Were following breaking results out of ferguson. This is the scene there now where you can still see smoke billowing from the charred remains of a Public Storage unit. Near the police headquarters. The street is lined with charred
remains of buildings after a night of anger and unrest. Two police cars were set on fire. Police officers fired smoke bombs and then tear gas. A dozen businesses were damaged, destroyed or looted. A total of 82 arrests were made overnight. 61 of them in ferguson. Many for burglary or trespassing. What ive seen tonight is probably much worse than any night we had in august. I said several months ago during an interview, what could be the worst possible thing that could happen . I said to tear the fabric of this community apart. Frankly, that has happened here tonight. We should point out that last nights violence was limited to a small area and there were many peaceful protests. This was the scene this morning in nearby clayton, missouri, where some of those peaceful
demonstrations took place. Churches have also opened their door to service safe places where people can go for medical services and receive counseling. Lets go to zach roth, live in ferguson. Have things coupled down overnight and whats the scene there this morning or this afternoon . Reporter joy, its been a morning of kind of picking up the pieces, literally, after what we saw last night. I just drove down south florissant next to the Ferguson Police department. Theres a whole row of restaurants and stores, that have had their windows smashed in. Its a line of people putting up plywood boards. I spoke to a beauty operator saying she didnt put up boards. They thought it would provoke peek. Unfortunately, her front store is smashed in and people looted a lot of the products in there. The other feeling is theres
a sense of frustration with the process as it played out last night. I just spoke to a woman in starbucks saying, it appeared like the prosecutor mccullough was acting as Darren Wilsons defense attorney rather than looking out for the interest of Michael Brown and his family. Its kind of those two themes running through it this morning. What about the decision to have the announcement so late at night, 8 00 central time 9 00 eastern time . Business owners that youre talking about, whether or not they decided to board up, did they have any comments or have people in the community had any comments just about the way the announcement was done, the timing of it . Reporter in the days leading up to the announcement, they wanted it done in the right way so people wouldnt be out on the streets, so they had advanced warning. I think that may have been what prompted them to do ist in the evening, to avoid rush hour when
people were out. What ended up happening was, it was already dark, it was night. There was a feeling that kind of provoked some of the anger and violence, and some people saying, this is their theory, of course, saying we think mccullough did that on purpose in order to provoke a reaction of violence, thereby, discredit protesters. That decision definitely adding to the sort of sense of suspicion and frustration about this process. You talked about some of the businesses, people who were making decisions about what to do, whether to board up. On ronan farrows show earlier, one person said police spent more time protecting businesses in clayton and not enough actually Police Officers that were protecting the businesses actually in florissant. Did you get any sense of whether people felt that the Police Presence was actually sufficient to protect their property and interests . Reporter it certainly was
not on the south florissant strip i was on last night. There was a heavy Police Presence outside the Police Department and at other times a few different intersections. A whole strip of stores and restaurants left entirely unguarded and all had their windows smashed in. I think people are people have a lot of questions about how those officers were deployed. All the individuals i saw, reacted calmly facing protesters, protesters yelling slurs and offensive things. Most of the protesters were not doing that but a few were. The officers handled themselves professionally. There did seem to be issues with how they were deployed and where they were deployed. A short time ago attorneys for Michael Browns family held
a News Conference in st. Louis where they blasted prosecutor mcculloughs decision to call a grand jury and not appoint a special prosecutor. They were joined by Michael Browns father, who did not speak and the reverend al sharpton, president of the National Action network and a host on msnbc. Let the record be clear, you have broken our hearts, but you have not broken our backs. We we are going to to continue to pursue justice. The National Action organization has organized rallies at federal buildings in cities including chicago, atlanta, and brooklyn, new york. The protests last not were not just confined to ferguson. Demonstrations took place in major cities nationwide and even more are scheduled to take place at federal buildings today. In new york about 1,000 demonstrators flooded times square while others tried to shut down the three major
