Well start with the news and the battle over the Supreme Court. The president says hell announce a nominee either friday or saturday, and there are two serious contenders. Meanwhile two more republican senators have switched their positions from 2016 on whether president s should appoint Supreme Court nominees in an Election Year. Chuck grassley of iowa and cory gardner whos locked in a tough reelection bat colorado both say they will support moving ahead with a nomination. In 2016 when president obama nominated merrick garland, grassley said, quote, the people shouldnt be denied a voice. Now he says in part, quote, the constitution gives the senate that authority, and the american peoples voices in an election couldnt be clearer while the direction in 2016 under a divided government, there is no such ambiguity in 2020. So make no mistake, grassley added, if the shoe were on the other foot, Senate Democrats wouldnt hesitate to use their Constitutional Authority and anything else at their authority to fill this seat. Back in 2016 cory gardner said this, quote, the next president of the United States should have the opportunity to fill the vacancy on the Supreme Court. In a Statement Last night announcing his support of a vote on the president s nominee, gardner didnt explain his reversal on Election Year nominations. Joining me now, nbc news correspondent leanne caldwell. Leanne, i want to get to your thoughts on how its shaping up on conservativing on abortion, but lets start with the news overnight where Lindsey Graham told sean hannity, we got the votes before the election. What is the thinking right now behind the scenes on whether they can push for a final vote because we know some people had been arguing to do the hearing but wait to have the vote until after the election. Whats the calculation . So i think that the concurrence is split according to the people im talking to, and theres two trains of thought, kasie. The first is go ahead and get this done before election day because if the president lieus on election day, if they lose the senate on election day, it proves much more difficult to prove this vote. Theyre saying, we have the white house, we have the senate, lets go ahead and do it and preserve a conservative court. Then it will motivate conservative voter, the evangelical voters in some of these critical states not only for the president but for Senate Republicans trying to win reelection as well to get to the polls on or before election day to ensure that that Supreme Court nominee is seated on the cou court. Those are the political applications. There are Practical Applications as well. Can they get the background check done and the vote on the senate floor done before the election . Thats a pretty heavy taf fk you compare it to recent nominations that have gone through, kasie. Not unprecedent but tricky. Do you think its a split between Mitch Mcconnell and the white house . Is it the white house that wants to push this through right away and mcconnell and republicans want to give themselves a stronger chance of holding onto the senate, or is the dynamic different . I think its a little mixed. Of course, the president has come out and says he wants a vote before election day. Also Lindsey Graham wants a vote before election day. And then you have these conservatives who whose big focus is a conservative judiciary who want a vote before election day. You have senator josh hollholly senator ted cruz, these members who care so much about the court want to get this done. And then you have mcconnell who wants to maintain his majority in the senate. Of course, its important to him, but, of course, keeping his position as majority leader is just as important to him, kasie. Right. Theres the maintaining power argument and the conservative abortionrelated argument. Yeah. Leigh ann, very quickly, reality check here. Can the democrats do anything to stop this from happening . Not really. Procedurally, not really. Theyre in the minority. Speaker pelosi said on chris hayes last night that she completely shot down the idea of shutting down the government in order to stop this. Of course, theres a government funding deadline just days away that both the house and the senate have to do. Pelosi said thats not going to happen. Democrats say any of these retaliatory tactics are not good. They think that it hurts them in these critical battleground states, and they need to focus on winning in november instead, kasie. The Louisville Police department has declared a state of emergency ahead of grand jury decision in the investigation of the killing of breonna taylor. The declaration allows the department to operate under emergency staffing and protocols such as canceling offday requests. As of today, there are 43 days until november 3rd and 104 days until the end of this congress. The senate has more than sufficient time to process a nomination. History and precedent make that perfectly clear. There was clear precedent behind the predictable outcome that came out of 2016. And theres even more overwhelming precedent behind the fact that the senate will vote on this nomination this year. Were going to keep our word once again. Were going to vote on this nomination on this floor. Weve got the votes to confirm Justice Ginsburgs replacement before the election. Were going to move forward in the committee. Were going to report it to the United States senate so we can vote before the election. Thats the constitutional process. After