Is timid. Thats not who we are. Is that Group Therapy or something . A day after the Senate Torture report was released the response has been stunning, the incredible outpouring of controversy in the light of this report has sparked outrage on either side. Some have contended on the one hand that americans should not have released this report because it makes more vulnerable the people who were left behind, the people who were in the face of torture now facing contradictions to the american government. On one hand say were not commit the to these practices and releasing this repeat make the enemies of america wrachet uch. On the other hand some contend this is the right thing to do. They think americans deserve to know the law was broken and on the flip side you have people who think this report should never have been released. This camp put navgs security and lives at risk because we know torture took place. Carl rove had no problem leading that charge last night. It kept america safe at a time when our country was at great risk. Just take one example, you had senator graham who said what happened was we kept them long term and we began to talk to us, only when we broke their spirit, it was these techniques where they began to corporate. In 2001 lead us to ksm. The Senate Report directly contradicts his statement. Fox news had no problem questioning if the report was even truthful. The players who are the ones responsible for this program were not not any of them interviewed by the committee. This is based entirely on documents acquired by the committee. They say, they are fond of saying, Diane Fienstein and oranges are fond of saying we couldnt interview those people because they were under the department of investigation. That was two years ago they could have interviewed the players in the last two years. And mark said to me, look, why dont we cry when Rolling Stone did it, that is a report that comes out without ever consulting the people who are accused. I dont think it is fair to compare Rolling Stones errors to the Senate Intelligence committee report. Theres a reason they werent interviewed. Then theres this bizarre comparison. Under president obama and his Drone Program we have death hol of 2400 and pakistan alone between 450 and 900 civilians, can you explain how the Drone Program under obama is not far more morally problematic than enhanced interrogation. And what do you make of Diane Fiensteins silence on that issue in comparison . Yeah, its a very interesting because you know, this administration actually does not take any prisoners. They prefer to kill them from afar using drones. Ill give you a chase. Get waterboarded or killed with a drone strike. I think i will take waterboarding. First off, torture is illegal, been outlawed by the geneva convention. President obama has kept Many Americans out of way by using drones. To draw a strict ethical relationship between drone strikes and torture is questionable at best. According to the Pakistan Government over 2,000 militants have been killed with 67 casualties. Drone strikes are completely different from torture. Meanwhile director hayden who over saw the program had this to say earlier today. Put the two deaths aside. They have been investigated twice by career prosecutors and theres not been a decision to prosecute and they were not part of this program. Deeply regrettable, different circumstances, but well put that aside. Lets get to the program were talking about, the one we went to president bush for permission to perform late 2002 with abbottab abbottabad. We thought we were doing the nations will. In fact having lived through the period and even looking back on it now, i think this was indeed about the nations will. And what you got here is a small group trying to say, oh, it was never about us. Its not us, its not us. Its its them. They did it. Frankly, that really is hypocritical. Sure some americans think torture was the right thing to do but to say you were doing the nations will is quite a bold statement. Then we have Mitch Mcconnell who thinks this is all about snubing george w. Bush, he said it served absolutely no purpose other than one last numb in the eye of the Bush Administration. Many people would disagee with mcconnell including president obama. I dont think there was ever going to be a perfect time to release this report. But my position consistently was that after having conducting this report it was important it go ahead and release it. One thing that sets us apart from other countries is when we make mistakes we admit them. President obama is right. The first step to restoring globals reputation is admitting we were wrong and this report is a huge part of 245. We have to confront these issues head on. The president is not putting his head in the stand but standing forth right, moving forward and to tell the truth where we are now in order to restore your reputation and move forward. I will bring in now retired ambassador joe wilson, why is releasing this report so important right now . Well, i think it goes to the core of our values as a nation and as a people. The use of torture has been basically outlawed since George Washington refused to torture german mercenaries he captured. It was subject of a letter Thomas Jefferson wrote and is the subject of discussion in the drafting of the bill of rights. General was cashiered for waterboarding in the philippines and after the second world war, japanese war criminals were convicted of waterboarding, which was consider the torture then. We are indeed authors of the Human Rights Convention so the history is quite clear on this. What stands us apart from third worth dictatorships is the fact that we dont do this and if we do do it we admit it and correct the errors. What about people saying, yeah, by correcting the errors we make, a, more vulnerable to american sicitizens around the world and leads us more vulnerable to attacks. Certainly what we were doing was immoral and probably illegal but thats the terrorists hate us anyway. I would remind you right after the attacks on the world trade center, the entire world was united with us against this brand of terrorism. Look at our standing in the world now. Thats not because of the release of the report. Thats a consequence of what the Bush Administration and the cia leadership and the Justice Department authorization led us to over the past decade. Sure. You are former ambassador, in your travels around the world, you got a