White houses think that through . Thats interesting and youve touched on this specific issue that i think is a tugofwar at the highest levels of this transition team, the wire circle team folks around the Law Enforcement and doj and fbi picks and there is a real divide is too strong but there is a tension between what you described and keeping someone like an fbi director because thats what you do. Because trump has ocho blib rabo many norms, do you hue to the norm out of the gate and i think that the decision to keep chris wray is a sign of a couple of things. One, that they viewed the tension between chris wray and donald trump as a sign hes properly running the building with integrity and two, that joe biden is going to lean and his impulse will be toward restoring those norms over anything else. Yeah, and i think you put your finger on it because it is you say it matters and yet, we could come up with hypothetical names and viewers could brainstorm some that worked in the Trump Administration where youd go wait a minute, keeping them for the next four years or more is a bigger problem and i think well see a lot of areas, doj and fbi is probably the first touch stone. I was curious what you thought of that and appreciate you spending time past your hour into ours. Always fun and always fun to race out and catch your show. Its been great. Thanks, ari. Thank you, nick coole. Appreciate you. Control of the u. S. Senate turns as Everybody Knows on Pivotal Senate races in georgia and were seeing something unheard of in political campaigning. Trump allies are literally telling their own supporters not to vote. I would encourage all georgians to make it known you will not vote at all until your vote is secure. They have not earned your vote. Dont you give it to them. Why would you go back and vote in another rigged election for gods sakes . Fix it. You got to fix it before well do it again. Fix it before you do it again, before you vote. This is actually pretty unusual and wild and it could go any number of ways in georgia, which as you know matters and i want to be as fair as possible. Everyone is entitled to their views about politics or voting. If a certain government process is truly compromised, if there is evidence of that, then yeah, there are times where a boycott might be legitimate where you dont vote or participate in something because its so flawed or ruined or tainted but honestly, that wasnt the case in georgia and this is getting absurd. Georgia held a free and fair i election and a dwindling effort is not about georgia or certainly serving the residents of georgia. Its more about providing content, video images and other political propaganda for Donald Trumps post white house plans as he pushed more of it today. Thats the context for Rudy Giulianis traveling road show. I cant call it a Legal Process entirely at this point because its so much more. He arrived in georgia today and note that giulianis efforts focused far more on rallies now and press interviews than actual Court Hearings that could lead to changes in the outcome of the election. This is a slide that we know will continue because there are things we can show you in the Legal Process. States locking in the results. States doing certifications which are not reversible. Plus, judges tossing out giulianis cases and denying his team standing, which matters legally because if you dont have standing, that means you cant even file a new motion or a different type of case. It is a worse loss than using an individual claim. And that may be part of why republicans are increasingly openly concerned that Donald Trumps focus on himself in this period could backfire on them for years to come literally. Now in georgia, we should note politically its largely been a large state when it comes to picking senators but there is concerns this could cost republicans potentially two seats and control of the senate dead pendi depending what comes next. For few avenues left, here is what went down on the tour stop in michigan. This is behold team trumps supposed star witness. Id say that poll book is off by over 100,000. That poll book, why dont you look at the registered voters on there . How many registered voters are on there . Do you even know the answer to that . No, im trying to get to the bottom of it. Zero, zero, zero. Thats how many what about the turnout rate . 120 . What about it . This is the last late stage broke period of this legal effort. How do you know that a witness is bad and my point is not to criticize any individual witness, its not that important or relevant, its just the way this whole process is ending backed by the departing president. Even Rudy Giuliani himself tries to calm the witness down. Youll see him in the video, it was too much for him. Take a look. Were not seeing a poll off by 30,000 votes. Thats not the case. Did you guys take it and do something crazy to it . Its wildly off and dead people voted and illegals voted. I know what i saw. I know what i saw. I signed something saying if im wrong, i can go to prison. Did you . As for the legal part of this, a judge found this testimony from this witness to be uncredible. Giulia giulianis travel road show continues and you have to understand, were in the thouear stage. It matters for the reasons ive shown you night after night here. Were talking about people with the power of the presidency at least until january 20th behind them and attempts to overturn the election, were talking about efforts in michigan to target people by their views and their race which is unconstitutional and illegal and wrong. So much of this matters and will be held to account even as yes, it gets more and more absurd. Those are the ballots that were stuck in the machine eight times, nine times, ten times. Oh my goodness, all the