Welcome to the week. The world is honoring an icon. Supreme Court JusticeRuth Bader Ginsburg. She died yesterday at the age of 87. A statement from President Trump calls her a titan of the law. Few would argue with that, even his critics. But heres what the president told supporters tonight and what supporters told him at his rally in fayetteville, north carolina. So article two of our constitution says the President Shall nominate justices of the Supreme Court. [ cheers ] oh, i hope you hear that back home. No, it says the president is supposed to fill the seat, right. And thats what were going to do. Were going to fill the seat. [ cheers ] the president said that he would be nominating a woman for the seat next week. He also said he disagrees with republican senator Susan Collins of maine. Senator collins said today that she believes the senate should wait until after the election to vote on the next justice. That election is now 45 days away. Early voting began this week in a handful of states. And Justice Ginsburgs death could change the race dramatically. Death has been on our minds a lot this year. Today the known death toll from covid19 passed 200,000 in america. That toll has doubled in just four months. Theres hope for a new vaccine, though it may take a year or more to actually get you your shot. And theres growing concern that flu season could bring a surge in infections and cost more lives. The work of the Supreme Court could affect all our lives in the upcoming term. Appointing Justice Ginsburgs successor could change everything. A larger conservative majority could cripple the Affordable Care act. That could leave more than 11 million Americans Without Health Care during this pandemic. Other cases could change the future of abortion rights and lgbtq rights or not. Justice ginsburg herself reminded us that the court is unpredictable. Even with justices who are appointed by republican president s. Well let her explain in her own words this hour. The week is here to help you survive a nonstop news cycle. Its so fascinating that Justice Ginsburg is barely gone 24 hours now, the politics started almost instantaneously with senator Mitch Mcconnell saying yes, we will hear President Trumps nominee to succeed Justice Ruth Bader ginsburg, were getting more statements tonight. Senator cory gardner, up for reelection, said we need take time for personal reflection right out in. Mark kelly whos running for senate in arizona said that the people elected to the presidency and senate in november should fill the vacancy. Felipe, its almost like Ruth Bader Ginsburg died a month ago instead of a day ago. We have blazed right past that to the politics. I mean, what does that tell you . Nothing good. Its just one more checklist item of 2020 and, frankly, the last five, ten years. Thats not good. I have a feeling that cory gardner is going to reflect in a remarkably short period of time. I think before the cynical political hack, its sad because she was a role model to so many people. To see people in my life react to it, im glad at least people i know are not jumping up. That said, this like Everything Else is a political matter. A few minutes ago you said it could change the race dramatically. Weve had this moment several times. Whether its covid, whether its george floyd, whether its the economy. And by nbcs own polling, donald trump started in january at about 42. 5 approval, and donald trump is now currently at 43 approval. So its not that this is baked or that it is impervious to change, but it might not be as simple as we think. The only comparison we really have in this environment is 2018 with brett kavanaugh. There was probably no more partisan moment of the last four years where things kind of reverted to the pretrump bad days it almost had nothing to do with trump. Obviously he nominated, but still, its hard to measure because he got kavanaugh. And i have a feeling that mcconnell and trump might be at odds a little bit here because mcconnell, he wants to get this done by, you know, friday. Theres probably people in trumps world say you know what, having the seat open and saying the democrats are holding it hostage might be theres two quick numbers that i saw of interest. First of all, abortion is not a 50 50 issue. You have the majority of the country who believe that abortion in some form or another should be legal. Hopefully let me im sorry, let me interject since you brought up abortion. I did want to ask you, susan, about the impact of this on senate races. Kind of to felipes point. Weve heard senator collins saying she does not believe there should be a vote prior to the election. There were questions about what senator Lindsey Graham said in the past and what hes saying now in terms of whether this should move. Im wondering what you think in terms of how republican senators are viewing this. If youre a republican in a tough race and you are concerned about losing the white house to joe biden and missing the chance to get another member of the Supreme Court confirmed that your constituents will like, i wonder if it makes more sense for some republican senators to just bite the bullet, break precedent, and go for the nominee. Otherwise, they go back to constituents with a double lose as opposed to a draw. We lost the white house, but we cemented a conservative majority for two generations. What do you think . [ inaudible ] susan, im real sorry, were having audio problems on your