We begin with a new and major sign how places hard hit by the coronavirus are trying to bounce back safely amidst the entire larger debate how to keep americas children safe specifically. New york city runs the Largest School system in the country. It is battled the most coronavirus cases in the country. Today, the mayor announcing its classrooms will reopen one to three days a week. This is the single biggest piece of the equation. 1. 1 million kids, millions of parents and Family Members who want to see their kids educated the best way possible. That means in person learning. Of course, everyone, everyone is focused on health and safety first. New york has been curbing its caseload more than many other places that have been hit recently. Indeed, florida facing a surge after the rush to reopen and the School Debate features teachers and parents ripping the governor for pushing schools to reopen before a little bit unlike new york, they got the virus more under control throughout the state. Now, those are the real decisions that governors and School Administrators are making on the ground in realtime. Over at the white house, donald trump is in open conflict with his own cdc which is of course part of his administration, for potential School Measure advice that he thinks is too restrictive. The president also posted an irrelevant tweet about this that says since the constitution doesnt give him order independent power over state and local schools, we wont have it on the news because its not relevant to the decisions on the grounds level. In fact, trumps now public battling with his own Staff Experts months into this crisis also feeds a perception that hes just not in control of his own administrations federal response to the virus. Let alone the virus. And to that end, there are reports the white house may release its own guidelines that may conflict with its own cdc guidelines. To which one might say, whatever. Not exactly a model of clarity on a model of life and death. The School Dilemma is one part of the larger spike that the u. S. Is experiencing. Cases up to 3 million. Thats roughly a quarter of all cases worldwide now. Over 132,000 confirmed deaths. The virus increasing in 37 different states. Lets get into this. As weve argued in our reporting, it is important to understand the numbers. The worst spriks in arizona, florida, and texas. And they account for almost half of all these new cases. So medical experts stress that first of all, obviously, any spike anywhere is bad news and needs to be address think. When you understand that figure, it does show to some degree how different policies and different places and geography matters. Without the challenges in those three states, for example, this entire horrific national count of the recent spike would be cut in half. There is no silver bullet, no perfect answers. As we have deliberately repeated in our reporting here, night after night, there are some proven methods to curb the spread of the virus to save lives. Dr. Fauci telling states to push social distancing and mandating masks during the first wave. Dr. Fauci we should note was not at todays task force briefing. He did recently cite europes success when briefing congress. Lets look at that again. Because it shows the u. S. A way to get out of this. On the left, you see as recently as april, the u. S. And europe, europe is the blue line, facing similar spikes in this virus. Now, europe applied strict measures. They slowed the spread and they went in a different direction. Boom you can see it right here. The blue line of europe over the past few months. The u. S. Never achieved that drop and now on the right, actually spiking in july, worse than ever. This is the whole policy story in one chart. It is a story with evidence and a grand scale that shows it can be done. Because they did it. They did it as a full cohesive society. The reward is not only fewer deaths, obviously. But it is also going back outside with less risk. It is a win win. The blue line there is a reality for hundreds of millions of westerners living in democracies. Our red line right now surging in a fever pitch of human exhaustion. Policy confusion and yes, political misinformation. We keep reporting on this chart. We keep asking our experts about it. You can go out with masks, you can social distance, you can do hand hygiene and you can bring the numbers down. That makes it so much easier to open up the economy. You want to open up the economy fast . Dont open it up while were at the peak of the curve, 35,000, 40,000 cases. Open it when were at the bottom. But you have to wait to get to the bottom. You have to apply these measures to get to the bottom. It was impatience, lack of discipline that led us to that second spike. By the way, that is characteristic of donald trump. Cant stick with anything for very long and he urged all these states to open up rapidly and not open in an orderly manner. And you can see the result. Soon well get the death rate going up again, too. This is wild. This shouldnt be a partisan issue. Not only is the good doctor describing donald trump but also the trump, republican governors who were unwilling to be responsible adults. And were willing to sort of put their heads down