playing a game? he's going to be watching the speech even if it's kind of like that. everybody is going to be watching the speech. like i said, the eyes of washington and the world are going to be on netanyahu. it's going to be fascinating. >> meanwhile susan rice also is out yesterday defending the push for a nuclear deal with iran. she said it at a pac. she said the position of netanyahu was not viable for negotiations. and she saw a hand full of standing ovations when she started zuzing policies that the proisrael crowd supported but she opposed. it was kind of some strange moments. >> we must also understand what will happen if these negotiations collapse. i know some would argue that we should just impose sanctions and walk away but let's remember let's remember my friends let's remember that sanctions unfortunately have never stopped iran from advancing its program. >> maybe she should have just stopped right there. she was getting a pretty good applause line. let's turn to news from susan rooi rice and barack obama to hillary clinton. did you see this? it came out overnight. a new report from the new york times is claiming that hillary clinton violated federal law and exclusively used private e-mails during her name as secretary of state. the paper reports she didn't have a government address, and that raised questions about the rick of hacking and whether she may have violated the federal requirements. the federal records act, it requires that e-mails like hers be preserved but the paper reports that her staff took no action to save any of her e-mails. two months ago aids sifted through her account and decided to hand over 50,000 pages. the spokesperson told the times that secretary clinton come plied with the letter of the ply. a state spokesperson said in a response to our request she provided our department with e-mails spanning her time at the department. after the state department reviewed those e-mails, last month the state department produced about 300 e-mails responsive to the recent requests from the select committee. >> we'll talk to somebody later and he'll tell us how unusual it is for the secretary of state to ignore federal compliance laws. let's go to l.a. now. a homeless man was reaching for a gun during an altercation before police officers opened fire killing him. it was captured on krch video and the question now is whether the use of force was appropriate. here's the report on that. >> reporter: police responding to a robbery call in the neighborhood known as skid row when the violence suddenly erupted. the video is posted on social media and show lapd officers confronting a homeless man. officers try to cuff him. next the sound of a taser. someone yells drop the gun. then, at least five shots from three officers leaving bystanders and witnesses in shock. >> it was kind of extreme. >> he didn't bother nobody. >> he didn't have no weapon. they just shot him. >> the l. displaying enhanced still pictures say the man reached for an officer's weapon. this is an awful tragedy, but the officers took on the face of it reasonable steps to avoid it. >> reporter: this is the spot where a man took a cell phone video. minutes before he says he captured the last images of the man known on the streets simply as africa. surveillance video shows the suspect talking to police and then entering his tent. that's when officers draw their weapons. >> this is a former s.w.a.t. officer and the expert on the use of deadly force. >> most of these situations are over in seconds and in that period of time you are going to be held to answer for years and years for those 2.5 to 3 seconds. >> on skid row a memorial is growing and so is the number of unanswered questions. >> and law enforcement officers are telling nbc news that audio from police body cameras may be more revealing than the video. the cameras don't provide a clear visual of whether the suspect reached for the gun but the audio suggests that he did but i don't understand. if they all have the body cameras and there are five officers and you have these other cameras coming in and there's not a single image of him grabbing for a gun. i don't know how audio would provide be six camera shots did not. we'll be talking about that on morning joe as well. in the wake of incidences like that. police departments across america have begun implements the use of body cameras and we have an in-depth look at this growing trend. >> reporter: from an officer shot in an albuquerque to a police shooting in oklahoma body cameras are proving to be a critical new eyewitness for police and citizens alleging police misconduct. not just the lopd lapd is testing this. seattle and d.c. are too. las vegas police has 200 cameras after people demand more police accountability accountability. >> we need the support from our community and if that raises that, that's where we need to go. >> every uniformed officer is now required to record every citizen contact and police insist the camera catches things. in this training scenario only the officer can see the man has a gun. >> don't touch that gun. you'll be shotgun. >> cities and states are drafting new procedures to ensure police can't edit the video and most importantly to determine when should the camera be turned on. >> from an accountability stand point they would be on all the time. that would raise intense privacy issues for the public and for the police officers. >> one big challenge is stimply storing and managing vast amounts of video data. how long are they kept? a traffic accident a few weeks but a homicide investigation, perhaps decades. >> reporter: already cameras have been used to exonerate and discipline officers. >> we trust them. we give them a gun and a badge but this is a way to review what's hatching if there's a complaint. >> and cameras say advocates have a funny way of assuring police and citizens are on their best behavior. >> we'll see how that plays out. i'm sure we'll be reviewing all of the body cameras. on monday president obama revealed the white house's task force on law enforcement practices across the country. among the requirements, independent investigations when deadly force or injury is caused by police. the task force rejected a. siting cost and privacy concerns. >> let's go overseas where details are emerging about the man known as jihadi john. according to bbc the man denies being an extremist in a 2009 interview. he also claims british spies told him they would be keeping a close eye on him. meanwhile is this the first film of jihadi john? the video posted online and reported by the daily mail purports to show him delivering a speech in syria. security analysts say there are similarities but nbc cannot confirm the man's identity. they also point out the man appears to be shorter an this man is holding a gun in his right hand while jihadi john held a knife in his life. let's turn to business. another record breaking day on wall street with the dow and sm the nasdaq closed above five,000 for the first time since march of 2000 right before the dot com bubble blew much. the nasdaq was riding high. give us the story on this 15-year claim back to 5,000. >> reporter: it's taken the nasdaq 15 years but it's finally above the 5,000 level. it's important for retail investors who think i can buy that and the institutional investor may be seeing it as a sell signal. it was driven in part by google and apple. since the 2000 lows up by a whopping 350%. >> is this just another bubble?