sense of what america is viewed like by others. How do you think the rest of the world is viewing this country right now . Oh, i think its a huge disappointment for the man on the street around the world for whom the United States has been an aspiration and inspiration for as long as i have been serving this country which is over 30 years. And the one enduring quality of the United States to most people that ive ever come into contact with is our freedom and the fact that we treat human beings with dignity. Rectal feeding is not a modicum of dignity. The president said this is the first step of globalization do you agree. I take the point those who were not interviewed should ought to be interviewed. I think they should. The republicans are taking over the senate and house. I think they should invite them all up there to give their side of the story. My own experience with the betrayal of my wifes identity as covert cia operative is we had to take dick cheney and others to the Supreme Court and even then couldnt get them to tell the truth. Right. Theyre slippery. Certainly. Given the fact that both sides are at such odds here, how do we begin to repair this mess and restore our reputation but get us on the right path where were treating people with Human Dignity as we pursue the procedures to secure our safety from terrorists. Well, i think first of all, this is an issue we need to address as americans. Would be nice to address it in a bipartisan fashion but that clearly is not going to happen. But i do think this goes to the core of what we are as a nation and the republicans who are whoo whining about how the information was cherrypicked and the guy who about wrote it at the Justice Department, they should be called up to give their side of the story so we can find out what a baseline truth is and secondly i think we have to take corrective actions to ensure these sort of abominations dont occur in the future. What is your reaction to hayden saying he was doing the nations will. He might well have thought that. I would argue as a general officer and director of cia he takes an oath to uphold the constitution against all enemies foreign and domestic and when you violate some of the basic tef tenants, that makes america what it has been over the past 200 years, you have failed in that obligation. Thanks very much much for your time tonight. Coming up the new code of conduct and what it means for the future of the game. Plus Rapid Response weighs in. Sweeping changes to the leagues personal conduct policy. Roger goodell rolls out new rules for nfl players. The new policy is expected to put players accused of Domestic Violence on immediate paid leave while investigation takes place. The new policy essentially removes the commissioner from the initial disciplinary proceedings. I dont know what my legacy will be and im not concerned about it. Hes about to put in place one of the toughest personal conduct policies for domestic vial nesn corporate america. What im concerned about is doing the right thing. Joining me now journalism professor and sports columnist. What do these new rules mean for the players themselves. What this means, michael, is that this is absolutely ridiculous. Okay. It is also absolutely predictable. Ill start with the predictable part. The nfl owners are pulling that old thing, stand by your man, and they should. Because this is a guy which is the may have been reason the average nfl franchise is worth 1. 4 billion. This is ridiculous because this actually changes nothing. You still have a situation where at the very end of all these situations, the person who will decide, the final decider will be Roger Goodell. Just because you will have this counsel in the beginning deciding what the discipline will be, that zp tdoesnt reall mean anything. The other thing for them to come out and say were now going to be more actively involved in the judicial system, they are already doing that. In atlanta, georgia, you have the head of security for atlanta falcons, hes a former secret service agent. So this means nothing. Let me ask you something. Last time we were on together you talked about how the fan base here is predominantly white while the players are overwhelming black and you thought he was trying to appease the white fan base by containing the threat. What kind of policy would you see implemented if you could. The thing that needs to happen is, its okay for the commissioner to have power, the commissioner just has to be consistent. This all goes back to ray rice and Everybody Knows that. He blew it with ray rice. If he gets ray rice in the beginning we are not even down this road. The incident happened in february with ray rice and his fiance who is now his wife and after february he meets with the commissioner in june and tells him everything that happened and we know that because the arbitrator came out and said basically that was the truth so what Roger Goodell did from that point on, he started to panic when Public Opinion started to turn against him. Lets listen to Roger Goodell giving a press conference right now. Brings Law Enforcement back ground that can help us navigate through all of the issues that they have to navigate through a legal standpoint and otherwise to collect all the information, make sure the record is clear and make sure to share it with everybody and make a decision with input from whoever they feel is appropriate. Do you anticipate a challenge from the union and do you feel the League Stands strong in terms of skrunitty of nlrv or any otherentity. I can let jeff answer that. I think what was laid out today is entirely consistent with the collective Bargaining Agreement and i dont know whether the union will challenge it or not but weve given it a lot of thought. I hope they dont challenge it because it is a policy that is a benefit to the players and the entire league. We have repeatedly colorasolici their input and we have had numerous conversation about it. I dont think theres any need for legal challenges. And some would question whether hiring this outside person is this the league doing the hiring . How do you aebs that . How do you answer that . Well we are happy to get input. Would be happy if dolores would like to discuss the types of people who are open to that. Were happy to have more dialogue and see what we can do to improve the policy. We would welcome that from the nfl p aor in any source who makes sure we have the best policy. We have a conduct