This is one of those days when it feels like all of washington is on egg shells and somethings about to crack and fail. But in the middle of all that, i would like to pile on something new because we have a bit of a scoop tonight. This is dana bente. He first became a public official of National Interest when President Trump fired sally yates. She was the acting attorney general. She was fired after she told the white house she believed the muslim ban was likely unconstitutional. Thats the reason she was fired. But we soon learned that while she had been acting attorney general, she had personally gone to the white house to give a warning about mike flynn and his communications with the russian government which he ehad been lying about. And this all happened at the very start of the trump aed ministration. Trump got sworn in friday the 20th. Flynn was interviewed the following tuesday. On thursday, sally yates was giving the warning. Then she got called back the next day to discuss that warning further. Friday the 27th. Then there was the weekend and monday she was fired, january 30th. The whole first 10 days of the Trump Administration. She was out. She was fired, even before flynn was. One of the enduring mysteries about the russia investigation and this president and this white house is that even after these totally unprecedented warnings from the Justice Department with the acting attorney general coming in person to deliver the unprecedented warning about being compromised by a foreign power and even after that warning and subsequent warnings that day, they kept that guy on for another 18 days. They didnt fire flynn until midfebruary. An enduring mystery that has yet to be explained. A few weeks after they finally did fire flynn in may 2017 we found out that the white house had way more warning than just the heads up they got in person from sally yates. This is where we first learned that federal prosecutors, in fact a veteran espionage prosecutor was actively pursuing a criminal investigation with a grand jury and subpoenas and the wholetia bang. It demands all records, bank records and other documents related to work with flynn and the flynn intel group, his business. The supoona are eviewed by the times was quote signed by the u. S. Attorney for the Eastern District of virginia. All right. Soethis revelation back in may was stunning at the time for a few reasons. One, president s National Security advisor was boo eing investiga being led by grand jury led by espionage prosecutor. Second, they knew that during the transition and mihired him anyway. And the federal prosecutor whose office convened that grand jury, the guy signing the subpoenas was dana boente. The same guy trump had made the acting attorney general of the United States after firing sally yates. And hooewent through a whole string of the highest jobs in the Trump Administration and its important now to recognize that every step of the way he had a key role in the russia investigation. I mean the first thing unusual about the way trump treated dana boente is that he kept him on as the u. S. Attorney general when he fired all the other attorney generals. We now learn that he was over seei seeing an investigation over michael flynn. And not just into flynn but into Paul Manafort. Trump did fire all the u. S. Attorneys last march. Boente was one of the only oneses he kept can on. And we later learned his office was leading the investigation. Then trump makes him acting attorney general. Then he became responsible for all the various threats of the russia investigation, beyond all the parts he ehad personally been helming in virginia. That lasts until Jeff Sessions comes on. Jeff sessions comes on. Boente gets another plum job, acting Deputy Attorney general. And for a few weeks was no longer responsible for over seaing the russia investigation. But only until sessions had to recuse himself. Then he was back over seeing all the parts of the russia investigation wunlsonce again. In that capacity, we now know he signed off on the fisa warrant against carter page. And then even after he got moved out of that job, after Rod Rosenstein took over, boente was still instrumental to the russia investigation because trump then gave boente another awesome job. And we learned just last week that in that capacity boente personally signed off on some of the criminal charges brought against Paul Manafort when he was first indicted. So boente, not the most memorable looking guy in the world. Hes everywhere. Or maybe hes the forest gump. Choose your movie. But he really has played a key role and at times the key top supervisory role in the russia investigation all the way back to the beginning. And ill tell you at a personal level, i remain convinced theres some interesting storay to tell about why boente got fired. Right when manafort got fired for the first time, he was abruptly told to resign. He held those jobs that same time. They bruptly told him to resign. I believe there is a story to tell there and some day we will tell it, mark my words. But boente ultimately got a soft landing. Then the fbi hired him on as their general counsel, which is where he works now. And arguably means he still has an Important Role to play in the russia investigation. As fbi increasingly comes under attack. So dana boente is the man in the middle from the very beginning here. Hes right at the heart of all of this. And heres what we figured out. Heres our little scoop. We have obtained some documents that have not previously been seen or reported on. We have authenticated them to the best of your ability and what we believe they show is a few important things about boente and the russia investigation. First, we can report exclusively ethat he has been asked to be interviewed in the russia investigation. We know that because of this letter, which we have obtained. Its dated january 2nd, 2018. Its from dana boente while he was still acting head at the Justice Department. To another Justice Department official notifying doj this eare equest has come in. Its addressed to scott schools. Hes the senior most careered attorney at the Justice Department. Special counsel robert