end. Youre really faint. Were going to try to fix that in one second. Sorry about that. Felipe, let me put that question to you briefly. What do you make of the calculus of that, of coming home with a draw, losing the white house but gaining a Supreme Court seat versus losing them both . You know, its a lot going on. I think for i want to apologize, its not the topic i got here doesnt like that im talking to the ipad and not him. Its really hard to tell because theres so much going on. Youre going to have someone making the argument, look, Mitch Mcconnell in his heart of hearts would rather keep the senate than keep donald trump. Now at the same time, that might require Susan Collins just to make political sudoku and say i know im going to lose my seat. Shes said she wont do that. Theres a lot to unpack. Yeah. And you know, theres obviously were focused on the trump part. Its really hard to say on the senate part. And i think one thing to note, you know, the mechanism that people give to most democratic, not all democratic candidates, is seeing tens of millions of dollars floated. Its not clear where that went. It didnt all go to joe biden. People might be taking a deep breath, they might be giving to jamie harrison. It will be interesting to see how the candidates are funded. On trump, its interesting in that 2016, somewhere between onefifth and one quarter of his voters were prochoice. They might have thought back then that he was not rabid prolife because he had not been in his life four years later with all the judges, people might repel. You know, women saved us in 2018. They might save us in 2020. I wanted to bring up two things. One is donald trump said at tonights rally we have plenty of time. We have until january 20th. So i think that youre right, joshua, bringing up the issue of theyre not sure what to do just yet. Then another issue, if the senate moves right for this confirmation hearing, how are they going to explain to their constituents they cant give covid funding . That is a gift frankly to the democrats because as tragic as it is losing Ruth Bader Ginsburg, we know that 200,000 people or more have passed away. And it is affecting these states they need it financially, and i think that that is something that really, if i were the democrats, id Start Playing up. Go do justice with a nomination which you thought was inappropriate four years ago. Meanwhile, you cant help the people in your state live . I think thats a tricky proposition. As you heard, they chanted that at President Trumps Campaign Rally tonight. Last night the president appeared to have learned of ginsburgs death from reporters after a rally in minnesota. He had kind words for her calling her an amazing woman. This morning, he tweeted that the gop has an obligation to select the next supreme Court Justice, in his words, without delay. That echoes the sentiment of Senate Majority leader Mitch Mcconnell. Ginsburg had been dead just a few hours when mcconnell announced that the senate would consider mr. Trumps nominee without delay. Tonight the president held a rally in fayetteville, north carolina, and that is where we find nbc National Political reporter Josh Letterman joining us live. Josh, what was the president s message tonight about Justice Ginsburg and about her possible successor . Clearly it was something that the crowd was happy to hear about. Reporter they were happy about that. Good evening, joshua. Congratulations on the new show. If there were any doubt in the last 24 hours or so that President Trump was going to try to push through a Supreme Court nominee, election or no election, he put that question to bed tonight, announcing that he does plan to move forward with a nominee to replace Justice Ginsburg within the next week. And also announcing that he plans to choose a woman. The president took whats obviously a solemn moment and a serious decision facing himself and the country and turned it into kind of a gimmick with the crowd here in fayetteville. He asked repeatedly whether the crowd wanted to see a man or a woman nominated and kind of judged which got the more applause. Essentially, jokingly crowd sourcing his pick for the Supreme Court. Now the president did not obviously name who this person is going to be. Said he has numerous women who are brilliant under consideration. But joshua, three people who will have judge of the president s have knowledge of the president s deliberations say among the frontrunners is amy coney barrett, a justice on judge on the seventh Circuit Court of appeals out of chicago. Shes someone thats been considered for the Supreme Court before. Someone that serves like very much. She also has the added benefit of being in her late 40s, which means she could potentially century for several decades on the court if she were confirmed. Now the one thing the president did not tell us tonight was whether he expects a vote before or after election day. Thats obviously a key question. The president suggesting hes going to leave it up to Mitch Mcconnell to decide. Thank you. Globally more than 900,000 deaths. Meanwhile, the search for a vaccine continues as the president and Public Health officials disagree on the timeline for its distribution. What will it take to get a vaccine from the lab to you . Joining us is dr. David shulkin, secretary of Veterans Affairs in the trump administration. Hes worked in hospital leadership at the university of pennsylvania, temple