Buffalo news perhaps says it all. A wall of snow. A reminder of how dangerous this type snow event can be. The Womens Basketball team from Niagara University stranded on a bus for 26 hours on i90 and rationing food. They were rescued this morning. Watching it all for us. Hi jose yeah were talking in that snowbelt just southeast of buffalo. Believe it or not, they have already picked up a years worth of snow. What the average would be for a years worth of snow. So 60 inches has already come down and typically during the year they get about 54 inches. So that is impressive. The snow continues. The lakeeffect snow continues for today for minneapolis all the way through chicago. And up through upstate new york as well. So thats where the snow will be concentrated before it winds down on thursday. We are still looking at the cold though for much of the nation. Still experiencing the cold all the way down to the south. 47 degrees for the high in atlanta today. Were looking at biting windchills up the i95 corridor. 35 for the high in washington, d. C. 33 in new york. So still a lot of places from the midwest off to the east youre going to be looking at temperatures struggling just to make it to the freezing mark. You can see there, a picture of buffalo and those whiteout conditions that they have been experiencing for the past 48 hours. Theres still a lot more to go about 2 to 3 inches per hour when some of the heavier bands move through this afternoon and then again tomorrow morning. Explain what this lakeeffect snow is and why its driving these incredible snowfall totals. Believe it or not, the band of lakeeffect snow that is moving over is about ten miles wide. That is really nothing. So actually buffalo airport, theyve only picked up 5 inches so far. But its just the places that are southeast that have really seen this walloping of snow over six feet in some cases. And this is all caused by the air coming over the lakes. So this is typical. This is the snowbelt. Theyre used to seeing this. Just not this soon. But of course because of this arctic air, coming in whats whats driving this lakeeffect snow. Its not something that they dont typically see. They just dont typically see it in november. This is more like january snowfall. Its really extraordinary. Thank you very much. What are we expecting there . What were expecting there is more cold. The winds are pretty biting this morning. The feel like temperatures in the Single Digits and the teens. Again, theyll see some squalls of snow moving through. Theyll likely see that through the afternoon. It will wind down some tonight and pick up tomorrow. The snow machine really starts to shut off for that area by thursday by thursday morning, we should really see that wind down. And then temperatures will start to rebound. But remember, you have fresh packed snow on the ground, which means temperatures are still going to stay cold. So through the weekend. What may be a Silver Lining for the white house, the possible veto showdown between the president and congress averted for now. The Keystone Pipeline bill defeated by one vote. Republicans planning to bring it back on their terms when they take control of the senate in january. This will be an early item on the agenda in august. Im confident the bill will succeed succeed. Weve got both ends of pennsylvania avenue covered. Chris jansing it at the white house. Kelly odonnell is at capitol hill. Chris, i want to start with you. This vote spares the president from breaking out his veto pen. You heard mcconnell keystone coming back early next year. Whats the white house going to do . The white house knows that. They realize its a new ball game with the Senate Majority being republican next year. But they also know its not completely a veto proof majority. So they see this as potentially an opportunity and although they wont say this explicitly it could be a little bit of deal making going on. So the president will threat been to veto. He has implicitly said that and josh earnest and others of the administration have said that as well. If they can come to a deal on some things that are very important to the president , thats one possibility. At least in the short term it saves the president from that confrontation and moves it off into january, jose. And come january, kelly, Republican Controlled Senate does that mean this bill is pretty much a done deal . And the other question is what are the implications of this vote for Mary Landrieu who all it seems was revolving around her . A shortterm defeat for republicans gives them that opportunity in january to get this passed. Theyll have bigger numbers. There are some democrats who support this. Even with some of those democrats who voted yes last night being out of the Senate Senate republicans are pretty confident this can pass. Will it have enough to override a president ial veto . They cant go too far just yet. I was in the Senate Chamber when the vote was coming down. I watched mary lawn droe really standing alone for much of that voting time. She approached some of her colleagues trying to make the final appeal and she was one vote short. She is the person with the most to lose in this. They just couldnt vote for it at this time. What chris mentioned about the potential for deal making will be sort of renewed in january where there might be some other related kinds of bills that have been talked about but not acted on. Maybe putting those together could sweeten the deal to attract other votes. The deal making will begin in january. For Mary Landrieu the implications are