into a right Wing Media Echo Chamber and cow tow to in some cases, armed protesters and billionaire funded protesters, who honestly, were thinking about their own comfort and their knee jerk reaction to any kind of public collective response to our biggest problems. And so what you see is that the states that opened up quickly, because they felt like this couldnt happen to them. What was happening in new york, where im sitting, it could happen to them. And the problem is, we have that also on the federal level as well. Nancy pelosi is in charge of the u. S. House that six weeks ago now, passed the necessary next part of our covid response. Our economic package, called the heroes act. And Mitch Mcconnell and the senate just gave the Republican Party in the senate and the entire senate the summer off. And it is just absolutely unconscionable. Yeah. Sort of a Summer Vacation while everyone is debating whether to bring the kids back in different places in the right way. On that, doctor, we are curious, your thoughts. And we do emphasize its geography. Not one size fits all. Were a National Debate but we have a lot of School Systems for good reason. Take listen to a prominent fox news voice on the schools debate. There is just no question. The kids benefit in school. Life is full of risk. Kids should learn it early. Life is full of hurdles. You have to find a way to overcome and five or six months, weve been hearing about it since february. A lockdown since march. Get ready by september. This is not ebola. It is the coronavirus. Doctor . Yeah. I actually in general do agree that we should get schools started. And you should get them started in places where the case count is low. You cant get them started in places like florida or the heart of texas where youve got these enormous explosions and hot spots. Why is school good . Well, there is clearly education, socialization, for many kids theres meals, and also this abuse issue where teachers and Staff Members can spot abuse. We know that kids you understand 11 or 12 are much less likely to transmit the virus. However, we do need resources. It takes money to get ready to teach in covid. You have to , youll need more teachers, more spaces, youll need filters to clean the air, the hepa filters, and you have to make sure thats not only something rich schools, rich and private schools can do but all schools across america can do so we dont increase this gap between the rich and the poor in terms of educational attainment. And what i worry about is trump doesnt want the cdc to give guidelines to schools. How is each school, or school district, going to make up its own rules . Thats hard work and hard protocols and we should have National Leadership on this. And it is just crazy that you want to open schools but you dont want to give them the guidance they need to do it properly. Yeah. Well, heather, ifgs go was go say, that makes a lot of sense. Heather im going to you but i want to add a topic. This trump reelection strategy at times, including with republican allies around the country, different states, is to just lean into the idea the pandemic is over. This is running. I want everyone to see this and get heathers response. It is running into conflict with the human instinct of survival. Right now were counting. New hampshires governor saying he wont attend the rally this very weekend. Im going to go greet the president as the governor. I will not be in the crowd of thousands of people. I wont put myself in the middle of a crowd of thousands of people. As a governor i try to be extra cautious for myself and my family. The two most powerful figures will skip out on the very thing theyre asking their own constituents and Party Faithful to do. Theyre opting to give speeches virtually. Heather, because this is both real and incredibly rich, your response. You know, there is this double standard that so many people in power have deployed. Asking low and underpaid workers to work without protective equipment while they work from home. Asking the federal government which just this week, a number of states sued betsy devos because they have been padding the numbers to get more money to private schools out of the money congressional indicated in the recovery in the First Recovery act here. You know, slipping in a republican tax cut into the cares act when absolutely we need to be raising taxes on the wealthy in the spirit of solidarity and National Interest right now, states and localities face tons of red ink trying to keep our communities safe. There is a sense of, you know, more and more advantage for those who are wealthy and powerful, and then literally, death and misery for everybody else. And you know, i hate to make this partisan. It shouldnt be partisan. These are life and death issues. We definitely have a party that has decided to become really a caricature of itself. With just leaving millions of americans to debt and misery while they make sure that their own pockets are lined. Yeah. Im running over on time. Doctor, the old criticism of right wing policy was capitalism for the leaders and socialism for the corporations to get what they wanted back. And you look at this in a covid lens. Joining me now, someone who coauthored a book with