Brutality, including this in buffalo, new york, Police Reform is atop the list for many activi activists. Is there a viable path forward to lasting change . We ask top leaders in Law Enforcement and a member of congress. Thats just not right. To clear peaceful american citizens for the president of the United States to do a photo op. There is nothing morally right about that. And dozens of retired generals sound off against trump for using troops to intimidate protesters on american soil. Could the breach come back and haunt the president . Velshi starts now. Its been nearly two weeks since george floyd died in the custody of the Minneapolis Police officers and since then, we have seen protests erupt across the country in solidarity. As americans of all an racraces religions unite against Police Brutality, police are fighting back with more brutality. This is america. It shouldnt be. We saw it in chicago and los angeles and louisville and philadelphia and in new york city. And now in buffalo. There is something broken in the culture of policing. That is something the president doesnt seem to acknowledge. Instead, trump used floyds name and protests going on around the country to tout last months jobs numbers yesterday. Equal justice under the law must mean that every american receives equal treatment in every encounter with Law Enforcement. We all saw what happened last week. We cant let that happen. Hopefully george is looking down and saying this is a great day for our country and great day for everybody. A great day for everybody. This is a great, great day in terms of equality. You just heard that correctly. George floyd may have been the catalyst here, but it is bigger than him. The demonstrations this week led to more arrests in the case. All four cops involved in floyds death now facing charges. Derek chauvins upgraded charge to seconddegree murder and j. Alexander kueng and thomas lane and tou thao. Now the use of force policy means any direct pressure on the air way to block air flow has been banned. Now we saw since of progress in minneapolis, but we see signs of police brutalitbrutality. We have a public viewing where george floyd will begin in just a few hours. Priscilla. Reporter ali, we are at the church where the viewing will take place. Four large cars left dropping off flowers. There are two dozen flowers inside the church with more possibly expected. Officials tell us they are expecting up to 3,000 people to descend upon the tiny town in north carolina. 5,000 people live in raeford. There are orange cones down the street. When people come up, they go into the church to view the casket and leave the same way through which they came. Until officials here are really preparing for the large numbers and prepare to memorialize george floyd, the place where he was born. Priscilla, the president says he has spoken to George Floyds sister. Reporter he did say that. George floyd has a sister here and an uncle and stepmom. Those are expected to be here today. One thing the family and officials emphasized is they would like to see peace. They dont want demonstrations. It is a day for the family to honor his life. I spoken to activist whose said they dont expect to have demonstrations here today. They want to be respectful of the family. State officials and local officials are prepared for anything. Priscilla, thank you. Nbc News Reporter in raeford, north carolina. As civil Rights Violations emerge, the calls for Police Accountability are getting louder. Attacked a 21yearold male College Student from behind with a baton and jumped on him to make the arrest. According to the District Attorney, the systvictim suffer serious injuries. The now the District Attorney says the officer has been arrested and charged with assault. Quote, this moment demands swift and even handed response to violent and criminal acts based on the facts and evidence. There can be no safety or peace without justice. Philadelphias District AttorneyLarry Krasner joins me. Larry, good to see you again. We have talked about the coronavirus the last couple times. Then this happened. Ive been on the streets for most of the nights of protests. First in minneapolis and then chicago and then new york. It is surprising to me the degree to which police are using force against many protesters who are not using any at all. Completely peaceful. What is the situation in philadelphia . You know, the situation in philadelphia in some ways is really good. A lot of officers showing restraint and being careful. We have some disturbing situations. The social media and cell phone use has a steady stream of information. There are occasions when you compare to the police event, it doesnt match up. The situation you referenced is one where we have a staff inspector and not a former staff inspector. A current staff inspector showing up in multiple videos in different places and locations engaging in conduct that does reflect well for the Police Department and what you described. It is simple. We believe in equality or we dont. For people to be upset and frankly there are some people in the city who are all upset that one officer would be charged with violent acts when police at this point have arrested between 2,000 and 3,000 people shows something about the culture. Let me ask you about what the president and secretary of the union. He said baloney. He said the sergeant you arrested was engaged in a chaotic situation with a mi millisecond to make the decision. That is not an unexpected response. It is one we