>> reporter: donald trump is the critical guy right now and new polls show he has a double digit lead. we wait and watch. >> thanks great seeing you. now to a developing story out west in about an hour and a half the penalty phase for convicted movie shooter james holmes will begin in a colorado courtroom. jurors convicted holmes of first degree murder last week in the attack that left 12 dead and 70 injured. the same jury must decide if he gets life in prison or the death penalty. reaction from survivors is pouring in. >> i used to be anti-death penalty, but what do you do to a person who goes into a theater with an ar-15, kef lar gear and semiautomatic weapons and planned it for months and shoots at an unarmed crowd and two were actually my friends. >> let's go live outside the courthouse in centennial colorado. what do we expect today in court? >> reporter: well good morning, jose we expect as this whole thing unfolds over the next month or so more emotional testimony like we saw in the trial itself. this penalty phase is divided into three distinct parts. the first part today is what's known as aggravation phase. what aggravating factors were involved in the killings? were they particularly heinous? was a child killed? there's no debate about that and that phase of the case that the jury will have to decide could be wrapped up as soon as today. then we move onto the mitigation phase, what are the mitigating factors. we're likely to hear from people who support holmes. the jury will hear videotaped testimony from his fifth grade teacher who said he was a renaissance child. that doesn't speak to the actions a decade or so later when he open fire in the theater. we could hear from holmes parents or holmes himself. if the jury decides that the aggravating factors outweigh the mitigating factors, we hear from victims and survivors and family members about what this shooting did and why many believe holmes should get the death penalty. then up to the jury to recommend to the judge whether holmes gets death or life in prison. >> thank you very much. we're gearing up for big news out of ferguson next hour when the mayor is expected to name a new interim police chief. we have early details to share with you this morning. the st. louis post dispatch reports the job will go to andre anderson a 24-year veteran of the glendale arizona police force. former boxer and corrections officer. ferguson has been without a police chief since march after a doj report criticizing his department's handling of the michael brown case. we'll bring you the live announcement right here next hour on msnbc. also take a look at this developing out of new jersey right now. this is what's left of a warehouse in north brunswick. massive five-alarm fire has been burning since early this morning. six nearby buildings have been evacuated, some res residential. it has sent thick black smoke more than 1,000 feet in the sky. no word on if somebody was inside at the time. the warehouse is 85 years old and housed an auto shop among other businesses. we're just getting started on this wednesday edition of the rundown live from new york city. still ahead, lawyers for bill cosby fighting back against the release of a decade old decade where he admitted his fame to pursue young women. the recent rains in california have not done much to help the drought there, but this is just the beginning of a stronger el nino weather pattern. that's what i'm being told. who better than bill karins to explain exactly what that means and whether the drought will see relief in the future? exchange for money. here's stephanie gosk. >> reporter: at the center of the controversy is a deposition given by bill cosby in 2005. partially released by a judge earlier this month. in it cosby admits he obtained qua lewds in the 1970s to give to women he wanted to have sex with. in court documents filed tuesday, his lawyers say the media, immediately pounced and misinterpreted their client's words, suggesting that cosby admitted to rape. cosby has never been charged with any crime and his attorneys vigorously deny accusations that he drugged and sexually assaulted more than two dozen women. over the weekend "the new york times" obtained the entire deposition. cosby's attorney says the alleged victim's -- never told the court reporter that the deposition was sealed. >> what this case boils down to is silence. should someone be able to buy silence? >> now it looks like not only could we have an el nino but could be our way to a super el nino. we only had two or three of those. the reason those may ring a bell '97, '98, those who lived in california had too much rain horrible flooding and devastation. it's interesting they are in a drought so they want the rain this time but without the devastation devastation. the area we watch is the tropical pacific. that is where the el nino developed depending on water temperatures. the easterly trade winds weaken and above average water here and that's what sets the stage and jet patterns across the pacific and all the weather that goes across our country. the other thing it does it actually increases winds and tends to steer the storms away. this is in 91997.