university, beth israel medical center, and elsewhere. Author of it shouldnt be this hard to serve your country. Secretary shulkin, good evening. Good evening. Nice to be with you. Let me get your sense of the logistics of this. You have state and federal officials who are trying to make sure that providers are equipped to administer a vaccine. Everything from getting enough of them to enough of the right places to keeping them cold enough, well below the Freezing Point to preserve them so they can get to my doctors office. Talk to us from the perspective of a Hospital Administrator whos been watching the politics of this week and wondering what the next step is. If you were back running a hospital system, what would be top of mind for you right now . Well, joshua, the way i think about this as a physician and as a person whos run Large Health Care systems, i think about it in terms of the science first. And the science is very encouraging. And then we need to talk about the public confidence. When you talk about the science, we have nine vaccines now in phasethree trials, 15 in phase two. And weve never seen this before. We have vaccines with all sorts of different mechanisms of action. Now that the pharmaceutical companies are pledging, coming out transparently showing the protocols that theyre using, i think that were seeing very positive steps on the scientific front. And i feel confident about that. When we look at public confidence, youve never seen anything like this. Only 21 of americans say that they will definitely take this vaccine. Just half of americans say that theyll probably take it. We have 77 of americans who are saying that they feel a vaccine may be released before its safe to do so. We really have a problem with people and people in very high places like in the white house talking about the release of a vaccine before we actually have the safety data. And thats my biggest concern because if we can produce a very good, safe vaccine, people need to take it for it to work. I can imagine that there are doctors across the country who have been tearing their hair out all year because you have contrasting messages from the administration, including what we heard from dr. Redfield when he held up his mask and said this is much more of a a deterrent for covid19 than the vaccine. I think part of the reason for that is you got to mask right now. Were waiting on a vaccine that may have contraindications, that may work for some people than other people, some of us may be allergic to. What do you think that people most need to know right now in terms of where all this sits for them, especially because the politics of this are so sticky . Well, i think you said something very important, joshua. We need to learn from what weve seen now with masks. We know that they are the most effective tool that we have. Yet, 45 compliance across the country. So we cant afford to repeat that if we come out with a safe vaccine. And i think what we need to be doing is we need to get the politicians out of this and return this to our scientists and to really being transparent with our data. And lets see what the data says about both effectiveness and about safety because if we are fortunate to have a vaccine, we need people to feel confident that this is the right thing to do in order to get this pandemic behind us. Secondly, we have to be planning right now a transparent process for the administration and distribution of this vaccine. Logistically, im confident that we can do this. But we have to first plan for the 20 Million Health care providers who are at high risk. You know, one in seven deaths in the world have been among health care workers. Yeah. We have 53 million 65 and older in this country. They are high risk, as well. We have to make sure we get this to the right people, get it distributed, make sure theres not politics in any of the way that this evacuates gets administered and return to a system where we have confidence in our scientists and those who are leading our health care agencies. I do agree. We have the means to do this. I think logistically once we have it we can figure that out. And i wonder hear what what is mind in terms of the future. I know the aclu has rededicated the center for liberty as the Ruth Bader GinsburgLiberty Center. Is there anything in particular you want the ginsburg Liberty Center to do in terms of furthering her legacy . Any top issues or concerns on the agenda . We have to carry on in the way, with the values that ruth taught us. Ruth Bader Ginsburg was our greatest contribution to american democracy. She served as the founding director of the womens rights project, 1972, in the eight years that she was director, she brought 34 cases before the Supreme Court, all in 300 cases. She herself argued six of those cases before the court on our behalf. She won all five. She was remarkable. She powered a whole revolution for gender equality. And she changed the face of how we interacted as people. It wasnt just about womens rights. It was about equality for all people. Some of our greatest clients were men. She had this one widower who tried to collect his survivor benefits. And people scratched their heads and say like, why are you bringing this case on behalf of a man . And she understood better than most. Back in the 70s, the suffocating identities that we impose upon men and women were a detriment to us all. And that what stood in the way for full equality