heard many times over. Including from the new york commissioner. How do you address the idea that police say were in a wild situation. We dont know whats going to happen next. We have to protect ourselves. First of all, it should be true. In this situation. It is not. Second, you know, one of the interesting things about him is he is so far described what happened in minneapolis to george floyd as quote unfortunate. Unquote. I like to hear him call it murder. Everybody in the country knows that is exactly what it is. Some of the union heads and fop chiefs around the country will make up excuses for almost anything. You saw the situation in buffalo. A 75yearold man is pushed down with his head cracks on pavement and head bleeding. The union head there said he slipped. Come on. It is okay to be a Police Officer and tell the truth. It is okay to be the head of the police union and say sometimes our guys get it wrong. Thats okay. Thats what truth is about and accountability is about. The people who hold us accountable have to be accountable or we will never have trust with all of the good Police Officers in the country and the communities they serve. Larry, good to talk to you. Thank you for joining me. Larry krasner is the philadelphia District Attorney. Joining me now is the delegate for the Congressional Black Caucus. She led the call with the director chris wray for social justice in america. Congress member, thank you for being with me today. The situation in the streets of america is very difficult this week. The things that led to it are longstanding problems about police abuse of africanamericans. What in your opinion can and should be done . Thank you for having me this morning. I hope you are doing well. The Congressional Black Caucus and leadership met with director chris wray yesterday for a very frank conversation about what the black caucus is looking for and what we are looking for from the fbi. From the federal bureau of investigation which is charged with the protection of americans and individual civil rights. We are concerned about accountability in the Police Department. We are concerned about excessive use of force. We are concerned about systemic racism in the United States and actually just taking the form of Police Brutality now. We recognize that it has many manifestations throughout social, economic and Community Structures in the country. I was frankly hartearheartened comments of director wray. He said he called the protesters a righteous important cause and the fbi was committed to protecting peaceful protests and they were not in the business of crowd control. So, you know, we talked about the things that the black caucus is going to be doing. We actually on monday will be rolling out a comprehensive criminal Justice Reform bill that is laser focus oed on the police. We had 40 bills with various members of the black caucus and other members of congress. We are having them look at it this week to make sure they go on the floor of the house and introduced in the senate by our colleagues Kamala Harris and cory booker so americans can see what is needed. Ali, one example in the conversation with director wray, he talked about the voluntary National Data base which has been created for use of force points by Police Officers. 40 of the Police Departments in the United States has put in that. Which is amazing. More information for Police Officers to have for Police Departments to have so they can do and police better so they can better support and serve their communities. So we want to make that a requirement of all Police Departments in the United States. Because without that information, we cannot investigate and do the things that are necessary to protect all american people. Representative, thank you for joining me. The Democratic Congress member for the United States virgin islands. Hundreds of retired generals rebuked the decision to send the military into the streets of washington, d. C. That conversation in a moment as we go to break. Look at mayor Muriel Bowser of d. C. Is letting the president know who controls the streets of d. C. Her message loud and clear. Three huge words painted on the street leading up to the white house. Black lives matter. She also officially renamed the street black lives matter plaza as she demanded the National Guard leave her city. How about that . Back in a moment. We have news in the 2020 election. Nbc news projects joe biden to be the Presumptive Democratic nominee for president. He has been the apparent nominee for some time. He is the only remaining democratic candidate. He amassed the 1,991 delegates needed to secure the nomination. He wont officially hold the title of nominee until formally selected by delegates at the Democratic National convention in august. It was scheduled for july originally, but the party pushed it back due to the coronavirus pandemic. The pentagon is looking to ease tension over the president s decision to bring in the military over the violence at the capitol. The guards members are being told not to use firearms or ammuniti ammunition. A move that mark esper made without consulting the white house. Additionally, hundreds of active duty troops that gathered at facilities outside the city in recent days are being sent home. Trumps decision is cause for concern with former u. S. Officials. Hundreds of retired diplomats and retired generals served in countries where the military is used to stop protests. Called on federal state and local leaders to hold the tradition of staying