had no intention of killing him. in the meantime now questions surround bates' training and reporting from the tul "tulsa world" that alleges those papers were falsified. first, here's robert bates with family and attorney earlier this morning on "today." >> mr. bates, i want to talk about your training about your training records in a second but i want you to take me back to april 2, the day this happened. you were not supposed to be actively involved in the arrest of mr. harris you were supposed to provide support from several blocks away but you did get involved in the struggle. you write in your written statement that you were not sure whether he was armed and you say you saw "a brief opening to use your taser to subdue him." take me back to that moment. >> matt, i was parked down the street at a station several blocks away from where the activity took place. in other words, the drug buy of dope and the gun purchase. he decided to bolt from the undercover's truck and run and he came to me. and two other cars that were in front. i was the last car as i always am. i carry the equipment that the deputies use to clear a scene, whatever. i've been involved in several hundred of these. i do cleanup when they're done. i take notes, i take photographs and that's my job, it's called containment. >> when you get involved in this struggle. many bates, did any of the other deputies or officers say "help us, tase him, use your taser"? >> no, matt. i yelled "taser taser," as required in training. the deputy below me ducked he pulled away from it so that i could. now, i've never, you know -- first and foremost let me apologize to the family of eric harris. this is the second-worst thing that's ever happened to me in my life. first. i've had cancer a number of years ago, i didn't think i was going to get there. luckily i was able to go to a hospital where i had hours of surgery. i rate this as number one on my list of things in my life that i regret. >> mr. bates, let me ask you do this. would you stand up for me for one second and show me where on your body when you are in your uniform you keep your taser and where you keep your weapon your revolver. can you stand up and show me? >> sure you bet. my taser is right here on the front tucked in a protective vest. my gun itself is on my side normally to the rear. >> people are going to look at that mr. bates and say how could you make this mistake? how could you think you were going for your taser on your chest tucked into that vest and accidentally pull your weapon? >> well let me say this has happened a number of times around the country. i have read about it in the past. i thought to myself after reading several cases i don't understand how this can happen you must believe me it can happen to anyone. >> you yelled "taser taser." you mentioned the other deputy ducked and cleared so you could use your taser and then you heard that gunshot. what were you thinking when you heard the shot? >> oh, my god, what has happened? the laser light is the same on each weapon. i saw the light and i squeezed the trigger and then realized i'd dropped the gun. this was not an intentional thing. i have no desire to ever take anyone's life. >> you can be heard on that tape "i shot him, i'm sorry" and there's a lot of emotion in your voice. what was the emotion? was it sorrow? was it shock? was it fear for the repercussions of what you had just done? >> matt i never considered the repercussions of what i had just done. it was shock. i can tell you it stayed with me for a number of days i'm not at all sure it's not still with me today. lack of sleep, inability to concentrate all of those plus more. i still can't believe it happened. >> mr. bates, in the wake of this incident you have been portrayed as a wealthy and generous supporter of the sheriff's department and a close friend of the sheriff who has been rewarded for your financial support with the student -- and this is what's throughout -- to play cop and carry a gun. the is that a fair characterization? >> that is unbelievably unfair. i have donated equipment as i saw fit when the need happened to arise to allow the task force and other areas of the sheriff's office to better do their jobs on the street of tulsa. tulsa has a drug problem, there is no question. nobody argues that i am willing to put up equipment to assist them, to better educate the public. i'll do with young people all the time matt 13 and 14-year-old kids using heroin. i talk to them once we're done and try to gain an understanding of why? why has this happened. when i was a policeman here in tulsa, there wasn't heroin that was a new york city chicago problem, not here. >> let me get back to this story now that's been reported by the "tulsa world" based on anonymous sources, unconfirmed by nbc news, that supervisors in the sheriff's department were ordered to falsify your training records and give you credit for field training and firearms certification that you did not deserve. how do you respond to those allegations? >> it is not correct. i have a written piece of paper that a mr. warren crittendon now in jail for first degree murder 40 miles east of here in mays county signed off to say i had done a good job. and ismthe smollen law firm is very interesting. they seem to represent all of the people that have been terminated by the sheriff's office. >> but without getting off on a tangent, you did the training and you can prove that you are certified? >> that is absolutely the truth i have in the writing. >> matt if i may just briefly, the so-called evidence of falsified training records comes from a person terminated by the sheriff's office seven years ago. he signed an affidavit. mr. bates would have been with the department as a reserve just about a half year or a year at that time so seven years ago, that's their evidence. he is a person represented by the firm that's representing the family and he has a year ago been charged with first degree murder. so the credibility of the witnesses should have been -- that particular witness should have been weighed carefully by press outlets before running that story. >> mr. bates, let me end on this. you've been charged with second degree manslaughter. you face up to four years in prison. have you allowed yourself to think about that possibility? >> certainly, how could i snot. >> that was matt lauer's exclusive interview with robert bates. a lot of news in it to get to. nbc's gabe gutierrez has been following this from tulsa. gabe, good morning. what did you see the key pieces of what bates had to say this morning? >> reporter: well he said several things. he flatly denied any of these records had been falsified and as you may have referenced earlier, the