stark. If she had gotten this through, it would have been something she could argue to voters shows her strength. It just didnt happen. Jose. Yeah it would have been vetoed probably anyways. Lets ask about immigration. I want to start with you. The president has told me a number of time also that he couldnt issue executive orders on immigration. We can expect an announcement any day now on immigration. I think theres been a lot of pressure. We heard it most recently from harry reid. At least for now. The Senate Majority leader. Get it done now. The white house has been very clear. They dont think theres any advantage to putting it off. There had been a scenario floated out there that maybe it would get in the way of budget issues and other lame duck session bills that need to go through. The white house doesnt necessarily believe that. They know that this is going to be a confrontation no matter what. Really, this is a battle now for their legal teams getting up to speed. We know the republicans have been getting their arguments together. Theyve been using the president s past statements including the ones he made to you, as one example of how they think this goes too far. But what senior white house aides tell me is the president wants to put this as far as he believes he possibly can with the Legal Authority and the advice hes getting from eric holder jose. And in just a few minutes, were going to have more on the i grags showdown and the republicans threat theyre threatening a lawsuit or even more to stop executive orders on immigration. People went about their morning prayers inside the synagogue where four people were killed just 24 hours ago. Overnight, a Police Officer caught in the shootout died of his wounds raising the death toll to five. Israeli Prime Minister netanyahu said israel is now fighting a battle for jerusalem, those are his words. Nbcs bill neely has our report from jerusalem. Reporter mr. Netanyahu has promised a harsh response to yesterdays mass killing. The big question is what exactly can he do because Israeli Police say that two palestinian cousins who were responsible for this massacre had no criminal record. And appeared to be acting alone. Very much the pattern, lone wolves, lone attacks, not necessarily connected or coordinated or ordered, although usually they have been praised by the Islamist Group hamas so a real problem for the israeli authorities here not just the intelligence agencies trying to predict who might attack next. But also what do you actually physically do. There are more helicopters in the air. There are more concrete barriers. More police on the ground. But as i say, this city has braced for another attack. The other on the ground from a security perspective. We saw that late last night. Israel destroyed the home of a palestinian man who was involved in a previous attack that killed israelis. This is a controversial policy that israel has adopted. Which is to destroy the homes of palestinian families belonging to the relatives of those who may have carried out those attacks. The problem is israel does not do that when it comes to israelis who may have committed similar crimes against palestinians and its the example palestinians say is a form of discrimination. But it also fuels tensions. It also raises the stakes for palestinians who live in parts of East Jerusalem and elsewhere. Thats what leads to the types of clashes weve been seeing. They said they were going to do with the two palestinian attackers. On the political front, you can expect israel perhaps to announce the construction of new settlements in occupied East Jerusalem and that would certainly anger palestinians and raise the tensions. Weve heard local schools will be given some notice. But thats about all we know at this point. I mean yesterday, it was reported that the grand jury continues to hear evidence related to the case. Were still acting on the announcement that was given out several months ago that a decision will be announced some time between mid to late november. But thats about all we have to go on right now. Spent some time yesterday talking to Business Owners, folks would live in this community, some local protesters as well. Just a handful of protesters have been out, i should know. One did say he has not boarded up his particular business and hes just one in this strip. Everyone else has boarded up. He says hes not going to board up because he still very much believes in this community, he still very much believes in ferguson. Thats a guy named charles davis. He runs my favorite hamburger joint. About a quarter mile up the road. Bravo for mr. Davis. There are other people taking all kinds of preparations. Tell me about that though. Yesterday, School District announced they were going to be sending home some homework packets, you know, when the violentvile violence erupted shortly after the august shooting, some students in the area missed six days of school. This time around to prepare for that, teachers and administrators say theyre sending home these homework packets so students dont get too far behind. Talked to a parent yesterday who said shes stocking up on blankets and other things. The temperature here has dropped considerably, just like it has over a large swath of this country. Although i can tell you today its a balmy 35 degrees. So folks are stocking up with supplies in anticipation of unrest. Lots of folks continue to do that. Again, at this point, no indication that the unrest is going to happen. But also no indication that an announcement is going to be made any time here