for women and men was to break down those barriers. She was a visionary. She was our icon. She embodied the best of our principles. Heavy heart today but with enormous gratitude and a great tribute to a wonderful woman who made such a difference to us and the world. Whats the conversation among aclu members . I think its fair to say theres a lot of progressives in this country who are heartbroke and angry at what heartbroken and angry at what the future looks like. Whats your sense of the aclu . People are frustrated. Let me say from the aclu, a point of personal privilege as we lawyers like to say, im disgusted at this process. This woman who spent her whole life dedicated to public service, she has not been gone from this earth for one day, and we already are fighting over who replaces her. We have not taken the moment to fully pour over her legacy, her contributions. Certainly her lifes achievements are more important than the day or the month or the year upon which she died. And it is scare louse to watch this kind of effort for folks to fight their way, to measure the windows in her chambers, to figure out the new drapes for her successor. Its tawdry. She deserved more. She taught us better. And Mitch Mcconnell was taught better by his mother. The words from President Trump, hollow rhetoric. We want to pay tribute to ruth, we take a moment, we reflect upon what she did for each and every single one of us. We pause, we pay tribute to a giant who walked among us and who touched the lives of each and every single person, man or woman, republican or democrat. A nation of laws demands that we apply this concept to everyone no matter how powerful. The week has included more questions about how or executive branch is using its power. Attorney general bill barr reportedly asked prosecutors to bring charges of saidition against the mayor of seattle. The issue letting protesters form a policefree protest zone there. Also, fbi director chris wray testified that russia is still working to affect the president ial election as we knew it would. Yesterday, President Trump was asked whether he would consider firing director wray. Mr. Trump said, quote, were looking at a lot of different things, unquote. Joining us now is Jonathan Chate, writer for new York Magazine. In a recent article he argued that the president s misdeeds are a moralism pairtive and possibly a con stunl cristituti problem in the making. I think this is another indication of one of the deepest problems weve seen in this presidency which is that President Trump redefines criminality the way he sees it which is that crimes are things that are done by his opponents. Anything he does is not a crime. Hes managed to find people in his administration especially attorney general barr, who will follow through on that vision and turn it into the policy of the United States government. And thats whats reaching almost crisis levels. And thats whats going to create a real problem for prosecutors to deal with if trump leaves office. Let me ask you about your article. The article in new York Magazine is entitled lock him up . For the republic to survive trumps presidency he must be tried for his crimes even if that sparks a constitutional crisis of its own. Now we have pardoned president s who broke the law ford pardoned nixon, famously. You in the article refer to countries that have been viewed as banana republics because of the way that one head of state deals with their predecessor. You refer to the kremlin, you refer to nazi germany where hitler came to power with another system that broke the laws of the government that was still in power there. These are very strong images to level at a time when the countrys already kind of worried about what the future might look like. If this went forward, how does that look . I mean, do we just drag him out by his ankles and in handcuffs on january 20th, or is it more to it than that . We dont know exactly what it will look like because there are a lot of ways that donald trump could face legal problems as a citizen whos no longer president. Hes managed to fend off prosecution by the department of justice because hes president. The department of justice named him as the person who ordered Michael Cohen to make hush money payments to Stormy Daniels but didnt prosecute him because the department of justice doesnt name the president as the target of criminal investigations as policy. If hes not president , that policy doesnt protect him anymore. Hes been investigated by two different prosecutors in the state of new york for pretty straightforward financial crimes. One of which was reported in pretty extensive detail by propublica where hes just misstated the value of his holdings and is basically defrauding the government on taxes. And i think this fits with the pattern of behavior going all the way back as long as he been in business. Even if we went forward with the prosecution, what you refer to in the article is also just the political fallout. Supporters of the president are going to say this is exactly what his enemies wanted to do with the impeachment and russia, russia, russia. And opponents of the president are going to walk away still broken because even if you catch the president and prosecute him and convict him and drag him to prison in an orange jumpsuit, the damage is still done, and we still have a country to fix. So it feels like damned if you do damned if you dont. Thats exactly