bridges. One man was arrested for tlo throwing what appeared to be red paint at Police Officers, including Police Commissioner will yan bratton. Hundreds of protesters blocked both east and westbound lanes. Police were eventually able to clear the freeway and several arrests were made. In the nations capital, protesters marched to the Supreme Court building. In a crowd of about 500 people gathered outside the white house to protest the grand jurys decision and to hold a moment of silence for mike brown. While inside the white house, president obama called for calm. I join michaels parents in anyone who protests this decision to do so peacefully. For more on the president s reaction, lets go to nbc senior White House Correspondent chris jansing. We know the president will be in chicago today. Fergusons only about 300 miles away. Any chance he will go to ferguson . Reporter not today. Theres a very practical reason why. Obviously, any time the president makes a visit, it
requires the cooperation of local Law Enforcement and they obviously have their hands full in ferguson right now. The president also doesnt want to focus a lot of attention on the things that went wrong. The question s is there a reason he could go at at a time to focus on things that have gone right. Heres what he said last night about whether or not he would go to ferguson. Lets take a look at see how things have been going. Eric holder has been there. Weve had a whole team from the Justice Department there. I think they have done some very good work. About building relationships between police and the communities they served. According to your reporting, is the Administration Planning to do anything to push that along and help that happen . Reporter this has been a priority of eric holder and the Justice Department. You heard the president just allude to it, which is the day after the shooting happened, they sent a team from the Justice Department and theyve been on the ground since then, working with the local community, trying to help to bridge, in particular, the relationship between the community and police. Its something that they think is important throughout the country, that the president talked about last night. He talked about something called best practices. They know a lot about the programs that work and they want to enlist local Law Enforcement, local Community Groups to work on that. I know there has been some frustration within the Justice Department that some of the help that they have offered and some of the expertise they have they felt was not used by the folks in ferguson. Thats something the president would like to expand. I dont know if you can hear whats going on in the background. The president marine one is just lifting off and hes heading to chicago. We continue to follow the protests going on in ferguson, missouri, and the reaction arent the country. Right now we want to look at the evidence the grand jury actually saw. In particular, the newly
released testimony of officer wilson. To evaluate the critiques from those who say there was enough there to diet. Lisa bloom is an attorney as well as a today show legal analyst. Lets get into this Darren Wilson testimony. Ill ask you, what stood out to you most about Darren Wilsons testimony to the grand jury . As you know, i stayed up most of the night reading it. I read it a couple times. I also read it against his police statement, which has also been released. Theres a number of inconsistencies. The biggest thing that simprumpz out is prosecutors who arent prosecuting. Who let the target of the investigation come in in a very friendly, relaxed way and simply tell the story. Theres absolutely zero crossexamination. Crossexamination is the hall mark of our society. Its the crucible of truth. I dont say that to use flowery language. Thats how we get at the truth. Darren wilson, as you see in these pictures, for example, doesnt have any obvious injuries. Maybe if you look closely, a tiny bit of pinkness on his face. Thats completely inconsistent with his story that mike brown, with full force, he says, punched him twice solidly in the face. Big, strong, mike brown. Inconsistent with his injuries. Hes not crossexamined about that or anything else. At one point we were having a side bar, you were saying i know this is hard for you, something the prosecutor asked. Doesnt sound so adversarial. These claims about the hard punches and the attack inside the car, he called mike brown hulk hogan. He said he felt like a 5yearold going up against hulk hogan and another point he described him as a demon. He says, this is my car door, i stepped back, and the only way i can describe it is it looked like a demon. The description of mike brown as almost a wild beast. Yes. Then does he explain how that led to the six or so shots that actually killed mike brown . Yes. He clearly paints a picture of mike brown as this super human,