tulsa "world" citing anonymous sources said bates's supervisors had had ordered to falsify some of his training and some may have been transferred to other positions when they refused to do so. the sheriff's office is calling that rumor and bates's lawyer as you have said, is flatly denying it. bates did as much in his interview he also wanted to apologize to eric harris's family. but i think one of the key parts of the interview is when matt asked him to stand up to describe the relationship between his taser and his gun. he and his attorney is arguing this is something "that can happen to anyone." he says this has happened in other parts of the country, a phenomenon known as slip and capture they're making the argument this was a horrible horrible mistake. >> we're going to speak to the reporter who broke the story but is there any comment from the tulsa world as to these allegations they've brought forth about this fake or the training or the inadequate training? the tulsa world has been standing by its story. they say in the sheriff's office that there were -- there was pressure in order to falsify some of his training. now, again, the attorney -- his attorney and bates himself said he had all the proper training. he had almost 300 hours since 2008 they are arguing, look we have the documentation. what the critics of the documentation said and what has been released so far is just a summary of his training and they're still pressing on more details. we should mention that earlier in the week the sheriff himself gave a radio interview where he acknowledged some of his gun certification records, they couldn't find it and that the gun instructor had since left the department and they were trying to talk to her to figure without that record keeping is going, the tulsa world is also reporting there may be issues with recordkeeping and perhaps the sheriff may have been able to grant exemptions so there are a lot of questions about how much training he really had. documentation for it. but, again, bob bates is flatly denying any of his records were falsified, jose. >> gabe gutierrez, thanks for being with me. i want to bring in former u.s. attorney kendall coffey in our studios. tell me about robert bates' decision to take his story public. he did so the today show everybody sees that. will this hurt him or help him? >> i think it's an incredibly risky thing to do. normally somebody charged with a crime stays the heck away from the press. we all know that portions of that interview could be used as evidence against him in the second degree manslaughter trial. as a former prosecutor watching it i thought matt lauer made an important part of the prosecution's case when he got him to stand up and show that the taser and lethal firearm were located in fundamentally different places. it will make it just that much harder to defend at least from a charge of recklessness. how could he get them mixed up when as that very interview demonstrated, they're very different locations on his body. >> and gabe was talking about this slip and capture, that you get confused in the heat of it all and you confuse where things were and it was the same laser siting on both of them. is that common? >> well, that will be the defense and certain lyly trained police officers have to make split-second decisions. but it doesn't mean it's without consequences. no one is charging him with an intentional homicide. the question is, when he takes it on himself to use some kind of weapon against basically an immobilized suspect and he gets it fayly wrong, will there be consequences? that's for a jury decide. >> let's talk about the falsified records that the tulsa world has been talking about. will that be a part of his defense or the prosecution? >> well it may not be part of the manslaughter case. it will certainly be something that gets a lot of attention and i can imagine the newspaper demanding an independent investigation rather than having the same sheriff's office look at it. but it cuts both ways i think, for bates to say he was properly trained because it's one thing to be a bumbling amateur and say you innocently inadvertently made a mistake. be if you're saying i had all the training to know what i was doing with these weapons and i still killed somebody because i used a pistol that's a harder sell. >> kendall coffey good to see you. we'll have much more of this throughout this edition of "the rundown." a huge day in new hampshire as the 2016 white house hopefuls converge on the granite state. we have two live events going on right now. on your left jeb bush speaking at the politics and eggs breakfast in manchester and on your right is the republican leadership conference. here's a former florida governor just a few minutes ago. >> i'm excited about this part of my life where i'm sounding out the views of people around the country. i've been traveling around. i'm seriously considering the possibility of running and over the next few months i'll make a decision about that. >> jeb bush is just one of more than a dozen high-profile republicans attending this weekend's summit. the first gathering of its kind in the first of the nation primary state. hillary clinton is due in new hampshire next monday and tuesday for round tables with students educators, and small business leaders. let's go to nashua where the gop summit is getting under way. msnbc political reporter benjy starlin joins us. benjy, what can we expect at the leadership summit? >> it's an unofficial kickoff to the primaries today. you'll have almost every single major presidential hopeful declared or undeclared here. today includes chris christie jeb bush marco rubio, tomorrow we have scott walker rand paul everyone gets a chance to make their case before an influential group of new hampshire republican operatives strategists, elected officials and at the same time many are doing their own events outside. jeb bush has one this morning, chris christie has a host of them. so does ted cruz rick perry. so this is really 2016 descending on new hampshire. >> james, the new hampshire primary is about 300 days away. how do granite staters view their role as the first in the nation primary state? >> very seriously. certainly there will be the people who pay to attend this event in nashua but all around the state where there will be dozens and dozens of event there is will be people particularly early activists who will come out and ask very smart substantive questions. though i must say the polling tells us two things. one, this is anyone's game very wide open on the republican side probably more than we have seen in the history of the new hampshire primary. second, you know the large vast majority of voters