in the near future as well jose. Everyone continues to wait. And, craig, you know you kind of mentioned a little bit about the weather. Is there any sense that the cold weather in ferguson right now might minimize some of the protests . Funny you should mention it. Thats something weve talked about on the ground. Ive had that conversation with producers, as well with mr. Davis yesterday. I dont know. I do know that the last time i was here a couple months ago, you know, when the weather was nice, yes, you saw a slew of protesters out there. It was one particular day where it rained pretty hard and the streets were a lot emptier. So one could assume perhaps the weather is having an effect. We are actually going to see more snow here believe it or not. For right now, though its crystal clear. We are dealing with about a foot or so of snow on the ground here. Its really hard to measure though because its been so windy. Windchills now below zero. It tossed a lot of this snow around. You dont have to go far to see totals like five six feet of snow. Were measuring the snow and p in feet here. And its really just right up the road. Were seeing these thin bands lakeeffect snow. They moved out of this area. Theyve even moved out of the area like hamburg, new york where they have about 76 inches of snow on the ground. Its now moved north of bouf lowuffalo up near niagara falls. Now, we are seeing cars buried. Weve had vehicles just stuck in the middle of the road with nowhere to go. The niagara Womens Basketball team was stuck for 20 hours on their bus. And now roofs are an issue. When you have six feet of snow on top, roof collapses will be a concern as we go through today. We will see another round of lakeeffect snow thursday and friday. A possibility this same area could pick up another 1 to 2 feet of snow. Incredible stuff. Jose. It really is. Were just at the end of november. Today, could the house sue president obama if and when he uses his executive authority on Immigration Reform . A group of House Republicans is already introducing a bill to make that possible. Being, this would not be the first lawsuit against the president. Speaker boehner has left the door open to expanding his lawsuit other the Affordable Care act to include imcombination. Talk about retainer. The gop has just hired a highprofile belt way lawyer to litigate that suit. Does the house have legal standing to sue the president over either aca or immigration . Who better to answer that question than nbc news justice correspondent Pete Williams. Pete, good morning. Well, good morning. Standing is the key to this. Standing is what the courts call does someone have the right to bring an action. Anybody can sue. The question is will the courts entertain it. What the federal courts have said in recent years, theyve been picky about who gets to make a claim. You have to show some particularized concrete injury. You might well say the house is defending itself as an institution. But the problem, some legal scholars say, is the house doesnt exist after two years. So the house, in theory could only defend the laws that it passed itself. Thats one way of looking at it. In any event, the courts sometimes say when one branch of government sues another, these are political disputes and the courts like to stay out of it. As one legal scholar says whenever this happens, if you want to take a bet, always bet on the presidency, not the congress, when these lawsuits get filed. And whose children are kids friends and go to school with then and play on ball teams with them. Maybe those families would get to Stay Together. And all signs point to the president doing something that could help those families Stay Together. But probably not this family. That would be this family. Her undocumented mother is facing a hearing to decide whether she will stay or be deported. Yesterday, her daughter wrote, president obama, dont leave my mother behind in any of your executive actions. The codirector of dream Action Coalition and her mother both join me now. Erica, i want to start with you. What is your message to the president , ahead of any announcement that very well might not include your mother and maybe not keep your family together . Thank you for having us jose. You know its it keeps me in the same message of him really going bold on this. I think that he has been getting a lot of heat from republicans. Just like you were mentioning earlier. Hes going to continue getting a lot of heat. Might as well, you know go big and the dreerms, its a little bit of hard moment to take because we are hearing a lot that dreamer parents who dont have u. S. Citizen children and other folks who dont have children at all might not be included. Its tough because well been in the middle of this fight, in the forefront of this fight for so long, and not having our parents be helped by this its definitely hard to take. Were hoping we can push into the end. Were going to continue to pushing until the end. I want to talk to you mother who does not speak english yet and ill be translating it. Thanks for being with me. Your message to the president. [ speaking Foreign Language ] my message is that please thank that he if he were separated by his family it would be a suffering that would be very large, thats how i am now. In threats of being deported. And for me it would be terrible to be separated from my daughters and kids or my grandchildren that all live in the United States. What do you face if you are deported back to mexico . [ speaking Foreign Language ] i dont know. In mexico i dont have