networks. Wow. All the networks. I dont know what the vote in michigan is. Our vote is owned by two venezuelans who were allies of chavez and i know its surprising. Ive been before state legislators who didnt realize it. Did youall watch my cousin vinnie . You know the movie . And did youall watch this . Im joined by emily, a legal writer with the New York Times magazine david from the atlantic and Bush White House and the president s ceo of the National Womens law center. Good evening all. Emily, i make the point about both things because some of this is absurd, its laughable, it is beneath words and yet, other parts of it are deadly serious particularly if they were closer in the states and they were able to get away with this. Your views about what were seeing when i call this beroek failed stage of the trump 2020 effort. I think youre right that its the later stages. Its going on for an incredibly long time. I cant believe how long its been going on and, you know, the Trump Campaign raised 200 million since the election for whatever comes next, the Political Action committee clearly and whatever Political Activities trump plans for when he leaves office. So i think a lot of what were looking at here is that fundraising machine, rather than a kind of serious legal effort. David . Yeah, theres a lot of talk how much impact this show will have on the vote in georgia. I think we may be about to discover that the impact is much exaggerated. We all have experienced this. If you go to a vampire movie, youll feel the horror during the movie. Step out of the movie and you dont believe in vampires. A lot of republicans in georgia are enjoying the denunciations of the process but dont believe vampires are real and wont act on the basis of stuff giuliani and others are saying. They enjoy the show and getting upset and watch fox news and they have the thrill but will it affect their behavior . I think the vote in georgia, the real world vote in georgia remains very, very tight. You know, i think the thing is theyre not going to be able to control this show in the same way giuliani wasnt able to control the witness to tell her to calm down. They wont be able to control what happens after. Our thing is our institutions have been working as they should, right . Youve had court after court say we arent considering this evidence. You havent provided anything. Weve had even the attorney general say there is no evidence and weve had elected officials do exactly what they are supposed to do and so the theater of it all is what people have to figure out what to do is on the other side and i dont think they will continue to be able to control it. Yeah, and emily, that goes to something that happened at the white house. We documented there is wide spread voter fraud and thats admitted in court by Trump Lawyers and the doj, et cetera. Here is a moment with political ally of the president s republican senator graham. Take a look. The level of loyalty, ive never seen anything like it. All over the country, they know it was a fixed election. It was a rigged election. They know it and i appreciate their support. Mr. President , just a few [ applause ] Lindsey Graham said you need to provide evidence. Thank you. Emily . You know, i think Lindsey Graham and a few other republican senators but what they have not done is need a strong collective statement this was a fair election, that president elect biden will take office in january and its time to end this legal charade and until they stand together it really easy for President Trump and the people who support him to kind of discount them one by one. Its really going to take more than that and i think we still havent seen that from National Republicans even though state and local republicans are starting to speak out because this is dangerous for poll workers. You see threats and intimidation. There is a need for action also from National Republicans. Right and that really goes to this contrast weve been talking about the whole time because i think david certainly has a fair point, that means 1789s hitting it and moving on and yet, the georgia official we showed this week went viral and the other concerns and context of, as i mentioned, racial discrimination, the other way to vote has been abused historically in america and what trump is tapping into is very real. The safety concerns of the Election Officials are actually real. They are getting threats. If you tell people there is a rigged election and we need to do something about it, people might start trying to do things about it and i think it was a huge mistake over the last year when people didnt show up against that rhetoric and now it is all coming together and i agree with emily, what it will take is people joining together in solidarity, condemning it and in support of our democracy saying that our democracy works and thats what theyre supporting. And david, inside the transition and incoming biden administration, i want to show reporting, Nicole Wallace was discussing the challenges ahead, which are very real and you have written a lot about what happened to government under trump, politico reporting this aid of the president was accused of approaching Justice Department staffers in the department demanding they give information about investigations including the socalled election probes and the doj took the step of banning them from the building. Thats how seriously they viewed this tempted alleged misconduct. There are also opportunities for the biden administration. People are frustrated and angry. I tweeted something a few moments ago. Since the year 2000, there have been 12 nominations for president. Donald trumps share of the vote ranked 10th and 11th out of 12. Hes an unpopular president. Joe biden is coming in with the second highest share of the vote of any