kavanaugh everything changed with me. Theyre not going to intimidate me, Mitch Mcconnell, or anybody else. They faced hard pushback from democrats after notoriously opposing voting on former president obamas Supreme Court justice pick back in 2016, only to seemingly flip flop now. Senate minority leader Chuck Schumer, meanwhile, paid tribute to the late Justice Ruth Bader ginsburg on the senate floor yesterday, remembering her as a woman of great right owness and v valor. Then he turned to politics. Leader mcconnell and chairman graham have made a mockery of their previous position. They seem ready to show the world their word is no good. Its enough to make your head explode. And then to hear leader mcconnell up on the floor trying to defend this. Pathetic. Pathetic. If the Senate Majority over the course of six years steals two Supreme Court seats using completely contradictory rationales, how could we expect to trust the other side again . How can we push one another if when push comes to shove, when the stakes are the highest, the other side will double crosstheir own standards when its politicallied a van tanks. Tell me how this would not spell the end of that supposedly great deliberative body. Joining me now political analyst for nbc and nbc news, my friend phil rucker. Thanks for getting up so early with us, phil. Its really great to have you on the show. Lets start where Chuck Schumer left off there and also what the white house is looking for behind the scenes. Ive spent a lot of time reporting on Mitch Mcconnells thinking around how this should play out, but ive seen reports that the white house in particular is pushing for this all to happen before the election. What does the president and his aides want to see from the senate in the next 40someodd days. Yeah. Well, first of all, kasie, congratulations for the show. Im so excited for you. Its going to be a great hour every day of the week, so congratulations. Im glad to be here with you. In terms of what the white house is looking for, you know, the president wants this vote to be completed for this justice the eventual nominee to be confirmed by the senate before the november 3rd election of, i guess now, 41 days. Mcconnell can make that happen, of course, given the calendar, you know that. Hes in charge of that process. But the president is not really interested in holding off on the eventual confirmation vote during the lameduck session, and i think thats in part because of all the political uncertainty. They cant control whats going happen after the election. The white house knows that this election, trump could lose the election or it could be very close or we could not have a declared winner for a number of days or weeks after november 3rd, and so they want to take care of the Supreme Court pick while theres more certainty in the environment before things change, and theyre also looking to postelection litigation fights potentially if the result is closed in a number of these battleground states. The president has been very transparent about his intentions to fight the lawsuit, to challenge the Election Results in the federal results. That, of course, could go all the way up to the Supreme Court as it did 20 years ago with bush v gore, and so the white house wants to see nine justices on the Supreme Court if that would be the case, and, of course, they feel trump would benefit by having the ninth seat filled by his own nominee. You know, i was going to ask you exactly that as a followuppings because theres the political followup in the senate, what does Mitch Mcconnell want to do to hold onto poweller for himself in the senate, but do you think the white house at this point basically expects the result of the election to be litigated in the courts, and what else are they doing around this to try to prepare for it . They do. You know, the president has said the quiet part out loud, so to speak. Hes made clear that his intention is to pursue litigation, to take this into the courts if these battleground states are as close as the polls suggest today they will be. In fact, if trump were to lose in a number of states narrowly, he fully intends, i believe, to appeal those results, to claim that there was Election Fraud in the mailin balloting. This is something ees laid the groundwork for for months now. Theyve assembled a large legal team to prepare for some of these challenges in the states. So it could be a very ugly november and des if we think that theres not going to be a clear outcome. You know, they want the court on their side. Its one of the reasons the republicans have moved so aggressively and urgently these last three years to stack the courts with as many jurors as they can, to fill ought these positions quickly with anyone the president puts forward, and that strategy continues with the Supreme Court today. Yeah. We have been covering that carefully. Very quickly, phil, Amy Coney Barrett met with President Trump. She seems to be the strong frontrunner. Whats your sense of whether this is how were going to move forward . Is she likely to be the nominee, or does Barbara Lagoa still have a shot . Barrett has the momentum inside the white house. Shes sort of a known quantity in part because she went through this process two years ago as a finalist for the seat Brett Kavanaugh eventually had, and shes good with evangelical conservatives. However, the president is also enticed by lagoa, first cuban american, and theres a belief she could lock down