The shooting death of an unarmed teenager. Last night was the fourth straight night of protests in this st. Louis suburb. Police fired tear gas and smoke bombs into the crowds after they say demonstrators threw rocks and even molotov cocktails at officers. Police were videotaped ordering protesters to keep back. Get back now. You may peacefully assemble 25 feet away. You are not peacefully assembling. You must leave or face arrest. You must leave the area immediately. For days now, police have been gathering in full riot gear. Yesterday and driving mineresistant vehicles around the suburb of 21,000 people. Security will likely be tight again today when governor jay nixon heads to ferguson later on. The governor gave this reminder to police last night. Quote, i urge Law Enforcement agencies to keep the peace and respect the rights of residents and the press during this difficult time. At one point msnbc. Coms National Reporter, trymaine lee got caught in a cloud of tear gas. He said he felt the effects even though he was further away than most of the protesters. I can barely breathe. My nose is burning, my lungs are burning. My eyes are burning. You just cant escape it. The further back you go, it still hangs in the air. It looks like the police have taken over completely at the end of the street. But again, far down the street the clouds of tear gas kind of engulfing everything. Two reporters, ryan reilly of the Huffington Post and wesley lowry were arrested. Both say the police were acting aggressively. Lets go. Im working on it. Stop videotaping, lets grab our stuff and go. I have the right to videotape you, sir . Lets go. You see me working. Please do not tell me time to go, lets go. Were down to about 45 seconds. Lets go. Reilly tweeted this picture just before he got arrested. Both reporters spoke to msnbc after their release. I said, officers, im going to need to stock my bag, give me one second at which point they said lets take him. Slammed me into the soda machine, grabbed my bag, grabbed my phone and put me in temporary restraints. I was given a countdown. I was told i had 45 seconds, 30 seconds to pack up all of my stuff and leave. At which point the officer in question who i have not who i repeatedly would ask for his name and was never or his badge number was never given it decided that he was going to help me pack. He grabbed my things, shoved them into my bag and i was then when i basically he then arrested me. As he handcuffed me, he put them on very tight. He used his finger to put a Pressure Point on my neck and it was just a very difficult experience. St. Louis alderman, antonio french, whos been live tweeting from ferguson since sunday night was also arrested last night. He was released just this morning. Joining me on the phone from ferguson is matt pierce, a National Reporter for the l. A. Times. Hes been in ferguson the past three nights and was instrumental in getting ryan reilly and Wesley Lowery released from custody. Matt, i understand you were not necessarily in the vicinity where the tear gas was, but you in fact called the police chief after wes lowery and ryan reilly, informed the police chief they were journalists to which he responded oh god. Thats right. This all started, there was a peaceful march in the afternoon that had gone down where a lot of the most the worst protests had been happening over the last few nights. So i had gone back to my car to charge my phone and, you know, just looking at twitter i saw that, you know, wes and ryan had just been arrested. I had just seen them a little while earlier. I knew if they were getting arrested, there was something probably wrong because theyre both professional, respected reporters. So i called Ferguson Police chief tom jackson, i told him that. He was just his reaction was stunned. So he told me thanks and hung up the phone. He added that, you know, they had both interviewed him earlier in the day and he had actually been impressed with their questions. And so i called him back a few minutes later and he told me that he had called into the st. Louis county police and told them to release wes and ryan and he said the person who had arrested them or the people who had arrested them was probably somebody who didnt know better. So if that was that was the sort of chain of events that apparently set off their release. Somebody who probably didnt know better, yet is still under the authority of that police chief that you called. Were seeing amazing video come in, amazing in the sense of how shocking it is of police literally taking tv cameras and pointing them down at the ground. As a journalist, what is it like reporting in ferguson right now . How hostile is the environment for journalist expressing their First Amendment rights . It goes back and forth. Ive had nights where police have refused to allow me through. They dont treat me any differently than any other demonstrator whos out in the streets. On the other hand, there are differences sometimes. Monday night was really, really hard. Last night was really hard. But tuesday night things were a little bit more peaceful. Police seemed more relaxed. We were able to get through to where demonstrators were gathering. So it really varies. And there are so