out of politics. Cities and neighborhoods which americans are assembling peacefully are not battle spa s spaces. There is no role for the u. S. Military to deal with american citizens exercising their constitutional right to free speech. Several high profile former defense leaders, including the First Defense secretary james mattis, condemned the move. Current secretary mark esper had reservations about using the men and women of the military to keep the peace. The option to use active duty forces should only be used as a matter of last resort. And only in the most urgent and tire dire situations. We are not in one of those situations now. I do not support invoking the insurrection act. Joining me is retired general Barry Mccaffrey and jeffrey rosen. Welcome, gentlemen. General, the expression crossing the rubicon refers to the idea in rome, the rule was no roman general may cross the rubicon riverhe headed to rome with a foreign army. In many ways, america follows that concept. Why is this a subject for confusion these days . It shouldnt be. Clearly the armed forces have on occasion used for domestic disturbances. To stay out of all domestic Law Enforcement. We dont arrest american citi n citizens and we dont collect evidence. Jeff, lets talk about the constitutionality of it. What does the law say about this . The general is absolutely right. The constitution gives specific circumstances where force can be used. Article i section 15 allows congress to authorize the use of the militia to execute the law suppre suppress, insurrection. And it gives the states protections of the republican form of government and on the request of state legislature against domestic violence. Secretary esper announced the insurrection act in 1807. That allows the president in limited circumstances to call out the militia when he thinks states cant enforce its own laws. It is under limited circumstances. He has to issue a formal proclamation and it has to be for limited times. Thats why we have a strong presumption against the use of the army to enforce domestic laws. The fear of standing armies is what called for the creation of the constitution. Including the second and third amendments. Thats why the situation today with the standoff with the president and mayor of d. C. Is so extraordinary. General mccaffrey, this is the esteem in which i hold you. The legal argument that jeff rosen presented to us and the sentimental view of military leaders. The joint chiefs mark millie sent a statement to troops. Every member swears an oath to support and defend the constitution and values embedded within it. He added a handwritten note. You see we are all committed our lives to the idea that is america. We will stay true to that oath and the american people. He is leaving room for interpretation. What is the message you read into that . I think both he and secretary esper were embarrassed of the cringe worthy photo op in lafayette park. Mark mille is one of the finest officers we had in years. A princeton grad and a lot of combat experience and smart as can be. Transparent. He is in a very difficult position. I might add he has zero command authority over any military forces. He is an adviser to the National Security council. I think he was communicating as the Service Chiefs that we swear an oath to the constitution, not the president of the United States. Look, there is some legal orders that trump could give the armed forces that would be a political disaster and entirely inappropriate. That is what secretary esper is trying to head off. Secretary esper and the president are the only two people who can give orders to the armed forces. Thats why the position of secretary of defense is so important and why secretary mattiss denunciation of the president was so powerful. Jeff, tom cotton, the senator of arkansas wrote an oped. This venerable law doesnt amount to marshall lmartial law. The federal government had a constitutional duty to the United States to protect from violence. Throughout the history, the president exercised authority on dozens of occasions to protect people from disorder. Constrains the military and Law Enforcement and expressly accepts staaccep accepts statutes. Whats your take on that . True that the act has been invoked in history. When you look at what happened, when president Grover Cleveland invoked, he had a disposal order before the strike. To confirm the generals point, Herbert Hoover never issued that with the insurrection act. That is the closest to what is going now. It was one of the greatest political disasters of his presidency and sealed his doom in history. Senator to the t senator cotton is correct, president s have invoked it in the past without the support of state governors have done so at their peril and found reputations sullied. Thanks to both of you. The need for change in america is echoing across the pond. Protests in the name of george floyd and all black lives are playing across the pond and europe. I ever experienced. It will not settle. It will not abate until i see change. Visibly implemented. I want to see the world change. I want to see it. I will not rest until i witness that. We have seen demonstrations in the name of george floyd span the globe from the United States to cities in europe and asia and australia. Lets check in on london now where we find International Correspondent sarah harman. Good morning. What is the situation . Reporter ali, good morning to you. There are thousands of people here in Parliament Square. These folks are