muraler has asked to interview me as part of the investigation to interfere in the 2016 election. I do not submit, special counsel mueller ewould have the ability to subpoena. I served as acting attorney general you see it says february 2011. You think he means 2017 but that typo is unexplained in terms of the letter. And as head of the National Security division from april to the present and writing january of this year. As the acting Deputy Attorney general, i was responsible for the Overall Department of justice. And i was also responsible for the investigation of the russian governments interference in the 2016 eelection. This concerns activities in the bounds and scope of my duties in the department of justice. I have no reason to believe im a subject of target of the investigation. So dana boente is not a subject or a target. That means hes a witness for the investigation. That means hes notifying the senior career in justice that hes been called in to give witness testimony from muellerer and he closes this letterer by asking for legal representation. He says quote i am requesting representation or a commitment for the reimbursement of legal fooes. So egigive me ep a a lawyer provide me with legal fees. And we havent confirmed boente actually did a interview with the mueller team. But this letter indicates dana boente has been asked to do so. Whos now the general counsel of the fbi. And now hes where it gets good. We have also obtained this document from another senior Justice Department official. This time the head of the Counterintelligence Division of the fbi. And its an unusual thing. You can can csee this letter isd two weeks after he was notified the Justice Department wanted to talk to him and its essentially a certification for boente that a certain set oof notes that he took, hand written notes that were marked by a Justice Department employee as top secret, those are not actually top secret at all. Check it out. Quote dear mr. Boente and then you see the you. I think that means this is unclassified. This letterer serves as conformation under my authority as an fbi official excuse me fbi original classification authority, that your hand written notes from your conversation with former director comey are unclassified. Understanding they were marked as top secret without your consultation, this letter memorializes a dually authorized finding that contents of your note are not top secret or classified lat. Youre getting the importance here. That very start of january, boente asks for legal representation or a commitment to pay legal fees. Couple of weeks later, he gets a certification that his notes, hand written notes from specific conversation with james comey should not be marked top secret. Now we dont know for sure because these are theve got. What we surmise is that hes getting his ducks in a row while preparing for his interview with muellerer or preparing to hand over those notes to muellerer as part of this interview. We have also obtained those handwritten notes from dana boente from james comey while he was fbi director. Specifically in which comey says he was pressured by the president about the russia investigation. This is key to the question of whether or not the president may be criminally liable to obstruction of justice. Comey said that the president had pressured him in a phone call of march 30th of last year. H quote immediate laeafter that conversation i called acting Deputy Attorney general, boente to report the substance of the call from the president. This is a key matter. Comey says the president pressured him. The white house responded by saying the president did no such thing. Comey says i have cooperating evidence and thats that i told other senior Justice Department and fbi officials about what happened between me and the president about what happened at the time it happened. Since that time. Comey and his subjects have been fired. Attacked for almost a year. Also deputy fbi directorer mccabe fired and attacked in much the same way. Mccabe says its because he can corroborate comeys testimony from his interactions at the time. And yeah, he did end up getting pushed out of the Justice Department by mysterious circumstances but hes at the fbi now as their general counsel and we have obtained what we believe are boentes notes from the troubling time with comey and those notes do corroborate in striking terms impactly what cocomey says happened. And for this second to last one, lets go back to the Comey Exchange with feinstein. There will boo eea little overlap but watch this until the end. Part of the obstruction of justice concern here is that the president shouldnt have been calling comey anyway, shouldnt have been making a direct call about an ongoing investigation. The president shouldnt be having soloo one on one about the russia investigation. He explained that according to the rules he shouldnt be talking to the president about this alone at all. Did you goeto anyone at the department of justs and ask them to call the White House Counsels Office and explain that the president had to have a far better understanding and appreciation of his role, visa vee the fbi . I spoke to the attorney general and the new attorney general, rosenstein when he took office about my concern about the way the president is interacting. And as i said in my testimony, i told the attorney general it cant happen that you get kicked out of the room and he talks to me. Told the attorney general it cant happen and i cant be having these conversations with the president alone. He says he threat Justice Department know, the attorney general know it cant be the attorney general gets kicked out and the president talks to the fbi directorer alone. Thats what comey says to congress about what his conversations were like on this subject. Well, turns out the notes we have obtained indicate he told boente the same thing. I cannot be speaking with the president alone. So the fbi director james come a etold congress about his basically strange interactions with the president on the russia investigation. He says he had these interactions about the russia investigation that were strange and then the