Many Police Agencies involved. In fact fergusons police chief was not in charge of the officers who arrested wes and ryan. For example, they were under the command of the st. Louis county police. This is something thats unique to st. Louis. You have several, several different municipalities, several Different Police forces involved with police in these protests. Theres sort of a real ambiguity sometimes about who is in charge with these police, are there one group of officers thats more accommodating or friendlier than others. Its just really not clear. The Ferguson Police chief told me command of these officers on a nightly basis rotates every single night. So, you know, it sounds like there may not be the same people running it. So its just very its very ambiguous. That could lead to a lot of confusion. Matt pearce of the l. A. Times thanks for phoning in and your great reporting. Stay safe. Take care. Now to iraq and a piece of good news amid an otherwise daunting and dangerous situation. The u. S. Now believes that American Forces may not have to undertake an evacuation of those refugees trapped on sinjar mountain in the north. Thats because, number one, the mission to drive isis fighters away from the mountain has been successful. Paving the way for tens of thousands to get out on their own. And number two, the refugees still on the mountain are in much better condition than previously assumed. In fact, some apparently want to stay on the mountain, believing it to be safer than going elsewhere. Its welcome news for president obama, who had been grappling with the possibility of having to send more u. S. Forces to open up an escape route for those refugees or airlift them out of the area. As things stand now, there are nearly 1,000 u. S. Troops operating in iraq. Nevertheless, the Administration Says the plan is to play defense, not go on offense. I think the principle holds that were not putting Ground Forces into a combat role in iraq. Were using u. S. Military personnel to assess what the best way is to bring people to safety and to provide them with humanitarian assistance. Despite whats happening on mt. Sinjar, the broader crisis may be getting worse. On wednesday, the u. N. Declared the humanitarian situation in iraq a level three emergency. A decision that will help ramp up the delivery of aid and money to those affected. In all 1. 5 Million People have been displaced as isis insurgents swept into Northern Iraq earlier this summer. Today fighting between isis and Kurdish Forces is continuing northeast of the capital and there are also reports that isis is amassing just an hour north of baghdad. Tracy shelton is a global post Senior Correspondent who covers the middle east, including iraq and syria. She joins me by phone from the kurdish capital of erbil. Tracy, whats the latest on the ground there after a few days of u. S. Air strikes and seemingly the return of some semblance of calm . Reporter i couldnt quite hear the last part of the question . I said whats this feeling on the ground after a few days of u. S. Air strikes and a semblance of calm from reports we have in the region . Reporter oh, yes. Yeah, well, things are improving. About a week ago there was a huge panic here in erbil, even among the kurdish people, that they were going to continue pushing forward here. Now that the front lines have stopped and the Peshmerga Forces seem to be making some progress, people have become much more calm here. Of course the minority groups are still very uncertain about their future because most of them are still living as displaced families here. Even some still sleeping in the streets and in the churches here. Many of the yezidi families still have no place to go because their towns are still occupied by islamic state. But it has calmed significantly over the past few days. Thats certainly welcome news. Tracey shelton, thanks for joining us. Despite its efforts to break away from the rest of iraq, kurds now find themselves on the front lines of the effort to protect the rest of the country from the isis threat. He is working to strengthen ties here in the u. S. And thank you for joining us on the program. A modest u. S. Involvement so far in iraq. There obviously has been air support. Is the u. S. Doing enough in your opinion to help out, which throughout history has been the most loyal faction of iraq to u. S. Interests . Thank you. Look, its good to be back. The air strikes that have already taken place have certainly stopped the isis momentum in making their moves on the capital city of erbil. These air strikes in addition to what already has been taking place on the ground by the Peshmerga Forces have certainly stopped that momentum. In addition to that, weve been able to rescue these people that have been stranded on the mountain, the yezidis that left sinjar. So this air strikes these air strikes have been very effective. Although they are limited, but were grateful for what has taken place and we hope this will continue as we go forward fighting isis. The administration is putting a lot of faith that a new government, a government not of al maliki, could have seemingly the ability to unite the country, could unite shia, sunnis, kurds. Where do you feel on that . Is