braving Rainy Weather and pandemic and lockdown order to rally here and demand black lives matter. I want to give you a look at Parliament Square where we are right now so you can see how full it is. Several thousand people have turned out today. Id like to introduce you to one of them. A young protester named sharisse. She had never been to a protest before this week. Why did you feel it is important to come out now . Were tired. Were tired. We want to be equals to everybody else. We want people to being taught that black lives do matter. Uk is built on the oppression of people of color. Uk is racist. It is not just other countries. It is here too. You need to stop turning a blind eye to the oppression people face every day. Reporter ali, black lives matter chanted in a british accent, but the message is the same. Back to you. Sarah harman for us in london. Look at that picture from london. Remarkab remarkable. As the economy attempts to rebound from coronavirus, black americans are still facing high rates of unemployment. The jobs number showing an increase an increase in black unemployment as white unemployment decreased. The president took credit for the good jobs report and disregarded the rise in unemployment in blacks. Mr. President , why havent you laid out a plan to address systemic racism . Id like to sign this bill. This is a very difficult thing. By the way, whats happened to our country and what you now see has been happening is the greatest thing that can happen for Race Relations and Africanamerican Community and asianamerican and hispanicamerican community. For women. Everything. Our country is so strong and thats what my plan is. Black unemployment went up by. 1 . Asianamerican went up. 5 . How is that a victory . You are something. Thank you very much. For the moment, lets put aside the president s patronizing tone to one of the greatest journalists. The president s victory lap over the jobs report may have come too soon. The bureaus miscalculation error, the may Unemployment Rate in fact looked much better than it actually is. It looked lower than it actually is. According to the government, Unemployment Rate is likely three points higher coming in at 16 rather than the 13. 3 . The misclassification error is at the root a Data Collection problem. We talked about this in the past. Workers unemployed and temporary layoff are not counted. Survey interviewers misclassified furloughed workers as absent from work for other reasons. Thats a designation for employees on vacation or furloughed worker doesnt consider themselves on vacation. The may report is not the first time this error has occurred. The same error occurred in aprils jobs report. April was 14. 7 and may may be three Percentage Points higher. With me is perry. Author of know your price. Andre, good to see you. The question to the president. Whats the plan . His response. A strong economy. However, even in a strong economy, we have not bridged the gap between africanamerican Household Wealth and white Household Wealth. Has a immediamedian of 70,000. Washington post study indicates you need 11. 5 black homes to equal the value of the white household in terms of value. This is the point you are making. It is not close to equal. Not a 2 split in unemployment. It is deeper. Absolutely. What people dont realize under normal conditions, the black Unemployment Rate that is almost double of the white rate. When President Trump claims we had the lowest Unemployment Rate in history, he is technically correct. That rate is always in service to white growth. While white people are getting m managerial positions, but black positions are lyft drivers and other services. So, the other element that consistent doubling of the Unemployment Rate shows there is something structurally wrong with the problem. If he doesnt want to address that structure issue, black unemployment will always be higher than the white rate. So in this country, other than the wage you earn for your job, the wage you build wealth. Your job and investments like your home. An article from npr which says blacks are 40 less likely to own their homes than whites. Depriving the opportunity to gui build wealth. The gap is something you told me about. The study by zillow found black ownership lags 50 Percentage Points below the white race. In minneapolis, black ownership is lower as a percentage. The value of the homes that blacks own are lower in value than the value of the homes that whites own. Weve talked about this on several other shows. If you helicopter a black home into a white neighborhood, it would increase on average by 23 . About 48,000 per home. That amounts to 156 billion of lost equity. People use that money to send their kids to college and start businesses and move to a better neighborhood. Municipalities use that money to Fund Education and better policing and infrastructure. It is a large number that essentially extracted by racism. Under all this, the same attitude that led to a cop to put his neknee in the back of george floyd is the same attitudes harbored by housing officials and other sectors. We really do have to get to the structure of racism. In some ways, it is easier to see when a cop is violating someones rights. It is harder to see in private markets when Business Leaders are doing a similar act. I think you are right. I appreciate the work you put in to state this for us. Andre perry. The author of the book know your price. State officials are urging anyone participating in a protest to get tested for the