demonic monster. Keep in mind that officer wilson did not have to give any statements to anyone until he first spoke to a lawyer and got to review all the evidence. You have to wonder if its information he came up with his lawyer. I also would tell you, joy, one thing that really, really deeply disturbed me was his testimony before the grand jury we are says, theres a lot of gangs that reside or associate with that area. Theres a lot of violence in that area. Theres a lot of gun activity, drug activity. It is just not a very wellliked community. First of all, this is completely objectionable legally. You cant paint somebody with a negative brush because of the community they reside in. But it really gets you into the heart of Darren Wilson. Hes pretty much saying straight out, i dont like the people that i am serving. I dont like the people in this community. They are not well liked is a passive way of saying, i dont like them. This is very Fertile Ground for xr crossexamination. Any trial lawyer would say, what do you mean about that . Do have you any hostility against the community . These prosecutors dont go there. Another part of the testimony where wilson claims that mike brown charged at him. Now, keeping in mind that Michael Brown was wearing flipflops and socks but he depicts him as charging at him very fast. Were you able to glean from that and other testimony, another witness said he, too, saw Michael Brown running toward him, the distance between the two when the fatal shots were fired . No. I handle excessive case forces, i know how to do it and its not all that complicated. What you do is you get the person whos accused of Excessive Force to break this down nano second by nano second so you can test if the story is true or not. This issue about charging, which i find to be a racially tinged offensive word in and of itself,
but i would have asked him, what exactly does that mean . At one point he says mike brown took a step forward. Another point he says, he took a hop, as he was going to run and then he began running. Which is it, mr. Wilson . I mean, you really have to get to the bottom of it. You cant let an ambiguous word like charged get out there to the grand jury without analyzing, it without crossexamining it. Having gone through all this evidence, staying up all night, would there have been enough to bind it over for trial . If this were any other case and you have a couple eyewitnesss who say this young man was shot with his hands up, that is more than sufficient for probable cause. You bind him over for trial. The one question that this prosecutor was never asked is why was this case treated differently than all the other defendants in the st. Louis area who are mostly black and brown. They did not get the breaks Darren Wilson got. If i were accused of a crime, i would like to get the Darren Wilson treatment. I think a lot of people concur with you. Lisa bloom, thank you very much. One, have i to tell you we are in phase three. That means that we need to make legislative changes. Not only at the county level, but also at the state level. Ive been working on some legislation dealing with Law Enforcement for the last couple of months. On monday i plan to prefile my omnibus bill dealing with Law Enforcement ranging anywhere from having ensuring that you have your audio and video cameras to the point when you have tear gas or state of emergency, you have thirdparty entities to ensure that you have your civil, human and Constitutional Rights heard and
observed. And also making sure that we have psychologists that are on the ground to help people out who are experiencing distress. I want to play you sound from a protester last night. The other thing have you to deal with is the human condition and, frankly, the despair you hear from some of the protesters. Lets listen to one of the protesters from last night. This is just what we expected. We didnt expect to get justice here. We didnt expect to get justice from the system. The system doesnt provide justice for anyone n our opinion, especially not black males. As a part of the system, as an elected state official, how do you answer that . This is a great opportunity to educate my constituents on how we develop law. Many of the things we have experienced in the last 109 days are really troubling. For example, being hogtied. I had constituents who were hogtied and kicked when they
were unconscious. I want to make sure through our legislation that not only can officers not do that thing, but i want to make sure that they are not namecalling people as well. Many of my constituents were called monkeys and animals. That should not be tolerated. Also in my legislation, we are going to enforce that every single officer wear his or her name badge when were in a situation like this. This is a wonderful opportunity to educate the community, but i want them to be a part of the process because this is our democracy. Our democracy can only be strong if were working together. Phillip, you heard the state representative that represents the ferguson area talk about instances just last night of people being called monkeys and dogs and people being hogtied. Can a Police Department that has that little currency with the community and still exhibiting that kind of behavior, at least according to some of these protesters, continue to police that community . Theres no community that will consent to being policed by a group that sees them as less than human. One thing disturbing that people have been picking up on in social media is Darren Wilson in his grand jury testimony said that he felt as if Michael Brown jr. Looked like a demon. Referred to Michael Brown jr. As it. Theres no way for a community