that a lot of faith the administration is putting into this new type of government . Well, what we have to do is we have to give some time and space to this new government, the new Prime Minister to form the government. You have a speaker from the sunni community, you have a president from the Kurdish Community and you have the new Prime Minister designate from the shiite bloc. What we have to do is give them time and space. What the previous Prime Minister had done, hijacked the community, alienated the kurds, marginalized the sunnis and made an army that was very sectarian. Thats the result of what we have seen in mosul and the advances that isis was able to make in such short notice. This has been very unfortunate that the country has been taken by the leadership in baghdad. One of the reasons why weve seen the growth of isis is because a lot of sunnis said, you know what, while isis is extreme, we feel more comfortable with them than we do the central government. What has to happen for those types of sunnis to now turn away from isis and support a centralized government . Similar things will have to happen. If you recall back in 2007 and 2008 when there was a surge of u. S. Military personnel on the ground and you brought general petraeus who took the lead, the sunnis were brought in the government, put on the payroll, given government jobs and they werent marginalized or overlooked. Similar things will have to happen pby the leadership in baghdad. What is isis today . Isis consists of the extremist elements coming from abroad, from within syria, and now baathists and the sunni tribesmen have also joined them. This has gained a lot of momentum within isis. That has to have a government has to be inclusive of all the communities and all other minorities. And lastly, quickly, obviously the kurds have taken a lot of New Territory during this conflict. The town of mosul. Theres a lot of talk about saying you know what, the kurds we can never really get a fair shake from the centralized government. How hard do you think it will be for kurdistan to remain a part of the unified iraq, especially after all the New Territory they took in the last conflict . Well, whats haptd pened is n we saw mosul collapse, the peshmerga moved to other areas making sure the minorities and others were protected. It was also a call by the governors of kirkuk and others calling for reinforcements because what we saw in mosul, the Security Forces melted away within a matter of hours and that was frightening for all the communities in the area. As far as the Peshmerga Forces being trusted, they are trusted, they are loyal, they are veterans and experienced and professionally organized so they are determined to carry this fight hopefully with the support of the u. S. And other partners in europe. It will be something to keep an eye on. Thank you for joining us. We appreciate it. With me now is former pennsylvania congressman, iraq war veteran and msnbc contributor Patrick Murphy. Thanks for being on the show. Congressman murphy, id like to ask you, there is a lot of criticism coming at the administration saying we support these air strikes but this is not enough, there should be more. We should have a crippling blow against isis right now while we have the opportunity. Where do you fall on that . Is this too defensive . Should the u. S. Be more on the offensive here while isis is to some degree on the run right now . I think, luke, the end game is a political solution. As you mentioned earlier with the representative from the kurdish area, you have the sunnis that were disenfranchised under maliki. They are not believing they are represented in baghdad. So the political pressure that weve put on really has marginalized maliki. His own party has stepped away, the shialed majority has stepped away and they should have a new government that will not be led by maliki, so thats the number one major thing. Youre seeing now moderate sunnis step up and see how extreme isis is. So just like what happened in the surge where al qaeda, which is an extreme sunni organization, was marginalized, youre going to see hopefully the same thing with isis. That does not mean, though, luke that we need boots on the ground. These air strikes against isis, Artillery Weapons are very effective. It stopped them from going into baghdad. It just stopped them from going into erbil and it protected our american interest, our boots our military advisers and our consulate personnel in erbil within the last several days. Are you confident after the iraqi military, which we supposedly funded and trained, was overrun by isis that somehow if a new government comes in they will now be able to fight back against that threat . It seems like the administration is putting a lot of faith that a new Prime Minister will somehow reverse all these terrible things that have occurred. Where do you think is the real the rationale for that, especially in a military sense . Well, the rationale, luke, is that its up to the iraqis to stand up for their own country and its up to the kurdish population, which is sunni, to make sure they understand that they now have a voice, a representative voice in baghdad. That didnt happen in the last year. They were