president fired him. Frrsh the president later told visiting russian officials and lester holt that firing of james comey did have to do with the russia investigation. The president yesterday made public claims that firing come a ewas the right thing to do. He ehas spent the last year saying hes somebody who lied publicly before he was fired by the president. Well, these notes, which we believe are dana boentes first hand written notes from his conversation with comey after the march 30th call, this is the first contemporaneous evidence weve seen about what jamess comey told other officials that time about the president s behavior and as best we ecan tell, it matches the statements about the president s behavior. So even if this is the firing itself, previous meetings and contacts between the president the person he fired, leading up to the firing end up being legally important because they go 92 why and whether or not. One is a bad act, which would be firing comey and then you need mental element, which is what was in the persons mind and so that intent we have lautsz of different pieces of evidence. Comey has contemporaneous notes. It would be and so ewe know in terms oof evidence of what happened between comey and the president , understanding why you just said that would be umpoimportant for criminal case. We know comey said he took notes and those memos were shared with other people and we believe the mueller investigation. We know, at least isin the case appears to have orally briefed in that moment and they took notes. Im getting pretgy at reading boentes handwriting. It seems detailed including quotes. Does the weight of them, the number of them matter . You cant really carbon date from a year ago. But you look at the notes. Its not just a sliver or a cut out. You see the notes were taken over time and youd ask a jury to look that and realize those were over a series of weeks that it looks like theyre in the flow of a narrative. And its not like it was a perfect science about thus. But when you line up notes together and you show that theyre contemporaneous, thats arer a way they do it. For this ubstreobstruction case theyre so consistent with what comey said. I want to go back to valentines day where there was a conversation between trump and komy where he says to comey flynn is a good guy. Flynn had just been fired. Immediate lae. And on february 14th goes to comey and said flynn is a good guy. How about letting him go. Thats a more direct intervention. Thats more than saying can can you lift a cloud . I dont think iyou can base an obstruction case on lifting a cloud. But ifuts a its part of a chai vents, thats trump getting into this investigation trying to obstruct thissings have. And if you remember this tweet that trump wrote, that hooesaid whereby wrote that tweet. This is december 3rd of the past year. John dowd may have been he said i wrote that tweet. The tweet said i had to fire flynn because he lied to the fbi. Because he lied to the fbi. Thats not what trump claimed before. Its not a crime to tlie vice president. Dana boente has been an unusually large number of different Law Enforcement positions that had an importa importaImportant Role in that investigation. They were pursuing grand jury interviews into flynn and manafort. As acting attorney general, after Jeff Sessions was rekwcus, heall soeover saw the investigation and signed off on charges against manafort and as general counsel, hes in an unusual position facing attacks from the president. Were reporting tonight that boente has been summend to give an interview ass a witness to the mueller investigation. As a prosecutor, before you embark on interviews of people who corroborate james comey, you have to ask lets assume everything james comey said was true, does that constitute evidence of obstruction of justice . And i agree that the suggestion or the dictate from the president that comey drop the flynn case is the single most significant action that the president asked for. But if your answer is no, then you dont do those interviews. But if your answerer is if we can accept or prove what comey said was true, that would constitute obstruction of justice, then you go through these interviews. So i think its significant that not only dana boente and mccabe and others are being brought before the special counsel and each of these witnesses has been the subject of either firing or disciplinary action or attack by the president or his allies. So you look at baker, who was the prior general counsel for comey, has been the subject of attack. Come ay of course has been fire and been the subject of attack. Boente and mccabe was fired. So all of those witnesses who corroborate james comey are in a position to do so have been the subject of efforts to undermine them and i dont think thats a coincidence. Let me ask you about that when it comes specifically to boen boente. It may be innocent, have nothing to do with the overall russia scandal. But it remain as strange story to me that boente was are removed from the Justice Department. The reporting is that although he resigned was directed that he should resign both as inNational Security division and u. S. Attorney generals office. Part of the reason we were able to report that out is because boente had told people just a few days before the resignation he was looking forward to running the u. S. Attorneys office full time. That happened around the time manafort was indicted for the first time. Do you know anything, as the top democrat about why boente was fired, who fired him or whether it was related to this scandal . I dont know the answerer to that and the only thing that occurs to me is if there was some issue with boente that could give the president or any of his people cause to have an issue with him, you would think it would be unlikely he would be brought in as general counsel for the fbi. So i dont know the reason why he was fired from those two positions or forced to resign from them but given that he was taken on by directorer ray, im sure is trying to dot every i and cross every t that may be unlikely to happen if he was pushed out because of his handling of the manafort case.