a house, i dont have anything in mexico. There are many years ive been here in the United States. In mexico i dont have my mother, i dont have a house, i dont have anywhere to live. Maria, what rubs through sruns through your mind as you face a possibility of being exported . [ speaking Foreign Language ] i dont know. Without my family i dont know what we could do. For me my family is the most important thing in the world. And im nothing. It would be suffering to be away from them. Erica, whatever executive action the president takes on immigration would not be a solution. That is in the hands of the congress. The republicans in the house have not wanted to tackle immigration. Isnt that where all of the focus should be on . Yeah. I think weve put so much of our focus already on trying to, you know, get a permanent solution a legislative solution. Unfortunately, weve seen a broken congress and they havent gone, you know, what theyre supposed to get done. At this point, weve told republicans to do this, weve pushed them so hard for a matter of 1 to 2 years and they didnt do it. For now, were asking the president to get it done. Were hoping republicans really want to fight for 2016 in terms of the latino and immigrant community, that theyre going to have to show theyre better than that and can face legislation. For now, we cant wait for legislation anymore. The president needs to do it. If the president does act, erica it will be maybe four or six months before any executive action would start taking effect. That would mean that regardless of how the president acts theres a very good chance maria, your mother, could be deported. Youve dealt with that issue. Yeah. I mean its like i said its a tough situation, right. Ive been getting a little emotional lately because i have been reading a lot. That theres a possibility that parents of dreamers or that dont have any kids in the u. S. Might not be included. Its a bit hard just to think of that because my entire i guess everything ive done within this movement has been for my mom. She sort of has been that sorry. Shes been that inspiration for me and just thinking that, you know, im not going to stop fighting for her. I think, you know, were not going to stop fighting one by one those cases that are not going to be included in this just to make sure theyre not deported, but its going to be a struggle having to deal with it every single year and her having to be in the hands of i. C. E. Is really scary. Again, its not regardless of what happens, its not over. Were going to continue having to fight for a permanent solution. And for those who are not inside of this executive action. I mean the nsa plays an Important Role on one aspect which is according to john hill theyre looking at the social media. Theyre analyzing locations. Theyre getting gis coded and tagged information for people who are, lets say, in syria. But i have to agree with senator leahy, hes right, the majority of people that are going off to join isis are what terrorists groups call clean skins. They have no background in terrorism. Were going monitor everybodys phone calls in the United States, were not going to capture those kinds of people that are going off to syria and that or might be lone actor terrorists. I think Patrick Leahy is correct. There are two westerners being held by isis and president obama is calling for review of u. S. Hostage policy. What does it mean and how might it change . Well, i understand why, for example, in the case of james foleys family they would have probably wanted to pay the ransom. But the ransom is a source of funding for isis. And so it has a perverse outcome where if they are getting money for people they kidnap theyre only going to kidnap for people. They have access to other resources like oil. They have luted the banks. I dont know if the issue of paying ransom or not paying ransom degrades isis to the extend it would have two years ago. But the question is and, you know, when the rest of the world seems very willing to pay ransom when the United States decides and so does Great Britain theyre not going to pay raysomes, they say, its so that the other organizations wouldnt feel the need to go and get americans because theyre getting money off them. Its not necessarily just about isis but the broader picture of paying ransom. I think its the broader picture. I think there are ethical dimensions. If i was ever kidnapped my family is under instruct instructions not to ransom. I agree with the fact it creates perverse incentives that i would worry about the longterm ramifications are if we started paying. They would have an incentive to kidnap a lot more americans. And you have written so much about the role of social media and propaganda in getting new isis recruits. How does it work . Why does it work . You know, we have to take into account at some level there is something that is very attractive about living in the caliphate. So just by using that kind of terminology, theyre going to attract people who think, wow, it would be great to live, you know, like the people who follow the prophet at the time of the believers and the first few rightfully guided caliphates. Its not at all like that. Its really, a beat and switch, i talk abouted with you theyre using the same kind of tactics to lure young people young women in particular as pedophiles use to entrapt children. Jose i just got off the phone with israel before coming on the air with my team in vale and my organization. Jerusalem is a city under siege. Im not sure how much the rest of israel feels as much