can consent to being policed when its being occupied and hogtied and kept in their place. Thats the very definition of undemocratic policing. When you see people stepping out of what is legal because what is legal has been dehumanizing for them. Weve talked about the demographics of ferguson, a community that is 67 africanamerican. A community it was a changing community that used to be majority white, now majority africanamerican. Only three black officers on that police force. When it comes to trying to bring this Community Back into some sort of working relationship, because that police force is still going to be there when all the news trucks pull out, what can, in theory, the Police Department do to try to change this . The advice i would give the Ferguson Police department i would give Many Americans which is confront the reality of racist ideas, conscious and unconscious, and institutional discrimination. Stop running from this rather
extensive reality so we can fix it. Because its not just about policies to fix it. Its about really confronting a fundamental reality. Once thats confronted, the various policies will follow in many ways. But the constant resistance, somehow its one cop who calls one resident a monkey or maybe its just one cop who used the word demon and had no Historical Context of the demonization literal demonization of africanamericans for quite a long time, that kind of exceptionalism, making excuses, makes very policies for change much more impossible. I want to read a statement from the fraternal order of police, the Missouri Division saying we cant undo the events of august 9, 2014, but we hope we can learn and grow from them. We hope peace prevailing in the coming days. Nice sentiments, but it doesnt really change the facts on the ground. I want to play you what president obama had to say about the kind of Bigger Picture in terms of policing in minority
communities. Take a listen. The fact is in too many parts of this country, a deep distrust exists. Some of this is the result of legacy of Racial Discrimination in this country. This is tragic because nobody needs good policing more than poor communities with higher crime rates. This is seen as a southern phenomenon, but month is the place where dred scott, that whole thing took place. On the Bigger Picture, outside of just ferguson, do we have a National Policing problem when it comes to back communities . Yes, we have at least two. One that is shown in an interview, almost anyone in black communities or underserved communities, broadly these are black and brown communities, any poor community, that say they dont trust the police. The police dont treat them equally. They dont share their values. Thats one of it. The other part is, i cant tell
you how big that problem is, because we have no National Data on police stops, police use of force, or any kind of Police Behavior on the street. So, we have two problems. One, we know we have a problem. Two, we cant prove it with the data which means we dont know how to go about solving the problem as directly as possible. And the same question to you, do we have a National Policing problem . If so, is there anything at this moment, this Michael Brown case can do or has done to change it origin to change it . Well, the possibility of this case changing what is definitely a National Problem is really in our collective hands. Theres no question, you know, phil is an expert on this question of data and the absence of it, but if you look at the way in which the general public denies the constant web of forces that africanamericans face around structural discrimination, whether its by the police in in type of a case, whether its the use of
revenuegenerating fines to control poor people, whether its stop and frisk in new york and other similar policies that have effectively criminalized a whole community, these are systematic, structural issues that need our serious attention and data. about possible federal charges for officer Darren Wilson. The federal inquiry has been independent of the local one from the start and remains so. Now even at this mature stage of the investigation, we have we have avoided prejudging any of the evidence. Although federal civil rights law imposes a high legal bar in these types of cases, we have resist the forming premature conclusions. Seema is a legal contributor to arise news. Lets talk about the possibilities of a federal probe. It doesnt happen very often, but it has happened in cases where a Police Officer was either not indicted or not convicted, right, in a case like this . Thats absolutely correct. In this case the federal investigation has been going on for quite a while soon after Michael Browns death. That continues to go on. It has been reported the feds do not think they are going to be successful in their criminal
