But it was congress that the public was relying on to make these tax returns immediately public. Now the lower courts will have to litigate that and i think the chances of us learning the answers to those questions are very low. Im simplifying three years of law school but i think everybody gets it. Heres the notion of centuries of histories that donald trump was trying to override. Two centuries of experience confirm a properly dated subpoena will not hamper the performance of a president s constitutional duties. Any time you have a Supreme Court opinion that tells you everything you want to know about the treason trial is a good day. Its a fascinating opinion. I recommend everybody read it. The fact that we are at a place in america where we have to say that with some relief and surprise is a sign of where we are. The Supreme Court could not have more clearly rejected this idea of absolute immunity, the fact they did it 72 shows, for that particular point, that was unanimous. All the justices agreed that there is no such thing for the president as absolute immune from this time of a subpoena. Theyll have to go back to the lower court because they have to work out the specifics with regard to this specific subpoena. The president like any other person who is subpoenaed may well have arguments to make about the subpoena. You can say it is overbroad, burdensome. But he cannot say that he cant be subpoenaed categorically. So this was a very big precedent setting decision. And at least for the new york piece, i think it is very likely that the Manhattan District Attorneys Office will get this material. As was said earlier. I dont know that theyll get in it time for the election. Even if they do, it will be subject to grand jury secrecy rules. However, this material will be gotten by prosecutors. And ultimately, if there is a crime, theyll know about it. Exactly. That raised the question of whether the length thats the president went to involved something more than personal secrecy or privacy. But as you say, fear of an open criminal probe. It involves conduct not entangled with his official functions, and i think it matters that he is the subject by the documents that theyre calling upon, that affect him. Also, he admitted in the appeal that it didnt matter, he believed that you could subpoena a president. Although he wanted to restrict it. But by making that admission, i think he moves himself into a worse position in terms of this Supreme Court with this specific case. Although there were seven opinions, seven justices, the two appointed by the president , kavanaugh writing, he took the position in the nixon case, they required a specific need in order to decide that a president had to produce something. And both gorsuch and kavanaugh criticized the majority, the remaining five justices for not making that requirements. Which may be saving it for down the road. I want to jump in and get joyce back in as well. This is a time when many are quite skeptical of many things in america. Government, justice, et cetera. But we would be remiss to let that actually also completely overtake what happened today in this ruling. I want to play in fairness what Justice Gorsuch pledged to do at his confirmation.