marginalized, luke. If you look at whats in a soldiers heart, thats the most important motivating factor of why they pick up a rifle and fight. That is huge. And i will say when you look at the american politics behind this, thats the right move. The American Population is war weary. You know that, i know that, Everybody Knows that. But youre seeing frankly the ted cruz wing of the Republican Party pushing for boots on the ground. Where that makes a difference is in places like iowa, where you have joni ernst against bruce braley. Thats doubling down on the very right wing of the ted cruz wing of the party. And i dont think thats that dog wont hunt in iowa, i can tell you that. Thats the one thing interestingly enough that ive seen covering different congressional districts around the country, republican or democratic, nobody wants more boots on the ground. According to the white house, a good time was had by all. They even danced and had surf and turf. On wednesday at a book signing at marthas vineyard, clinton tried to downplay any supposed tensions. No. We agreed, we are committed to the values and the interests of the security of our country together. The latest episode in the familiar team of rivals soap opera began five days ago when clinton pointily distanced herself saying great nations need organizing principles and dont do stupid stuff is not an organizing principle. Former obama adviser David Axelrod fired back on twitter attacking clintons vote for the iraq war saying, quote, just to clarify, dont do stupid stuff, being stuff like occupying iraq in the first place, which was a tragically bad decision. Clinton announced on tuesday that she had called the president to mend fences and nothing she said was an attempt to attack him, his policies or his leadership. The white house also tried to downplay the differences. They continue to agree on a broad majority of issues confronting our country, even if they have the occasional policy difference. The president appreciates her counsel and advice but more importantly he appreciates her friendship. Joining me now, ruth mark us and amy tozic. Amy, interesting quote by David Axelrod saying i dont even understand why theyre doing this. If i were her, i would be so sparring with this, she makes herself a candidate and a target. Why does she want to be out there so early is beyond me. That was of course in your piece in todays new york times. Thats what i sort of found as a political observer, which is really early on in the process to make this distancing statement. I think thats right. I think obviously many clinton people say if shes running, shes not running for Barack Obamas third term, she has to point out those differences. I think everyone acknowledges this. I think axelrods point is why do you have to point it out so early. Its still ahead of a very contentious 2014 midterm and some members of the party dont think it looks good to have the front runner for 2016 kind of bad mouthing the sitting president. Ruth, whats been fascinating through the expire hillary book rollout is for a long time the story has been that shes just a total juggernaut. She is stwins iinvincible, she to be the nominee how boring would that be. Since she stepped back into the public eye, we have seen a lot of unforced errors. We have seen a lot of the campaign mistakes which hurt her around the last time. What happened . Why do you think shes had difficulty learning from the errors of 2008 and she seems to be making these same types of mistakes . Well, i think that there has been youre totally right about the book tour. It has not been the easy stroll from bookstore to bookstore. I think that there is a rustiness in secretary clintons handling of interviews. You saw it with the remark about dead broke. I think that i wanted to get to David Axelrods tweet. Sure. I think that that assumes, and this goes to the question of rustiness, that assumes an intentionality from secretary clinton that she meant to be really distancing herself, that she meant to be creating a situation where she was going to end up where she was going to have to hug it out, my least favorite phrase. I dont necessarily think that thats true. I think that she probably went a step further. We did know that they had a difference on syria, thats not news. The dont do stupid stuff thing goes further. Im not sure shement the kerfuffle that ensued. The stupid stuff you would have thought would have gotten some traction simply because of how much the white house has used that term in another way. Amy, i want to go back to you. Interestingly enough, Gayle Collins had an oped where she said, quote, on hillary, she was probably being neither politically calculating nor blundering in the atlantic interview but simply being unusually clear about what she believes and we need to hear more, not less. So going back to what you just said, there is certainly an element of that where she wants to project an independence from the administration and also an image of being capable. Absolutely. Thats going to be a fine line that theyre going to have to deal with if shes a candidate. How does she draw her differences. Its not just in Foreign Policy but that is the main area that she and paum clashobama clashed democratic