aren't paying attention right now. this is really about the early activists as these campaigns try to get a foothold in the granite state. >> we're seeing live immamgs of jeb bush taking all kinds of questions. he also spoke to a small gathering last night and fielded tough questions including his stance on immigration reform. let's look at what he said. >> we have to deal with the 11 million people that are here. you can't self-deport, that's not an american value. you can't round up everybody. the dislocation and cost of that i have not seen someone with a serious plan to deal with that. it's not practical. >> how did that go over? >> well he was pretty blunt about what he believes even though there's some opposition to it. sure enough right after he gave that answer a man named charles pewitt of concord, numew hampshire about what he called the illegal alien bill. jeb listened respectfully and said "i respect your views but don't agree with them. >> good morning, jose. today is a very critical point in the lawsuit against president obama's executive actions. for those who are directly impacted, this will mean whether they have to wait a matter of weeks before they can begin enrollment or whether they have to wait a matter of months before the situation is tangled through the courts. today's hearing is largely unprecedented. each side gets one hour of oral argument which is many legal experts say is unheard of for such a motion like this. this fifth circuit will decide whether or not they will issue an emergency stay and lift the temporary freeze that has been placed on the executive actions enrollments. we know many families plan to come here and rally outside the courthouse today to show the human side of the story and how many families are impacted by this lawsuit. now, it's a bit of an uphill chime for the obama administration. this is a notoriously conservative court here in new orleans and the three-judge panel, two of those judges are known for having very conservative views. so what they will have to overcome those obstacles but it's likely this issue will be kicked up to the supreme court. back to you, jose. >> msnbc's amanda sakuma in new orleans. now to another courtroom in ohio where a somali-born american citizen picked up after coming back from syria is set for an arraignment later this morning. authorities say the suspect who appeared in court on state charges back in february trained with a terror group overseas and had a plan to attack here. pete williams is nbc's justice correspondent. pete good morning. tell us about this case. >> jose, his name is abdel mohammed, he's 23 from columbus. authorities say he left a year ago, april 2014 to fight with syria. they say he got a passport then bought a one-way ticket to greece but didn't take the connecting night from istanbul to athens and instead completed pre-arranged plans to go to syria. once there he got training in firing weapons, breaking into houses explosives and hand-to-hand combat. but then they say after coming back to the u.s. in june after just a couple of month there is he told people here that he was instructed by a cleric in the organization to commit an act of terror and that he wanted to target armed forces police officers, or uniformed individuals and go to a military base in texas and kill thee or four americans execution style. he'll be in court in just a couple of hours and his lawyer says he will plead not guilty. >> these are the kind of people officials are worried about. are they surprised we haven't seen more of them? >> that's fine. i'll play your video, so careful. >> reporter: that's britt mchenry, a washington, d.c. based reporter for espn who acknowledged the cameras present while picking up her car after it was reportedly towed from this spot where mchenry pocked. >> after the video's release on thursday, mchenry apologized on twitter saying "in an intense and stressful moment i allowed my emotions to get the best of me and said some insulting and regrettable things. as frustrated as i was, i should always choose to be respectful and take the high road. i am so sorry for my actions and will learn from this mistake." espn announced they had suspended mchenry for one week effective immediately. overnight, nbc news spoke with someone in mchenry's camp who contends the tape has been edited and doesn't show the complete version of events but also admitted either way it does not justify her actions. social media exploded in response to the tape. wow everyone has intense moments, difference is most adults know not to berate someone for doing their job. and "a whole week? >> i'm inside the plane. i feel like it's moving in the air. flight 448. can you please tell somebody stop it? >> reporter: the man pleading for help is a baggage handler, who told authorities he took a nap in the plane's belly. the dispatcher is confused. >> where are you in the plane at? >> i'm inside the plane, alaska airlines flight 448. >> are you at the airport? >> i'm at -- not in the airport, i feel like it's moved. because i feel like my -- >> reporter: with the flight bound for los angeles, the call abruptly comes to an end. >> are you by yourself or are you with somebody? >> please! >> reporter: as the jet climbed, now at 5,000 feet passengers hear a call for help and pounding from just below their seats. the baggage handler was lucky, say experts, trapped near the nose of the plane where the cargo hold is pressurized and the temperature controlled. >> cargo holds are not designed from people to ride from a to b so it could have had consequences. >> alaska airlines says the baggage handler is now banned from working for them. reached by known, he told us he's in good spirits but still feeling a bit tired. miguel almaguer nbc news los angeles. >> that's one lucky guy. now to another aviation hot topic trending right now. just when you thought airline seats couldn't get any smaller, passengers on some airbus planes may feel a bit more of a squeeze. manufacturers preparing to add an extra chair to each row. in economy class, 11 seats across and not ten. joining me now is managing partner with "airline weekly," seth caplan. tell us about this seats aren't small enough let's add another one. >> this is the most visible example yet, but not the only one of a trend a lot of people don't realize. almost everybody by now realizes some airlines have been taking away leg room but more quietly, yeah, they've been taking away a little elbow room too. american airlines here in the u.s. was the first a couple years ago on its boeing 777s, almost all of us have flown on if we'd gone abroad. instead of nine seats across, let's go to ten. because that plane is more narrow, that's even