$1997. notice most of the path were in the open atlantic only danny made landfall in northern portions of florida. we're expecting a relatively quiet next three months of the peak of hurricane season. that's good. also typically during the summer it's cooler and wetter in the southern half. typically but not every el nino is the same. we've been blistering hot through the south. we did get the unusual rain storm in california. a lot of people are wondering, how will it affect winter? it does typically bring warmer air and doesn't allow polar air to come in. for those who suffered the last couple of winters, they are hoping for warmer. getting back to california this is the predictions here. they need about a foot of rainfall in california almost 2 feet in get rid of the drought. these are the odds with the el nino, maybe super el nino coming, still only 35 to 45% in northern california and 5% in the southern. this drought is of so long even with a wet six months we're still only going to take a dent out of it. >> let's hope it does get a dent. >> we want the rains -- >> not the flooding. >> not that. >> thanks good to see you. deadly baghdad blast and el chapo arrest. >> 25 killed in a slew of bombings in baghdad on tuesday the deadliest where a car bomb took aim at the predominantly shiite community. similar attacks killed civilians and soldiers wounding more than 50 people. no organization has yet claimed responsibility for the attacks. lat itest in the hunt for notorious drug lord el chapo guzman. three with ties were arrested in guatemala on tuesday, according to gaut mall an radio station. last week seven were arrested in connection with a jail break. nearly three dozen people pulled in for questioning in the case. guzman escaped from his maximum security prison in mexico through a perfectly constructed tunnel a week and a half ago. china returned the passport of a prominent dissident after authorities confiscated it four years ago. activist posted this photo of himself holding up his passport on instagram, charged with tax evasion and had his passport evoked in 2011 a move he said was strictly political motivated. he was the designer of the bird's nest olympic stadium. officials have not said why the passport was returned all after a sudden. check out this surveillance video out of massachusetts, a speeding truck loses control hitting a telephone pole before slamming into a car dealership. all of the used cars on the lot and star front were damaged. the driver facing charges for drunk driving and destruction of property. no one was injured in the accident. still ahead, it's been one year since a "washington post" reporter was arrested in iran. we're going to talk about his status given the new nuclear deal. why donald trump has put the rest of the field between a rock and hard place. first, president obama made his last appearance on "the daily show" and made one final executive order. >> what do you have about a year? the deal can actually keep iran from getting nuclear weapons. just days ago ayatollah khomeini said it won't change the relationship between the u.s. and iran. joining me now, senior white house correspondent chris jansing jansing, good morning. >> reporter: good morning. >> john kerry on capitol hill today briefing and i guess really selling the deal to congress. what's he up against? >> reporter: a tough sales job with ernie moniz, they are sending folks involved in the negotiations most deeply steeped in them to answer questions they think that the facts will help them win over some of the undecideds. they are not going to change the minds of people who have been on the record for a long time but they do think that this is the best possible deal and in fact keeps the possibility of war at bay. so they are going to be a lot of questions to be answered. not only going to be facing skepticism but anger. there are a number of folks on both sides who are very unhappy that the united nations decided to vote on the deal before congress had a chance to look at it. it's going to be a tough day on capitol hill. but they know what they are up against, jose. >> then chris, there's the issue of what comes out of iran during these very tense times when the white house is busy trying to sell this historic deal to congress. then you have the leader of iran maybe the foreign minister talking about it. it's not helping very much. >> reporter: the supreme leader i don't think anybody is surprised this doesn't change the calculus of the relationship with the united states. we're not going to suddenly become a different country and president obama has been saying that all along as well. i think those are -- those really sort of play into the issues of can iran be trusted in the whole concept of verification, which is one of the toughest arguments that the folks are going to carry, moniz and so forth will have when they come on capitol hill today and answering questions before committees is going to be about can they be trusted and what they've said is you don't trust, you have to verify. but there's a lot of skepticism whether that verification mechanism gives iran too much time from the time that questions might be raised about whether they are breaking the deal and whether -- and when inspectors can get in jose. >> let's see that the iranians see the same deal as the united states and other countries see as being the same one. they have maybe different interpretations of what they agree to. chris jansing, thank you for being with me. always a pleasure. >> let's bring in christopher dickey and author of "our man in charleston." let's talk about this. there