candidate in the 21st century except for barack obama in 2008 and hes heading interest a landscape where there will be a vaccine soon probably and an economic recovery soon and he has an opportunity to be quite a popular president and although democrats did badly down the ballot, and Many Democrats are frustrated about that, there will be members in the house who want their seats and in his district, biden, not trump with the dominant vote getter. There will be opportunities here to put the country on a healthy and productive track than its been on for the past four years. After 14 or 15 minutes of giulianimania, i appreciate the optimism. Way tonight tha i want to thank you, david, emily for kicking us off. We have a 30second break and a lot more tonight. Ivanka trumps deposition. News on that. Three former president s unifying over this vaccine. Thats a sight you dont see every day and well speak with billy about comedy, trump and what hes doing in georgia. My interview with politzer prize winner thomas free when were back in just 30 seconds. S were back in just 30 seconds. After just 2 doses. As President Trump molds pardons for his family including his daughter ivanka, the interesting news timing shes also deposed in a new case here, this is her first deposition in a case about the alleged misuse of inaugural money. Ivanka sat for five hours. The suit alleges over 1 million was spent in a ballroom in a Donald Trump Hotel that the activity involved trump family members but allegedly the scheme was to grossly over pay for the space to personally enrich those involved family members with a convict of interest. There is a attorney general for the district of colombia doing this and stating that the inaugural committee went into an over priced contract with the trump hotel. This is no response to icvanka trump who continues to insist, as is her right, she did nothing wrong. She instructed a hotel to quote charge a fair market rate and the investigation proceeded saying it revealed the committee used nonprofit funds to enrich trumps family and broke the law explaining thats why they sued. Lets be clear. This is a case with multiple points of view and thats why she was deposed and if something was over paid or wrong, she wasnt directly ordering it. Stephanie winston helped run events for the inaugural. She faces a deposition next week thats very much alive. The complaint alleges that she met with donald and ivanka trump sharing her concerns about cost and trump directed ivanka to quote handle this issue. She famously had this publicly falling out with the trumps and talked about taping conversations and discussed some of those very concerns with rachel. I do know that at the time that i questioned where the money was going or how much everything costs, i was asked to not attend the budget meetings. People need to follow the money. The last thing any of these people want is for the truth to be told. Im part of three different investigations yet im a witness to all of them and it really is a charade of shenanigans and i feel that the Trump Presidency is hurting the country. Well go to professor Melissa Murray from ny us here. Nice to see you. Nice to see you, too. One of the Core Principles of the law that people understand is fairness is if you think someone did one thing bad, you cant just go after them about something else. That may happen in life but thats not fair in law and so whatever peoples feelings about the Trump Administration or policies or support, you know, hook line or sinker for everything her father has basically done, where do you come down on what is known about the alleged improprieties here . As you say, this is a deposition so its really early days in the civil case where they are gathering information. What a deposition is basically a series of questions between the subject of the deposition and the lawyers on the other side to try to elicit information about the allegations and so you can imagine that the d. C. Attorney general is asking ms. Trump about the whole question about her involvement and having the president ial inaugural committee either accept those or negotiate them and basically what happened. The real issue here is whether the president ial Inauguration Committee over paid for the use of those trump properties. So thats the big question here and its a violation of d. C. s nonprofit laws if you use the funds for a nonprofit to benefit private persons or parties like a hotel or the Trump Organization for example. Right. Which sounds bad and speaks to the conflicts of interest that were driven by all of the insisting on continuing to seek profits while president and then there is the evidence that we have as you emphasized fairly, we dont have everything. Im curious how you would in a case or for your law students distinguished between denial, right, which someone does to cover themselves and evidence that actually makes it look like maybe they didnt do the bad thing. For that, i go to a simple email here. This is dated december 2016. Ivanka trump, always interesting we get to read emails. Subject buyout minimum. Why dont you call and negotiate, it should be a fair market rate. How do you decide whether that genuinely her saying the right thing and putting her in the clear or someone saying one thing and writing and maybe doing another . Well, i think a lot of it will depend on what happened after that email was sent. Shes directed them to negotiate and get to a fair market rate. What is a fair market rate. One of the allegations in this complaint is another nonprofit, the Prayer Breakfast went to the same ballroom space for 5,000 earlier in the day but when the president ial inaugural committee came, they were charged 175,000 and arguably far in excess of what might be a fair market rate. The question is professor