under siege as jerusalem. The escalation of terrorism and violence, which some people may preclude as a has to be arrested. The fact of the matter is that ever since the hamas israeli conflict the situation has been extremely, extremely dangerous throughout israel and throughout the west bank. And the fact of the matter is that extremist on both sides, their voices seem to be drowning out the voices of moderates and what this needs right now is a Prime Minister in israel and a president in palestinian who are going to stop the incitement and top calling each other names and stop blaming each other and try to arrest the cycle of violence. Thats what it needs now is leadership from the top. Ayman, the Prime Minister of israel called this a battle. Is there a military component . Not necessarily in the conventional sense. Theres no doubt the Israeli Security forces the domestic Security Forces are going to be stepping up their efforts to make sure that similar attacks dont take place. I think the challenge for Israeli Security services is theyve done a good job over the course of several years to isolate the west bank. So organizations or paramilitary organizations in their military wings have had a hard time carrying out attacks inside vale proper. But the risk and the challenge is going to be coming from the palestinian population within israel. Particularly those from East Jerusalem. Over the alast several months the attacks have been from res dentds of East Jerusalem. Thats harder for the Israeli Government to tackle. Thats why were seeing the punitive measures in against the families in the wake attacks. Does the u. S. Have a role in trying to ease tensions there . Secretary kerry has met with both israeli Prime Minister netanyahu as well as president hamas. In jordan few days ago because the jordan has the custodial control over what became the initial flash point that is known as the nobel sanctuary. The area above the western wall. Where the dome of the rock is located where there was an attempted assassination of an israeli activist who wants to open up that sanctuary that two nonmuslim jewish prayer. As you know jose next week november 24th is the deadline to determine whether or not there will be an agreement between iran and the p5 1 countries. So far is reigning in the Nuclear Weapons program. Number two, there may be an extension beyond the november 24th in terms of trying to reach an negotiation. I think highly unlikely the talks will completely collapse. What is the overarching theme for today . Well, the overarching theme is really the title of our program, which is making progress. We think our country, our movement and most americans today want to make progress on some of the issues confronting our country. Climate, income inequality the whole issue of how we address infrastructure more effectively. How we create more opportunities for better jobs. Those are the kind of things that i think are on the minds of just about everybody attending the conference today. And senator, the conference as you know is getting underway after some losses by democrats in the midterm. The loss in the senate the house, they lost in governors offices. How do you turn things around . First of all, these are midterm elections that are historically ones that act those currently in power. We expected some of this to begin with. I think what we have to do is ensure people understand were fighting for them. That we recognize the importance of the messages that the American People are so hopeful to hear. Messages about improving their economic status. Messages about better housing. Messages about dealing with immigration, finally. And finally ways to with climate. These are the kinds of things that American People want to hear and i think the big lesson from the last election was that the turn out was low in part because they werent getting the messages loudly and clearly as repetitively as we needed to make it. In places like colorado as you know the issue on immigration may have played a role in the low turn out by lets say some latinos in that race. Lets talk about the immigration issue. As we expect the president any minute now, any day now could announce executive orders on immigration. Is that the right way to go . Well, i think that it doesnt have to be either or. Theres absolutely no doubt that having statute is better than having an executive order. If we can find a way to ensure that through statute we improve the lives of millions of people that are living in this country, then i think we ought to do that. The president has clearly articulated his vision for what we ought to do with regard to immigration. And so i think laying out his objectives, his plan through an executive order that could later become statute is exactly the right approach. Senator, what happened to bipartisanship . Well, i think the polarization today is reflected, really, across the country, jose. Weve had a lot of people very deeply divided between conservatives and liberals. Those who believe that there is a role for people coming together. To work on issues together. And those who believe it ought to be done independently. Largely the debate is about the role of government. And its as e visive debate as in generations. We have to find ways through our leader and the effort to find Common Ground to restore the bipartisanship. So critical to a democratic republic. Senator tom daschle, a particular to see you. Yeah i was specifically asking him why not include for deferred action for the parents of kids that have already received deferred