are reports last night and this morning that iran's foreign minister zarif said on iranian state radio that if sanctions are reimposed iran would reconsider cooperating with nuclear inspectors and as a matter of fact the reviews of these inspectors don't necessarily matter that they may not agree to letting their plants and areas be inspected. >> they are going to sign onto the additional protocol to the nuclear proliferation treaty. clearly their line is if the west goes back on its deal if the united states goes back on the deal by reimposing sanctions, they are going to say we're going to throw that out the window. we're not going to sign onto the additional protocol. >> that's if the united states does something that they had agreed not to do or vice verse is a. right now we're hearing different voices out of iran. the supreme leader saying we're not going to change and foreign minister saying we may not let these guys do what the agreement says they are going to do. >> they are trying to show -- especially zarif, is showing troo show he's a hard line guy. you're going to see a lot of that game playing in the future. there's a fundamental problem with iran. you really can never be sure which iran are you dealing with. are you dealing with the z saxtarif iran santa claus, that's all great, but what about the iran of the people who were subverting all of the neighbors of iran and behind terrorism for a long time. >> that's a key point. one thing is what you say and then see what your actions ar. in the middle east they have been a power house of in many cases terror. >> absolutely they have been. in fact we even had one former presidential candidate in iran saying the other day, that if the united states decided to attack iran they would kidnap 1,000 american soldiers somewhere -- i don't know maybe iraq who knows where -- then ransom them back and make lots of money that way. they throw this kind of stuff out. it can be really crazy dealing with them. >> talk about the "washington post" reporter one year right now and still no justice and he's still not back home. >> i'm afraid he's going to be there for a long time. at least we see now the "washington post" and his family doing something they were reluctant to do. usually when someone is taken prisoner or hostage, please lie low and don't rock the boat and push buttons to make things worse. the problem is if you don't push those buttons they don't respond. i was directly involved in winning the freedom of the "newsweek" correspondent taken prisoner in 2009. we never let anybody rest for a moment. no president or official of iran could be anywhere they wouldn't be confronted with the case and he was out in three months. maybe that would have worked or wouldn't have worked -- >> there are four americans. >> there are four and one of them we don't know the status of the former fbi guy. >> tell me about your book. >> the book is about basically about the origins of the fight over slavery in the south and the question -- a lot of the questions that you look at today when you u.s. servicemen stationed in england by two men who planned to join isis. one of the men is a delivery driver accused of plotting to run over a serviceman and kill him with a knife. prosecutor say both men had hoped to join isis in syria. a top terror leader in syria dead killed in u.s. drone strikes, al fadi was the leader of the cora zon group and one of the al qaeda leaders who knew about the 9/11 plot. back to presidential politics, republican candidates are having a tough time grabbing a spotlight away from a guy who, well, loves the spotlight, donald trul p. moments ago it was confirmed that the candidate will visit the border between the u.s. and mexico tomorrow. >> meantime the first gop primary debate two weeks from tomorrow. as of today, donald trump will be on the stage with nine other rpz republicans. calls for him to withdraw from the race are seeming to go on in one ear and out the other. now republicans ss weary to push him too far away for fear of an independent run. if he would run as a third party candidate, he gives the election to hillary clinton. clinton garnering half of the vote. jeb bush and trump splitting the difference. here with me now is nick and jonathan alter. what's the biggest thing trump can learn at the border? >> how badly he can mess up this primary for the gop. it's a huge problem. if you're one of these candidates otherwise well credentialed and have two weeks to make the top ten, it's hard to do so when he's making all the news and being a spectacle and not being borg. >> how does this conversation for the republicans get away from trump and his cell phone numbers of lindsey graham and all of these other issues? how do they get back into discussing issues of importance to the american people? >> i'm not sure it does, he is talking about an issue of importance in the american people and that's immigration. his perspective on it is shared by one part of the party and the other part is trying to moderate that position and appeal more to people of color and minorities and immigrants. it's a tough bind. it's very hartd for a gop leaders and i'm not sure what they can do about it. >> we heard before that trump isn't bound by the same rules as candidates. he's shown that hasn't he? >> he's always play bid his own rules, 30 years since he emerged as a major celebrity in new york. he will be a