federal investigation. However, there is another action, a prooilt action the family could pursue. Thats a federal civil action. Well, explain what what would federal civil rights charges entail and what is the bar . How high is it . Its impossibly high. That is the problem. There is this this willful, intentional deputy ra vags of Michael BrownsConstitutional Rights that the officer would have had to engage in. That is very difficult to say that at the moment in time when bchael brown and officer wilson nging this up. Ere is a parallel investigation going on by the feds into Ferguson Police as a whole. So, number one, you have the training, right . Because theyre looking at the pattern and the conduct. Thats number one. Number two, and this is very important, joy, they are going to be looking at the statute,
the jury instruction given, that justified officer wilsons actions. This is important because in 1985, tennessee versus garner, the Supreme Court ruled that in order to justify certain deadly force, the Police Officer had to have probable cause. That the perpetrator was dangerous. Missouri is still using their old law, which doesnt say probable cause. It just says maybe the person is dangerous. Do you see that huge difference . This is a frightening nightmare for every parent or guardian of black and brown children and another setback for race relations. What does it mean for elected representatives in congress to feel that despondent about the state of black men citizenship in this country . Like when charles diggs, the congressmen, went to mississippi to look into emmit tills death and he was referred to the n word congressman. We understand the presence of political power, you know, given the representation of black people at the highest level of government now in the white house is insufficient to ceasing this state of affairs. It has managed to continue unabated in our history. It means we exist on many of the same circumstances we already have. Michael, down to the shirt youre wearing that says unapologetically black. One thing i love about your writing is you try assert and salvage a sense of black male per sonhood despite everything from the Trayvon Martin case to this. How do you continue to do that and salvage that sense of citizenship in a situation like this . Well, i do it because i have no other choice. My survival depends on it. Our survival depends on it. We are constantly asserting ourselves and we are finding ourselves constantly back in the situation. The point is to reach the people that are not hearing us, to make them really uncomfortable with this with the situation and make it untenable for them as well. And i think that thats the point of all of the demonstrations. Thats the point of the protests and the organizing thats happening on the ground, is to make people the people in these privileged and powerful positions uncomfortable with all of the death that we are facing,
the terrorization we are facing as a community so that they understand and feel where were coming from so theyre moved to action in the same way we have been. I mean, that message is being sent loud and clear. Not only from the cbc but president of the Theological Seminary in new york city wrote a striking piece in time talking about this grand jury decision saying in part, the state sanctioned violence perpetrated against colored men in this country is sadistic and its the myriad privilege attached to whiteness. That kind of in your face presentation, sometimes is a conversationstopper. For a lot of americans they dont recognize that reality of america and are offended at america being portrayed this way. How does this conversation even happen . This is simply exaugs and
fatigue. People have become too frustrated and tired of nuance. Weve seen this how many times . We could start naming people, you know, like John Crawford and ford and oscar grant and mcbride and, you know, just a litany of people. At what point do you just state something for what it is . I teach africanamerican history and theres a way of looking at the history of black people in this country as a multicentury attempt to have our fundamental humanity recognized. As a human being, what would you do in this circumstance . How would you respond to event after event after event in which theyre always convenient extenuating circumstances in which the black person whos deceased has somehow done something to bring about their own death . Even the characterizations of a demon and the things we heard. Michael, theres this

It shows an illustration of mike brown Walking Around with an illustration of Trayvon Martin. We were supposed to deal with this on a National Level in the Trayvon Martin instance and we have not. What does that mean for this country that we have not dealt with it . We have this conversation over and over again. People come to the conversation with a sort of amnesia and forget we had it before, also the parameters of the conversation are so narrowly defined as to define racism as a personal hatred towards black people. Were not then dealing with the systematic ideas that uphold racism and White Supremacy in this country and then lead to a death of Trayvon Martin or mcbride, on and on and on. What we havent dealt we
refuse to deal with it is the idea the fact the foundation of this country is racism and White Supremacy. And we are all of our institutions uphold that. Depressing and yet its really actually a hopeful sign that the two of you are out there among so many people trying to keep this going, and keep peoples spirits going in this situation.