primary. You think the clintons being much more pro business than the Current Administration has been. So how does she project a message that, hey, im not running for obamas third term but is not so critical that it gets People Like Us talking about these deeprooted intentions that go back to the 2008 primary between the obama camps and the clinton camps. I would say a lot of it is between the camps. You have axelrod, you have loyalists on both sides who support both people who still maybe harbor some hard feelings. I do generally think obama and hillary had a good working relationship when she was isnt the state department. Yes, one thing ive learned on capitol hill is that aides never, ever, ever forget a grudge. Ill go back to you, ruth, to sort of close it out. One thing the clinton folks like to say, and amy brought this up in her piece, who are candidates calling for from the campaign trail . They want bill clinton, they welcome an endorsement of hilla hillary. Not a lot of Campaign Candidates want barack obama in their districts or in his states, but they want his money. That shows where the party is going and who has got the more favorable image right now. Well, its a lot easier to be a successful expresident than a sitting president struggling with the array of problems that president obama is struggling with. And we look back perhaps on bill clintons presidency more fondly and more and as more successful than we experienced it at the time, but he is clearly in a better position to help democrats than the author of obamacare et al. , just in terms of the states those democrats are struggling in. Back to the developing story were following out of ferguson, missouri, where protesters and Police Clashed for the fourth night in a row. Police in full riot gear deployed tear gas and smoke bombs in the crowds, but today officials are promising to reach out to the community. The governor has cleared his schedule to visit the st. Louis suburb this afternoon. The tension started, of course, on saturday when a Police Officer shot and killed an unarmed teen, 18yearold michael brown. Besides Police Clashes with crowds, officers in full riot gear confronted reporters and arrested two print reporters at a nearby mcdonalds. They have since been released. An alderman from st. Louis, antonio french, was also arrested last night. He had been live tweeting about the protests since they began sunday night. We just got this into msnbc. Alderman french spoke to nbc affiliate ksdk moments ago after being released. The officers got on the bull horn. They said this is no longer a Peaceful Assembly and that everyone should leave or return to their cars. They said that about two or three more times. Then they said this is your final warning. And then they started to move in. As they started to move in, that agitated the crowd. A lot of young men started cursing again at the officers and then the Police Released smoke bombs and then people scattered and ran. When they realized it was just smoke bombs, not tear gas, some of them started to come back. The police started to move forward with their assault vehicles and their riot gear and then the tear gas started coming. One other interesting development, the official websites for st. Louis county are down right now. The cause is unknown and its not enclosure if itclear if it recent violence. There are a few hacking groups trying to go after those the last few days. Joining me is the attorney representing Michael Browns family, Benjamin Crump. Thank you for being on the program. Obviously a lot of people want answers, perhaps no more so than the family of michael brown, who you represent, as well as the hundreds who are protesting his untimely death this past saturday. Legally what is the course of action for the public here to get some answers, for the family to get some answers. Obviously the fbi is investigating, you see doj there, but whats the timeline legally for any answers on this . You know, unfortunately when you have a tragedy like this occur, the police can i wont say hide behind, they can prolong, shall we say, the investigation and youre at their mercy unless you as a family can just say im going to file a wrongful death lawsuit. But even then, it would be stayed until the Law Enforcement agencies finish whatever investigation and doing several policeinvolved kills and brutality matters, luke, its always the playbook they use. Were going to have this long investigation for a year and then when nobody is paying attention anymore, were going to say its justified and sweep it under the rug. Thats what the people in missouri have seen over and over again, and so when this tragedy happened, this terrible, terrible tragedy of shooting this kid, unarmed, multiple times in broad daylight, it just sprung so much emotion. Yeah, and youre starting to see that emotion starting to play out in the streets. One thing is that ferguson has obviously said we are not going to take the lead on this investigation because of questions about objectivity that has gone to st. Louis county, but there are a lot of questions about whether or not st. Louis county can be objective in this type of police investigation, considering that some of their very officers are