coronavirus. The potential for new outbreaks is high as americans take to the streets. We are getting a look at the memorial in minneapolis. People created a makeshift graveyard honoring black victims of Police Brutality. You see in the front a grave for george floyd. Ahmaud arbery. And many, many more. More velshi after this. As thousands of americans continue to take to the streets to protest the death of george floyd and systemic racism, there say growing concern the gatherings could create a second wave of the coronavirus in the fall worse. With states with the largest marches, the number of confirmed coronavirus cases are sky rockets. Utah and arizona are already signaling a spike. North carolina, florida, arkansas and mississippi are a few states with cases trending up in recent days as urban areas see an influx of Democrat Administration radministratio demonstrations. It is hard to determine what will expect in the coming days. I want to bring in the professor of surgery at the university of california san francisco. Dr. Campbell, good to see you again. Let me ask you about this. I have been on the streets in minneapolis and chicago and new york. These protests are not socially distance and people are not using masks. What do you see when you look at them . So this is what i see. Good morning, ali. Thank you for having me on again. First thing i want to say is that we have we as Health Care Professionals are very, very concerned about what is going on with the protests because first of all, everyone has a right to protest. Let me say that. What has happened is an absolutely terrible thing over what happened in minneapolis, number one. They have a right to protest. What happens is because there are so many people, there is a potential for what you call a super spreader event. We know from the literature and what is published is a choir practice where 58 people were there because people were singing and they were with each other and close spaces and over 50 people were sickened and over 50 died. What we had been preaching for the last 85 days is because we dont have a vaccine, social distancing and wearing a mask and staying at home. This is the opposite of that. The second wave we are really quite concerned about happening. It looks like it may happen. We hope not. Were praying. I hope what the governor said about getting testing. If you are exposed or out, it is the thing to do. In fact, when you think of the things that shouldnt happen, we have been talking for the last 85 days about prisons and where they are good places. We have the cdc director Robert Redfield in testimony saying tear gas causes people to cough could help spread the virus. Densely packed crowds. Project your choicevoices. The number of arrests. Detainees stuffed in small vans for transport to jail. All of these things work against everything we have been discussing for the last few months. It is exactly the wrong thing you want to do if you want to contain the pandemic. Ali, i have to feel sorry for you. You were the subject of a tear gas attack in the streets to clear the crowd. You know what it does. Tearing eyes. Runny nose and coughing. Coughing six feet. It could go past that. You are spreading the virus. Two things we worry about. People asymptomatic spreaders and people who have a test which is a false negative. They may feel lifine and spread the virus. Everyone should have a mask if they go to the mass protests and we should try to keep social distancing if we can. If you are being detained, you cant do that. If you inside a car, you cant do that. If you are with 100,000 people, you cant do that. Dr. Campbell, good to see you. Dr. Campbell. A professor of surgery at uc san francisco. Because 3 is better than 1 none of us are free none of us are free if one of us are chained. Those are the lyrics of the a song recorded in 1993 by legendary singer ray charms. Those lyrics were revived in the chants of so many freedom seeking americans in the streets. Since the death of george floyd, ive been in the streets of minneapolis, chicago, and new york city with protesters, almost all peaceful, most angry, all hurt, all confused, but all of them certain of the thing that comes in the second verse of that song. If you dont say its wrong, then that says its right. Weve got to try to feel for each other, let our brothers know that we care, got to get the message, send it out loud and clear. What the protesters are saying in shorthand is that this isnt a black problem, its an everybody problem. If one among us is not treated fairly by the police or as they try to vote or in our courts or by the economy or in the wages that they are paid or the health care to which they are entitled, then none of us are. If you accept that premise, then let us acknowledge that we are not free. Nearly 13. 4 of americans black, and they live their lives in fear. They follow a set of unwritten protocols literally to stay alive. That sounds like an exaggeration, and to many white americans the concept of lynching is something from the history books, but lynching in which the accused gets no due process has never really ended. George floyd got no due process, and he died at the hands of police, Ahmaud Arbery got no due process, he was killed on february 23rd of this year by two vigilantes who allegedly thought he was a burglar. Breonna taylor got no due process when police used a battering ram to get into her apartment and killed her in a shootout with her boyfriend who lived with her and had a licensed firearm.