the seat in november. If they want to move fast, Amy Coney Barrett seems like the better bet. Phil rucker, thanks for getting up early with us. Thank, you kasie. The cdc has removed its previous language saying the coronavirus can spread through the air. On friday the agency updated its website that the virus can transmit beyond six feet and that indoor ventilation was vital to prevent infection. Before then, the cdc noted it spread primarily between people in close contact through droplets by those infected. It was confirmed the agencys update was scrubbed. They said, quote, unfortunately an early draft of a revision went up without any technical review. The agencys website now says the cdc is currently updating its transmissions regarding the transmission. The updated language will be posted. It is the third major revision to cdc information or guidelines since may. It was really an ugg session yesterday with the dow closing off over 500 points. The interesting thing was we didnt see a similar selloff in the nasdaq. The 1 big thing were looking at is bipartisan, which is good news but the bad news is its a failure. Its a bipartisan failure to get something done to invigorate the economy. As you know, as well as anyone, the cares act is past the initial one, the second one p s passed in may didnt really move. Theres a great deal of concern what this will do across industries, not just for Small Businesses but for hospitals, states, localities, congress has failed to get something done. And the death of Ruth Bader Ginsburg and all thats going to inject makes it less likely youll have any sort of stimulus, any sort of package before the election. Kasie . I was going to say, hans, this was already relying on nancy pelosi being able to cut a deal with the Trump Administration and that was foundering. Now, the temperature has just been turned up, democrats are so angry about how republicans are handling this Supreme Court vacancy. It seems impossible that something is going to get out there before the election. And that seems like it could potentially have ramifications for the economy overall, no . It will have short term and long term ramifications for the economy. This isnt just a fourmonth window or a window to the end of Donald Trumps first term or whatever happens in january. This has generational impacts. When you look at the effect on schools, day cares. The failure right now by washington d. C. Is going to have longterm consequences. And its something were hearing for a lot of our sources. You know this as well. Now, sometimes deadlines can be forcing. We have a start of the new fiscal year, that could be a potential opportunity but theres not a lot of impetus and momentum for any sort of bipartisan progress. Its really discouraging for a lot of people who were hoping there was more help out there. Youre also reporting about the growing complaints of the politicalization of the cdc. Yeah. What are you reporting about whats going on there . It almost reads like censorship really . One with the cdc we see a lot of trust thats been eroded, a lot of errors. Just over the weekend they had a website, something that went up and they had to take it back down. Theres another angle to the story and thats how it bleeds into whats happening with the vaccine. Our new polling shows a great deal of vaccine resistance. That is a huge problem. Ill give you one data figure, kasie. In august, there were about 17 of americans said theyd take a first generation vaccine, thats down to 9 . Across the line theres a great deal of growing resistance the idea of vaccine and that just indicates a fundamental lack of trust in science and what our institutions are doing. Kasie . Well, hans, we were just showing a chart, maybe we can throw that back up on the screen. This is not one party or another party where this decline in trust is showing up. Its clearly there are more democrats who are excited or willing to do it, but those trend lines all go in the same direction. And youre i take your point about science absolutely. But it also seems like theres a lot of distrust in President Trump and, you know, frankly the fact that he continually. The Washington Post has documented every mistruth out there, there are a lot of them. That has a real impact where it matters. Youre directionally its going in the same direction, its going in the wrong direction. And that is a huge concern. So when you look at where it was just a couple of months ago, there seem to be some thats much more willing to accept this and embrace a potential vaccine, but its the fact that theyre moving in tandem these two lines, and that tells us something is going on, something we might not totally understand right now, something is going on with trust in this country. It could have implications and it could have disastrous implications. I know youve been on the trail with the Biden Campaign as well. It strikes me if he does win the election on november 3rd and takes office in january, this may be Public Policy challenge number one for him as president , to convince americans that this is safe, effective, and something they should do. What are their plans, what are they thinking about . Do they have policy options to try to encourage people to take this vaccine . Joe bidens personal dignity and his trust. That seems to be the plan. You saw biden speak yesterday to all americans, not just democrats. Theyre laying the ground work for this because they recognize the challenge. Kasie .