present at these protests right now. As the attorney for Michael Browns family, are you confident that investigators for st. Louis county can be objective in this case . No, im not, luke. And its not just specifically to st. Louis county. I just think any time you have an officerinvolved shooting and you have people affiliated with those officers investigating, it has a hint of not being transparent and not being clear. And thats why the community who have a long history of these Police Shootings dont trust the local Law Enforcement agency to do this investigation. We are calling on the attorney general to have a completely independent investigation and more directly, luke, we want a completely independent autopsy done by the fbi because the bullets and the trajectory of those bullets are going to be crucial, because this is one of the worst Police Shootings that ive ever seen, considering he was unarmed, in the middle of the day, had no weapon, but yet he was executed. One thing weve seen here is that a lot of witnesses to the shooting have been reluctant to actually speak to Law Enforcement. Michael browns friend who was walking with him on saturday by the name of Dorian Johnson to my knowledge so far has not spoken to authorities. Will mr. Johnson from your understanding speak to authorities as probably the most important eyewitness as well as what can you do to make sure that eyewitnesses are comfortable speaking to Law Enforcement in order for the investigation to move forward . Yes, sir. Luke, what were encouraging all the witnesses to do is to cooperate with the federal Law Enforcement agencies, the Justice Department is on the ground there in ferguson, and so we think its important that you have the integrity of a Law Enforcement agency talking to witnesses. But theres such distrust with the st. Louis Law Enforcement agencies, intimidation and them coming after the cameras are gone and holding it against those witnesses. So theres a trust factor. But at the crux of the matter, everybody is saying what could he have possibly done to be executed like this in broad daylight and then his body be left out there on the ground for four hours. I mean these people knew this family and so its so emotional, luke. But the family is calling for calm, calling for peaceful protests. If you respect michael and his memory, if you want to see michael get justice, try to be responsible and nonviolent. Thats the family only wants justice. Governor nixon is arriving on the ground there today. What would you like from him, if you say that basically you only have faith in the federal authorities to carry out this investigation. Can the governor do anything, and has he been too late to react in your opinion . Well, i know nobody has really reached out to the family to give answers. In fact, luke, i think it hasnt been transparent. I think thats whats causing some of the problems. You know, they wont give the officers name and we want a right to know whats in his background, has he done these kind of things before. Also, you know, they release strategically on their benefit, oh, the officer had an injury to his face, but yet when the reporters asked how many shots were michael hit by, they say, oh, we cant tell you that because it will compromise the investigation. How is that fair . So i think the governor should encourage the st. Louis Police Department to turn this whole investigation over to the fbi so people can have confidence that are completely independent Law Enforcement agency is going to get to why this kid was shot multiple times, even though he had only a tshirt, shorts and flipflops. Obviously unarmed. But as all the witnesses accounts said, he was executed in broad daylight. While the crime is certainly or the incident, i should say, is certainly shocking, one thing that has sort of stayed here in the public conscience is seeing these pictures of u. S. Law enforcement in full military fatigues with minesweeping vehicles really sort of playing into the protesters hand of saying that this is way over the top in terms of a response. This is the department in ferguson, of the 53 commissioned officers, only three are africanamerican. From your perspective who youve been involved in a lot of these types of cases, have you ever seen a Public Relations strategy more poorly than this one . You know, ill say i think they have not been responsible to the community. The community has a right under the First Amendment to protest, to assemble, and to try to strongarm them you know the reporters, luke, they were in mcdonalds and it was just fate that they were there. But can you imagine how the people in ferguson, those 70 of africanamericans who live there are being treated when the cameras arent around . Because they just happened to be there and then they felt embarrassed when the reporters saw how they were being treated and they found out they were reporters. But what about the brothers and sisters who are there every day saying we have a right to say you work for us, youre our government and we dont like how you killed this kid. For that you get to get tear gas and just lock me away. They released the reporters but theyre not relesion tasing the people, so how is it fair, how is it transparent .