wild card for the next year until the republican convention. if the republicans are lucky, he won't run as an independent. as you mentioned if he does do that it's curtains for the republicans in the 2016 election. in the short term in this august 6th debate you can expect trump to dominate the conversation about immigration and because that's such a big issue in their party, it will come up. as they compete to try to outtough each other on immigration, again the winner is the democratic party. >> interesting, yeah. >> the latino vote which went 70% for barack obama the last time, the republicans have to get those voters back or they can't win a general election. >> jonathan because immigration is going to be clearly center if trump has his say in that debate, it could -- it could open the field for those candidates who have another position on immigration, i'm thinking jeb bush and kasich if he gets to the top ten. but to maybe make a difference and say, well that's you but there are other positions on it. >> that's what would be healthy, if by throwing this kind of bomb into the center of the gop, if it actually freed the party to have a genuine debate on an issue like immigration, rather than everybody walking around on tip toes afraid to alienate the hard line base of the party that doesn't want immigration reform. there are a certain number of republicans, particularly those whom you might call finance republicans who are for comprehensive immigration reform and waiting for a candidate to step forward to make the argument for why a hard line on immigrants is not the right way for the country to go. if we get that debate jose it actually could, as you suggest, it could be something positive for the country that comes out of the trump clown show. >> nick as long as trump is in the show it's going to be difficult for any other candidate to get significant air time. >> look, i mean the whole game right now is to make some noise, put some ads up and get your name i.d. up so in the polls you crack the top ten. we saw rand paul of kentucky was taking a chain saw to a copy of the tax code. you'll see this and it's awfully hard against a (music) hotels.com. they don't need me right now. new fuel this morning in a worldwide fight centered around the on demand car service uber. they are taking to the air waves with this commercial in new york, a blunt message aim at the progressive mayor and famous yellow taxis. bill de blasio wants to cap the number of uber cars on the road. taxi drivers are being squeezed by less regulated and sometimes less expensive services like uber. not just in new york all over the country and throughout the world in paris, taxi drivers set uber cars on fire protested in the streets. here with me now, new york city controller, scott stringer. thanks for being with me. talk about this controversy. i know you have a different opinion on this. >> the bottom line is our transportation infrastructure is changing in new york city and around the world. yellow taxis dominated for 30 years because they understood how to navigate the political process in new york. >> what does that mean? >> in other words, they were able to get the rules put in place that they needed to be a successful business model. and they obviously had great relationships with elected officials. what changed is technology has created competition for the first time in new york city and our job as government officials is to bring everyone to the table and figure out how to expand our transportation network. we're a big vast city but there are definitely transportation deserts in many of our city -- >> like where? >> most are beyond -- >> give me an example. >> where i was growing up back in the day, we didn't know a yellow cab existed because we took liveries and had to go to the corner and that was the way we had to go when we took a for hire car. now we have a new -- we figured out how that industry benefits the world or benefits the city and we act accordingly. i think uber should be regulated. the real issue is not the cab but the rights of workers. many people who are drivers and people of different backgrounds and immigrants who come to the city this is their gateway to the middle class but they've been exploited. >> by whom? >> by the taxi industry low wages, no benefits. that's a conversation i want to have across the country. >> tomorrow i understand city council could vote on the capping issue. what's your position on that? >> my sense is we should have a study that has been proposed by the council, smart to do that but don't cap or take action before you have data. we're doing this all backwards. we don't want a political solution. we want a transportation solution -- >> that requires negotiation, discussion and data to figure out the best way to protect workers and make sure that all people of different backgrounds around the city have access to transportation alternatives. >> have you buying this is about congestion? what do they say? >> going into the verdict last week it was certainly clear that everyone wanted to see him convicted. they did not want him acquitted by way of insanity put in a mental institution where he had the possibility of eventually getting out. but when it comes to the death penalty, they are far from unanimous. >> he should get it yes. i'm for the death penalty for him. for him, yes. yes. my granddaughter is gone. he should be