him, art of the zeile deal. A friend of the show, tony schwartz, and someone who has gone on to be critical of donald trump. Nice to see you. Nice to see you. I look at this and i see another book which donald trump understands as potentially pivotal. You guys wrote a book together and he rode it to the top of the charts and turned it into a brand. Im curious, given all that, your views on this. Im very interested in the parallels. She, too, was a ghost writer. She was the person who was supposed to write the book, the second book after i turned down that opportunity. And she found that she couldnt get anything from him because there was not anything that he had to give. So she didnt end up doing it. And now she is 30 years later, writing what i think is, i see this as one more Tipping Point in the descent of donald trump, and i do think it will have a big impact. Not just because it is like a Family Member who observed it up close but because she does bring the psychologist perspective to this. When you look at the power of this, there are many ways we get information now. And yet, big book from the right person with the right insights and access, it still can move the needle. Yeah. I think what were seeing is an accumulation of needle movers, in terms of one disaster for trump after another, and there is a Tipping Point, and i think again, that we probably reached it. I think the really interesting thing that mary trumps book brings up, not so much its revelations. We know all this kind of stuff already. It is just more of it. It is the insight into his childhood. And one of the great tragedies in this country is the inattention to the shaping influences in our life. There is something called the Adverse Child Experience study. The ace study, which shows the vast percentage of americans, of people, have had traumatizing experiences. It is not the exception. It is much more the rule. And if we dont Pay Attention to the shaping influences in peoples life, in trumps case, an abusive father and a neglectful mother, were going to end up having very disturbed human beings acting out in the ways that trump has. Add the money into that and now he has a platform and were all suffering from it. Yeah. And tony, that is something that comes up in the book that you did coauthor with him. Maybe protest too. But ill read with regard to this relationship. The nieces book is arguing, as you just alluded to, that donald trump was stunted by the overbearing father figure, that he found a way to collaborate with his father while others suffered under him. Here it says in that book, your book, i was never intimidated by my father the way other people were. We had a relationship that was almost business like. I sometimes wonder if we had gotten along so well if i had not been as business oriented as i am. What is that all about . Its a lie. Its not true. He was totally intimidated by his father. He was terrified of his father. And he lived to please his father as his own five children do. Particularly his three first children. I think what that is telling us is that this is the story he built around how he managed the terrible impact that his father had on him. And listen, its no excuse. Trumps behavior is not accused by the fact that he was traumatized by his parents. I believe he was. And he is still sub to the social contract. He still has an obligation to be part of the comments. He is be. It is true that if we had a world in which we took seriously the kinds of deprivations and costs of children who are so defenseless when theyre young incur because parents sometimes are themselves so screwed up, and sometimes just are busy doing their own thing, and meanwhile, the child suffers from some kind of lack of attention. We need to Pay Attention to this. Listen, when i wrote some weeks ago, the psychopath in chief, a psychological perspective on trump, i wrote it on medium. I sent it to six or seven main stream media publications. One of the most prominent Media Magazines in the country, the editorinchief, wrote back to me and said, we dont do this kind of piece. I. E. , we ignore the whole interior of human beings. And i couldnt get that piece published. So i published it myself. It got a half a million views. It shows that you people do want to know about whats going on inside them. Because you cant change what you dont notice. Right. Its a challenge. I understand the journalistic bar of trying to stick to evidence. When you go interior, it is harder. To your point, it is very relevant to everyones lived lies. Im out of time but ill say as a long time interviewer and beat friend of yours, it really captures the understate energy you bring to so much analysis. Tomorrow is the Supreme Courts day to announce the opinions so it is likely a day for a monumental decision for one of the most consequential tests of trumps power. On the night of the 2018 midterms, as the newsrooms were buzzing with all the returns, we broke the story right here that top House Democrats were already confirming they would demand trumps taxes within their probes of russian influence and money laundering. There will be democratic chairs of every committee in the house with everything that entails in terms of oversight. And we have some