committee now that is overseeing this. One of the roles that is important there is to make sure they continually evaluate that and determine if theres any changes that need to be made, anything that would keep us from being consistent with bepractic and that is something we will take very seriously going forward. In anyway do you look at it all right, terrence, lets pull away from there. You know the commissioner is saying, look, this is what were going to do then i think it was jeff who said, look, were not going to the legal counsel, we didnt consult with the Players Union and smith but we think it goes well with the collective Bargaining Agreement. Why not simply bring mr. Smith in and work it out together to craft a document that would be accept able to the players with no further controversy. That would make too much sense. You cant take the players out of this either. They are also at fault. In 2011 they in the collective bargaining session allowed this to happen. They gave the commissioner the power he has now which is basically the junk a which is basically the judge and the jury in the situation. There was a great article in the u. S. A. Today that was interviewing various nfl agents who were talking about when their clients got in trouble they would go into the commissioner ae Commissioners Office and listen to information and the office would present stuff that even the agent didnt know his client did. So to act like it is out of the Clear Blue Sky is a fabrication. Do you think it repairs the leagues reputation with woman. You see men who cant say anything, they are inarticulate in the face of enormity of the threat of Domestic Violence. Weigh in there. For some who are gullible, perhaps. The bottom line, michael, this has to be said, as far as fans are concerned, this is not going to mean that much. People are still going to go to nfl games and watch nfl games on television. Were seeing all of that taking place. On the other hand, they are doing at least a decent job of pr here. When you just give the impress that you care just a little bit thats not necessarily a bad thing. Let me ask you this. There are many womans groups that are certainly conscious of the fact that they dont want to make the poster boys for all the ills of Society Black men but at the same sometime to hold people accountable for their behavior. How do we talk about that without playing into the stereo types that prevail. Lets do both. No question about that. We were just talking about it a few minutes ago about the commercials with various players come out saying no more and what have you it would be better if people would become more sincere in this effort. I think is interesting this committee that is overseeing this conduct policy includes two former players, one of which is warren dunn, i have a lot of respect for him, he played for the atlanta falcons. So if you can get other players like him to be the face of this and look sincere and talk sincere and be sincere than that could help out quite a bit. Thank you so much for joining us tonight. My pleas to the president have been interpreted as critical of the president , not so, i was twice a supporter of the president as a surrogate i leave in him. But he has to speak intelligently about the problems that exist then those of us in communities who are teachers and preachers and doctors and parents much speak to our communilityis and our children to remove the vicious prejudice that is it will and institutionally we must side with those who are victims of Police Brutality and the like in institutions so it is not just personal but collective as well. Kobe bryant wearing a i cant breath tshirt. On saturday the weeks events will cull minute ate in washington, d. C. , thousands are expected to march on the capitol with the families of killed unarmed black civilians. President obama stressed the necessity of protests. As long as theyre peaceful i think theyre necessary. The old addage power concedes nothing without a fight, i think thats true, but whats also true a countrys conscious sometimes have to be triggered by inconvenience. Thats a quote from Frederick Douglas who made a statement about power preceding nothing without a demand the question remains to what end. Marching is not translating into legislative change. The new york state attorngenera. Whats next. Whats the solution look like for a National Wounded humanity . Thank you for our guests joining us now. Thanks both of you for coming on. Thank you. Professor, president obama said hearts and minds will catch up to legislation. What legislation needs to be in take to tackle this racial injustice. I think the first step is questions about Police Accountability and the grand jury purpose and its indictment powers. More importantly i think these protests have really looked at structure and institutions. As long as we have economic oppression in communities, no one thing will do it. It is about communities that are incredible vulnerable and have been left behind. Absolutely right. There are interlocking impressions that Police Brutality touches often other forms of racism that is devastating to these communities, solidarity with the lakers wearing the i cant breath tshirts last night, what do you think they can do for change. I just really want to shout out the young people from ferguson and all around this country who are forcing the discussion outside of the realms of reform and talking about systemic change and talking about a system of white spr supremacy which dominates every institution, including pleasio e policeing. These young folks know were in a movement. Theyre trying to talk about how we depolice our communities. Im hearing young people have conversation about why are the police in our Community Ticketing us for crimes that they would never be in White Communities doing that. How do we decriminalize things. How do we talk about the police as an Occupying Force in our communities because if we look within the well many of human rights within the realm of human rights, then we understand this is a human rights violation that is specifically targeting and attacking predominantly young africanamerican and latino young people all over this country regardless of gender or social economic sta s status. In light of that, what solutions are you hearing from your students that can address those systemic changes that need to be brought into bear. I first thing my students have done beautifully is they have