocating this. And some more pro democrat, but if you listen to the way biden talks about it, whats the potential there . The potential, courtpacking, a phrase that first came up when Franklin Delano tried to expand the size of the court, to enfact that new deal legislation. Courtpacking has an ugly stench do it. Congress refused to do what fdr wanted at the time and people are reflex siively opposed to i. Its perfectly right for Vice President nominee joe biden not to want to talk about it when a new conservative justice is added to the court because it does distract. And it does have an aura of turning the court into a partisan institution. Its the kind of thing, let me just say quickly, that weve been witnessing Stealth Court packing. With not letting president obama get a hearing for his justice. Now, theyre packing the court just beweeks before a new electn to add a new justice. So if the democrats were to respond to retaliate by expanding i would argue doing so on a temporary basis by expanding the size of the court. Theyre not doing this in a vacuum. Theyre doing this in the context of republicans having engaged in the Stealth Court packing. What is the time line, what role does the time line play in this . And what is the sense with republicans trying to seek this justice because theyre preparing for a potentially conservative Supreme Court to play some role in the next decision about whos the next president . Well, i think theres three issues. One is the reality that a 4 4 split means that whatever the decision from the lower court stands. So certainly, if youre looking at a possibility of an election that is going to end up in the courts and is going to be close, you would want an additional justice there. Thats factor number one. Fact th factor number two is if President Trump were to lose, especially if republicans were to lose the senate, to have a Lame Duck Congress vote on a nominee is even more distasteful. Seems even more antidemocratic than voting on a nominee now. But the most important thing is that this is the moment for conservatives to fundamentally cement their conservative majority. I wrote a book about Brett Kavanaugh called supreme ambition Brett Kavanaugh and the new conservative majority. But that majority, as we saw last term, is not fully in lockstep with what conservatives want to do. So, this sixth conservative justice would be an enormous achievement. Wall street is fearing a meltdown over the election and thats being amplified by what were seeing on the Supreme Court. So, when you say a meltdown over the election, expand on that little bit. Are they worried about a trump victory, a biden victory, a mess that will cause havoc in the stock market . Whats the concern . Yeah, its really that last thing you said, a mess that will cause havoc in the stock market. Its less about whether its going to be trump or biden and more about that we may not know whether its trump or biden on election night, and maybe not for days, maybe not for weeks, potentially for months after we have election night, we may still not know. And also really importantly, we may not know the makeup of the senate. And as ive been talking to guys on wall street, what they say is really worrisome is that if we get a victory in the president ial election and we still dont know who makes up the senate, well, as the stimulus bill has been pushed back and onto the back burner for this year, it may not get done into start of next year, and that really makes a difference for the economy and for a lot of the stock market that actually is tied to the real economy, things like smallcap stocks and really a lot of these economically Viable Companies that are hurting right now and have been for a while. Yeah, i mean, do you get the sense traders and wall streeters, people who are running these Big Companies feel Like Congress has essentially forgotten about them . And how serious do they think it is . I mean, we talk a lot, and its so important, how many regular americans are hurting because Unemployment Benefits will be part of this. There are so many Small Businesses that are closing. But it seems like theres major concern about the underlying fundamentals, too. What are they talking to you about in terms of that . Yeah. Well, you know, when people talk about the stock market, they just kind of look at the indexes, the s p or the nasdaq. The nasdaq has actually done really well this year because a lot of those Tech Companies people are expecting to do even better, you know, if the coronavirus is keeping us locked up or as we have these changes in work and more money flows to the big businesses, Companies Like facebook, google, apple, those kinds of things. But for a lot of the companies on the s p 500 and even the russell 2000, they really need this stimulus to keep money flowing in. Business and commerce have essentially stopped in a lot of ways, so that stimulus makes a big difference for those companies. And while you may not see it just on the headline of the index, because the indexes are made up so much of those big, giant Tech Companies, underneath a lot of peoples portfolios are made up of these smaller sort of names, these other names that really do rely on the economy, and they are having a hard time. And that means a lot for peoples 401 k s, it means a lot for their savings and investment. And pension funds, of course, as well. Absolutely. What are we looking at timelinewise . If congress doesnt do anything more, whats your sense of how long it will take us to get out of this hole . And what do people who are looking at those numbers telling you . Well, i mean, we are seeing the ramifications already. The nasdaq and the dow and the s p all rose yesterday, but thats a bit of a dead cat bounce. We are down about 10 on the nasdaq and about 8 thrs on the s p 500, just this month. Thats a pretty significant move. And if we donthe stimulus is pu back further and further and we dont know the makeup of the senate or know the president moving into december and january, then thats really going to cause a pretty marked selloff, is what investors are telling me, because again, we need that stimulus. The market needs that stimulus, and if it looks like it might be getting pushed off, not just, you know, into early 2021, but maybe into late 2021 or even worse, we dont get that stimulus, thats going to be bad for the market and that could cause some pretty significant selloffs.