action. For the first time yesterday, White House Press secretary ernst indicated some things have changed since then. Obviously there have some things that have changed. We have been in a situation where the president ordered a broader indepth review of existing law to determine what sort of executive authority does rest with the presidency to determine what kind of steps he could take on his own. Based on your reporting, what do we expect out of the white house . Things have changed but how much since last year or the year before when i asked him the same question or the year before that . Reporter now president obama is expected to shield from deportation any type of undocumented immigrants who have americanborn children here or anyone with hightech skills. But now notably, there are reports that they will not be eligible for health care subsidizes under the Affordable Care act. Now white house Officials Say theyre still nailing down the details of what exactly will be in the actions, but it is expected that it will be model modelled after daca which was largely successful in shielding hundreds of thousands of young dreamers from deportation offering the work permits but notably without health care. Yeah and just its important to point out that dack kids are not eligible for bachobamacare, theyre not eligible for any kind of federal assistance programs. Youve been covering the activism angle. Weve heard so many numbers. What are you hearing from them . What are the numbers that the president is considering . Young dreamer groups and advocates groups on capitol hill to press lawmakers who are threatening to put the executive action in jeopardy. As many as 4 to 5 million undocumented immigrants could be shielded. To many of the dreamers these are deeply parent. These are their parents. Theyre taking it to saying this is my mom or dad. I want them to stay in the u. S. With me. Yeah. We just heard from maria,er can erika andiolas mother who could be deported next month. I want to bring your attention to something youve been reporting on. Theres closure of a Controversial Center for immigration families. Exactly. It seems that the Obama Administration is doubling down on Family Detention Centers is coming off as deeply problematic to human rights advocates. Basically theyre shutting this temporary facilitying that is holding mostly immigrant women and children. Theyre transferring them to a far larger facility in texas that could hold as many as 2400 individuals. The federal Officials Say its the best way to ensure their Immigration Court cases are making their way through the court in an expeditionus fashions. Many dont want these to exist at all. Amanda sakuma, thank you so much for your time. And since the legal aspect of all of this is key, let me bring in a lawyer immigration attorney with deep knowledge about the issue alma rosa. What a pleasure to see you. Pleasure to see you as well. What impact legally would the president s pending actions have on the way the system currently works . It would be huge. It would be first, it would be a message to congress that they have to do something. Our system is obviously broken. It is archaic, its not functional. This is a message were going to do something because congress hasnt. But for the families that it would affect of course it i think it would boost the economy. It will allow people to start businesses. To go back to school. It would be a great plus for the nation. Alma rosa. We have talked so much about this over the last ten years. But one of the things that folks say is if you give legalization to 4, 5, 6million people that may cause a waive of people from central america, from mexico to come over here because they here theres something of legalization going on in the United States. Is that a possibility . It could. I doubt it. These new executive actions that the president ments to take of course, will require a certain amount of time to be in the United States. Five to ten years. Anyone coming across now would not benefit from the changes. So i dont see this as happening. Also another reason why we should fix immigration system so we dont have pore us borders. You have your finger on the pulse of so many people in the Hispanic Community that live in mixed status families. Tell me about what it means to be in a mixed status family. And how important this issue is for them. Greatly. I can talk about one particular case. A young woman admitted to harvard. Undocumented mother and undocumented father. Other children undocumented. She went through harvard crossing her fingers every day that she wouldnt be deported. Now thanks to daca was able to obtain some legalization. Because it means someone is legal in some way. She has at least a permit. Now is working at a topnotch job because she had this opportunity. So this is obviously, allowing families not only to Stay Together but to explore and use their brilliance in this country. Anna rosa, i want you back, if you would be kind very shortly. Our bus driver was great. Our Coaching Staff did a great job that making 0 sure our players were focussed on what we could control. Social media really helped us actually. When i see the pictures you tweeted out and you have been putting on different social media. It looks like theyre smiling. I would imagine 26 hours is a long time for people to be in a small space. How did you keep the smiles going . Yeah. Social media helped. We did, you know, we played some games. We watched movies. We were fortunate enough, unlike the caller that i caught the end of before me we were