resisted the narrative that one person is more valuable then another. Black lives matter. Regardless which community you come from, you have the right to be respected and valued. But deeper, i think the students are saying if we have access to these systems and that privilege through an education how do we make sure the communities have the tools and resources they can organize. I have seen an incredible outreach with students going around the country saying how do we support the community lid from within. They are feeling empoured within them. The kind of political geography, the what is the next institution that needs to be isolated and challenged. The economy. Capitalism, i think that is the institution all over this country. It is really the oppressive force. And the police in my opinion, we have a lot of theory that proves this, are that force that are keeping us as particularly working class people from achieving this idea of, you know, economic justice. Economic justice is not devoid from Racial Justice just like its not devoid of gender justice. I think what the sister before me was just speaking about, im also in the classroom at California State University los angeles and my students are having those conversations, these are working class students, going to School Full Time working two jobs and continually being harassed by the police at many different levels. So i think what these young people are talking about, is now, as we are talking about policeing how are we talking again about the system, particularly the Economic System that really from birth determines how were going to be looked on. Absolutely. Professor so how will this moment be remember in history. You are one of the leading historians of your generation, what is going to be the long view looking ahead. I think looking ahead we will see an incredible ground swell of people recognizing the role of young women in leading this movement and being the power house behind this movement in previous movements have erased women from it. But another thing that has come out of in moment is an incredible critique of capitalism that it isnt just Police Brutality but the way people are forced to live. I cant wait to write this story. More than 2 dozen hearings but not one, not one has helped to implement the aca more effectively or efficiently. Unfortunately this hearing is no different. As far as i can tell, we are here today to beat up on jonathan gruber. For stupid. I mean, absolutely stupid comments he made over the past few years. This will not help americans get Health Insurance. House Oversight Committee spent time grilling gruber. He apologized for saying the passage of obamacare relied on the stupidity of the american voter. Lawmakers from both sides of the aisle took him to task for his comments but as congressman Elijah Cummings said, this may make for good political theater but it doesnt help a Single Person get health care. All this does is overshadow the real successes of obamacare. Instead of focusing on gruber, we should be focusing on the 10. 3 Million People who gained Health Insurance in the Affordable Care acts first year. Callup estimates that 5 of americans were newly insured in 2013. Yet these oversight hearings have turned into Public Relations bonanzas. The focus should be on educating the American Public about what coverage they need and how to sign up. The acas second open Enrollment Period opened november 15th and ends february 15th. Three months shorter than last year. We have less time to get the word out. That should be the focus. Joining me now, professor at the lsu Health Sciences central. What do you want lawmakers to focus on right now . What i want them to focus on is in the seconds Enrollment Period, 100,000 people logged on to the website the first day. No matter what anyone says, republicans or democrats, we know people want this. The republicans, what theyre trying to do is to make you think that all the things that gruber said were actually correct. The democrats, what theyre trying to do is to say, look. Theyre trying to link him with king republican, mitt romney saying obviously, gruber worked with mitt romney a lot more than he worked with president obama so theyre just trying to do this political, you know, back and forth. The reality is i see patients every day that did not have health care and now they do. Thats just the bottom line. Well, look. The open enrollment ends february 15th. What during this period do you want americans to know that will facilitate more americans getting coverage . What i want them to know, no matter any smoke screen being put out there, they need to go online and register so that they can get Health Insurance. If you dont have Health Insurance, we know that the odds of you going bankrupt from any illness are exponentially increased. And people dont like to think about it like that but just breaking your leg and having a surgery can brumt you. Thats what obamacare was put into place for any way. To stop the Insurance Companies from running peoples lives into the ground financially. So we have to remember. And also, i want them to make sure that they talk to their senators. Talk to their congressmen. Because the Supreme Court has a very serious case coming up. King versus burr well. And i think chief roberts is shaking in his boots. They will have a lot of pressure. If they try to repeal those six dis, well have a big problem in this country. President obama on the colbert report suggested that look, you can stay on your parents insurance until youre 26 years old. Thats one of the great incentives. Tell us about the challenges that remain moving forward. What we have to remember is that there are so many people saying that their Health Insurance is going up. Theyre not getting the health care that they needed and all that is is a smoke screen. The bigger challenge is to get the word out that this is working. We have to remember that there are a lot of people who are not computer savvy. If youre not computer savvy, go to one of the sites so you can link one a navigator and it will navigate with you the intricacies that you need for your particular health plan. By no means if you go online and the website is down or whatever happens, your friends call you and divert you. I dont care what it is. You need to make sure that you stay steadfast so you can meet the deadline and get covered. We know if you dont do this within the next week or so, you wont be covered by january 1st.