right. Thats the argument i tried to make. Whatever happens is going to be bad. Its not like prosecuting him solves all our problems. Prosecuting him creates problems. I want to argue that not prosecuting him creates bigger problems. I could the watergate example is a pretty good way to look at that. At the time when gerald ford pardoned nixon, it was seen it was controversial. Then it became seen as heroic. Think about how nixons memory lasted over time. How trump has taken nixon as a kind of hero. How roger stone has a nixon tattoo on his back. How trump took nixons slogan law and order, come became ironic after it was found how much criminality was found and took out the irony. Right, right. If nixon had gone to jail, i dont think that would have happened. I think people would have learned the lesson from nixons crimes. Here we have someone thats gotten all the wrong [ inaudible ] we should rethink what that episode teaches us about allowing a president to violate the [ inaudible ] Jonathan Chate of new York Magazine. Professor reasosen, welcome. Good to be here. What are you expecting in terms of the legal battle over Justice Ginsburg . I know there are always constitutional questions that come up in the confirmation process. Do you expect the big issues to be hot buttons like abortion, or are there other issues we should be paying attention to . I have to say, i spent the day mourning Justice Ginsburg, and i want to spend today still just giving honor to the legacy of this extraordinary woman before the explosive battles ahead. If thats what we must talk about, which will be the case in the coming weeks, its im sorry. Can i stop you right there . Sure. I appreciate the point that you just made. I tend to agree with you. I think we should be spending today mourning Justice Ginsburg. It feels a little inappropriate to jump to politics because politicians have jumped to politics. But i get it were 45 days from an election. What impact do you think that has on her legacy . I mean, the National Constitution center just recently in the last little while just honored Justice Ginsburg for the totality of her career. Now were talking politics. How do you gauge the impact of that on her larger legacy . It was so meaningful to be able to honor her just thursday night, the night before she passed. We assembled her favorite Opera Singers and special friends to pay tributes in words and music. The testament to her legacy there which conveyed the fact that shes one of the most influential figures for constitution change in American History as well as the most significant ad invoke for gender equality of our time as Thurgood Marshall was for racial equality in his time, is what we need to focus on and honor. And nothing that happens next will affect that legacy. Her position in history is unshakeable. Shes transcended the partisan politics of this particular court, and her position in the history is secure. Nevertheless, of course many. Her landmark decisions might be eradicated. She was concerned about the future of roe versus wade, of course. And she told me ain our conversations over the years which he allowed me to collect in a book that came out recently, i asked in all of the interviews do you think roe will be overturned, and she said, no, im skeptically hopeful it wont be as long as the current composition of the court remains the same. She believed that chief Justice John Roberts would not vote to overturn roe. That was contingent to her remaining on the court. If shes replaced, the law in the court will be changed in extremely dramatic ways. And of course, the battles that you asked about, which are right to ask about, i didnt mean to undermine the seriousness of them, could transform the legitimacy of the court if we go down the spiral of a republican confirmation followed by Democratic Court packing. Could transform the legitimacy of the court in ways that we havent seen, i dont know, since the election of 1800 or before that. So were in very serious territory ahead. He became the chief justice and the court did some brave things, not just in ending apartheid in america but, in the criminal justice system. Justice brennen was a republican. A member of the Supreme Court of new jersey, and he was thought to be a good middleoftheroad type. Justice john paul stevens, in my tenure on the court, Justice John Paul stevens and dave suitor, both republicans. Stevens was a pointed by president ford. And suitor was appointed by was bush. President bush. First bush. And i guess, if you would rank the court, who are the most liberal justices, they would turn out to be David Stevens and suitor. What the court did today is devastating for women. I think two of my old chief chief Justice Rehnquist. In the 70s, when i was arguing on cases, i could count on him to be in dissent. The miranda warnings that you have to give someone who is reacted. He criticized it, many times. Then, we had a case where the question was should miranda be overruled . And the chief wrote an opinion saying no, it has become a part of the culture that the police have to tell you you have a right to remain silent. If you speak, whatever you say can be used against you. You have a right to have a lawyer and, if you cant pay for one, the state will provide one. Those, the chief said, have become part of our culture. And its working. All, a huge surprise to me. He was on my side in the vmi case. The mo was the family medical leave act.