less elbow room than the 8380 are going to have. >> is this the largest plane, period, among the largest planes? >> it is jose. if you've been to some of the largest airports in america, you might have seen this plane. it has two decks all the way across, not just like on the older 747s where you see a little bit of a second deck. it can hold in some cases in excess of 600 passengers. and now, yeah packing 11 across instead of ten in economy. >> seth also this week the department of transportation is looking into a safety issue. what can we expect changes or recommendations from the d.o.t.? >> it's a good question jose and we'll see. what hasn't changed is that they always evaluate to evacuate an aircraft, so there are limits that have always been there. that hasn't changed. you cannot put more seats than those limits which were established years ago. the difference is some airlines are pushing closer up against the limits but the faa until now has considered safe. >> i want to talk about two former tsa officers in denver a man and a woman, who could be facing criminal charges after allegations of manipulating screening systems so one could grope male passengers. the tsa just issued this new statement, the vast majority of our employees act with integrity and professionalism every day, but unfortunately the conduct of a few can do significant damage to the entire workforce and this damage is very difficult to overcome. >> every workplace everywhere that many thousands of people you're going to have a few bad apples. unfortunately, talking about aviation security, it matters in a way it might not matter in other walks of life. you can bet, yeah, extra steps to make sure that sort of thing can't happen again. >> tsa folks i deal with all the time are topnotch. seth, before i let you go are you a big "star wars" fan? (announcer) the subaru xv crosstrek. symmetrical all-wheel drive plus 34 mpg. love. it's what makes a subaru a subaru. welcome back to the "the rundown." at the top of this hour we're digging deeper into the shooting death of eric harris and the complicated story surrounding robert bates, who said he mistook his handgun for his taser on the day harris was killed. we heard from bates himself. here's part of what he said today on "today." >> first and foremost let me apologize to the family of eric harris. this is the second worst thing that's ever happened to me or first, ever happened to me in my life. i've had cancer a number of years ago, i didn't think i was going to get there, luckily i was able to go to a hospital where i had hours of surgery. i rate this as number one on my list of things in my life. that i regret. >> mr. bates, in the wake of this incident you have been portrayed as a wealthy and generous supporter of the sheriff's department and a close friend of the sheriff, who has been rewarded for your financial support with the opportunity and this is what's out there, to play cop and carry a gun. is that a fair characterization? >> that is unbelievably unfair. i have donated equipment as i saw fit. when the need happened to arise to allow the task force and other areas of the sheriff's office to better do their jobs on the street of tulsa. >> bates and his attorney are also pushing back against the tulsa world's report on thursday that said some of bates' training records were falsified. nbc has not confirmed that report, but today the tulsa county sheriff's department some of the requirements can be waived by the sheriff, although it's not clear that happened in bates' case. tulsa world enterprise editor joins me now. good to see you. >> thank you for having me. >> what do we know about bates' records and what still remains unclear? >> well a lot remains unclear. the sheriff's department handed out a thick list of courses that bates had allegedly taken and passed, 400 hours to become an advanced deputy. this is about a week ago, and now after we published the story in which sources, five sources, said that that training was largely falsified, that supervisors were pressured to sign off on it and were transferred. now the sheriff's department is saying that they can't find the training records, they are not sure they have to have more information, their old paper records, so i think the question of whether they even have the records is very unclear and there's a lot of other related questions. >> really right now you don't know if those records exist or don't. >> i don't know. i just heard robert bates tell you know, say that he had a piece of paper that could prove he's certified and qualified, so i think he should just give that to the sheriff's department and we would all know. >> i want to play by the way, what bates and his attorney said on "today" about the questions raised by your story. listen to this. >> you did the training and you can prove that you were certified? >> that is absolutely the truth. i have it in writing. >> matt if i might address this just briefly, that point, the so-called evidence of falsified training records comes from a person that was terminated by the sheriff's office seven years ago. he signed an affidavit. mr. bates would have been with the department as a reserve just about a half a year or a year at that time so seven years ago, that's their evidence. and he is a person represented by the firm that's representing the family and he has a year ago been charged with first-degree murder so the credibility of the witnesses should have been -- or that particular witness, should have been waved carefully by press outlets before running that story. >> let's talk about your reaction in response to this. >> well they are absolutely wrong. the deputy they are talking about is not one of our sources. the documents that -- >> who got fired seven years ago? >> correct. we have heard and we'd still like to know did he sign off on department bates' handgun qualifications, any of the training before he was fired by the sheriff's office that would be, to me indicate they are the ones who had him sign off on the training. i don't know that because they haven't given us the records, you know so there's more questions, again, they could answer. the things that do corroborate our sources include department bates' own statement to investigators after the shooting in which he said he took active shooter training at the maricopa county sheriff's office. they say that's not true he wouldn't even have been able to do that as someone from out of state and not a real deputy. the sheriff's admission that some of the handgun records have been lost. so those are the issues that are sort of corroborating our sources. >> one of the sources that i just want to make clear is not this guy who was fired seven years