news on that front. Our friend ari melber has been doing some reporting in terms of what to expect now that the democrats are assured of the house. Ive opponent to a senior democrat on the ways and Means Committee who says, breaking news, they do intend to request president trumps tax returns. They did. Plus the separate d. A. Subpoenaing for a criminal investigation raising different legal issues than a fight with congress. This court will decide both cases and rule on sweeping claims by trumps lawyer, jay sekulow, that the president has a temporary immunity. Like it or not, oral, a utility, even obama appointed justices agree that a president does have more protection than an ordinary citizen while stressing that doesnt automatically mean hes above the law. Criminal process targeting the president is a violation of the constitution. This is a temporary immunity. This is for while the president is in office. It seems that youre asking for a broadness of immune that Justice Thomas pointed out is nowhere in the constitution. Well, hes the president of the United States. The president cant be treated just like an ordinary citizen. But its also true, and indeed a fundamental pre september of our constitutional order, that a president isnt above the law. Trump lawyer jay sekulow trying to flex at the Supreme Court, arguing trump has money and power and is not subject to the law requiring they take his taxes out of the vault. This is basically a remake of the rapper who. I put all them racks in a vault, in a vault. Hey, we rich and above the law, above the law. That sounds confident. But only the court will decide if trump is above this particular law and if the tax returns stay in the vault. Joining us now, former acting stand general of the United States, neal katyal. He has unique up close views of how this gets worked out. Will they rule tomorrow . If so, what are the clues to how they might rule on these hidden taxes in the vault . So all indications are that they will rule tomorrow. They said it is the last day of the material. Ive been in court on the last day of the term in which they announced a reargument in the fall. It is not 100 certain but were at the 99 100 certainty that we will together a decision tomorrow. Even if it goes against trump, that doesnt mean americans will see the tax returns right away. These are confidential inquiries by the manhattan prosecutor and the house of representatives and they will keep that information confidential until, for example, an indictment or Something Like that, which is what is going on in manhattan. The grand jury is investigating donald trump and why he expensed 130,000 deducted as a business expense to stormy daniels. I never thought that feasible. And so theyre investigating all that and we will hopefully get a decision tomorrow on whether or not the investigators will get the financial information. On that crux that we explored, jay sekulow saying, look, we have special rights as the president and the justice saying, some but laws apply, the federal law says congress, for example, can demand the tax returns. What do you see in the clues from organize argument there it did not go well for trump. You can never predict it but it didnt go well. It is kind of humorous to think that a guy who donald trump thinks strictly could not trueing the constitution as written is kming in asking for immune thats nowhere in the text of the constitution, which is what that excerpt was all about. I suspect at least the manhattan prosecutors are likely to get that information. With almost to house case, and that investigation, thats a little more complicated. Because the house is asking the federal courts to come in and refer a dispute. Sometimes they dome want to do that. In this case, it has political overtones. Im glad you broke news on Election Night. But darn it, we shouldnt have had to wait for Election Night for a house investigation into the president and all of his financial dealings. The republicans were in charge for two years. You make such a broad argument and observation, for example, any president , who cares the party, any president in a position where they could literally owe billions of dollars to foreign owned banks or foreign countrybacked entities, there are so many reasons that the public and the Congress Care about that regardless of the other stuff. Asking the white house to seek witnesses who would come forward and say he acted ill properly. There were public statements that he shared including about his father who emigrated from soviet russia. In russia, the concern on a private channel would have severe and public repercussions. Dad, ill sitting here today in the u. S. Capitol talking to our elected professionals, is proof that you made the right decision 40 years ago to leave the soviet union, come here to the United States of america in search of a better life for our family. Do not worry. I will be fine for telling the truthf truthful. Im ll be fine or the tellin the truth. He said that under oath in faith of the system. It is your view that was ultimately proven wrong by his actions. As reported by the New York Times, do you view this as potentially improper or left field retaliation . Its a heart breaking day. I remember