gone yes. that's how i feel. >> i'm terrified. if he gets the death penalty, i can't imagine any other response but me being devastated and crying and weeping for his family, but at the same time like, how do i honor john's memory, you know? i mean that's what he would have liked, so i'm really torn and it's been hard. >> jansen young only survived the shooting because her boyfriend jonathan blunt protected her. she is personally not so sure and that's what the survivors and family members are looking at a very difficult phase for them to go through, but they are pleased, at least, that jonathan holmes will remain behind bars for now. >> scott cohen, thank you very much. get out of the car now or i'm going to remove you. i'm going to yank you out of here. >> this is the latest dash cam video released from the department of transportation. it was the dash cam video that resulted in sandra bland's arrest. she was found hanged in her cell three days later. >> the department of public safety is looking at that video. clearly there are two parts in the video that either skips or repeets asats as the video continues. the video is 52 minutes long. he picks up a student at texas a&m, very cordial, lets them go. he then does a u-turn to pick up sandra bland. asks for her license. goes to her car and runs her license. goes back to her, asks her to put out her cigarette. she said why do i have to put out my cigarette? i'm in my own car. that's when he asked her to get out, uses his taser. he says in his affidavit that she kicked him and elbowed him several times, but it doesn't say in the report that he used his taser or asked her to put out her cigarette. he's now on desk duty for not following proper protocol in that arrest and not showing professional proper courtesy and professionalism. there was a meeting at texas a&m. her mother spoke. she wants some answers. >> stuff has to change in this county. there is something wrong. her death was untimed for what god needed her to do. but there is still something wrong in this case. i am not hiding it. there is not anywhere that i can see that my baby took her own life. [ applause ] >> the independent autopsy and the state autopsy, the family has returned to chicago and they will bury sandra bland on saturday. jose? >> by the way, the department of public safety insists that video was not edited, and there you see their statement. it's a technical issue during posting later in the video, and we are working to correct that. now to chattanooga, tennessee where we're about to get new details from authorities on last week's shooting massacre at two military facilities. in just the past hour new details from jordan about the uncle of gunman mohammad youssuf abdulazeez who has been detained in connection with the case. let's get vet latest from nbc's sarah daloff in chattanooga. sarah, welcome. lots of moving parts here. >> there really is jose. new details about the uncle detained in jordan. authorities are describing him as a radical. they want to know if he influenced the gunman during a 7-month trip there in 2014. his lawyer is now speaking out, the lawyer of the uncle jordan he disputes the situation as a radical. he also says during abdulazeez's trip there in 2014 he spent the majority of time with family and playing sports not as an extremist. authorities reveal the gunman downloaded videos of al araqi. he was killed in a drone strike in 2011 in yemen. we are expecting an update on the investigation at noon today. we're hoping to learn more about the timeline of the attack. this really is a community hungry for information, hungry for answers. in this growing memorial behind me, it has become a meeting place of sorts for the community. thousands have visited over the past days. you can see the ocean of american flags. in between them are more personal mementos for example, the mother of one of the fallen leaving his baseball mitt and ball behind playing tribute to a cross that was left there in his honor. jose, this really has become a physical example of the collective grief asknd shock here in chattanooga. >> the grief and shock the nation expresses as a whole. talk to me about the family of abdulazeez because we've been hearing about arrests and whether they are involved in some conversations with terrorist organizations. >> well the family so far has denied that he was an extremist or radicalized in any way. they do say, however, that he would express some extremist views when his depression was a bound. police also found some writings that they describe as pages of ramblings and they talk about martyr martyrdom and suicide as far back as 2013. we're hearing these elements to possible links to terrorism or possible links by terrorists but we're also hearing he struggled with mental illness as well as drug and alcohol abuse. so we're really waiting to hear how authorities tie these two narratives together and exactly what comes of this and what his motive in this attack was. >> sarah, thank you very much. happening now on capitol hill, the house committee and veterans affairs are holding a hearing in response to a major budget shortfall it says could lead to a closure of hospitals next month. they are asking the house to act quickly to address its $200 billion shortfall. in addition to hospital closures the va says it's also considering hiring freezes and furloughs. joining me is roman farrow. good