ago who may have a beef. >> absolutely not. i did contact his attorney. i thought it would be interesting to talk to him and hasn't been granted. i've never talked to the man, he's not one of our sources, period. >> on the other hand, if he says he has the paperwork, it would be interesting to see that paperwork. >> we'd all be interested in seeing it. i'm sure it's more than this affidavit, more than one page of paper, these hundreds of hours of training he supposedly took. >> you're still confident you have your story right? >> we firmly stand behind our story and heard from more people inside and outside the department who say the story is absolutely on target. >> thanks for being with me. appreciate your time. >> thanks. >> i want to bring back kendall kovcoffey coffey, what's your reaction to what you heard? >> she's very credible, very impress impressive and it's enough to carry out an investigation. >> who should carry that out? >> not the sheriff's department. falsifying records by a police agency is a serious matter. it could be done by an independent source within the state government and i think it's something even federal authorities should consider. a lot of important investigations begin based on well documented media coverage and media articles. this strikes me as something that should also be pursued. >> what's the logic and take me through the logic of having someone who was involved in this go on national tv and by his lawyer's side and talk about this. what are they trying to achieve? >> 99.9% of criminal defense lawyers would say, don't go on the air and subject yourself -- >> he was probably told the same thing. >> very likely so but individuals have an incredible desire to protect their reputation. they think they are going to say to their lawyer their family i've done nothing wrong, i want to go on national television and clear the air. lawyer is going to say, i'm more concerned about protecting your liberty and the risk of a criminal prosecution but many many times people care more about getting out their side of the story, care more about the court of public opinion than the court of law. >> he was there with his family you could see he was clearly moved and touched by what he was talking about. he firmly believes what he did was a mistake, but legally, this interview is going to play a part. >> this interview is going to be used at least in some parts, by the prosecution. he came off pretty well overall, but there were at least a couple things i think are going to come back to haunt him. first of all, matt lauer had him stand up and show where the different weapons were located. that's not going to help at all in the trial because they are in very, very different locations. secondly, he acknowledged the police did not tell him to engage using a taser or anything else and the third thing, if he's willing to talk to national television, he better be prepared to get on the stand in front of a jury. jury's not going to like it if he doesn't testify. >> thank you, good to see you. i want to turn now to iraq where fierce battles are under way for the largest oil refinery in the country and on the threat of being overrun by terrorists. heavy clashes are being reported after militants broke through the iraqis' defensive lines in ramadi. troops are gathering in the center of the city in anticipation of an attack but martin dempsey made it clear ramadi is not a priority for the united states. >> the city itself is not symbolic in any way, not been declared part of the calafit or central to the future of iraq but we want to get it back. part of the oil infrastructure, once the iraqis have full control of beiji, they'll control all of their oil infrastructure, both north and south, so beiji is a more strategic target. >> richard engel joins me this morning from istanbul. always a pleasure to see you. interesting to hear the united states is concerned about the north and the south. pretty much the west is up for grabs? >> reporter: no i don't think so. i think there's a major campaign under way by the iraqi army by the tribes by shiite militias by iran by the u.s. by all of these different forces to try and attack isis but it is not very well coordinated and i think that's one of the biggest problems, because each one of those different groups has something of a different agenda for iraq. and each battleground has become fraught with local politics. let's take beiji for example, the oil refinery has become a symbol for the iraqi government. i can't count the number of times the iraqi government claimed beiji has been secure liberated, and it became a propaganda victory or tool for isis which put out numerous videos showing its militants setting fire to some oil containment facilities fighting heavily in beiji, and that's just the battle there. in ramadi you have i think, a serious humanitarian situation. you've had for about a year year and a half, the parts of ramadi occupied by isis and government forces and tribes really just sort of hold out, surrounded by three sides by isis and you have this hold out part of ramadi. and earlier this week it looked like they might lose that part until iraqi army and coalition air strikes came in to save that pocket of ramadi that is still being held by friendly forces if you will. >> so ramadi there's a standoff, and the people suffering are the people who live there? >> absolutely. there have been according to one official we spoke to at least 2,000 families that have fled ramadi in the last several days. other estimates put that number much, much higher in the tens of thousands. they've been leaving ramadi heading towards baghdad, but again this sunni/shia conflict iran agenda and u.s. agenda the iraqi army agenda are continually in opposition. a lot of the people leaving ramadi are sunnis and they are not getting a great reception when they arrive in shiite parts of baghdad. so that's just one of the problems. another reason that it has been so difficult to defend ramadi if you remember a few days ago, also a few weeks ago, there was the battle to retake the city of tikrit, and a lot of that battle was led by shiite-iranian backed militias. the people of ramadi don't want to see those shia militias come in and aid in their defense. it is so immensely complicated, and the u.s. is trying to help out and guide this mission with a few advisers on the ground and from the air. >> richard, i want to quickly -- sorry, quickly ask about developing news reporting iraqi forces killed saddam hussein's former deputy? >> this is the claim that emerged a short while ago from an iraqi governor. they are claiming that the former top lieutenant of saddam hussein has been killed. they just broadcast