There is not a single pending legal case in the nation. At the same time to concede but to speak since he became the loser on saturday is putting his party and the country through this sort of rolling absurdity this week. Most people are familiar with the classic five stages of grief, a concept by a psychologist, denial, anger, depression and acceptance. Trump appears still mired in the first stages of denial and anger and note that puts him way behind his supporters. Only 3 of americans falsely think donald trump won according to the latest polling. Now republican leg sislators se to have hit that in private while they publicly coddle trump which is one way to view his new found focus this republican discussion of something as intelligence briefings. They are operating as some kind of middle stage between trumps denial and later acceptance and the headlines, you have republicans backing this basic thing, briefings for president elect biden because hes president elect. Its that simple. Some day they may even be able to say this second part out loud but thanks to donald trump, his party has to make this painful part take longer. They have to work through more drama, more emotion that is leading some to ask throughout american history, has there ever been a transition period more tailored to snow flake sensitivitie sensitivities. There is danger the longer they delay this for the incoming administration. I know trump doesnt care about this but republicans that claim to care about governance should be doing something. Do you think that the intel briefings have takenimportant substantively, they have taken a larger role . Exactly. Its a way for them to signal im not really with trump, im saying that he should get the intelligence briefing but honestly, its not enough because Trump Supporters need to hear his message loud and clear, not things that all of us right now understand what it means. Its most unfortunate that the republicans have decided that they will not respect the will of the people, and let me just say lets like the house is burning down and they just refuse to throw water on it. We know that a transition is underway whether or not the Trump Administration with republicans in the senate wanted to be so or not and so i am just feeling good about the fact that our incoming president has so much experience with government that he is not flying blind. Surely, it would be helpful if there was a proper transition happening if he was in the briefings, if they were being corporative but president elect joe biden spent eight years in and around the white house. He knows how to stand up for government. He also has just appointed a chief of staff who has managed through a major pandemic, the ebola crisis and managed through a financial crisis. I am actually feeling pretty good about the position were in and yes, you know, we can continue to spend the next eight weeks or more talking about what a disaster republicans are but if we know anything to be true as if they are going to be who they are and now that the American People have spoken, its time for us to be who we are and stand up a new government and plow forward. Trump is demanding these public shows of denial but his almost senior aids are working on the plans for his departure. Weve got now reporting. They are explicitly leaking to the press a farewell agenda finalizing rules, deregulation plans, and executive orders. This is for before biden takes over when they get ready to leave and it does seem to reinforce how everyone around trump is planning the exit. You know, the important point that has been made is that a lot of this is using coded language, the signaling to people in power, dont worry, there is a plan. We know this is a democracy. We know this is a decisive victory for joe biden but i feel like the danger, ari, the average person who voted for donald trump is not necessarily understanding the filters or getting everything given to them through straight talking news outlets. They are getting it through social media feeds if i look at the fundraising emails that Donald TrumpsCampaign Continues to put out, they are talking about this in absolutely false language and asking for money to fight, you know, a myth battle. And where and where does that money go . Thats a great question. Right . Thats i mean, ill propose an answer. I wanted to let you, if you have it. Well, i think there i mean, theres a big legal issue looming for President Trump, actually, multiple legal issues but some of the reporting is interesting. If you give under about 8,000, which is what most people are able to give far less than that, if you give a political contribution of 50 to 100, none of it goes to the legal battle, it goes to his pact for post presidency and rnc, and so libby, some people are pointing out as you say, those messages are going around social media and its unfair and ill say this, its unfair to maga supporters to be conned one last time. Well, i have to say, ari, i talked about legal issues, not fighting the election. Donald trump has been soliciting money for a long time, perhaps depending on the legal trouble he faces. There is a question who President Trumps own political future looks like. Who would he support . Son in a president ial run. Absolutely. This is clearly an opportunity for them. But this is such a dangerous opportunity because its hard to sort of parse through it all and thats why its so important for the media and experts to keep just, you know, hitting the drum beat of this is no longer donald trump versus joe biden. Right . Joe biden has won and so this is really donald trump versus, you know, democracy. Donald trump versus reality. Thats what joe bidens team is trying to do, not get in the fight. They