morning. >> good morning, jose. >> what's with the massive budget shortfall? >> it's important for the audience to know that this is an organization that has suffered through a lot of accusations of mismanagement, long wait times, people dying waiting at certain hospitals like phoenix. additionally especially with the investigation, we at this network have done a great deal of coverage at individual hospitals rife with accusations. that includes where i did a news program where there was a series of deaths by overdose and questions how those came about, where there's been retaliation against whistle blowers. so a culture of what certain oversight individuals in this committee call a lack of transparency. now, as that has all happened we've seen this massive shortfall you're talking about due to really two main factors. one of those is the advent of several new hepatitis drugs which have hiked up the cost of hepatitis c treatment. also in the last year a spike in the survival of non-va care solutions for veterans. so veterans seeking help from private caregivers. they're not getting it from the system. >> you add the fact that the government says the va can't keep count of how many people have actually died waiting for medical assistance. does it just seem to you like it's overbloated and now they're with a budget deficit? >> there are several things. this is a complicated issue, but there are 3.5 million citizens on the island. >> 3.5 million? >> yes. in terms of reimbursement rates for the health care of medicare in puerto rico we as an island gets less than what a state gets in reimbursement. that's something that at the administrative level the president can kind of take care of. >> how could deehe do that? >> it is through administrative decisions, the department of health, and i know they've been discussing this. there is also a 1917 jones act which basically forces everything imported to the island to be used on u.s. maritime fleets which actually increases the cost of shipping and that's why you have the high cost of energy et cetera. and the third thing is the issue of being able to declare bankruptcy. we have a congress that unfortunately is not very willing and open to this conversation. >> why is puerto rico an extraordinary island with extraordinary people going through such tough times? and it's not a new thing. >> it's not new, it's structural. it's been over decades. the economy has been shrinking. there has to be a change on how economic business is done. >> unemployment is what? >> it's higher than other states. we have the private investment the hedge funds, that are acting as vultures actively lobbying congress to prevent declaring bankruptcy on the island. >> there is a problem that governor after governor and legislature after legislatures cannot deal with this issue. >> they have been ignored and those are challenges we need to deal with internally but we also need to be allowed some breathing space. so between the bankruptcy organization as a way of restructuring the debts, not walking away from your obligations, restructuring debt trying to get some breathing space with the ability to get medical reimbursement at the equal rate of states and the jones law being suspended, these are ways that can provide relief as a way of restructuring the economy on the island and making it productive. >> i want to talk to something that's also very close to your heart. you're working with unaccompanied immigrant children that are in the united states and a lot of them have not seen representation when they go and deal with this. >> no. we have about over a thousand cases. we have a private, public initiative we have done with the robin foundation in the new york city trust. we are making sure every child from ages 2 to 17 here in new york city trying to be reunited with their families have legal representation -- >> this is important. >> it is important. we have a thousand cases that were screened. about 600 of these children are being provided legal counsel. we would hope other municipalities look at this as a model. these children are seeking asylum. they're leaving very horrific situations. >> children as young as 2? >> yes. >> how do you present your case? if you're two, four six or 18 and aren't from here don't speak the language don't know the i haddiosyncratic way of it how do you present your case to a court? >> you know what is it doing right now? i'm just trying to look for the board. i think it's off its lows and the nasdaq is sitting down by only half a percent, so it's not exacting tankly here but nonetheless, compared to the s&p and the dow, in percentage terms, it's certainly the loser. >> mandy drury, always a pleasure. the city of ferguson missouri announced its second interim police chief will be andre anderson. the police commander from glen tail arizona, anderson a 24-year veteran on the force, is taking a 6-month leave from the department to work in ferguson. he begins tomorrow. senator, what a pleasure to see you. >> it's a pleasure to be here again, jose. >> thanks. i'd like your reaction to this. >> well i have to tell you, i looked up some statistics today, and of course glendale arizona is in maricopa county. we have to consider that and the history of performance when it comes to the treatment of immigrants and refugees there in arizona. but i'm glad to note that we do have some african-american representation. but