a picture of -- i saw the picture. i don't know frankly, if it was him, al-douri was characteristic, had bright red hair, this iraqi official is insisting this very graphic image put on tv is in fact al douri, but the iraqi government also claimed in the past to have killed izzat al douri several times, but the interesting part is they are claiming this saddam fugitive, perhaps late saddam fugitive, had lined up with isis and that is a similar kind of claim that we heard when the u.s. had a presence in iraq that some of these saddam era fugitives were then lining up with what the u.s. military at the time called insurgent groups. >> richard engel in istanbul thank you much. ambassador power will be on andrea mitchell reports today. after a quick break here on "the rundown," granite state of mind. we take you back to new hampshire, where there's a grand old party going on for republicans, two events featuring almost all the 2016 hopefuls. jeb bush just wrapped up his event after last night holding a politics and pie event. >> hell with the diet. >> much more from new hampshire ahead. no promises on more snacks though. plus a major spring snow storm is hitting the rockies today. details on this latest round of wicked weather next. ugh... ...heartburn. did someone say burn? >> good morning, it seems this we're seeing here in the u.s. was triggered by some actions overseas starting in china, where some new rules were introduced to allow short selling in the chinese markets. the chinese market has been trading recently at a seven-year high so that raised worry. you can see short selling undercut that rally and the markets pulled back. so that triggered some sellouts in china. it's spread to the european markets, as well and, of course there there are concerns over whether or not greece will default on its debt so that's putting pressure on the european markets and leading to u.s. trading, as you can see right now, the dow is off 252 points. here in the u.s. we had some mixed earnings news. we did get decent numbers out of ge and it is bucking the downward trend fractionally higher, but overall, a down session on wall street today. back to you. >> mary thompson thank you so much. developing now, the kickoff to the 2016 season under way in new hampshire. right now they are gathering for the republican leadership summit in nashville. take a look at these speakers today, more than a dozen republican candidates and potential candidates will test campaign themes with voters. rick perry, chris christie marco rubio, jeb bush all speak today. last hour we heard from the governor in another local event. >> in a six-year recovery it is shameful median income is lower than it was at the start of the recovery, but that's the fact. in a sixth year of a so-called recovery, it's shameful there are more businesses failing than starting in this country. in the sixth year of a so-called recovery, it troubles me and it should trouble you, that business formation rates are lower than they were in the 1980s. >> msnbc political correspondent kasie hunt joins us from manchester and joining us from nashville, where the leadership summit takes off a short time ago. kasie, let's start with you, talk about the politics and eggs breakfast that just wrapped up. >> reporter: good morning, jose. well, politics and eggs here is a hallowed tradition here in the new hampshire primary. the room inside is decorated with old photos of lyndon johnson campaigning, hillary clinton campaigning, barack obama campaigning, and, obviously, george w. bush and his father so you heard from jeb bush today. he talked a little bit about that family relationship. he said you know what i'm not my brother, i'm not my father anyone who has a sibling would know that. it's been a subject of some interest here from the voters who bush has encountered so far on this trip. bush has also been asked at an event last night and today about immigration. it's a subject that's clearly on the mind of the voters here. take a listen how jeb bush has been handling the question in new hampshire. >> what makes us different is that our national identity is based on a set of shared values. it's not some exclusionary racial deal or ethnicity. we define ourselves by our aspirations, by our tolerance, by our courage, by the things that the founders started that we've embraced, and we need to embrace it again. >> reporter: that's a tone that's a little bit different from some of the other republican candidates and that's how bush described himself more broadly just now, one of the new hampshire reporters up here asked him if he was more moderate than others in the field and he said you know, my policies aren't necessarily more moderate than they are, but possibly my tone is, and that gets mistaken for being moderate overall. jose? >> and benjie, you're at the other event happening right now, how important is this leadership summit when it comes to the 2016 field? >> reporter: well it's a big opportunity to start off right in new hampshire. the day is going to be absolutely critical to jeb bush in particular but every candidate's 2016 hopes. this is a really elite gathering here of many top republicans, there's a lot of people you want to impress, people that are going to end up being endorsed and staffers so this is definitely a good chance to really show off that method strong out of the gate. >> who's expected today? >> reporter: let's see, we have jeb bush coming here really making a round today after the politics and eggs we have chris christie, who's really staking his 2016 hopes almost entirely on new hampshire. we have marco rubio coming in addition there's rick perry and some of the lesser known potential candidates like george pa tack key are around and rand paul and scott walker so it really is pretty much everybody coming here. >> kasie, just real quickly, the people the folks like bush have been talking to they are not prescreened. they are just people that go into these events? >> he followed essentially, in the footsteps of his brother, who had traveled before him to syria and joined al qaeda's franchise there. he appeared to be or likely that he was influenced by his brother, but he made you know clear steps to book a ticket travel overseas, and cross the border into syria. it's not clear which group he joined but we know both al qaeda's franchise there, as well as the islamic state known as isis have attracted foreign fighters from all around the world, and some of those fighters including americans, have indeed carried out operations there. >> how were they tipped off this was happening, authorities? >> i believe there's a lot of intelligence sharing, but we know the united states security forces are