need to look forward, talking about ron klain, the purpose he serves and the exp t experience he brings to the job and moving forward because as this swirling is going on, they have work to do and there are so many crisis that will be facing this incoming administration, its a shame and i think anyone can say that objectively that its a shame that they cant Work Together because america is facing some pretty serious c crisis that arent pausing. On your screen right now you will see the names of other deceased voters. They played a role in last weeks president ial election. Losses are being filed alleging serious election misconduct. Joe and fellow democrats and the mob, they dont really care about the integrity of elections. No Conspiracy Theory too grand, no riot to deadly, may not have another honest election ever again. There has always been good journalists working at Fox News Channel and what you see here is the way in which those journalists really from 1996 when both msnbc and fox news launched Election Nights were to shine and quick back in 2000 with the florida recount, et cetera and that was when for the first time fox went ahead of cnn in the ratings because of that election and it going into over time as this feels as though it is not with standing the lack of evidence for the president to get past the Electoral College and the inauguration. Its reporters there who did great work and when they called arizona that shocked the president and hes been out of his head ever since and now hes picking on those who point out that theres an absence of evidence and to the extent that the opinion hosts are the prime time hosts and they bring in the bigged ads and revenue. It goes on because after all Cable Television is a business and though journalism is supposed to be objective, that can get polluted when you have opinion hosts who choose to take sides. But let me more so let me press you on that a little bit. We talked before. You know how it is. Well talk it through. Youre implying its on a spectrum of that but there is a big difference between someone saying accurately they love a politician or love the president or the president is entitled to pursue challenges and cases, which he is. There is a difference between that at some level and people going on and using that platform where you once reported and leading the poub liublic to thi election is invalid and donald trump could win or has won and c, there is voter fraud in our american democracy, which there isnt. I respect and defend their right to go and say how much they love donald trump but isnt there Something Different about the other part . Absolutely. I dont dispute a word of what you just described. Its very, very dangerous. And im old enough to remember nixon and there are people our age who are still haunted by that and there will be people years to come who will be haunted by this. The level of corruption from donald trump, the level of distrust that he has fostered in the country and the media is truly horrible and i worry about the kids of people who are still supporting this president while he tries to convince the country that this electoral process of ours is somehow corrupt because theyre the next generation of kids who are going to be hanging outdoor signs and putting up stickers and trying to motivate voters in the years ahead and they are not being taught the kind of values that most americans believed in. You know, we like to tell our kids or at least we used to when i was in eloqueementary school, George Washington couldnt tell a lie and when his father said you cut down the cherry tree, you said dad i didnt do that. That never happened. The point is we value those values. We value those values. Yeah, thats fair and means a lot from where you sit. I got one more thing for you, carl, which is forward looking. The new reports donald trump is eyeing his own media plans that could actually try somehow to compete with fox news, youre very knowledgeable on this. Do they have anything to worry about there . I absolutely do. I think donald trump is going to do everything he possibly can to keep people listening to him. I have a tremendous amount of apprehension what kinds of things he could be spilling to people overseas once hes out of office, either inadvertently ordeal l or delib rid lly. If donald trump were really claiming to contest these results, well, this would be the quietest legal challenge to an election in the history of the world. Donald trump hasnt even spoken in public in six days since losing to biden. Everyone knows when donald trump has something to say, he says it. And thats especially true on legal matters where trump has loudly publicly taken on everyone from the irs to the i fbi. This is a losing project. A smattering of losing insignificant local cases as a kind of a chaser to a losing election where donald trump is the loser. Now, thats not the kind of thing that donald trump wants to talk about on television so he has instead been sending out anyone who will do it for him, leaning on his children and people paid to talk in court, lawyers. Were going to win pennsylvania. We came here today. We met with all our lawyers. Were going to file suit. When we tile a lawsuit in michigan, thats another step. In pennsylvania, its another step. Its illegal and unconstitutional and well be bringing an action challenging that. Now filing empty and losing lawsuits is not actually another step to anywhere. As weve reported, there is not a single pending case that can change the outcome of this race in the United States. So to be clear, because i want to give you context, these cases are not that important no matter how they end. Legally, they are effectively moot. But it gets worse for donald trump