at the same time, what we have to recognize is that today there will be a protest to recall mayor knowles. so i think this announcement today may be smoke and mirrors because they're only 27 signatures away the ground level support group, they're actively engaged in recalling the mayor, and it's very important to them to raise the consciousness of people in the area who want a change. this would be the first win for ferguson if they are able to recall the mayor. so i'm glad that we do have an interim police chief that's very good, but again, he comes from maricopa county and they only have 25% hispanics and less than 5% african-americans. >> also maricopa county in arizona is where sheriff joe opaio is and he's a strong force there, oughtsbut as you say, he's been very tough on the undocumented community, makes his prisoners aware of pink underwear and live in tents in the summer. but that's how he i guess, gets reelected there. talk to me about ferguson a year after. we always talk about issues when they're hot on the headlines. >> well i have to tell you, every single day we're still struggling. there are a lot of people who still have ptsd. there are a lot of people who are trying to brush the dust under the rug, as some say, so it's very important that we communicate with your audience and all those throughout america that we are struggling every single day. our education system is still in shambles, and we still have to address the second chancers. there are so many people out there who have been in jail for one reason or another a long time ago, and they still can't find jobs. so we're going to have to have a plan in place that recognizes there are valuable people ready to go into the work force. we don't want them to go back in jail, we don't want them to commit crime. we're going to have to embrace this community that has felt this renewal of respect. >> and, you know state senator, you know better than anybody else, there was just a report released yesterday at the level of poverty and how, among our communities, among the african-american community, the hispanic community, poverty is on the increase. young people cannot get a job. if you think the unemployment rate is tough in your neighborhood, look at the african-american community, look at the latino community and how difficult it is to get a job. >> yes, 36% of the people in my district live in povpoverty, and that's a sad state. >> it is indeed. always a pleasure to see you. turning back to iran one week after the historic nuclear deal congress has 59 days left to review the plan and it's stirring up a lot of descent on the hill. here's house speaker john boehner just moments ago. >> while the president's iran deal may have been applauded at the united nations, i think he faces serious skepticism here at home. let me just assure you that members of congress will ask much tougher questions this afternoon when we meet with the president's team. a bad deal threatens the security of the american people and we're going to do everything possible to stop it. >> nbc news chief correspondent richard engel joins me now. richard, how are you? >> good jose. >> the supreme leader lashed out at the united states said they're not going to change anything in the future relationships. there are reports that the foreign minister said that these inspections that the united states and other countries announced they'll be able to carry out really aren't true. what's going on? >> well i think just the way the obama administration is now trying to persuade the american people and trying to persuade congress, i think the iran i leadership is trying to do the same thing, to persuade their own people that this is a good deal and it won't actually change anything. because the hard-liners in iran are very worried that the president who just signed this deal could end up looking like gorbachev, the guy who opens up and brings down the entire soviet union. the iranian leadership is trying to say, that's not going to happen here. we signed a specific agreement on nuclear issues only that is going to create an economic windfall for the people but it is not going to bring down the islamic revolutionary system that has been in place since 1979. that's why you're seeing those statements. >> it's interesting to watch a authorize tear authorize tear authoritarian regimes say, yes, we have some money going to them but don't think this is going to make things change. let's talk about the middle east a little bit because iran plays a large role not only in iraq it plays a large role in syria, it plays a large role through its people in lebanon. how do you deal way country that's going to have $100 billion plus in the next couple years when they didn't have that money, have allthe intention to have their tentacles in the middle east and africa? >> i think there is likelihood there could be more violence in the middle east. iran has already been very supportive of its proxyiesproxies. it's supported shiite militias in iraq. it has supported hezbollah, it has supported yemen, and it will have much more money to do these things and feel emboldened to do them. that is an argument that israel is making that is an argument that gulf states are making and frankly it's not an unreasonable argument. what the u.s. is trying to argue, i think, and i need to talk to u.s. officials and analysts about this is that after 10 