fortunate enough we were in a motor coach. We had power and we had movies. We had 15 players entertain my sons so they didnt go crazy as well. We played games. They made up songs. We made videos. Anything we could do to keep ourselves busy. As it started to get dark you could tell there was a little bit of tension. Were trying to keep close contact with the authorities and First Responders and time lines. Theres a lot going on. And so those kept getting pushed back which was unnerving. But probably more unnerving for First Responders that are trying to help the people that are stuck. Within the past hour a South Carolina judge has started issuing the first samesex marriage licenses in that state. The move came ahead of the state attorney general intervening to block such unions. Nbc news justice correspondent Pete Williams is in washington. Pete, good morning what can you tell us about this . These are the first marriage licenses to be issued in the deep south. So it has some symbolic significance significance. The question is whether it will hold. There were Court Decisions in South Carolina last week. Court decisions one last week. One just this week saying the states ban on samesex marriage is unconstitutional. The first is the key one. It said that those marriage licenses can go ahead. The state has now challenged and gone to the Fourth Circuit court of appeals. It turned the state down. Now the state has gone to the u. S. Supreme court and said we need to stop. We want to challenge it. Please put a hold on granting any licenses. Thats sitting before john roberts, not only the chief justice but the circuit justice for that part of the country and the state is waiting for him to respond. In the normal course what would happen here is that the chief justice would ask the other side for a response and then and only then would he issue any kind of an answer to that. So were waiting to see what the Supreme Court is going to do here in the meantime the marriage licenses are going ahead. It should be noted that South Carolina is part of the Fourth Circuit court of appeals. Its no surprise that the Fourth Circuit said no and already upheld lower decisions that is unconstitutional. What happens if Darren Wilson is indicted or if hes not well from the legal side, if hes indicted well see him go through a legal process. Hell be arraigned, hell be arrested, and well see motions. If he doesnt plea to something well see a trial and hell be convicted or acquitted. If hes not indicted theres still a federal investigation. He could be charged federally. Of course he could also be charged he could also face civil action. He could be sued by Michael Browns family. Those options are still open if he is not indicted. If he is indicted. If hes indicted well see a trial before we see the feds move in and the family suing him. Yeah, rechbd youre training people on how to interact with the police in protesting. What are you expecting from the decision. How are you preparing . Well, we are engaging a rich tradition of nonviolence civil disobedience predicated upon our Constitutional Rights and our inailble rights. Through nonviolence civil obedience we have provided people the kind of resources necessary. Theres been legal training. Unfortunately weve had to do medic training. How do you deal with tear gas, how do you deal with pepper spray, what to do if someone is hurt. While this process has gone on for several 100 days the summer of tear gas turned into a winter of waiting. City is on edge. Were doing all we can to keep our organizers, our community, and our democracy safe. And a question to both of you. Yesterday Governor Nixon a 16person panel. A message to send on the day he called in the National Guard, right reverend . Yes. At the same time he issued a state of emergency which mobilizes the National Guard as well as the policing officials of this area have acquired some quarter Million Dollars in militarized weaponry. Which seems the case theyre preparing for war. While call for peace. Were struggling to preserve and save our democracy. And tell me what struck you in this covering. What sticks in your minds . How calm it is right now. I think a lot of people are somewhat offended by the fact that the governor has called in the state of emergency. It doesnt look like an mrjt emergency now. The governor put in before when there was snow damage. Theres some precedent. People are saying ferguson is getting the reputation its a war zone. That people are violent here. There are riots. As someone that covered it for a month and a half. There were days of violence but for the most part 90 of the time people have been peaceful. I think a lot of people are somewhat offended by this and some are frustrated. For over 100 days these protests have been mostly nonviolent. People have been disciplined. On august 9th a child was unarmed, shot and left in the street for four and a half hours. A Police Officer i have spent more days in jail and more time in jail than Darren Wilson as a nonviolent protester. And the Police Responded with an unconstitutional level of violence against peaceful protesters. And so let us never lose track of Michael Browns body and all of the Michael Browns of america. These are pictures from Traffic Cameras on the new york state throughway showing crews digging out drivers who are stranding after a monster storm that has already taken the life of five people. Troopers are using all terrain vehicles to search a 130mile stretch of the highway in western new york for people who have been trapped since yesterday morning.