very vigilant when it comes to tracking down americans who don't just return to the united states from overseas but those who actually do travel from the united states overseas you know likely there has been a number of red flags, including what he wrote online but also booking tickets that show travel routes, the likelihood that that travel route would have led him to end up in syria. it's likely tipped off the authorities. >> what concerns you most about these home grown terrorists? >> look the number one concern is a number of them are self radicalized, they go there, get even further radicalized on the ground they receive militant training including training on rifles and automatic rifles as well as explosives and even armed combat. and they return here with the same ideology and there is no battlefield here they will try to put their training and radical ideology into action. the united states is on top of that list as enemy target. >> pleasure to see you, thank you. >> thank you jose. more now on the race for the white house heating up this morning with a first of its kind republican leadership summit kicking off in new hampshire. nearly 20 presidential hopefuls are attending the two-day event. at the same time, hillary clinton is preparing to tour the granite state on monday similar to her swing through iowa earlier this week. while republicans are sure to criticize clinton in new hampshire, she's also taking hits from members of her own party. martin o'malley criticized the evolution of clinton's position on same-sex marriage and lincoln chafee hit her on her foreign policy credentials. joining me now, "the washington post," thank you both for being with me. what's your reaction from the clinton camp with criticism from fellow democrats? >> certainly we know martin o'malley is a likely challenger in iowa new hampshire, at least some of the early states. he's not considered a real threat in the long term largely because he has much much much lower name i.d. and nowhere near the ability to raise money that she does but they were certainly expecting some criticism from him. the marriage equality issue is one the campaign frankly, i think, is struggling with. hillary's position clearly evolved, to use a common phrase on that issue, but they don't want to say that she has shifted. clearly, she is taking a different position on how to get to the outcome of universal marriage equality across the country, that she now supports a constitutional ruling by the supreme court on that issue as opposed to a state by state approach, but the campaign really just doesn't want to say, for whatever reason that's different than the position she took even six, eight months ago, when she appeared to back the state by state issue. lincoln chafee i don't know that kind of came out of nowhere. >> another issue clinton has been criticized on is foreign donations to the clinton foundation. just last week rand paul accused the foundation of taking money from countries that have abused the rights of women. limit but not eliminate these donations. could this be an issue of a stumbling block for mrs. clinton? >> i think so. of all the criticism in terms of her candidacy, this one, i think, will have the legs first of all, because the clinton foundation is still running and operating, it's not something that's been passed it's something ongoing. presidential candidates have used it against her, rand paul has talked about it at length other presidential candidates on the gop side talk about it this week as well in nashua. this is a real line of attack. it also hits in what she considers her expertise now, foreign policy dealing with other countries. this could be one of the first elections in a long time that centers on foreign policy. so a real weak point for her. >> i want to ask you about something that happened yesterday involving carly fiorina before asking a question, a male reporter made a comment, "well, ma'am, i've never met a presidential candidate with pink finger nail polish on." later telling "the washington post" people focus on her appearance as much as her policies. regardless of political affiliation, is this a type of comment anybody should be getting? >> you wouldn't think in 2015 heading into the 2016 presidential campaign that it would, but i think, unfortunately, that is still something that all women in positions of power and influence or who aspire to those positions do find themselves in. one thing interesting about carly fiorina is that she says just straight up look i can criticize hillary clinton on every single issue, and i can do it from exactly the same position as a woman candidate. and that i mean she's not anywhere near the top of the republican hopefuls right now in polling, but it different gives her a completely different perch, and, frankly, it shakes up the republican field. of the 20 you mentioned, she is the only woman. >> if she says she can touch on any single issue, kind of implies maybe guys can't. >> right. it gives her a different platform, sort of erases the issue of a woman candidate running from one party and a man running from the other. it to the extent that hillary's gender is a plus for her attracts more people to the polls. certainly, definitely gives her a huge leg up with a large activist portion of the party, democratic party that wants to see a woman run and win. carly fiorina candidacy does neutralize at least some of that. >> again what a dorky question you know? i just never talked to somebody -- i guess, you know still happening. and thank you both for being with me. >> thank you. now to a new warning from the centers of disease control about the growing popularity of e-cigarettes. in one year the number of high school students that have been using these things has more than tripled, but the health risks of e-cigarettes are largely unknown, leaving as many as 2.5 million teenagers in danger. nbc's tom costello has more. >> reporter: the flashy marketing is designed to lure a younger population from traditional cigarettes, but the warning from the cdc is e-cigarettes contain potentially dangerous chemicals and nicotine that carry their own health risks. >> we don't want to be playing a game of tobacco and nicotine whack-a-mole. >> reporter: but that's what's happening. traditional cigarette use had dropped to a record low, just 9% among teens. while e-cigarette use has tripled to more than 13% of all teens. 