you have that disparity, how do you link it . Youre putting your finger on exactly the details that make it look really bad could really good catering account for the price difference . Catering could account for it. This is why youre having the deposition. Youre eliciting this information. What sorts of things go into that rate if you negotiate a rate, have a rack rate for the facilit facility, are you including the cost of food and service and what not . Are there different times of day where things are priced differently. To be really clear here, the way president ial inaugural committees avoided the impropriety and avoided having a lawsuit is not to own hotels in which inaugural activities are held and thats exactly advice that the Trump Inaugural Committee received when it was planning all of this. Exactly. I think you walked us through it so well. Its very helpful. In all fairness to ivanka trump, there is some descent written evidence on her side about what she did. The larger swamp of corruption which you reminded us is pretty play tabl blatant. Thanks for joining us. Thanks for having me. Absolutely. Coming up tonight, we have stuff im excited about. The return of Billy Eichner and first, i want to go inside Donald Trumps priorities with y you. Hes been declared the loser. Since losing the election, donald trump has largely stopped doing the work of the president. Historians say there are just very few precedents for a president dropping job duties other than incapacitation. The evidence actually clear, on many days, it is publicly known that President Trump has virtually abandoned the schedule and the few times that trump has spoken since his loss, its not even governing but bemoaning the results or pushing misinformation or discussed his failed legal effort that consoled trump. The Washington Post said trump is fixated on overturning the results in 20 days of fantasy and failure which states an approach where trump largely advocated the responsibilities of the job he was fighting so hard to keep. Chief among them, managing the coronavirus pandemic as the numbers of infections and deaths soared. Nowed a voe ca ed a v now, advocating this job is dangerous facing a once in a sen daughter century when it peaks. These four records set, the u. S. Hitting 14 million total cases. Juiced by 200,000 new cases with over 2,000 deaths and 100,000 americans now in the hospital. Numbers are factual but of course, they dont begin to capture the scale and humanity of these experiences. The many tragedies, some of them perhaps avoidable. While trumps refusal to work is unprecedented, there are examples of leaders who turn their backs on pressing problems. History has judged them harshly. Take president hoover missing the mark during the great depression. He refused to do much amidst the poverty and unemployment and distress for areas that literally became known as hoovervilles or take the more classic examples like the roman e emperor and rome reportedly burned for six days straight and he was so out of touch with the human suffering, so bubbled by his wealth and position that he watched the scene as he quote exalted in the beauty of the flames. To him the human toll was literally scenery, imagery. It was not real to him if it did not affect him, which history has long recorded as the ultimate classic example of the failure of a leader. So its understandable that many have linked trumps bubbled failures on covid19 like this rather stunning float that made its way through a german parade. The trump statute fiddling and tweeting. You can see the bluebird tweets coming out emanating from the instrument as the building burns behind him. Here we are. Trump continues to tweet amongst the recordbreaking covid surges. The fire is around the nation and the world. The majority of trumps most election tweets are of course about topics other than gove governing let alone covid and there are signs other will not just watch this virus burn our nation. President elect biden has been stressing there is no time to waste with the Covid Response and the Trump Administration is facilitating an administration, it will let biden heat with ome officials which he did with dr. Fauci which is a contrast the current president hasnt met with fauci in months including this post election time off. Biden and his tehave experience from the prep during the h1n1 square. They wo they worked with some of the same experts and led on solid science which means rebutting information no matter where it comes from. It could be right wing misinformation and propaganda against vaccinations and lies that have no place in the political spectrum and that brings us to this unusual and potentially hopeful scene, obama, bush, clinton leading by example. Volunteering to take new vaccines on camera, which is one more way for everyone to see the science because we got a challenge ahead of us, to see it. To know that fda approved vaccinations are scientifically overwhelmingly safe. Former president obama even name checking his old coal lelleague fauci. If Anthony Fauci tells me this vaccine is safe, absolutely im going to take it. I may end upta taking it on tv having it filmed so people know, you know, i trust this science. Okay. What i dont trust is getting covid. You cant really unsee the contrast here across president s, across the historical imperative and to be clear, its not really about party or ideology. Its really about leadership and getting to work so these retired former president s arguably doing more work today on this Covid Vaccine than the one who is technically still on the job. We wanted to share that with you. Well fit in a break. Congrats journalist to journalist and thanks for coming back. Thanks, always great to be with you. Lets start with something notable that president