years in the middle east after a 10-year experience, it really locked in the quagmire in the middle east that the u.s. wants to rise above it. the u.s. wants to have a superpower status where we no longer are living the sunni-shia conflict that we can be friends with both sides and if the two want to fight each other, that's their problem. i think it's an idealistic approach to try to create a new dynamic in the middle east. i think this deal is more than nuclear weapons, but if the mideast has proven anything to us in the last 10 years or so that attempts to walk away from it or attempts to manage it from afar have so far been unsuccessful. >> 10 years and a thousand years as well. richard engel, it's a pleasure to see you. >> absolutely. up next the guilty verdict came in. now the penalty phase for shooter james holmes starts in just a couple minutes in a colorado courtroom. will it be life or death for holmes? >> this is a time when he should be speaking but you have a little bit of a different defendant here. this is a student who is going for their phd for neuro science. so if he comes off very intelligent, that could actually be a really bad factor for him. if you put him on the stand and he sounds intelligent and they go after him on the premeditation, that could be a lot substantially worse for him than getting up there and pleading for his life. >> i'm thinking of the dzhokhar case where you really go for the script. >> right. but when you have people who are super intelligent, i think people are kind of downplaying the fact that he was a phd student and really had made it pretty far, which is extraordinary. and especially extraordinary when you have someone of that caliber and intelligence now killing 12 people and going insane. >> thank you, karen. >> thank you, jose. over in washington on capitol hill right now, planned parenthood is once again under fire for the second time in as many weeks. the center for mental progress has released a video showing what they say is a planned parenthood discussing providing fetal parts to two people proposing as buyers from a medical research firm. planned parenthood said the edited video deceptively characterizes what was said. that includes a discussion of the fees they charge for expenses. but they have stripped the organization of federal funds by the time next fiscal year rolls around in october. nbc's luke russert is on capitol hill. luke, what do we know? >> good morning, jose. i think we're seeing the beginning of this issue playing a significant role in the overall appropriations process. what do i mean by that? i think what you're going to see here over the next few months as we head into the summer recess as well as when congress comes back into the fall a real concerted effort by republicans to try and put amendments in budget bills that would essentially strip planned parenthood of any federal funding. now, the federal funding they get as of right now is supposed to go directly to women's health initiatives, sort of breast cancer screenings things of that nature. most people are confident that is, in fact, where the money goes. but there's always been a sort of, shall we say, republican hesitancy, a support budget for these funds, because they're always worried that money will go possibly to abortion practices. this is a situation that's reared on capitol hill for some time. what's really going to be interesting to see moving forward, jose is this is the second video of there's more to come. you hear democrats saying they're edited we have to know more about it. but harry reid was very cautious in the press conference yesterday when he was talking about this and this has democrats on their heels because of the gruesome nature of these edited videos. this is also a really easy way for them to toss them some read meat at a time they need it on their budget bill, but they will say it funds too many of obama's priorities. it's almost a perfect storm. remember back in 2011 i was covering this. there was almost a government shutdown over funds for planned parenthood that had to be worked out in the 11th hour. this is something thatie elicits a lot of passions for the democrats and republicans. >> a video changes the conversation on something, in this case two videos. the second one was heavily edited, the first one was released in its entirety. >> correct, and that's sort of why you have democrats treading lightly on this is because they don't know how many more videos there are, and they don't know exactly how they were edited. planned parenthood is saying one thing, the filmmakers are saying another, but on its face and in the 30-second sound bite world in which we live in in the social media sphere we live in it's very hard to sort of push back and put that in context in a political argument. so this is something where democrats in the past are starting to see an opening -- we all remember the famous war on women analogy that the republicans were guilty of in 2012. they don't have that high ground as much in this capacity because they just don't know what's out there and what's to come. >> nbc's luke russert on capitol hill for us. great seeing you. next using comedy to fight hate. that's the goal of the first ever american muslim comedy fest happening now in new york city. we'll tell you about that. but first, check out this "sharknado 3" comedy. that's my friend coming up. where is he?