2.5 million people. another 1.5 million smoked hookah pipes. >> i enjoy it a lot more. i think it tastes a lot better i think the smell is a lot better. >> reporter: ian king used to smoke a pack a day, now carries e-cigarette flavors with him. this is better you think? [ whirring ] [ train whistle blows ] she makes trains that are friends with trees. ♪ ♪ my mom works at ge. ♪ ♪ i want to update you now on a multi-vehicle crash in california's san fernando valley. we are being told one person confirmed dead a dump truck and at least three other vehicles the big rig crashed off the freeway and down an embankment before slamming into a vehicle. two pickups also collided nearby. we are going to keep our eye on this developing story for you. in new orleans, protests under way outside a federal courthouse in new orleans, where in just minutes the court will hold a high stakes hearing on immigration. the white house trying to lift the actions as families like this one, the vazquezs continue to wait in legal limbo. the longer they wait, the closer they are to being torn apart. here's more on the human side of the immigration story. >> a lot of sadness, because two months i haven't seen them. >> reporter: 11-year-old ashley vazquez was afraid she and her two siblings would have to grow up without their father by their side. >> me and my sister started crying a lot. we just couldn't open our christmas presents. we just started to cry a lot and we couldn't stop. >> reporter: her dad, melvin, was hours away from being deported locked in a holding cell steps from an airplane to take him back to honduras. >> translator: it was a really hard experience. i was constantly worried about my children. i didn't sleep, i just thought about them and their future. >> reporter: but at the last minute immigration officials let him go and sent him home to his children thanks in part to his other family, a growing latino community in new orleans. >> it took a tremendous amount of public outcry outcry from his family and just general consciousness in order for him to be released. >> reporter: the community activist helps families like melvin fight their deportation cases. >> the fact of the matter is if that wouldn't have happened, he would have been deported to honduras last friday. >> reporter: while the vazquez family got help millions of other immigrant mothers, fathers, husbands wives, face an uncertain future. they would have been left alone under president obama's executive action program which provides a shield from deportation and temporary work permits in the u.s. but the program has been delayed for months thanks to a lawsuit brought by texas and 25 other states that cause the measures executive overreach. in the meantime, the president has promised that felons not families, would face deportation, even saying in an msnbc town hall there would be consequences for immigration agents who don't follow new the directives that families would be safe. >> if you've been here for a long time and you qualify generally, then during this period even with legal uncertainty, they should be in a good place. >> reporter: even as the president spoke at that town hall meeting, henry alvarado a father of four and no criminal record, was deported back to honduras. his wife jenny went to washington to tell members of congress her family had been wrongly separated. >> translator: i want to let them know my story, so there are no more injustices. they are people working honorably and they get deported because they don't have documents. >> reporter: his homecoming involved a packed crowd of more than 200 parents and kids on their feet chanting "yes we can," to see melvin's family together again. he thanked the community that supported them but the moment was bittersweet. he reminded the crowd there were fathers in detention with him still being held or deported. young ashley is ready to put the ordeal behind her. she hopes others will see families like hers should stay together. >> the experience i had, it hurt me a lot to see my dad was getting taken away and i don't want any other children to feel the same way i felt. >> that was msnbc reporting from new orleans. let me bring in contributor and professor victoria francesca soto. how much will stories like these we've seen real families waiting for a decision have an impact on what the court decides? >> i don't know about what the court decides, jose but my hope is that these larger stories will impact our politicians and move them to find a resolution. we did see the effect of human stories with the issue of gay marriage. we have seen a change in public opinion across the country when we see that it's not just an abstract concept of gay marriage but actually families. same thing with immigration. we're talking about families and when we're confronting the opposition to immigration with many republican members of our community, we need to keep reminding them this is about family values. we know the gop talks a lot about family values keeping the vazquez family together keeping the alvarado family together it is ultimately family values. >> this of course comes back to where you are, texas. what solution does the governor of that state have for the people affected by this lawsuit? >> yes, well the governor says he's very concerned, given the location of texas on the border and that an influx of individuals coming across from mexico and from south america are going to have a negative fiscal impact on our state, but the truth of the matter is we know that immigration has a positive impact on us economically, because more immigration means we have a larger economy, a boon for the gdp, and we also know that immigrants pay taxes. that they are active contributors to our society, to our economy, so these arguments, for example, the texas judge cited it's going to cost the state too much money to issue driver's licenses to undocumented persons, that's disingenuous. texas is one state that loves issuing fees. if texas is so concerned about that, why don't we up the fees for undocumented persons who want driver's licenses. the issue is bigger. >> there are two things the people opposing the president's immigration action because they say it was an executive overreach, then the issue of immigration and immigration reform and the separation of families, two different discussions. is the discussion on immigration going to play an important part in the 2016 race? >> absolutely jose. i mean we've already started the 2016 race. i'm going to be very curious to see how the republican party in particular cleaves on this issue. i mean i think we see some factions very conservative, some moderate, are they going to battle it out and balance it out in the end. >> victoria thank you, pleasure seeing you. >> thank you, jose. turn off your cell phone, senator roberts. it's good to know even congress has unscripted interruptions. by the way, so do we. >> the old generation -- oh! there goes the water. spilled water on the set. are you all right?