elect biden said to you, quote, maybe when trump is gone from the immediate scene, im not sure the ugliness stays. Maybe 20 of it. 25 of it i dont know. Walk us through that part of your conversation and what you gleamed from it. You know, ari, one thing that really struck me in the comments on the column, let me start there in the New York Times. Com is how many people wrote in and simply said wow, i forgot what it was like to hear a president speak seriously, soberly, nonpersonal about Serious Problems and the whole tone just really reminded us what a warped period weve been through. You know, it just really struck me and struck so many of the readers of the column. You know, he is full of concern about the division in the country. And again, you know, listening to him, ari, you come away thinking maybe we just got really lucky here that after four years of just such a hate filled politics, we have a president who is really hard to hate. It is just really, i think even for republicans, worse republican enemies and the real question Going Forward and this is a dynamic we dont know, a lot depends where the senate ends up after georgia is what happens to that party . You know, jim baker when he was secretary of state used to joke. I covered baker and he used to joke how do you know youre out of power in washington is when your limousine was yellow and your driver speaks your limousine is a taxi. Exactly. Who is donald trump and what is the Republican Party when hes no longer in the white house . If you look to the breakdown right now, ari between those who say the election is over, these allegations of fraud are crazy and those that seem to be really disconnected from reality and doubling down on that disconnection, theres going to be a fracture there and i think well only know how deep and broad it is after trump is out of power and biden is that you will have 20, 25 who are going to say we just cant go on like this where i stick a spoke in your wheel and then you stick a spoke in my wheel. We have too many big hard things we need to do and they need to be done together. As you said at the end, if we cant do that, we really are in trouble. And you mentioned the senate. You definitely caught some peoples ears around the election when you said maybe the best outcome would be still a Republican Senate with a president elect biden. Take a look. Possibly the best outcome for the country would be that biden wins the presidency and maybe the republicans hold the senate by one seat. So close that they would have to be a much more willing to cooperate and collaborate with biden, also chasing by the fact they lost the presidency. Maybe the best thing for the country would be some kind of balanced outcome like that. That was really i feel you know what is really funny we hardly knew you. You went up and saying youre against trump which is interesting. Now i feel like were going back saying its your call but reporter to reporter, i want to press you on freedman on fre freedman and let you respond. How do these issues well put up on the screen, take a look. Look at these issues from freed m freedmans columns, how do these get improved by Republican Senate, a platform for Single Payer Health care backing the environment which youve written many times about and ultimately quote nothing will change unless younged a 2ku89s th ed adults ta will register. Do any of those approve Mitch Mcconnell stays in charge . Certainly not. Here is what is really funny about this whole thing. I was on cuomo a week later because i pref franaced that by saying depends the Mitch Mcconnell you have. If you have a Mitch Mcconnell that wants to destroy obamas agenda, of course not. You dont want a republican majority a. Week later i was on cuomo, same show in which i said at this point it was clear mcconnell wasnt recognizing bidens victory and i said if thats the mcconnell we have then i hope people go down to georgia and register to vote and vote for the democratic candidate and i got in huge trouble from the other side for that. Okay . So were you wavering because this is what i want to press you on and you are a leader. Im not here to over compliment you. There is reason the president elect of the United States is calling you and there is this concern i think youre aware of even after trumpism that washington defaults to a kind of a mushing middle but the middle between mcconnell and biden, right, in his obstruction record, im not saying this is ideological criticism that biden wants to sign or is that unfair . My whole point, ari, in the first cuomo interview and second and im not for people violating the laws of georgia and going to register to vote. Lets make this as legal as possibly can. If we dont have some kind of bipartisan collision in the center, you cant get anything big done. Thats fact number one. Fact number two, if you have the Mitch Mcconnell of old, okay, then were not going to have any possibility of getting anything done in the center. Okay . So all i was doing is expressing the view i do believe without some kind of compromise and this is what biden said in the interview, were not going to get anything done. Now it all depends to me when i said on cuomo both times, it did pends on the Mitch Mcconnell you have. If you have a Republican Party ready to compromise at the center, thats most unlikely now and even more unlikely since weve seen their behavior in the election but ari, youre not going to get anything big done without some kind of problem solves caucus in the middle. Okay . Thats all im saying. Right. I hear you on that. I only have to fit in a break because i have Billy Eichner coming up. We go from freedman who wrote eloquently about the quote unquote arab street to billy on the street. We hope you come back, tom. Any time. I love it. Okay . Yes, sir.