that testimony so vividly. I think it is the most powerful ive heard in 20 years here in the congress. It breaks my heart that that is an open question whether his father was right to be worried. Whether the colonels assurance to his dad proved to be true or not true. I think it is still too early in the story of his life to give a complete answer to that question but the president s actions in essentially pushing both he and his brother out of their positions at the National Security council, the actions of the white house to continue to bully and intimidate him, to put his promotion in question, if the reporting is accurate, to seek dirt on him to try to justify what is really just retaliation for his telling the truth when he was compelled by a subpoena. It looks like a lot of the fears the colonels father had about his testimony have become all too realized. I dont think the story is over for this patriotic american. Hes moving on to a different chapter. It is tragic that he should be compelled to retire for these reasons but i think he has earned the admiration of millions and millions of americans. I think he still has a very Bright Future in front of him. And there is work that we need to do. I think there should be Inspector General investigation by the Defense Department Inspector General into the circumstances behind this compelled retirement. Behind the campaign bullying that he refers to. And the colonel like others before your committee, we all watched. We covered it. Stood up at risk, whether everyone agreed with the witness testimony or what to do about it. They took a risk and went under oath to give eyewitness accounts. Mr. Bolton didnt. He waited to publish a lucrative book. Im saying that. Even he late to the gathering is cosigning colonel vindman. Take a look. In my experience with him, i think he merited promotion. His performance was exceptional. Im sure that congress will be very interested over the coming weeks as to exactly what factored into his decision. What specifically does congress do now, going into the election where the American People may or may not factor any of this into it, where the doj that weve reported on and youve worked on, and these other measures through retaliation, ousting inspectors general, retaliating against these individuals until you get them out of government, what is done to stop that . If there is no punishment, isnt the other takeaway for honest people in government, stay out of the way, its too risky, your whole career and life. Thats exactly right. Co they worked for him. They have the courage to do the right thing. To speak out. And not to make money from a lucrative book deal but because it was the right thing and the necessary thing to do. They displayed a courage and love of country that we did not see from john bolton who said that he would sue us if we tried to compel him to testify. And as we know, were still in court trying t mcgahn to testify. So there is a very sharp contrast. I appreciate john bolton vouching for colonel vindman but theres no vouching for what john bolton did. In terms of where we go forward, we are working on you are on own post watergate reforms. To give greater protection to whistleblowers, to give greater protection to people do what they need to do, to require when Inspector General is fired, that the investigative files be provided to congress so we can determine whether it is yet another act of obstruction of justice. Well need a whole pan plee of reforms. The other thing is what makes the pum of colonel vindman possible is not just punishment but the gop in congress that is not only unwilling to lift a finger or speak a word in his defense but quite to the contrary. Piled on the attacks on colonel vindman this decorated war hero. Right. Theres history and as you say, with policy and a government process, there may be a reckoning. Floyds dying remarks were captured on the cell phone video which was broad cast, which sparked protests and call for social change. What were getting here is new evidence that adds to just that externally recorded video. It also shows mr. Floyds acute concern that the officers were killing him. But even in this transcript for officer lane towards the end, in this transcript, theres this argument that well, yeah, okay, maybe i was worried but i listened to officer chauvin because sometimes people are high and they pass out because officer lane pointed out that he didnt think that he was breathing anymore. A bystander is yelling hes not breathing anymore, and he dismisses it, because sometimes that happens with people who are high, and then they come back aggressive. I mean, this is the kind of logic and thinking that results in death. And its the kind of thing that the rest of us have to look at and say, theres something really look, if this officer is the person you listened to, and you dont listen to your own good common sense and your training, which definitely says you dont leave someone in that position for that length of time, expressing trouble breathing, and just dont do anything about it. Its very hard to listen to the transcript and be extremely disturbed and angry, but also to see all the ways that the prosecution can also use this against the officers.