because these cases, while they may not be that relevant. They show him losing badly and there are fact checks now coming forward under oath that could haunt related republican efforts for years so tonight, we dig into the new reporting that frankly we havent had time to share with you this week, there is a lot going on and this is about something important in our system of government. So i want you to tune in and see what were about to show you because its independent judges who are doing the Fact Checking and it aint pretty. Lets start in the key city of philadelphia, which captivated the nation as those ballots were being counted at the big board. Well, bidens margin there is too large for trump to overcome with any of these cases. But they still went to court claiming that some observers were excluded from the counting room. So lets go right into court. This is real what im about to read to you. A judge asked the trump official, the lawyer well, are they in that room or not . The trump lawyer spins by saying well, the observers were not being given equal access to the room and the judge cuts right into the real question, are they in the room . So whats happening in this moment in court is a trump lawyer trying to spin an independent judge and learning that its harder to lie in court than at, say, a white house briefing. So the lawyer says well, there is a nonzero number of people in the room and the judge just shreds that and says nonzero number of people . I dont know what that is and puts on the heat on this poor lawyer by citing their oath as a member of the bar of this court. Violating that can get a lawyer in trouble or in jail and the judge says point blank, are there trump observers in the room or not and the trump lawyer admits yes and the judge ends this whole charade saying im sorry, then whats your problem . Thats a rough day in court. Now, again, this case wouldnt change who won anyway but when your lawyer has that much trouble with a judge, you have a problem. My opinion, this was getting pretty close to my cousin vinnie territory. How do your clients plead . My clients caught completely by surprise. What are you telling me . They plead not guilty . No, im just trying to explain. I dont want to hear explanations. There are only two ways to answer it, guilty or not guilty. Your honor, my clients didnt do anything. Once again, the come pkocomin process is broken down. Now, ill be fair of course, any lawyer could have a bad day somewhere but this problem i showed you in philly, this is not isolated for the trump team. Take pennsylvania. The campaign sued to stop the counting of alleged irregularities or take montgomery, a different courtroom where a judge is pressing the trump lawyer and hes not even claiming that any of these bored electors were found guilty of fraud. The trump lawyer dodges. Accusing people of fraud is a big step. The judge is not having it. Responding i understand. Im asking you a specific question. Im looking for a specific answer. Saying to the trump lawyer are you claiming there is any fraud with these 592 disputed ballots . There it is america. The big question. We have a sitting president tweeting about fraud. We have a Campaign Filing actual lawsuits about fraud. And the judge is doing what judges are supposed to do, getting at the questions and the evidence. So is there any fraud in what is still a tiny sliver of ballots there . As Trump Lawyers under oath, lets look at the answer together. The lawyer responds to my knowledge at present, no. There it is. No fraud. No knowledge of fraud. No evidence of fraud from even the people suing about it. Now let me take you to michigan where trump allies lost an absurd lawsuit that asked a judge to stop counting votes in detroit and then tried to stop certification of results and the judge honestly said its speculation to quote hundreds of thousands of ballots have in fact, been changed and presumably falsified. That claim failing because trumps lawyers made only a claim the judge notes but have offered, here it is again, no evidence. Now, many of these accounts are coming clearly from Court Transcripts as you see and we have tape of an actual courtroom moment in michigan when a judge had to basically take a trump lawyer back to law school to distinguish between admissible hard evidence and inadmissible hearsay, stuff you cant use in court because youre repeating it second hand and yes, repeating things that other people say that arent true, maybe that gets you a retweet, it doesnt go far in court. Listen. Im still trying to understand why this isnt hearsay. I heard somebody else say something. Tell me why thats not hearsay, come on, now. Well, its a firsthand statement of her physical its an out of Court Statement offered for the truth of the matter asserted therein, right . That judge is actually, literally having to repeat the textbook definition of inadmissible hearsay for someone apparently frulunking out of he court. Its a high bar for donald trump to remain silence but maybe hes exercising his right to remain silent because he sees how hard it is to speak the words of any argument in public let alone the oath where lying can be criminal to challenge the fact that he is, yes, the loser of this election. Now, most reporters are not covering these irrelevant cases in depth because they are not big legal or electoral news. Just as trump supposed election appeal fund doesnt actually fund many election appeals because of course, it doesnt. Now these cases are dwindling and dying in such an absurd manner, they may not even end just in my cousin vinnie territory. They may end somewhere even more ridiculous, a court film with a fitting nod to the trump era liar, liar. Honor knock it off. Sit down.
